good afternoon and thank you for joining us on this monday. i'm ama daetz. >> and i'm dan ashley in for larry beil. first at 4:00 here a man arrested after a break-in in dublin has been charged in a bizarre kidnapping incident in vallejo. police investigators believe matthew muller broke into a home and tried to zip tie a couple in their bedroom. the husband fought back forcing the suspect to run. investigators found a phone left behind and used it to track down muller. >> they contacted vallejo police because of a similarity to an incident in march. a man was tied up and drugged his girlfriend abducted for two days. the girlfriend told investigators she was sexually assaulted twice before being dropped off near her family in southern california.

vallejo police dismissed the case as a hoax. in the last few minutes attorneys for the victim saw the news conference and are now demanding an apology from police. >> this changes nothing about the humiliation, the violence that was purposeerpetrated on them by a psychopath, a sociopath a person bent on destroying other people's lives. the vallejo police department owes an apology to miss huskins and mr. quinn. they owe an apology to the public because the individual or individuals who committed this offense were at liberty to continue on their crime spree. >> now muller was also a suspect in a home invasion in palo alto in 2009 but never charged. he is a harvard graduate, an attorney and a former marine. >> abc 7 news reporter is live in the newsroom with more about the suspect's background. >> reporter: i talked to a former co-worker and number of investigators about this case and all of them have described matthew muller's arrest as bizarre. he most recently worked as an

immigration attorney in san francisco. he was featured in this 2012 story by univision catorce. >> they have said up until today that, no we will not even let you have your day in court. >> reporter: the california bar association, muller is scheduled to be disbarred by the california supreme court next week. he's accused of telling a client he had filed immigration papers for a relative, which he never did, but billed that client anyway. muller told the fbi that he is a former marine who was suffering effects of posttraumatic stress disorder. according to the marines, he served from 1995 to 1999 and was a sergeant who played trumpet in the marine band. we're learning that he is also a possible suspect in two other similar bay area cases one from 2009 in palo alto and another in the same year in mountain view. >> firefighters are investigating four small brush fires that broke out in contra

costa county this morning. sky 7 hd took pictures of these flames in the area of willow pass road just before 10:00 this morning. the chp issued an alert due to heavy smoke that you can clearly see blowing across two lanes of the highway. crews brought the fires under control just after 10:30. a brush fire burned at least one structure and threatened several others today near irvine in orange county. fire broke out near highway 241 near santiago canyon road. authorities evacuated several people from a nearby campground. air tankers had to be brought in to battle those flames. it had charred at least 150 acres. no word on how the fire got started. let's turn now to our workweek weather. tough to spend time outdoors in this kind of forecast. >> very trying. spencer christian is here with our accuweather update. >> i can't wait to get back in the studio with you guys. it's lovely out here today. we've got mostly sunny skies. just a few clouds passing through the bay yar at the

moment. here's a look westward from our emeryville camera. you can see some clouds thinly distributed across the sky. 67 right now in san francisco 72 in oakland mountain view 76 77 in san jose 84 in morgan hill and 66 at half moon bay. here's a lovely view from mt. tam looking at just a little patch of low clouds near the coast but not very widespread. it's currently 84 in santa rosa, napa 80 77 at novato, 83 at livermore. here's our first forecast as we look at a partly cloudy sky over sfo. it will be partly cloudy and mild this evening. we'll see a mix of sun and clouds but skies should be relatively bright, especially away from the coast. tomorrow afternoon, mild to warm. mild at the coast, warm inland with my temperatures ranging from mid and upper 60s at the coast to right around 90 in the warmest inland locations. and it's going to get warmer inland. i'll have the forecast in just a few minutes. well for the first time, evening commuters are experiencing the new doyle drive

