good afternoon. i'm katie marzullo in for larry beil. >> and i'm ama daetz. developing news out of tennessee with what is being called an act of domestic terrorism. we have new information about the gunman who open fire. >> the shooting started at an army recruiting office in chattanooga and ended at a u.s. navy reserve center. here is the latest. four marines are dead, a marine recruiter and police officer are among injured. >> and the shooter is identified as 24-year-old mohammod youssuf abdulazeez. he is also dead but officials are not saying how he was killed. >> this is a mug shot of him from a dui arrest in april. authorities believe he was born

in kuwait and lived across the river from chattanooga. >> reporter: a spray of bullets fired at two military centers in chattanooga. >> it is imcomprehensivable to see what happened and the way that individuals who proudly serve our country were treated. >> reporter: an officer injured and several marines killed, the gunman targeting this recruiting center and a nearby naval center. witnesses say he pulled up in a car and immediately started shooting. >> we saw the silver convertible mustang and he was just unloading some type of large rifle. >> next thing you know he lifted up his arms like this with a big black gun and it was one shot and then endless shots one after another just unloading into the army. >> reporter: police and the fbi rushing in tracking down the alleged gunman who they say died

have an outbreak of thunderstorms in the afternoon up and down the sierra crest. it goes up and down the central sierra from lake tahoe area southward. here is how it looks from our emeryville camera. low clouds at the coast. it's 66 degrees in san francisco right now 68 across the bay in oakland. san jose 79. 81 in morgan hill. and you can see low clouds hovering over the golden gate right now. we have 74 degrees in santa rosa. napa 73. 89 fairfield. 90 at livermore. livermore is the warm spot and looking at partly to mostly sunny skies. here is the first forecast coastal fog expanding. areas of fog and low clouds near the coast. by afternoon tomorrow sunny and warm for most of the bay area and hot inland with highs reaching the mid to upper 90s. will there be change in the pattern over the weekend?

i will answer that in my forecast. >> thank you so much. a turn about from cal trans. the cause of monday's fire on the bay bridge may not be -- two small fires broke out on the eastern span of the bay bridge this week. the fires burned several feet of rubber at an expansion joint. according to cal trans yesterday's fire was likely caused by a road flare put down by maintenance crews but monday's fire is still under investigation. a high sped chase ended with an arrest last night. sheriff's deputies spotted a vehicle similar to one used in a string of burglaryies. the pursuit ended when the suspect crashed into several cars. the driver ran away but was found a short time later inside a bar. fire crews in pittsburgh are keeping an eye out for hot spots after a fire. here is what the fire looked like when firefighters arrived

around 2:30 this morning. it spread to two buildings and knocked out power to the area for a short time. it took crews about an hour to get it under control. fire martial says this place caught fire three times in the last ten years. in san jose police are concerned about rising violence after another homicide this morning. it happened near highway 101 and the tully road exit just around the corner from a popular hangout for kids a chuck e. cheese. matt keller has more from san jose. >> reporter: a tan colored minivan crashed in front of the social security administration building just before 2:30 this morning. when police arrived they found a man in the driver's seat with at least one gun shot wound. he was taken to the hospital where he later died. officers canvassed the area for evidence and questioned people staying at two nearby motels. >> told me to get up and come out and talk to him. that's what i did. >> reporter: the latest homicide is the fifth in san jose in just

the past three weeks. because of increased violence in the city this summer police started a new enforcement effort this past weekend targeting several different areas. two homicides have taken place including this one. >> we have implemented a strategy to go ahead and provide additional resources in certain areas, hot spots in san jose. so we are definitely concerned and we are addressing the issues. >> reporter: police say the victim is a man in his late 40s. so far no arrests have been made. in san jose matt keller, abc 7 news. still ahead on abc 7 news at 4:00 the just released grand jury report that says ambulances need critical care. and new at 4:30 the clock is ticking for coliseum city. the development that could keep raiders in oakland. and a live look outside at the evening commute.

