te steinle. >> had ice sought the requested legal order or warrants the san francisco sheriff's department naturally and will always comply and would have complied. >> reporter: that's not what he said during a debate in march. listen. >> what i have the honor of saying, i'm the first sheriff in this city and one of the first in the united states to say no ice transfers. >> reporter: he now says he is following the city's refugee due process ordinance passed two years ago. mayor lee says the sheriff could have simply called ice. perhaps just as controversial it was the sheriff's decision to bring sanchez back to san francisco to face a 20-year-old bench warrant. the d.a. dismissed the drug charge. the sheriff still held sanchez

in jail for more than two weeks. he said his office wanted to make sure sanchez served all his time in federal prison. >> he had aliases. we wanted to make sure we had the right person based on the database that local, state and federal agencies have access to. >> reporter: san francisco public defender represents sanchez. he says once charges are dropped you can only hold that person for five days. to hold a person beyond two weeks would be unusual. >> reporter: the bureau of prison says sanchez did serve all his time. vic lee, abc 7 news. a 17 year old was shot and killed by sheriff's deputies earlier today. the sheriff says it happened after the teen beat up his grandfather and killed the family pet and then threatened officers with a gun. david louie has the story. >> reporter: sheriff's deputies

were called out to the secluded house because of a report on a 17 year old on a violent rampage. the 70-year-old grandfather told deputies his grand son had just killed the family kitten. >> the teen was alone in the house. the grandfather telling them they had guns in the house. the deputies called for backup as well as a negotiator. they also requested fire units and an ambulance to stand by. the teen expressed no interest in talking to the deputies. about 40 minutes later the situation escalated. >> the young man walked out of the home carrying a rifle. our deputies ordered him to drop the rifle. however, the young man pointed the rifle at two of our deputy sheriffs. fearing for their lives the two deputy sheriffs fired their weapons and shot the young man

four times. >> reporter: the teenager was air lifted to a regional trauma center in san jose where he died in the operating room. sheriff jim hart told reporters he didn't know if the rifle was loaded or not. two years ago deputies were called to the same house when he threatened to kill family members with a knife and held under a mental health hold for evaluation. in santa cruz county david louie, abc 7 news. a truck smashed through a protective sound wall in san jose killing the passenger and putting the driver in the hospital. sky 7 hd was over the accident on ruby avenue about 11:00 this morning. police say speed was a factor but have not said how fast the truck was going when it left the road. the passenger died at the scene. no word on the condition of the driver at the hospital. no one inside the house was injured. seems most got the message after months of warnings about the full closure on doyle drive

phone or tablet and enable push alerts. the app is free from your app store or more details at abc7news.com/apps. crews are on the scene of a 40 acre wildfire. it is burning near ascot parkway between vallejo. the fire started about 2:00 and is currently 75% contained so they have made solid progress. no structures have been damaged. the gray wet weather we have seen the last couple of days is moving out. here is a live picture from our east bay hills camera. clouds are still around but nothing like we saw this morning. drivers heading over the bay bridge had to put on windshield wipers. parts of the east bay woke up to the sound of rain today maybe where you live, as well. meteorologist sandhya patel is live outside with a look at what is going on for the weekend. >> the weekend is going to be beautiful. right now half and half. clouds and sun.

something we need to pay attention to. >> reporter: that something is this the oriental fruit fly about the size of a regular house fly and doesn't belong here. >> this is such a problem because the female can sting a perfectly good piece of fruit and go right through the rind like a banana. >> reporter: this insecondt has been known to attack. california constantly monitors various fruit flies for the reason. >> i have a very old organic lemon tree in my backyard that probably has about 200 lemons on it right now. >> reporter: experts believe someone either brought over infested fruit or fruit shipment came in and oriental fruit flies weren't detected. the goal is to eliminate as many as possible. >> we squirt the sexual pheromone of the fly which brings the male to that spot and then he ingests some of this.

