being done but investigators believe it is the gun used by francisco sanchez, the man caught later that night not far from the shooting charged with steinle's murder. sanchez is on probation in texas and has a long sheet including seven felonies. sources say he has been arrested not only in texas but oregon and washington and deported to mexico five times. ice had him in custody in march but says turned him over to the sheriff's office when they discovered he had an outstanding drug warrant but the d.a.'s office dropped the case and the sheriff's office subsequently released sanchez. in a written statement ice says it lodged an immigration detainer requesting notification prior to release so they could take him into custody again. ice says the detainer was not honored. city supervisors two years ago approved policy which would prohibit local law enforcement

from complying with federal detainers unless the person was convicted of a violent felony or other crimes such as human trafficking in the past seven years and was in custody again on a similar offense. sheriff carved out an even stricter policy which in almost all cases would require ice to go to court. >> if a court order or judicial order for review were issued of course we would honor that order or that warrant. there were none in this case. >> reporter: ice says all it wanted was the simple courtesy of being told that sanchez was going to be released. >> as you heard kathryn steinle was walking with her father when she was killed. her family is remembering kate as a kind soul. chris is live in san jose with what that family wants the world to know about their daughter and their loss. >> reporter: good evening.

the family says they are very grateful for the outpouring of support from the community. they will be following new developments in the case but they are really focused on one thing right now and that is to make sure that kate's legacy is honored. independent, assertive and beautiful inside and out, 32-year-old kate steinle loved the people who surrounded her. >> a beautiful and good person. i am so thankful for the time that we had with her and we were so close. >> reporter: nearly 48 hours after the death of their daughter liz sullivan and jim steinle were trying to come to terms with what happened. >> experiencing the horror that we experienced i have a little solace that i was with her. >> reporter: san francisco police say kate was randomly shot not far from her apartment. her father told us she didn't go down without a fight. >> she went down and she was fighting, gasping for every

presidential campaign issue courtesy of donald trump who has taken heat for strong comments made about illegal immigrants. a police officer was hurt today when he and a suspect crashed head on at the mobile home park this afternoon. the press democrat reports a disturbance at a home when a man inside ran away. neighbors say he barely made it around the corner before slamming into another patrol car. the suspect did have moderate injuries. a novato high school track coach is accused of having sex with a student. the sheriff's department says 64-year-old steven deschler was having an inappropriate relationship. deputies arrested him at oakland international airport last night as he returned from a hawaiien

vacation with his wife. >> detectives intercepted him as he departed the airplane. we separated him from his wife in order so we could talk to her in regards to what she may or may not know. that part of the investigation is still continuing. i will add this arrest is a complete surprise to his wife. >> he has been the track coach for almost 20 years and released today on $100,000 bail. millions are about to see electricity bills go way up. state regulators approved a new structure today. lyanne melendez joins us in san francisco to explain what this means. >> reporter: many others will see their power bills go down but is it fair the vote today was unanimous. the new pricing system will benefit customers who live inland where it is hot and run air conditioners longer. for years they complained the

rate system favored people along the coast. >> they have the advantage of being frozen in tier 1 in cooler coastal climates and smaller families. >> reporter: san francisco and other coastal cities will feel the impact of this new system. the valley in some east bay cities will benefit from it. for years the public utilities commission used a four-tier pricing system. once you use the amount allotted for tier one you move on to the next tier where price is higher. if you reach tiers 3 and 4 your rates for that power increases dramatically. under the new pricing system the highest power users get a break by paying less than they have in order to balance things out those who consume less see a slightly higher power bill. the utility reform network calls it unfair. >> that really makes no sense, is completely unfair. we think customers should be

rewarded for saving energy not punished. >> reporter: many in san francisco say this is far from a compromise. >> the people that use the most should pay the most as far as i'm concerned just like water usage. >> thinking about another increase in cost. that's very frustrating. >> reporter: the three major utility companies in the state including pg&e can begin increasing rates within 60 days. lyanne melendez, abc 7 news. nine people including three children escaped from a burning home in san jose this morning. officer stan wall was driving when he saw smoke coming from the attic of the house. that was about 9:20. 13-year veteran ran inside to alert occupies and get them out. firefighters say it was likely an electrical fire. there were no working smoke detectors in the home. >> it is high fire danger double