in san francisco. check out the new roadway. in this video from our abc 7 news 360 camera, the rebuilt doyle drive opened last night ahead of schedule and drivers appear to like this new and improved section of the roadway. abc 7 news reporter wayne freedman is there with a look. >> reporter: not too shabby. happy monday dan. it is a happy monday if you're a commuter using doyle drive. we're right where we were last friday on top of the south tunnel and there is traffic moving smoothly. much lighter it would appear than ever before because we now have two tunnels. carmeggedan never happened, drivers are happy and everyone expected this to be much worse. take a look at your brave new presidio parkway. the cars seem to be moving faster than our past weekend did. >> what surprised you most? >> the lack of delay. >> reporter: or maybe the lack of overwhelming delay, as caltrans crammed 10,000 manhours

of labor into 71 actual hours between thursday night at 10:00 p.m. and sunday night at 9:00 p.m. when the roadway reopened eight hours early or actually on time, we now learn. >> we have eight hours of contingency going into this closure. >> why didn't you tell us that? >> because if i would have told you that then everybody would have said, oh they're going to open at 9:00 on sunday night and then we do find something unexpected and you tell us why are you opening late? >> reporter: the first time through beware of a quick change of the striping as you enter the southbound tunnel. it should be an issue for about a month, right about here. if you go through at 35 miles an hour, the chp says, you ought to be fine. reviews from drivers who took the road this morning, all positive. >> it's not perfect yet. >> but? >> but they got it done on time

and as far as i know, and i mean it's worked in the right direction, i think. >> reporter: two directions if he wants to get technical about it. along the new presidio parkway wayne freedman, abc 7 news. sky 7 hd was over danville after a chp motorcycle officer was hurt in a freeway accident. it happened on northbound 680 just after 9:00 this morning. the officer is expected to recover. drivers faced delays for more than an hour while investigators closed all lanes on 680. the chp suspects the officer might have been clipped by a large truck. two youth soccer teams in south san jose are hoping that a fire over the weekend in their coach's home hasn't destroyed their hopes of playing this coming season. the teams play at watson team but $3,000 used to pay for the fields was burned up along with their soccer equipment. many of the players come from low income families and they don't have checking accounts. >> okay we're going to be 350.

okay, give us $50 every month or $40. then a couple might be late. come on, man you've got to pay. >> the coach has no renter's insurance and he's still trying to figure out where he and his family are going to stay long term. president obama is commuting the sentences of 46 prisoners convicted of nonviolent drug offenses. >> the president says america is a nation of second chances and these offenders deserve a second chance. >> their punishments didn't fit the crime. if they had been sentenced under today's laws nearly all of them would have served their time. >> most of the offenders have been incarcerated for at least 20 years. 14 were serving life in prison. the president says he's trying to make the justice system more fair. today's decision brings his commutations to nearly 90 since taking office. donald trump faces online threats from a man claiming to be the son from the world's most notorious drug leaders. >> now el chapo is on the run

after escaping from a mexican prison. >> marci gonzalez has more from new york. >> reporter: an intense manhunt today for the most powerful and dangerous drug lord in the world, a man mexican officials said would never escape from prison again. joaquin "el chapo" guzman moving them wrong, breaking out of this maximum security prison outside of mexico city saturday night. >> chapo guzman is like the osama bin laden of drug trafficking. >> reporter: officials believe the 60-year-old dug a small hole beneath the shower in his cell. then used a ladder to drops himself 30 feet belong ground winding his way through a labyrinth of tunnels before climbing out in this hole in a building under construction. investigators are now questioning at least 18 prison workers trying to figure out why the man officials say is responsible for thousands of overdose deaths and murders wasn't more closely guarded. >> whenever there's a community in the united states where you can find the presence of drugs, such as heroin cocaine,

marijuana, methamphetamine, even designer drugs those drugs are connected to el chapo. >> reporter: the last time el chapo broke out of a maximum security prison in 2001 he wasn't captured for 13 years. investigators concerned the kingpin who was once on "forbes" billionaire list has the resources to stay hidden again. we're told the fbi is now looking into tweets from someone claiming to be el chapo's son sent to donald trump, threatening to make the presidential candidate, quote, swallow his words after he made disparaging comments about the drug lord. marci gonzalez, abc news, new york. still ahead the price at the pump skyrockets so is there any relief in sight? >> plus the bad dreams haunting lebron james weeks after losing the nba finals to the dubs. and a convicted sex offender moves into a quiet east bay neighborhood. why he is not calling walnut creek home anymore.

