water park today it happened in the water park on lone tree way. this is video of the scene. about 40 people reported problems breathing. some started vomiting. we are live with the latest on this. allen? >> the first call came in around 2:30. the fire department said 34 kids were affected and now, this public pool has been closed for the day. the water park is a series of swimming pools. 17 children were transported to the hospital. and 17 treated. one witness said he was screaming and complaining his throat was burning. officials say the kids were exposed to high levels of sodium

forth. >> he tells me this picture shows the system was designed well. with flashing connecting to a water proof membrane on the balcony. but the wooden beams suffered from dry rot. >> implication is that it was not implemented properly. why not? who inspected it? >> he looked through all 57 pages from the library gardens construction and couldn't find a note about water proofing the next question, did the builter, segway construction install it correctly? >> this is just an accident waiting to happen we see these accidents all the time. >> attorneys sued the builder of this complex over faulty balconies including water intrusion issues and settled two years ago for $3.5 million with no admission of liability.

we saw crews back there, today miller tells us they're fixing the same problems that led to the library gardens collapse. >> it's clear there were signs of dry rot water intrusion. that led to that disaster. >> segway construction did not return my calls and e mails but yesterday a spokesman told me that segway construction built 6,000 units. also today, these records show berkeley police show noise complaints about parties 71 times in the past year and a half including the night of the collapse. the neighbors tell me managers were not strict about cracking down on the parties. even when

>> in the north bay, police are searching for an armed man accused of trying to sexual assault a woman the victim says she was in her apartment parking lot last night, when a man grabbed her and put a knife to her throat. the woman pushed a panic button and the man ran away. an oakland man will spend his life in prison. he was sentenced to 131 years, to life in prison for strangling his estranged girlfriend. the judge called alana a liar before sentencing him. he was acquitted of murdering another oakland woman 30 years earlier. >> the rush is on to build a float

hundreds of people have been evacuated because of a lake fire at san bernardino national forest. most campers have been evacuated the fire is just 5% contained. a large grass fire is threatening other structures. the fire began. >> a terrible welcome for an army veteran who just moved to oakland his belongings were stolen.

s there. that continues warming up. >> we're going to remember a colleague and dear friend here at abc7 news who died this morning. laura marquez joined abc7 news in 1989, 1 of the first reporters on the scene in the marina district. not knowing she was one of those who had lost her home. laura became one of the bay area's top political reporters and joined abc news in washington, went to the network. laura bravely battled cancer for 16 years. she lost that fight today but she never lost her bright spirit and sense of joy and optimism. she was a great reporter but a better person and a very dear friend she was 56 and will be missed by all of us at abc7 news and by