checking everyone buying fireworks has the right to do so. david louie has the story. >> reporter: this is the best way a group can promote who is going to benefit from this stand's firework sales. the boosters are counting on customers to support them so is the gilroy little league ball field fund. >> how much do you generate? >> it's a big fundraiser for us. >> reporter: sales are limited to a very small universe. that 51,000 residents of gilroy. customers have to show i.d. >> did you have to show your i.d.? >> yes. >> you're okay with that? >> i hope everybody shows their i.d. to prove they are from gilroy that way fireworks do stay here. >> reporter: even these safe and sane fireworks are illegal in the rest of the county.

francisco and by most accounts they are long overdue. next week a ground breaking for a memorial for those who fought in the korean war. wayne freedman spent time with three of the men who made it happen. >> reporter: at the national cemetery changes to the landscape happen slowly and usually are permanent which explains three staring at a sign next to a vacant lot. >> unone reason we like the spot is heavy traffic. >> reporter: lots of cars and pedestrians. >> this is called the forgotten war because i don't think history gives it the kind of attention it should. >> reporter: the korean war which killed more than 33,000 americans. fortunately for retired commander john stevens and retired judge they survived. but raising the money and finding property to establish a memorial here would take more than half a century.

bridge today as people held signs. on tuesday governor brown signed the law requiring all public and private school children to get vaccines starting next year and eliminates exemptions. supporters say the law protects public health. protesters say it takes away their right to parent. they are holding rallies across the state and working on a ballot initiative to repeal the law. the american academy of pediatrics says vaccines are safe and effective. an unexpected discovery recovering eight large bags of marijuana plants. the workers took the pot back to their maintenance yard and contacted chp. the officers tweeted out these photos before they took charge of the dope. they will process it and eventually dispose of it. at a traffic stop this week led to the arrest of these three arizona residents. police say they found $4,000 worth of heroin, a stolen unloaded glaucand two loaded

pistol magazines. one passenger was high and the driver had a suspended license. warning signs remain posted. they were posted at the park entrance on monday after 15 sharks were spotted. usually the signs remain up for 24 hours after a sighting but park officials will leave signs there because of the busy holiday. people are advised to stay out of the water. >> this is the type of thing that happens at any wild life park. like bears at yellow stone, life guards rangers need to look after everybody. don't go running towards the bear cubs or paddling at the sharks in an intertube. >> there have been no sightings in santa cruz. public safety officials say it is safe to go in the water there. san francisco water officials haven't said what caused a massive water main break on 22nd street.

drought conscious neighbors did not want that water going to waste and started using buckets to water their lawn. at this point the san francisco public utilities commission says it is hard to tell how many gallons were lost. >> we don't know because we have to estimate when this started to figure out how much water was lost. at this point in time i really can't give you a guesstimate. >> reporter: where is it going? >> one resident tells abc 7 news same thing happened a week ago. officials say they finished repairs about noon today. there is a user revolt on red it over the firing over director of talent. it is sometimes called the internet front page. it works like kind of an online bulletin board content organized into sections. taylor played a key role in the ask me anything section. when the news of her firing broke it was shut down and left

let's take a look at the forecast for the fireworks, the all important if you are going to check them out tomorrow night. we will have fog around near the beaches. clear skies around our inland communities. temperatures in the 50s and 60s. some inland spots into the 70s. specifically at 9:30 when the fireworks are going off most areas quite mild. you don't have to worry about layering up. in san francisco if you are bringing little ones you might want to bring that sweater or jacket just in case. it will be in the 50s. let's take a look at the live doppler 7 hd. fog near the coast. we have thunderstorms. chester area strong thunderstorms developing and we will continue to see that possibility as we head towards the weekend. temperatures right now along the coast running three to six degrees above average. these are the sea surface temperatures. monterey bay 62 degrees right now.