b gas prices are soaring across the state. at some stations prices jumped by 16 cents a gallon while drivers were filling up. the spike comes as gas prices nationwide are actually trending downward. abc news reporter brandy hicks

is live in los angeles with more. hi, brandy. >> reporter: yeah, drivers are not happy. there are some gas stations here in southern california that have raised prices 90 cents a gallon just over the last three days 90 cents. and drivers worry they're about to soar even higher. anger and frustration for california drivers filling up their gas tanks. >> it's killing us. >> it's kind of ridiculous. >> reporter: prices at the pump have skyrocketed up nearly $1 a gallon since last week at some stations. several now topping $5 a gallon. >> now it's like almost $5 within two nights. >> that was one sticker shock. >> reporter: while gas prices nationwide are on a downward trend, analysts say this spike in california is thanks to a refinery explosion back in the spring and a shortage of other components needed for the state's unique blend of less polluting gas. >> for us refiners they all better work perfectly because we don't have exxonmobil and not

all are working perfectly. >> reporter: some drivers don't believe it. for others they consider parking their gusas-guzzling suvs for good. >> it makes me want to buy an electric car. >> the u.s. department of energy did release a new report this afternoon. statewide a gallon of regular is now $3.88. that is 45 cents higher than last week. some analysts believe those prices will in fact continue to go up this week before drivers finally see a significant drop. reporting live in los angeles, brandy hicks, abc 7 news. dan. >> brandy thanks very much. there are new concerns today about california's rising syphilis rate, especially among pregnant women and newborns. the state department reports the number of syphilis cases in women doubled from 248 to 594 from 2012 to 2014.

congenital syphilis more than tripled from 30 to 100 cases. that's the type of syphilis that is transmitted from an infected mother to her child during pregnancy. most of those mothers of infected babies received inadequate prenatal care. more troubles today for rapper and actor 50 cent. he has filed for bankruptcy protection. his real name is curtis jackson iii. jackson made the bankruptcy filing today, days after a new york jury sided with a woman who accused him of leaking a sex tape featuring her and another rapper. jackson has been ordered to pay that woman $5 million. lebron james admits he has nightmares over missing opportunities in the cavaliers' loss to the warriors in the nba finals. james says it's taking him a while to get over the funk as a result. he also says he can never get away from losing in the finals. this story is trending right now on our abc 7 news facebook page by the way. you can like it on facebook to share it on your news feed. a reminder, steph curry and the warriors are nominated for five espy awards, and this

composite image showing a little ripple in the jetstream moving in our direction, which is pushing that little line of clouds in our direction. but coming behind that we'll have mainly sunny days the next two or three days with a minor warmup which will result in inland highs in the mid-90s on wednesday and thursday. meanwhile down in the tropics we have two systems we're tracking. one is hurricane dolores just off the west coast of mexico and the other is tropical storm enrique which poses no threat to land areas at the moment. over the next few days dolores is expected to intensify into a category 3 hurricane. the good news is it will be moving away from populated areas so we'll obviously continue following that storm. back to the bay area, partly cloudy overnight, especially near the coast. it will be mostly cloudy at the coast, mostly clear in the north bay. overnight lows generally around 60 degrees. tomorrow mainly sunny in the south bay and warm with highs in the low to mid-80s. about 81 at san jose 85 at