>> reporter: these fruit flies were found last month in couper ercoupe -- until then they will continue to monitor traps and apply bait in areas deemed necessary. >> i am glad to hear there is something being done. it's important. president obama used his executive power to by pass congress this time to the delight of californian environmentalists. the president designated three wilderness areas as national monuments. among them is the snow mountain, an area half the size of yosemite. it includes pine forests rivers and a mountain peak 7,000 feet high bald eagles call it home as have native americans for generations.

cheers in south carolina today as the confederate flag came down from the state house grounds. many families of the victims of the deadly shooting in the black church in charleston were there. that shooting led to today's historic change. the flag will be displayed in the state museum. the suspect in the church shooting should not have been allowed to buy the gun used in the attack. an fbi examiner missed an arrest report in which roof had admitted to possessing drugs. under fbi policy that admission should have disqualified roof from buying a gun. the agency is looking into why the national background system failed in this case. job regulators suffered a setback today. a judge temporarily blocked the board from punishing senior water rights holders in the central valley who ignore orders

to cut back. the sacramento judge ruled that regulators ordered cutbacks without a hearing. legal analysts say the decision could have a ripple effect on all cutbacks ordered statewide. our drought is creating some strange situations. many people are now paying more for using less but officials are actually giving away water for free recycled water. abc 7 news reporter laura anthony is there to show us what has become a very popular spot. >> reporter: it is 5:00 on a friday and these guys are lined up truck after truck picking up this water. as you can see this man is filling up his tank nearly 300 gallons. it's all free. you can take as much as you like throughout the day 300 gallons per visit. unlike the other potable water this stuff is unlimited supply. >> the water is flowing almost

nonstop at the district in martinez where residents can pick up as much recycled water as they need, up to 300 gallons per visit. >> people do use it for growing gardens and stuff getting a lot of feedback that the gardens have been thriving off this water. it can't hurt. >> basically saving your garden? >> yeah. because probably couldn't water it with the water restrictions. >> reporter: the program started late last year but really didn't take off until now. >> once the governor made the proclamation in april about the mandatory conservation we saw growth to our program so much that now we are over 1100 registered users in the program. >> the whole family is doing it. >> reporter: for some this has become a daily ritual. >> we wouldn't be able to water the lawns or keep up our gardens or other plants that we have. >> reporter: those who take

advantage should be aware. 300 gallons of water weighs more than 2,000 pounds. so users should be certain their trucks trailer or car is capable of carrying as much as they take. in martinez laura anthony, abc 7 news. the california drought could make things a little uncomfortable at state beaches. next wednesday all california state parks shut off outdoor rinse stations in order to save water. that move could save 18 million gallons of water every year. park officials suggest using towels to brush off the sand or bring jugs of water maybe from home. a beach fouled by a oil spill in may will reopen a week from today. crews just finished cleanup operations after an underground pipeline ruptured releasing 100,000 gallons of oil. about 21,000 flowed into the ocean. preliminary information suggests

corrosion played a role. one library is doing more than just feeding minds this summer feeding children. abc 7 news was at the east palo alto library, one of 80 sites where children can get a free lunch through the summer food service program. the program helps fill the gaps for children who depend on school lunch programs for healthy meals. nearly 200 children and parents participate in the week day program at the library. a silicon valley charity hopes to hand out school supplies to 3,000 students this year. abc 7 news was at sacred heart community. sacred heart is collecting supplies until late july. most in demand items are new backpacks and scientific calculateers and gift cards. moving on. kitchen counter tops can be one of the most expensive parts. choosing wisely can save a lot of money. >> michael finney has the

san rafael bright and sunny. oakland 73. inland spots you will be warm but not too hot. 81 walnut creek. 83 in livermore. look at the accuweather seven day forecast will keep it mild to warm for the upcoming weekend although temperatures come down with increase in the cloud cover. as we head towards monday not much change but really start to notice those numbers rise especially inland where we are used to seeing some 90s. they will be back in the forecast. low 90s inland. mid 60s along the coast line. this weekend we have the avon walk for breast cancer saturday and then the reverse on sunday. there will be fog around in the morning but really comfortable weather for the afternoon with 60s and 70s and if you do have outdoor birthday parties or weddings this weekend and were concerned about the recent rain no need to worry. it will be dry this weekend. >> even the 90s early next week

gas prices went up more than 6 cents a gallon and is expected to go higher. prices spiked after a new report finding fuel inventory in california. inventory is low and fuel imports have dropped to 0 for the first time since march. experts say prices could soar as much as 60 cents per gallon. u.s. airways will stop flying in october. the airline announced today that farewell flight will be a red eye flight 434 scheduled to leave and arrive the next morning in philadelphia. u.s. airways merged with american. it will take time to paint planes with americans colors and logo. paul mccartney issued a warning of sorts to british prime minister david cameron don't mess with fox hunting ban.
