live from the kgo-tv broadcast center, this is abc7 news. >> you just don't expect that in your neighborhood. you think it is safe and you think it is quiet and then you see this. >> it is devastating not only to the families of the victims, but to the neighbors here as well. >> five people killed. tonight a suspect is behind bars. we learned more about him and his relationship with the victim. good evening. martin martinez is accused of killing five people, three under six years old in a house in modesto. the bodies were found yesterday afternoon. martinez was arrested 80 miles away overnight in san jose. a crew was in san jose. abc7 news reporter sergio has been following it since it broke and has the latest from

modesto. >> they set up candles outside the home. neighbors never talked with the people who lived here. one resident was recognizable. >> they never like to be friendly. i remember seeing the guy whose picture i saw on days book. i remember seeing him. >> she is talking about this picture released by modesto police of martin martinez. he was quickly thaimed as a person of interest when officers found five dead people in this home on saturday afternoon. two women and three little girls aged between six months and six years old. his red lincoln navigator was spotted near his relative's home a few hours into the investigation. he was arrested by san jose police shortly after that and booked on suspicion of murder. investigators say the youngest victim is his own daughter. >> we have also determined that there is a past relationship between martin and one of the victims inside

and one of the children is his. >> it is not clear which one of the adult vic i'm its martin may have had a relationship with. she is one of the victims found in the house and one of her colleagues tells us at least two of the children were victims in the house. police have not confirmed the identity of the second adult in that house. residents on the street say the murders of five people here is unnerving. >> it is very scary. you have to be very careful. i cannot believe a person doing this to his own family. >> police have not said how the five victims died. the friends who have come out to leave these candles and flowers for dr. amanda cruz and her family say she was their physician and they are shocked she is gone. in modesto abc7 news. >> amanda cruz was a physician stanislaus county and she recently moved to the house in

martinez. we know two of the three children killed were her children and one was also the child of martinez. the children ranged in age from six months to six years old. according to a facebook post by someone claiming to be martinez's sister the other adult killed was martinez's mother. stay with abc7 news for the latest on the murders in modesto. we will have updates on our website, abc7 fuse.com and on the abc7 morning news at 4:30. and now to some incredible photos and video out of southern california where rain has caused a brej on interstate 10 in riverside county to collapse. one driver was hurt and they had to be rescued after their truck fell into the river below the road that washed out. the highway is closed in both directions at eying dwell mountain road about 50 miles west of the arizona border. cal fire says at least 500 drivers are strappedded. stranded. cal trans says this major highway between california and arizona will be closed

indefinately. the remanence of tropical storm dolores because record breaking rain to southern california. it caused mudslide in san bernadino county. the angels and padres' games were rained out for the first time in years. let's head to meteorologist drew touma for a eke which. >> we ended on a humid and hot note in parts of the bay area. new records were set in san francisco. a high of 86 besting the old record of 82 and a new high in oakland warm at 91. you can see every whenner we were in the -- we were in the 80s and 90s. live doppler 7hd along with satellite showing you we were humid. the reason why is moisture is streaming up from the remanence of dolores. we'll tell you what that means when you head back to work and when we will see relief in the accu-weather seven-day forecast in a few minutes. >> thank you. rain in san bernadino

county helped calm a large grassfire that swept across interstate 15. the north fire is now 60% contained. on friday flames destroyed 20 cars and trucks as drivers ran for their lives. the fire burned seven homes and 44 more vehicles. cell phone video shows flames rise above pleasanton. the fire started around 8:00 tonight in the molo ranch neighborhood. crews from cal fire assisted the alameda county fire department. two spanish motorcycle -- motorcyclists died at the raceway in monterey county. several racers collided during the first lap of today's moto america super bike, super stock 1,000 race. the crash killed martinez and daniel rivas fernandez. they said, quote our prayers and hearts go out to the family. it has been a little over a month since the balcony

collapsed in berkeley killing six students five from ireland. tonight a vigil to mark the date and the family members of the survivors were there. lilian kim is live at berkeley's par tin luther king civic center park with the story. lilian? >> katie, it is what the irish call a month's hind. a month's mind. it is held a month after a person's death. six survived and -- six dead and seven survived. friends and family members of the victims were joined by others in the irish community who came to pay respects. it has been one month since severe dry rot caused the fifth story balcony to collapse. six people died and seven were injured. >> we failed them. >> people keep saying thank you for all you have done for us and i thought oh my god we haven't done much of anything. we should thank you for your warmth.

