and we say good thursday morning, everyone. i'm kendis gibson. >> and i'm mara schiavocampo. reena and t.j. are off. breaking overnight a second prison guard is under arrest accused of helping two dangerous inmates escape. >> investigators say gene palmer brought tools hidden in hamburger meat to the two men. his lawyer claims palmer had no idea of the escape plot and was dupred along with everyone else. with more here's abc's kenneth moton. >> reporter: maximum security prison guard gene palmer was the one in handcuffs accused of several crimes in connection with the daring prison escape by convicted killers, david sweat and richard matt in upstate new york june 6th. investigators say for months palmer provided contraband to the now escaped inmates. needlenose pliers and a screw screwdriver. he even allowed the men to use

catwalks behind their cell at the clinton county correctional facility. >> he would take both men back behind the cells in the catwalk area and in those locations they were working on the electrical system for their cells that is totally inappropriate behavior for a correction officer. >> reporter: prison employee joyce mitchell was also charged in connection with the escape. investigator say the woman who was romantically involved with the prisoners and maybe others smuggled hacksaws and other tools in hamburger meat. >> mr. palmer has been fully cooperative. he understands this is a public emergency. he's willing to continue to cooperate with the investigation in order that these two individuals are captured. >> reporter: a weekend sighting moved the intense search to dense woods in owls head. police found the killer's dna on food and a bloody sock and warned the fugitives are likely armed. >> just about every cabin or

study, it was in the same room where he and eight others were gunned down a week ago and this morning, there's word the justice department will likely file federal hate crime charges against suspected shooter dylann roof. more confederate flags are falling across the south in response to the racially motivated church shooting. the flag was removed from alabama's capitol. both mississippi senators are calling for their state flag to be redesigned without the confederate emblem and officials in kentucky want a statue of confederate president jefferson davis removed from the statehouse. to d.c. and president obama shutting down a heckler who tried interrupting him during a white house reception honoring lgbt pride month. he was talking about civil rights and same-sex marriage when an activist thoughted at him calling for an end to the tension and deportation of lgbt immigrants but mr. obama was having none of it. >> listen you're in my house.

two former vanderbilt football players convicted of raping an unconscious student have been released from jail after serving five months. their freedom comes after a judge declared a mistrial because one of the jurors failed to disclose he was a victim of sexual assault. the prosecution says that it will retry the men. president obama is getting more authority to negotiate major trade agreements. the republican led congress gave the democratic president this major win. his own party opposed it. the bill allows the president to negotiate trade deals which congress can then approve or reject but not modify. it should help with the major trade negotiations under way now with 12 other pacific rim countries. upscale grocery chain is kused of overcharging.

whole foods routinely overcharged customers and overstates the weight of prepackaged products and the customers are overcharged by the pound. whole foods disputes the complaint but last year they paid to settle similar charges in southern california. a blockbuster supermarket merger in europe brings together several chains. it will include stop and shop giant food lion and pea pod, all in the eastern u.s. it'll be the fourth largest supermarket operator in this country worldwide. it will have 6500 stores and serve more than 50 million customers a week. well before you stop at a supermarket to pick up some imported beer you might want to check the label. many so-called imports are actually brewed right here in the u.s. in fact beck's drinkers may get refunds as a result of a lawsuit. beck's is really brewed in st. louis by the same company that makes budweiser. production moved here three years ago.

her condition worsened in the five months since she was found unresponsive in her bathtub and they say she's now, quote, in god's hands. a court appointed conservator filed a lawsuit against her boyfriend, nick gordon the suit charging that he abused her and stole money. a woman from texas is recovering from being attacked by a shark while surfing in australia. she was in the water with her husband when the shark attacked leaving her with a cut hand and a bruised face. her surfboard, however, made out much worse. the shark taking a big bite out of it. she says that she didn't really feel safe until she was back on the beach. >> i didn't really know i guess, what was going on other than that i was scared. >> charged her, hit her and the next thing i know she was in the water off her board and she was screaming. >> she was treated at a hospital and then released. despite the attack she says she'll be back in the water soon. the beach where the attack happened is closed for a few

days. well it was a surprise delivery at a third floor apartment near montreal. it was the front wheel of a small business jet. the building is on the approach to a major airport. thankfully no one was in the apartment when it crashed through the roof and landed in the kitchen in the middle of the night. the tenant found it when she returned home a few hours later. >> i think it's ridiculous. it's a plane tire. i mean there's got to be quality checks someone checking that everything on the plane is attached and attached well. how can a tire just fall off a plane? >> the canadian investigators are looking for the answer to that and other questions of the falcon 10 jet landed safely without injuries. something else fell from the sky near yakima washington a ball of ice the side of a cantaloupe. it also crashed through a roof into a home landing inside a walk-in closet. no one injured in this case either. now, it's not hail but it could still be something natural or it may have fallen from a passing