morgan hill. on the peninsula a few clouds early but mainly sunny in the afternoon hours with highs ranging from mid to upper 70s. 75 at san mateo, 79 at palo alto. mild on the coast also even with the presence of some clouds. mid to upper 60s from pacifica down to half moon bay. in and around san francisco look for highs around 70 degrees downtown, 65 at daly city. up in the north bay 60s on the coast and mid to upper 80s inland from santa rosa to calistoga to napa. over on the east bay we'll see highs of 75 at oakland, 76 san leandro, 79 castro valley and freemont fremont. in the inland east bay upper 80s to around 90 at antioch. 93 at brentwood. 88 at livermore and 89 at fairfield. here's the accuweather seven-day forecast. as i mentioned wednesday and thursday will be quite warm inland with highs in the mid-90s. temperatures moderate on friday and a little cooldown on the weekend with saturday and sunday in the mid-80s but temperatures

an oakland a's fan is suing major league baseball accusing it does too little to protect fans from shattered bats. gayle payne feels vulnerable because fans are not protected by netting. payne is an a's season ticket holder. her unusual seat is on the second deck of the coliseum down the first baseline. on the heels of that new suit, a new england woman is recovering after being hit right in the head by a foul ball at the boston red sox game on friday. >> she really caught it too. it's just the latest incident at fenway park. >> a swing and a foul ball into the seats. >> reporter: this morning boston red sox fan stephanie recovering after a foul ball at fenway left her with this scar. >> the instant i saw the ball it hit me at exactly the same time. it felt so -- there was no reaction time. i did see it coming.

>> reporter: the 36-year-old and her fiance were celebrating their one-year engagement anniversary at the stadium friday. the same place where the jumbotron captured their proposal last year. but this year, her experience quite different. hit in the stands right between the eyes needing more than 30 stitches. >> everything got quiet, sort of buzzy. i just hutftst put my head in my hands. >> reporter: this after part of a broken bat hit a woman in the face in the same section of the same stadium just last month, leaving her hospitalized for a week. >> to the right side -- >> reporter: but america's pastime is a sport that allows fans to get close to the action. while many stadiums hang signs and print reminders on tickets warning fans of the danger now some are saying it's not enough to protect fans. yankees manager joe girardi telling ngj.com following friday's game netting needs to be expanded.

38-year-old attorney matthew mueller is under arrest for the kidnapping of a vallejo woman. denise huskins was taken from her home back in march. her boyfriend was tied up and given a list of instructions to follow. huskins turned up two days later in southern california. vallejo police called the whole thing a hoax but now the fbi says it was a kidnapping. melanie woodrow has been looking into mueller's alleged involvement into a similar home invasion in the east bay. she'll tie it altogether in a live report at 5:00. a divorced couple is now battling over their frozen embryos. carolyn tyler says there are thousands of frozen embryos couple sign consent forms over the use. what happens if there's a divorce? she'll have the story coming up at 5:00. charles chrisman, a sexual predator who moved into iawalnut creek neighborhood was sent back to jail for alleged sexualized thoughts about an 18-year-old.

laura anthony joins us in martinez with the details. laura. >> reporter: hi, ana. this is exactly what charles chrisman's neighbors in walnut creek feared, that given the opportunity he would pursue a young person. according to testimony here in court today that's exactly what he did in concord on june 5th. >> they feel they can't adequately control his dynamic risk factors. >> reporter: a deputy d.a. says charles chrisman has shown he has no business living in a walnut creek neighborhood after the sexually violent predator allegedly violated the conditions of his release on a visit to a concord community center. >> there's no allegation that he touched anybody or that he actually committed a sex crime but he had certain urges. he made a contact with a young man based on those urges and he failed to disclose that to treatment personnel. >> reporter: chrisman moved into a house on walnut boulevard in february. after neighbors and the d.a. on

jektd objected, he wore an ankle bracelet and liberty was monitoring his every move. but june 5th chrisman violated the conditions of his release during a supervised meeting to the senior group meeting at the concord center when he made contact with an 18-year-old man and didn't tell his caseworker. >> in this case he proved our concerns correct. >> reporter: kelly dosa lives near where chrisman was placed in walnut creek. >> we didn't feel like he was going to be an upstanding citizen and so unfortunately, it sounds like he did exactly what we said -- what we feared he would do. >> reporter: the revocation hearing will continue later this month. in martinez, laura anthony, abc 7 news. the son of a boston police captain is under arrest this afternoon, accused of plotting a terror attack on behalf of isis. court documents unsealed today show 23-year-old alexander chicolo is accused of planning