>> the families are aware of the ordinance the city council passed just last week mandating periodic inspections of balconies and setting new standards during construction. the family's main focus is on recovery of the seven survivors and five remain in the bay area. of the five one is leaving to ireland soon while the four will remain in rehabilitation centers in the south bay. >> what we are doing is trying to support them. normally what they would be doing is earning income summer work. we are helping them pay their rent and helping them travel up and down to the hospitals. we are helping the families find accommodation. >> the evening was an opportunity for the families to thank the first responders. they are still keeping tabs on the true. >> we are providing intervention to the crew members. they are expressing some sensitivity about responding to the incident. >> an incident that has brought together a community that continues to find comfort and grieving together. in berkeley, lilian kim, abc7

news. >> the impact of our local crime will reach capitol hill when the family of the shooting victim testifies before a committee. she was shot at pier14 on july 1st. she was shot by an undocumented immigrant. san francisco has a sanctuary city policy designed to protect against deportation. lawmakers in michigan have introduced four different bills to crackdown on cities that protect undocumented immigrants. one would deny state funding to those cities. michigan has two known sanctuary cities, detroit and anne arbor. another attack on a mural in san francisco and this time surveillance video shows the vandal in the act. san francisco police hope someone will rec cog thighs this person. you can see the person splashing some kind of liquid on to the mural on june 29th. it was the third time someone damaged the mural at 24th

>> covering vaw knee shaw, san ramon and san mateo and all of the bay area, this is a bcc7 news. abc7 news. amazing video of the first time a shark attack was captured live by cameras as it was happening. the attack during a professional surfing competition in south africa. the surfer punching and kicking as the shark came for him. lyndsay janice has the details. >> reporter: watch as pro surfer neck fanning is attacked by a shark on live television. fanning on his board off the south african coast when a giant fin comes up behind him. the shark thrashing around and fanning kicking and punching to get away.

the shark's powerful tail knocking him off his board and then dragging him under. for several terrifying seconds fanning can't be seen, but then he pops up. rescuers are racing to pull fanning and his competitor out of the water and looking out for that shark. its teeth suffering the robe connecting fanning's leg to his board. the world class surfer miraculously getting away without a scratch. >> waiting for the teeth to come at me while i was swimming. >> fanning was emotional saying he was worried about wilson. >> you know, even though we are competitors we are still friends. >> wilson also fighting back tears. >> i saw the whole thing and saw him get knocked off his board. a little wave popped up and i thought he has one. >> the organizers cancelling the event and the friends agreeing to share the prize money and feeling lucky to be

alive. >> i am happy to never compete again. seriously to walk away from that, i'm just so stoked. oh man. >> experts say that surfer did the right thing. if you are ever attacked by a shark, your best bet is to punch and kick aiming for the shark's ayes and nose. abc news, new york. a 21-year-old man accidentally drowned in actress demi moore's pool this evening. police were called to the home just after 5:30 this morning. moore's assistant had thrown a party at the house the night before. 20,000 people in the bay area raised $2.2 million to help people living with aids. abc7 news was at golden gate park for the 29th annual aidswalk. the rate of hiv infections has been cut by more than a third thanks in part to research funded by this event. and even though we are past the dark days of the aids

it is an isolated shower and it is an indication of the moisture we have in the atmosphere. we will take you live outside and a look at the embarcadero. the flags are barely moving. there is no light breeze happening. remaining warm and muggy with all of the moisture in the atmosphere. it is pretty unsettled. the chance is there on monday and tuesday, and from you looking for relief from the heat and humidity more comfortable temperatures come in the middle of the week. you do not see this all the time in july. we are in the 70s in most spots. 77 in antioch. 73 in oakland. it is a warm 71 in downtown san francisco. 73 in mountain view and the same in san jose. overnight not the best sleeping weather if you don't have ac. the 24-hour temperature change shows you we are some 5 to 13 degrees warmer than we were at this time last night. along with the mild temperatures it is muggy out

