live this is abc 7 news. >> first at 4 investigating a deadly industrial accident in san jose. a man died after falling from a cherry picker. it happened on south second street in san jose. that's in the martha gardens neighborhood. that is where we find chris live with the details. >> reporter: a portion of the intersection remains blocked off to traffic. you can see what is left at the scene. the accident happened on what is normally a busy three-lane one way street where nearly six hours later investigators are still working to determine what happened. at around 9:40 this morning san

jose police were called to south second and martha amid reports that a body was in the road next to a boom truck. >> we spoke to one witness. we don't have anybody that actually saw him fall. >> reporter: police tell us the man who appears to be in his 40s fell from the truck. a logo on the driver's side door displays the company contracted to lead the street light conversion program. neighbors say they are used to seeing crews working along the street whether fixing power lines, clipping trees or working on the lights one thing is consistent. >> i see them all the time putting cones out hard hats. they wear safety belts. they have the cones pretty much far away from the curb and where the traffic is passing so that nobody is in danger. >> reporter: however, it appears those preventive measures may have not been followed. as investigators try to piece together what led to the fall it

is unclear how long it will take before this stretch of road reopens. authorities now believe last night's fatal shooting is related to saturday's shooting death of a 20-year-old man. >> they both happened near the san marco boulevard exit. sheriff's investigators say the incidents are gang related but no suspects have been identified. >> we do believe these incidents do have relation to one another and we believe there was relationship between the suspects and victims and the public should have no concern about driving down highway 4. >> the shooting happened around 10:00. 19-year-old was killed and a 26-year-old bay point man was wounded. he is expected to survive. police are asking anyone who may have seen anything to contact them. animal services need your help to find the person who

killed a 14-year-old dog in walnut creek. >> the way the dog was found has many worried about their own animals. abc 7 news reporter has the story. >> my husband was frantically looking for him. >> reporter: she says her dog, a 14-year-old australian shepherd went missing sometime late sunday night from their home in wall intercreeknut creek. >> this is the poster that i put up around the different walk areas that we used to go on. talked to people no one had seen him. no one had seen any dog. >> reporter: later that morning a worker from the water district had the misfortune of finding geno clearing the grate a few feet from the home. >> the dog was found floating in the canal right at an area where debris concentrates. and they witnessed a piece of probably shoe lace wrapped

around the dog's hind legs. >> that was the horrible part that his legs were tied together. there is no need for my dog to die. >> reporter: the animal services department here put out this media advisory asking the public for any information to help solve this case. they are now in charge of the investigation. >> we don't have any forensic information right now. we will need someone who has heard or seen anything to help us out. >> animal cruelty is sick. this is sick behavior. >> reporter: the person who did this she says is in need of mental help. in walnut creek abc 7 news. a 7-year-old leukemia survivor delivered a petition to the state capitol calling on lawmakers to pass a controversial vaccine bill. she has a compromised immune system and couldn't attend school because many fellow

students weren't immunized. the bill would require immunization for all school children. sacramento governor brown signed a new $167 billion budget and met with leader of the state senate and assembly speaker when he signed the plan which includes expanding health care to children who are in the country illegally. the new spending plan goes into effect july 1. turning to our weather. >> an accuweather update. today it was beautiful in the south bay and here in san francisco. >> beautiful all over the bay area. warm but not uncomfortably so. tomorrow it's going to be quite hot. here is a look at live doppler 7 hd. it's mild to warm. here is the view looking out over san francisco with blue skies at 66 degrees. 70 across the bay.

san jose 79. 82 at morgan hill and 59 in half moon bay. check out this view of a clear coastal sky looking westward from the hills. current readings of 87 degrees at santa rosa. fairfield 91. livermore 91. you can see where most of the heat is right now in our inland east bay location. as we look at blue sky this is our first forecast we will see mainly clear skies this evening and will be even at the coast will be mainly clear. it will see a patch or two of fog develop along the coast over the wee hours of the morning. tomorrow it starts to sizzle. we see high temperatures above 100 degrees up to near 70 degrees on the coast and i'll show you where those hot spots can be expected tomorrow in just a few minutes in my accuweather seven day forecast. >> thank you. we do have breaking news in southern california where dry warm conditions are fuelling

