live from the kgo tv broadcast center this is "abc 7 news." >> good afternoon. thank you for joining us. i'm ama daetz. >> the man accused of killing a woman made his first court appearance. francisco sanchez appeared before the judge in the last two hours. we learned more about the weapon used in that deadly shooting. vic lee has the latest on that shooting. >> reporter: there are several developments today in this bizarre and tragic case. but first to that gun. abc 7 news has learned that the gun which police found off the waters of pier 14 the day after the shooting the gun they believe sanchez used reliable sources tell us the gun belonged

to a federal agent. belonged to a federal agent and that police are trying to figure out where he got the gun and from whom. we've also learned 3 of the 7 felony convictions that sanchez had involved heroin arrests. now to another major development today, the arraignment. >> translator: i am not guilty. >> francisco lopez sanchez with a translator standing by pleaded not guilty. bail was set at $5 million. outside the courtroom, san francisco public defender jeff adachi said the bail was set too high. >> mr. sanchez was only in san francisco for a very short period of time. he has no convictions in the state of california. this very well could be a completely accidental discharge of a firearm. >> reporter: assistant district

attorney then spoke to reporters. >> today is about kate, it's about this incredible family that has shown such strength in this incredibly difficult time. it's about bringing justice to that family. >> reporter: sanchez admitted during a jail house interview sunday that he shot kate steinly. >> did you shoot kate steinly, the lady who was down on pier 14? >> yes. >> you did shoot her? >> sanchez said he found the gun wrapped in a t-shirt on pier 14 and the gun accidentally went off. >> boom, boom, three times. >> reporter: three shots he told us but witness told us they only heard one shot. his story has many inconsistencies but his record has none. five previous deportations and his release from san francisco sheriff's custody in march, even though i.c.e. had a detainer on

him because he was again in the country illegally. san francisco police officers association president martin hallaran fired off this blistering letter which reads sanchez is an illegal alien, not an undocumented immigrant. if he was where he belonged mexico, this innocent victim would still be alive. vic lee abc 7 news. california senator dianne feinstein is speaking out against some of san francisco's sanctuary policies and the sheriff's decision not to inform immigration when they release suspect francisco sanchez. the priority program focuses on those convicted of crimes. she said i strongly believe a convicted criminal and with a de tainer rekwefts 23r078quest from i.c.e. should not have been set loose.

mayor ed lee issued a response to senator feinstein saying he shares her concern over how sanchez was released from jail. stay with abc 7 news for continuing coverage of the pier shooting on air and online. our reporting continues on twitter at abc7 news bay area. raymond will be charged. today they ordered him to stand trial. they'll face racketeering and weapons and money laundering charges. much of the case will rely on the testimony of an imformant. the trial is scheduled to begin november 2nd. the state's controversial right to die bill won't become law this year. they announced they'll not pursue the bill. senate bill 128 would have aloud

doctors to prescribe lethal drugs to terminally ill patients. it passed the senate last month but stalled in committee two weeks ago. the case was sparked by brittany maynard who was forced to move to oregon to get a prescription for lethal drugs. these are live pictures from the scene. this firefighter is walking there. 100 firefighters are battling the blaze not far from dodger stadium. the fire was first reported in the attic of the church of jeessus christ of latter day saints. you can't see it right now, but we've been seeing the roof with flames. we are taking a live look in the los angeles area where they are battling the fire of that

drive. thursday night until monday morning. >> abc 7 news carolyn tyler got a look at the work leading up to this closure. she's live in the presidio. >> you've heard that expression no pain, no gain. it is going to be quite painful for these doyle drive commuters. the big payoff, a nicer, smoother ride starting monday. it's a $1.4 billion project that began in 2009. doyle drive, the approach to the golden gate bridge is old, built in 1936 and not up to earthquake standards. commuters were shifted to a temporary bypass two years ago. but nothing like the up close views we were given today. there are no tunnels high and low viaducts and wider lanes.

now around the clock work to get presidio open on monday. >> that's a lot of work in a short time. because it's special concrete we have to excavate out, do compaction work put base material in and cast this concrete. that takes time. >> reporter: his crew is planning to get it done by closing doyle drive thursday until 5:00asm m. monday. that means a mess for the daily commuters. expect major delays. there will be no access to high 101 from marina boulevard or lombard street. officials are advising commuters to take buses, ferries or the bay bridge. >> monday morning a whole new driving experience new access to the presidio and marina and connections between highway 1 and 101 will be open. they've been closed since 2010.

focusing on the road. >> we try to specialize in or pay attention to areas where that particular city might have high accidents. >> this crackdown is in pacifica and half moon bay with more bay area cities to come. >> he sees lots of texting at red lights. >> immediately you see people's head go down. you don't have to be a cop to see it. >> reporter: using your phone at a red light is still a driving violation. it's about $160 not including court fees. with each citation, the cost goes up. while some drivers make a point of taking notice when patrol officers are around law enforcement is on the lookout when you least expect it. >> especially motorcycle officers because they have the advantage of being able to see the drivers driving before the drivers can see them. >> reporter: officers are taking a zero tolerance approach. something else police officers see people doing is taking their phone, putting it on speaker and