there. you can see the circulation off the coast of southern california and that's the leftovers of dolores. the moisture is streaming north and giving us an increase in humidity. but the showers have really brought downpours for the past 48 hours in southern california. look at this north of l.a. and they picked up nearly an inch of rain. south of palm springs anywhere from three to four inches of rain and even around san diego they picked up about two inches of rain. future weather shows you here tomorrow besides coastal clouds a lot of sunshine on the way and perhaps an isolated shower popping up in the afternoon. the threat is still there on tuesday in the morning with that moisture in the atmosphere. we may be dealing with light showers. overnight it is going to be warm and sticky temperatures in the mid60s to the low 70s in portions of the bay area. highs for your monday starting in starting in the south bay. 88 cupertino and 86 milpitas. 82 san mateo and 87 palo alto.

live from the kgo-tv broadcast center this is abc7 news. >> good evening. i'm katie. in tonight's headlines there is a growing memorial for five people killed in a home in modesto. police arrested martin martinez in san jose for the murders. the victims are amanda cruz, a woman he had a relationship with and their daughter. two other children and another adult woman were also killed. in berkeley a vigil to mark the month after a deadly balance con thee collapse. the mayor and first responders and families paid respects to the six students who were killed. four of the seven survivors are still in the hospital. kate's parents and brother will be in washington, d.c. on tuesday to push lawmakers for immigration reform. undocumented i'm dwrant francisco san -- sanchez is accused of shooting her.

he had been deported five times. this was an extreme weather weekend across the country. in southern california rain has flooded roadways and even collapsed part of highway 10 tonight. the nation is being hit hard with flooding, tornadoes and tropical heat. abc news reporter richard cantu has more. >> from flash floods out west. >> who says it never rains in southern california? >> to golf ball-sized hail in maine the weather ran rampant. in phoenix arizona these storm clouds, an ominous warning of what's to come. >> this is wicked. >> torrential rain and flash floods, remanence of tropical storm dolores swept everything in their path and turning them into debris. the aftermath is a mire of mud. near cincinnati the floods turned deadly destroying this mobile home and killing a pregnant woman and her two children. >> she loved her kids to death. she is a good mother. >> several tornadoes were reported in the middle of the country. this one in illinois.

aftermath of the deadly shooting in tennessee. as other states make bold moves to protect the military recruiters we are learning more about the gunman who killed five servicemen last week. chuck has the latest. >> i wish i could hold him one more time. >> a mother's raw emotions are on display. she made the trip to chattanooga hoping her son randal smith would leave the hospital injured but alive. instead he made the trip to the memorial outside of a recruiting center one day after he died. >> he died doing what he loved. >> in the wake of a gunman's rampage that killed smith and four marines several states including indiana, texas louisiana, arkansas and florida have ordered the national guard to arm military personnel at facilities and recruiting offices. >> i will not permit our citizen soldiers to remain unable to defend themselves

54-year-old chuck limon is accused of using a fake military record to get money out of his close friends and neighbors. dan noyes has this case of stolen value lore. valor. >> the criminal complaint against chuck limon reflects what i reported last year. he convinced his own girlfriend and neighbors at this complex that he had an incredible military record. >> he said he worked in the service and he was currently employed by the coast guard. >> when i first met him he brought up navy seals and special force. >> i thought it was the army corp of engineers and he was an exnavy seal. >> none of it was true. records i obtained under the freedom of information show he spent six months with the army national reserve as a mechanic and no active duty. when he didn't return my phone calls i caught up with him in a grocery store parking lot. >> you claimed you are a navy

seal. >> that's [bleep]. >> they say they convinced him of a special forces background and another navy seal was working on a great deal buying containers and refurbishing them and then selling them at triple the price. >> 6,000 over time. >> 2,500. >> 17,000. >> 30,000. >> this week i interviewed him from his new home in oregon about the 6,850 he gave limon and his navy seal business partner. >> he was supposed to be the other forces -- special forces guy. >> a police detective couldn't find vernon the navy seal. but they learned vern was the name of defendant's first dog. >> you made my day. i don't know what to say about that. >> he can laugh now, but he is deadly serious about what he wants for limon's future. >> i want my money back