this wildfire that erupted hours ago next to i-5 which is north of los angeles. we are seeing live pictures as the flames burn through hilly terrain. emergency crews are evacuating homes in the area. about 300 people and 30 horses have been forced out. two firefighters have suffered minor injuries. some northbound lanes of i-5 are closed. you can see a bull dozer type vehicle as they try to work on the fire. the fire is burning not far from six flags. we are not sure what started it at this point but you can see firefighters working in the center of the screen and you can see them hosing down the area. >> my brother lives in the area and is a worker at the college in the hills over there. it is a real hilly region. very dry conditions. they have had several devastating fires in the area. winds are always a concern.

you can see homes in the hills. the concern for firefighters keeping the homes safe and keeping people safe in the foothills there. >> we will keep you updated with the latest on twitter where breaking news reporting always continues. we have time lapsed video of a wildfire burning now for a week. it has grown to 29 square miles. >> that fire is one of seven major wild fires burning across california. >> following fires from los angeles and joins us live. >> reporter: these firefighters cannot get a break. one minute getting upperhand on one of several wild fires burning when another one sparks. it's a grueling battle in the west. several massive wild fires continue to burn out of control from alaska to arizona including this wildfire in northern california that exploded to

nearly 2,500 miles south of tahoe. >> this is a little close to home. >> reporter: california crews are calling this year's fire conditions the worst on record after four years of devastating drought they responded to more than 2,400 wild fires this year well above the five-year average of 1,600. >> the extreme heat the extreme conditions make it difficult for us. >> reporter: so far fewer acres have burned thanks to an all-out assault on every fire that sparks. >> we launch everything. we are talking ground crews, helicopters, hand crews. we have to hit it hard hit it immediately. >> reporter: cal fire giving us a first-hand glimpse in may at the exhausting fight. >> past the point of exhaustion. >> reporter: firefighters are expecting to last well beyond summer. >> you have an update on the fire. interstate 5 is now reopened in

state house. mourners were greeting his widow and two daughters. he was the head pastor at the methodist church. he and eight others were shot a week ago inside the church. his funeral is set for friday. president obama will give the yuleeulogy eulogy. dzhokhar tsarnaev apologized to victims and families and asked for forgiveness. more on the emotional sentencing of the young man now headed to death row. >> reporter: an astounding apology from the boston marathon bomber speaking publically for the first time since the attacks that killed four people and injured more than 260 others. the killer admitting his guilt in court today and saying i'm sorry for the lives i have taken, the suffering i have caused you for the damage i have done. >> he said he was remorseful.

i find that hard to believe. >> reporter: his soft spoken words following hours of heart wrenching testimony from survivors and victims' families. the sister of mit officer calling dzhokhar tsarnaev a coward liar. and the father of the youngest victim 8-year-old martin richard saying tsarnaev chose hate, destruction, chose death. this is all on him. we choose love. the richards and others wanted a life sentence for tsarnaev and we learned together tsarnaev offered to plead guilty in 2013 in exchange for that but the government rejected the deal. the death penalty made official by the judge today as tsarnaev ended his statement focusing on his faith saying i ask for mercy on me, my brother, my family. i ask for mercy on those here today. >> a sincere apology would have

been nice a simple believable apology. >> reporter: none has impact on his sentence. tsarnaev is still expected to be brought to federal death row in indiana and executed though there is an automatic appeal on his behalf. president obama's campaign for fast track trade negotiating authority got a boost today from nancy pelosi announcing she will vote in favor of a companion bill. a house vote on the worker retraining program could come tomorrow. the legislation is part of the president's effort to push through the trans pacific trade agreement. yahoo ceo announced two moves that she hopes will boost the company's fortunes. announced yahoo partnered to be the default search engine for java and signed to keep katie curing on. >> today we see more than a