several attacks using pressure cooker bombs, similar to the attack at the boston marathon in 2013. he also wanted to execute students at a boston area university and live stream his attacks on the internet. a jail clerk made a mistake when entering information about a drug arrest for the charleston church shooting suspect, dylann roof. that mistake allowed roof to buy a gun used in the attacks. the lexington county sheriff says the jail discovered the mistake two days after roof's arrest but the change was not corrected in the state police database. the fbi promises a full review of this case. pentagon leaders are finalizing plans aimed at lifting the ban on transgender people serving in the military. senior u.s. officials tell the associated press an announcement is expected this week. the military would have six months to determine the impact and work out details. officials say transgender individuals still wouldn't be able to join the military during that transition. the boy scouts are a step closer to allowing gay adults to serve as leaders in the

organization. last week the scouts executive committee unanimously approved a resolution to change its adult leadership policy. the resolution doesn't require counsels or troops to allow gay leaders but lifts a long-standing ban that prevented people who are openly gay from serving. scout activists say the resolution isn't perfect but it's an important first step. it goes before the executive board on july 27th. a heckler interrupted former secretary of state hillary clinton during a presidential campaign speech in new york city today. [ applause ] however, clinton supporters drowned out the heckler by clapping and cheering. the heckler demanded that clinton separate commercial and investment banks to take a stand against wall street. clinton's speech resumed after security ejected the young man from the auditorium. well believe it or not the race for the white house just got a bit more crowded this afternoon. in the last hour wisconsin governor scott walker officially

revealed that he too is running for president. walker is the 15th republican to launch a campaign. abc news reporter mary bruce has the story. [ applause ] >> reporter: the republican race for the white house is getting even more crowded. >> we are running to serve as your president of the united states of america. >> reporter: wisconsin governor scott walker now the 15th republican to jump in, hoechping to set himself apart as a harley riding washington outsider. tonight in his first campaign speech casting himself as a proven leader who can get things done. >> we need new fresh leadership. leaders with big, bold ideas from outside of washington. >> reporter: but right now all the momentum is with donald trump. he's surging in the polls, drawing huge crowds. the biggest yet of this campaign season, and condemnation for his controversial comments on illegal immigrants. >> they're bringing drugs they're bringing crime they're rapists. >> reporter: republicans are worried that trump is hurting

the party's outreach to hispanics. but in an exclusive interview with abc's david muir walker steered clear of that fight. >> i think donald trump and any others can speak fop themselves. what i'm going to lay out is what i'm for. >> reporter: but he didn't spare his other opponents, saying it's time for new blood in the white house. >> i don't think a name from the past beats a name from the past. i think you need a name from the future. >> reporter: hillary clinton wasted no time jabbing her latest competition. >> republican governors like scott walker have made their names stomping on workers' rights. >> reporter: make no mistake scott walker is a top tier candidate. he's led every major poll in the key state of iowa since february. his challenge now, to emerge as a front runner nationally. mary bruce, abc news washington. president obama focused on protecting seniors at today's white house conference on aging. the appellatepresident says senior citizens are able to live healthier, more productive lives than ever before. he singled out an 82-year-old

teaching a new lesson no man is perfect. >> harper collins tells abc news that lee requested the book be published as written with no editorial intervention. there is a new miss usa today and she won by tackling controversial remarks by pageant co-owner donald trump. miss oklahoma, 26-year-old olivia jordan, won the crowd last night. she stood out thanks to a strong performance in the interview portion of the competition saying race relations are the next big issue the media has to address. afterward she praised her fellow contestants. >> i'm very grateful for all the women that came together. we stood strong and we all made sure to share our own beliefs and be strong in what we believed and we ourselves on stage. >> sponsors and tv networks pulled out of the pageant last month following trump's comments bashing mexican immigrants. the pageant passed with no mention of trump, who did not attend the event. tyson foods is investigating claims that chickens raised for the company face brutal treatment and harsh living