abc 7 news was in san francisco south of market area as housing activists lobby for stronger eviction actions. they want to change the rent ordinance. >> we have tenants come into our office that are getting evicted because in their lease it says they can't leave their bikes in a hallway or baby stroller in the lobby. >> it gives tenantses time to fix minor violations. attempted evictsions have risen in the past five years. the city council will debate a plan to implement rent control. rental housing is getting morexpensive. rentals make up about 48% of richmond's housing. they want to impose a moratorium

on rising rents. the city council will select a developer to handle the 100-year-old auditorium. it was shut down after it became too expensive too operate. two firms are vying for the exclusive agreement with the city. brazil's economic output barely beat california's. california was the only state in the top seven economies. the u.s. topside the list followed by china and japan. california still could pass brazil later this year when the world bank revises its numbers. one of the most difficult climbing routes became more difficult. a granite sheet that peeled off the rock measured 100 by 200 feet. a santa rosa man who

breaking news in vallejo. a police investigation and possible standoff following a shooting around capital and alameda in vallejo. sky 7 hd was overhead as police responded. two people walked out of the house with their hands up. we do believe at least one person was shot, possibly two, but not fatally. the shooting was discovered after a car crash. it's unclear if police are still trying to detain others at the scene. we'll stay on top of this story and bring you more as we get it. follow breaking news on twitter. the warriors have traded david lee to the boston celtics. with the emergence of draymond green, lee's playing time diminished. lee wanted to go to a team on which he had an opportunity to start again. in exchange for lee, the

live from the kgo tv broadcast center this is "abc 7 news." >> in news making headlines, the man charged with the murder of kate steinly at pier 14 made his first court appearance today. vic lee was at the hall of justice. francisco sanchez pleads not goolt to murder. a man who came to the united states when he was 3 years old was convicted of robbery more than 20 years ago and served his time for the krooimcrime. that man is now battling to stay here and not be deported to china. >> reporter: he was arrested last month by i.c.e. agents. he's at a detntion center in southern california awaiting

deportation to china. they called his imminent deportation a highly political move one which makes no sense. the chinese government has asked the u.s. for help. >> they want the u.s. to hand over about 100 or so high level chinese government officials who are living in the u.s. but are wanted in china to face prosecution for corruption charges. >> what does resident mayor hayward have to do withis? they claim he and other chinese americans with criminal backgrounds and on deportation lists are pawns of both governments. >> as a trade-off, the u.s. is asking china to accept all of these people with no ties to corruption or bribery for deportation. >> reporter: 20 years ago he was convicted of robbery. he was 19 at the time. he served five years and was

ready to be deported but at the time china didn't want him. u.s. officials had no choice but to let him go. he's turned his life around. he's been the director of the recyc ling program in berkeley. still, he remains an enforcement priority based on his criminal history. the asian law and some of his co-workers criticized i.c.e. for trying to deport him. >> the i.c.e. detainee program once again has shown how flawed it is. by forcibly removing a person like daniel from his home and workplace. >> his family left china when he was only a toddler. he's information been back. his brother told reporters he doesn't speak the language and would be lost if he were to be

deported to china. lyanne melendez, abc 7 news. police are investigating why a man crashed his car into a light pole this morning. the fatal accident happened just before 6:00 a.m. firefighters got the man out of his car but he died at the hospital. the crash stopped traffic at that area for several hours. an investigation under way on the east coast into what caused a fatal accident in the air involving an f-16 and small private plane. this happened around 11:00 near charleston, south carolina. officials say the f-16 slammed into a cessna killing both people inside the small plane. the pilot of the f-16 ejected safely before hitting that plane. there's more danger in washington state at the scene of a deadly ice cave collapse. one person was killed and five others injured after heavy ice came crashing down at the big four ice caves yesterday

burlingame and campbell, this is abc 7 news. the number of heroin users has grown. that's according to a report released by the centers of disease control and prevention. they believe the increase was driven by people switching from vicodin and oxycontin. the study reveals people who abused painkillers are 40% more likely to abuse heroin. california is among the most active states anywhere in the country. >> is going gluten free really with it? jan king has those stories and more. >> reporter: a new study says gluten free health benefits are overhyped. researchers looked at 3200 gluten-free products and determined that the removal of gluten either makes healthy food s healthy.

we've all gone to work with a cough or sniffle or worse. a new study shows most health professionals do it too even though they know better than anyone they shouldn't. the children's hospital of philadelphia and colleagues surveyed 500 physicians nurses, physicians assistants and midwives and all of them graed that working while sick puts their patients at risk. yet 83% admit they'd done it at least once in the last year. fitness apps data reveals california colorado and washington as the most active states. the district of columbia north dakota and delaware, the least active residents. mammograms may not reduce breast cancer deaths. breast cancer death rates were no lower than in areas of fewer screenings. that's the latest research from

seattle, washington. carnival plans to operate cruises to cuba by may of next year. it's received approval from the u.s. government. they are still awaiting for approval from the cuban government. carnival becomes the latest travel company to begin service to cuba in wake of the recent move to restore diplomatic ties with the country. starbucks is raising prices again. the increases range from 5 cents to 20 cents for most drinks. large coffee jumps to $2.25 in most states. starbucks is raising prices because the cost of doing business is going up. if you buy a tall brewed coffee every day that will add up to $36. $36.50 a year. time for "ask finney." first up does east bay mud