>> it is spectacular. sunny skies. let's take a look at live doppler 7 hd. nice and clear. no low clouds at the coast at least few hints of low clouds. blue sky over the bay. it will be hot inland tomorrow. really hot. over 100 degrees. cooling begins on friday and we will have temperatures back near average this weekend. so it's just a one-day surge of heat. here is what is happening in the atmosphere. big warm air mass sliding westward from the desert southwest causing temperatures to soar especially in inland areas tomorrow. let me give you an indication of what we can expect in terms of temperature range. tomorrow sizzling inland with highs at 104. 101 at livermore. numerous locations have highs in the 90s. we see mid to upper 80s around the bay and a few low 70s on the

coast. on friday the heat eases and inland temperatures drop closer to seasonal range mainly 80s to mid 90s. we see 70s and low 60s on the coast. as we get through the weekend a cooler afternoon. certainly cooler tomorrow and more seasonal range of highs. overnight mild conditions here in the bay area with low temperatures mid to upper 50s. there will be a few patches of fog forming near the coast line but not a strong presence. tomorrow sunny and warm in the south bay. highs 90 to 94. we will see highs in the upper 80s in the peninsula. almost up to 90. upper 60s on the coast. 69 at pacifica. downtown san francisco a high of 75. from the north bay 95 at santa rosa. 91 at napa. east bay high of 83. oakland 84. and the inland east bay lots of

100s. 101 at fairfield. 102 at antioch and livermore. here is the accuweather seven day forecast. notice the drop in temperatures on friday. inland areas will be quite warm but not up to 100 degrees. over the weekend we see mid 80s inland. we start warming up early next week with temperatures bouncing back. not talking about extreme heat next week but it will be hot in our inland areas. >> thank you so much. and it's hot in southern california where we have this breaking news to tell you about this fire is 91 degrees in the area right now. >> they say that is typical weather for august. not for this time of year. obviously hot conditions there. we all know because of the drought very dry conditions. a lot of wild land to burn and a very rural area with mountains but have a lot of homes nearby. >> this is north of los angeles.

it's burning near i-5. magic mountain is there. there were lanes that were closed for a time but now are back open. look a all of the smoke coming off of this. we are told 100 acres are burning. >> 1,000 people evacuated. it started near a mobile home park. in this area i'm familiar with this area that there are a lot of homes and ranches where people keep animals. they had to set up an evacuation center for the animals. so obviously a big concern of getting people out. you can see how large the flames are. >> about 30 horses have been forced out. you can see how close it is to the homes. you can see helicopters flying above. we are told 300 firefighters are battling this blaze. always follow us on twitter at abc 7 news bay area. still to come here at 4:00 diving into stands.

and towed but had to pay to retreat it. letters to those using four times the average of water a day. abc 7 news reporter joins us live with more. >> reporter: many here are obviously doing their part. you can tell by the color of their lawns. many others according to east bay are not and fines and penalties don't work the next step could be public exposure. >> with a new drought rate structure set to go into effect sent warning letters to more than 5,000 residential customers who are clearly using too much water. they read, quote, your water consumption indicates if you don't cut back you will be above the threshold of 984 gallons per day, four times the average per household in the district. some of those customers are using as much as 3,000 gallons

per day. >> usually that indicates that you have a leak or that you are really watering too much overwatering. nearly one quarter of letters have gone to customers in one town, danville. 25% are going to people in danville. >> i thought that was an l.a. thing. i wouldn't be too surprised. >> reporter: penalties will kick in for customers who don't reduce their water usage. perhaps a greater deterrent after september 1 could release the names and addresses of those on the excessive use list. >> unfortunately, if we are asked we are going to have to release the names and addresses and consumption data of the customers. >> reporter: danville has highest number of households receiving warning letters. laura anthony, abc 7 news. the district attorney's office is launching an

investigation into the deadly balcony collapse in berkeley. six people died and seven people were hurt in last tuesday's accident. this week police say they would not consider criminal charges and confirmed the wooden beams had severe dry rot but the building was up to date on inspections. google lost second team member to a tragic accident. an executive this week was killed after being hit by a vehicle. his identity has not been released. in april google executive died in a 7.8 magnitude earthquake in nepal climbing mt. everest. wild life officials are looking for a bear that attacked a dog and owner. a woman was scratched, bitten and bruised after she tried to protect her golden retriever. the dog was fighting with what turned out to be a medium sized