conditions. tyson says it takes the claims very seriously. this is video from the company. a video released last week by the advocacy called mercy for animals showed farm workers showing crates of baby chickens and leaving injured birds to starve. the footage was captured by a whistleblower and is part of its campaign asking consumers to sign a petition and avoid eating meat. comcast is launching a streaming video service. they are expanding to battle growing sbrugsz from companies like netflix and a rising number of customers who are more mobile using tablets and phones for entertainment purposes. the new service will cost $15 a month. internet customers would be able to watch live tv from about a dozen networks on phones tablets and laptops. the service includes on demand movies and shows. an online shopping war is developing between walmart and amazon. on wednesday walmart will launch a rival sale to compete against amazon's recently announced

native afghanistan where he'll serve as an advisor to the president. the two are long-time friends. abc 7 news anchor cheryl jennings was the first western journalist to interview him last february in afghanistan. the owners of a south bay nudist camp were arraigned today on charges they were stealing water from their neighbors. >> vic lee is live at the santa clara hall of justice with this story. vic. >> reporter: well, there are seven charges against the husband/wife owners. they did not enter a plea today here at the courthouse. the most serious charge carries a maximum three-year prison term, trespassing for the purpose of injuring property rights. here's how the prosecutor put it. >> a business who ran out of water last year in the middle of our drought and decided to divert water from their neighbors. >> reporter: the allegation is simple. add to that nudist camp. then there's more to this than one can see with the naked eye. glen and lori run a clothing optional nudist camp in the los

gatos hills. the stouts are charged with diverting water from a creek managed by the open stays district, a group that manages 60,000 acres of open space preserves. the district repeatedly refused the camp's request to install water lines to one of its creeks to siphon water for the swimming pool in an 87,000 gallon tank. abc 7 news toured the camp last september. the two wells on the camp's 110 acres were drying up and so was the nearby stream. the lush lawns were gone. residents had conserved water by 40%. lori stout told us they began trucking in water at great expense. >> they truck in 3,800 gallons at a time and it ranges from $200 to over $400 per truckload. >> reporter: the stouts and their lawyer left the court house after the hearing and declined to comment. vic lee, abc 7 news. >> thank you so much for joining us for abc 7 news at 4:00.

local attorney for the crime. investigators say matthew muller committed a home invasion robbery in the east bay that led them to him as their suspect in the kidnapping. >> abc 7 news reporter melanie woodrow is live in vallejo where the victims' attorneys are point fingers. melanie. >> reporter: absolutely. denise huskins and aaron quinn, the couple in all of this, they held hands tightly and appeared strong as their attorney spoke this afternoon and called on vallejo police to issue them and the public an apology for originally calling this kidnapping a hoax, all while the alleged suspect continued on his crime spree. >> nearly four months ago we told you that denise huskins was right. that she was not only innocent of perpetrating a hoax but that she was a victim of a very serious and violent crime. and today there is vindication. >> reporter: denise huskins and aaron quinn tightly held hands as attorneys for the couple called on vallejo pd to do their jobs. >> go out, find out if there are

other guys get them in custody. >> reporter: vallejo pd previously said the couple made up a story in march of being drug, bound and kidnapped. >> the fact that we've essentially wasted all of these resources for really nothing is upsetting. >> in a short period of time they decided it was a hoax. you know that only works in batman movies. >> reporter: now fbi agents have arrested 38-year-old matthew muller a former attorney himself, and charged him with the kidnapping. the affidavit describes a terrifying ordeal inside this vallejo home, including huskins and quinn being threatened they'd be cut or shocked if the couple didn't comply. >> as poor a job as the vallejo police department did, the alameda county sheriff's office did a terrific job. >> reporter: that agency recognized similarities between a june home invasion robbery in dublin and the march one. >> i'm glad we caught him, because who knows what he could have done. >> rep
