berkeley city council passed an urgency ordinance aimed at improving the safety of balconies in the city after last month's deadly collapse. good evening. i'm ama daetz. dan ashley is off. the collapse at an apartment complex killed six students and severely injured seven nearly a month ago. abc7 news reporter katie is live at berkeley city hall with the late breaking developments. katie? >> ama an attorney representing ashley donaho's family says they called for balcony inspections every year. you can see the line of people posed to speak. a series of proposals to improve the safety of balconies from the frequency of inspections and the type of materials used to balcony design. the council approved the urgency ordinance and it goes into affect immediately. local building amendments have to be approved by the state. council decided to call for inspections every three years.

the donaho attorney called for every year. >> there may be other buildings with this same design issue and problem out there. why do i say that? we know these same contractors have had similar issues with other buildings that were built at the same time in other locations. >> building organizations represents also spoke and they would like to form a task force to make sure changes made to the building code don't have uninend ited consequences. unintended consequences. they asked them to pause after looking into the collapse. >> there were code amendments that make sense for the bay area for berkeley's need. >> the city plans to hire certified professionals to do the additional inspection. at this point there is no word

on how much it will cost the city to do those additional inspections nor how many balconies are currently in the city that would be deemed unsafe. live in berkeley abc7 news. >> thank you. >> there are new details in the march kidnapping that vallejo police believe was a hoax. the department is not apologizing to the victims. at least not yet. the suspect is being held at the santa rita jail in dublin where his lawyer met with him. lilian kim is live with the latest. lilian? >> no mea-culpa and maybe not ever. based on what one captain had to say the department had no regrets. >> was the vallejo police department too quick to call it a hoax? >> i don't think so based on some of the evidence that we had at the time. >> captain john whitney won't elaborate why they believe the march kidnapping was a hoax. only saying if they do offer an apology it won't come anytime soon. >> it is important that we

wait until the conclusion of the investigation to decide either way if it was a hoax or not. >> there was a sworn affidavit linking muller to the kidnapping case and a similar case in dublin in june. there is a mountain of evidence including items seized from his storage unit if vallejo. they found white sheets duct taped. four channelless receivers and drones. >> the only information we have comes from an fbi affidavit. it is to the an indictment and it is certainly not a scwur verdict. >> thomas johnson is representing muller and he will be exploring his client's mental disease and psychosis as part of his defense. he says these latest developments rank among the strangest stories he has had to cover. he received e-mails from someone claiming to be the kidnapper. the sender described himself and his accomplices as a a group of professional thieves more than two and fewer than eight

victims in that shooting to survive. investigators are looking for witnesses to speak with. >> harsh words for presidential candidate donald trump from the brother of the woman killed on san francisco's waterfront. trump has been fighting the death of kate steinle to support his controversial position on immigration. she was an immigrant who was deported to mexico several times. he says politicizing his sister's death is insulting. >> i don't want to be affiliated with somebody who doesn't have the common courtesey to reach out and ask about kate and ask about our political views and what we want. >> he said trump's immigration policies were, quote not common sense. new details tonight, the family of a girl hit and killed by an uber driver in san francisco has settled their wrongful death lawsuit. she died and her mother was injured on new year's eve of 2013. the family claimed the driver

was looking for customers on the uber app at the time of the accident. the terms of the settlement robert being released. abc7 news was in san francisco's union -- abc7 news was in san francisco's muni square. they say a bicyclist ran into the car just after 6:00 this evening. passengers saw the cyclist walking away from the scene moments after the collision. >> the driver was telling us to come back and he had blood coming down his face. he said he was fine. he didn't look fine. >> paramedics took the cyclist to the hospital. the cable car riders faced delays until the damaged car was towed away. the transit union leaders called on muni and the police department to target people who drive unsafely along the cable car routes. sky 7hd was in menlo park where a car smashed into a railroad crossing gate. the gate fell on to the tracks and punctured an air hose on a train that hit it. the incidentland to the delays

of up to 35 minutes during the evening rush. cheers broke out at the new horizons mission control today. the tiny space probe messaged back to earth that it completed its first fly by of pluto. abc7 news reporter alan wang was at the science center in oakland where space buffs gathered for the historic moment. >> it was history in the making. a tiny space probe traveled more than three billion miles and snapped the friers detailed photos of pluto and messaged back saying it was preparing to send the images to earth. >> i am beyond excited about this. >> zachary goldberg was only two years old when the new horizons space probe launched into the unknown in 2006. >> it is gonna help us learn so much about the origins of our solar system. we are going to learn about its atmosphere and the composition of its surface. >> copy that. thermal is nominal.

she was taken to the hospital and is now okay. surveillance video shows a man robbing a bakery in san jose. he stole a cash from a nothing bundt cakes on june 23rd. the robber ran out the door but nobody saw him get into a vehicle. san jose police urge you to call if you recognize the robber. new details tonight in the case of a miracle survivor. a young woman who survived a plane crash over the weekend emerged from the woods after more than two days but sadly her step grandparents didn't survive the crash. here is the abc fuse reporter ryan owens with her story. >> a selfie in her hospital room. she is 16 after all. autumn continues to recover even watching news coverage of her survival story. tonight we hear the young woman's voice for the first time as she tells a 9-1-1 operator how she lived through a plane crash. >> are you injured at all? >> yeah, i have a lot of burns on my hands and i am covered

and i will step aside. one is enrique. tropical storm enrique is no concern as far as land is concerned. hurricane dolores is what we are watching. it is a category 2 with 105 mile-an-hour winds. it is expected to intensity into a major category 3 hurricane by tomorrow morning. so if you have travel plans to puerto vallarta and cabo san lucas the next couple days this is where the surf and the rain bands will be impacting the area as we head toward the next few days. and then it falls apart. when it does fall apart, it is a trough kl storm on saturday and -- it is a tropical storm on saturday and eventually it will move into southern california on saturday evening where they will be the possibility of showers and thunderstorms. we are watching it carefully because an area of low pressure will drop south and that will pull up some of the moisture from dolores. there is a slight chance of showers on sunday around 4:00, 5:00 in the afternoon and maybe an isolated thunderstorm.