to give you an idea of how important the civil grand jury believes this issue is last year 76% of all emergency calls were for medical reasons. the report says too often first responders had no paramedics on board. last summer a statue toppled on to a toddler. police and firefighters came immediately but took a fire department ambulance 13 minutes to arrive exceeding the department's goal of a ten-minute response time. 2-year-old cason shelton later died at the hospital. since then fire chief has made improvements. >> in particularly bringing in new ambulances and training new paramedics. i feel like she's working on solutions. >> reporter: the civil grand jury believes ambulances are not responding to emergencies fast enough and often enough. the report adds there is a

chronic lack of serviceable ambulances and they are spaced in different parts of the city which the panel's foreperson says effects the response time. >> people who live in the western part of san francisco may have longer waits for ambulances than people who live, say, in the downtown part of san francisco. >> reporter: the report also criticizes the fire department for its failure to find a new home for its training center now at treasure island. the department has been told it has to vacate the facility. supervisor says she asked for some answers. >> unfortunately, i still have not gotten information that indicates that there are any major changes that are going to happen to the department. >> reporter: the fire department says it is reviewing the report and will respond within 60 days. vic lee, abc 7 news. a woman fighting her ex-husband over frozen embryos testified in court.

46-year-old mimi lee and her husband froze embryoes five years ago. they are divorced and lee wants to use the embryos despite a previous agreement saying they would be destroyed if they split up. abc 7 news reporter carolyn tyler has been in court today. tonight caroline tells us what both sides are saying about that contract. the california assembly has approved a bill that would allow children of domestic workers to attend schools in the district where the parents work after a girl was kicked out of a school even though her mother worked as a live in nanny in the district. the senate has voted to roll back parts of the controversial no child left behind law. the changes would leave in place the annual testing schedule but would give states and local districts more control over how to use the tests to assess performance. a similar measure passed the house last week. if you had trouble logging on to instagram you are not

alone. an outage lasted about an hour effecting users nationwide and abroad. instagram hasn't said what caused the outage but it was related to the log in server. a sea world employee accused of posing as an activist and trying to encourage violence among protesters. you can see the employee being arrested. the animal rights group claims he posted inflammatory comments on social media inon an attempt to get a reaction. the california water district and actor tom celek have settled a dispute on water he used on his ranch in ventura county. he was sued after a private investigator learned water from public hydrants was being trucked. water district officials voted

fully restored. president obama was greeted in oklahoma by a contingent of confederate flag supporters. about a dozen people waved the flag outside the hotel where the president stayed last night. president obama spent part of the day behind bars. he visited a federal prison in oklahoma and met with officials and nonviolent drug offenders as part of an effort to highlight the challenge faced by the criminal justice system. >> i think we have a tendency sometimes to almost take for granted or think it is normal that so many young people end up in our criminal justice system. it's not normal. >> the visit topped a week of sentencing reform initiatives. earlier this week the president pardoned 14 nonviolent offenders and reduced sentences.

of high rates of accidental poisonings in kids. poison control centers have had to deal with more than 6,000 reported cases of children under the age of 5 this year. >> children ingest these pods. the things they are seeing are stomach upset, difficulty breathing, wheezing. two children have actually died. >> proctor & gamble tells abc news it takes every incident of accidental exposure seriously and believes the accidents are preventable. in health news can it be true? sea weed that tastes like bacon. smart phones may be used to diagnose depression. >> reporter: researchers think smart phones can one day serve as an early warning system by possibly monitoring behavior. recent study found patients at risk for depression were more likely to spend time at home and use smart phone more frequently.

cheryl jennings. this a potentially precedent setting battle. a divorced woman who wants to use the embryos to start a family and her ex-husband who does not want that to happen. carolyn tyler joins us live outside court. >> reporter: it was an emotional day in court today as the woman fighting for her embryos broke down crying. she says those embryos are priceless to me. >> my client is a very private man. it's unfortunate that dr. lee has involved the media in this case. >> reporter: the case has captured national attention. they were newly weds in 2010 when she was diagnosed with cancer. they froze embryos signing a form like this directing that they would be destroyed if the couple divorced. they are now exs but in court today the 46-year-old lee