back to breaking news in southern california. this wildfire which 300 firefighters are battling. 100 acres. look at the flames. >> a lot of homes in the area. you can see some of the homes there up above have the fire barrier. a lot of trees and dry brushes. southern california is dealing with the drought. >> no homes have burned right now. they are taking precautionary measures trying to keep the homes safe. some lanes were closed for a

areas tomorrow. first looking at the national weather picture we see changing conditions. temperatures 80s across the northern interior states. 90s southward down towards the nation's mid section. 100 degrees or higher. and areas of showers scattered over the nation tomorrow but no well organized line of storms at least not developing at this point. across the state of california we see numerous triple digit readings. 105 in fresno. 112 at palm springs. only 81 in los angeles tomorrow. here in the bay area triple digits around. we will see upper 90s in inland locations. highs around the bay in the upper 80s. up to about 70 on the coast. our heat that we experience

we told you about the fire in southern california. we have one closer to home in the east bay. you are taking a live look of the smoke coming off of this fire which is about 25 acres happening at regional park. so far no homes or buildings are threatened. you can just see the black skorgeed area where the fire has been burning. our breaking news coverage continues on twitter. police say food is likely causing thousands of dollars a year.

it's not just bad for your budget, food waste is the single biggest item in u.s. land fills where it rots and releases methane. whole foods is under investigation for allegedly overcharging for packaged goods. the new york department of consumer affairs says the grocery giant overcharged customers for prepackaged meat dairy and other goods by overstating the weight. whole foods denies the claims. in health news subway has ditched artificial ingredients but doctors say it is not enough. >> google has a new gadget to help you stay fit. >> google's life sciences group created health tracking wrist band. the band can give doctors a minute by minute look at how patients are fairing. bands measure pulse heart rhythm and skin temperature.

a group of health experts calling on subway to stop serving meats raised with antibiotics. the medical experts say some that antibiotics in meat cause people to be less responsive to medication. thnchlths latest version of the dietary guidelines for americans could contain a number of big changes. in its recommendation on fat. the guidelines would emphasize the type of fat in the diet. and it's a water bottle. no it's a speaker. maybe a lantern. it is all of those things in more. the smart bottle has a speaker and can glow which helps bikers. it is trying to raise money on kick starter and has more than tripled the funding. i'm jane king. here's to your health. a new survey claims 43% of married couples don't know how

much money their spouses earn. 10% of those surveyed were off the mark by more than $25,000. not a gender issue. the number of men and women in the dark was exactly the same. 43%. officials say they were surprised how many spouses missed the mark. they say couples don't know the household income it makes it difficult to plan for the future. time for ask finney. michael finney answering questions sent to him by facebook, twitter and e-mail. >> first from rosemary who asked i heard that all credit cards have to have a smart chip by the end of the year. when do stores have to have equipment that uses the chip? >> great question. there is a lot of misinformation going around. there is no big mandate. the government isn't saying your card has to have chips. nothing like that going on. basically the banks and card issuers say they are going to start issuing cards with chips. at the end of the year they

expect 600 million cards with the chips in it. most of the rest of the world already uses them. what they are telling stores are you have up until october to keep your -- you can pass on a problem. right now if there is a problem with a card then the bank is held responsible or the issuer is held responsible. come october if they don't have a chip reader then the store is responsible. that is why stores are gearing up. >> is it the practice to pay only 10% to a contractor prior to the job being done then why is it home depot's policy to pay in full? >> they are an exception to the rule. there are about ten of them. if you take out the overall performance bond that says we can cover every single job that is going on in the state right now with our money. if they put up that kind of bond they can ask for money up front. lowe's has that sears has that.

spreading off highway 4. >> the flames started at black diamond regional park. sky 7 hd was just overhead as flames burned through at least 25 acres. >> we have somebody on the phone right now from the east bay regional park. thank you for joining us. can you tell us what is going on? >> the call came in around 4:13 today that the grass fire started in the black diamond mines regional preserve and spread. it's very fast moving. i understand now it's probably closer to about 50 acres. i understand homes in the area are threatened. the park district is evacuating both parks right now. >> any idea how many homes and from my understanding there is a reservoir and swimming lagoon.
