around. >> it was like right in my face right there, standing on the roof watching it come down the hill. >> reporter: when the wragg fire broke out it looked luke a bad one. flames consumed 500 acres in the first hour on their way to roughly 7,000 acres now. even today firefighters face a prolonged fight across tough turf. >> it is real slow going with the terrain we're dealing with. >> reporter: it has been slow going and long waiting, last night the red cross brought up five people, and an emergency center in winters. >> we told we may be able to go back this afternoon. >> you're hopeful. >> very hopeful. >> reporter: and they're patient. that includes ethel hoskins who owns much of the land that burned on the mountain above. >> even tonight it won't be going down without a prolonged dirty fight, but the roar of the wragg fire is gone. >> the numbers that we quoted a while ago, they have not been updated by cal fire since this

with special circumstances for the 2011 killing of jim capu. he was shot as he chased down smith following a bank robbery. deliberations in this trial had to restart twice. just this week, the judge removed a juror for bias against police. after the juror allegedly called a bailiff a thug with a gun. earlier a judge had to be replaced due to a health emergency. prosecutors are seeking the death penalty against smith. >> the mother of the man accused of shooting and killing a hayward police sergeant says she's confident her son will be cleared. hayward police officers packed the courtroom along with estrada's family. estrada's mother says he's not violent. she said she feels badly for the family of the fallen officer. >> i know there is no words that could even touch you know, to

help them. and, i mean, i don't have the words, but i really feel for them too. i do. >> police have surveillance video, dna and other evidence proving estrada shot lunger in the head. estrada faces first degree murder and firearms charges. the judge denied him bail. he's due back in court on august 25th. sergeant lunger, a 15 year veteran of the force, will be laid to rest with full honors next thursday. his funeral is scheduled to begin at 10:00 a.m. at neighborhood church in castro valley and is open to the public. >> you can offer your condolences by sharing this badge on social media. you'll find it on our abc 7 facebook page. or on twitter and instagram under abc 7 news bay area. sergeant scott lunger will be memorialized at a new monument in hayward. ground was bren foroken today. it will honor first responders and those who died on 9/11.

vic lee is there live. a fitting tribute. >> reporter: that memorial to 9/11 victims and to hayward first responders will be built over there right by that sign on this corner lot. the land was donated by the city. and all of the construction and the materials will be donated by citizens. and among the names on those stone tablets, sadly, there will now be another. >> the memorial is dedicated to the victims of 9/11. and to three hayward police officers and firefighter who died in the line of duty. but those here at the groundbreaking today had heavier hearts. >> when we plan this we didn't know that sadly this week we were going to have another name to add to that list. >> reporter: the name of hayward police sergeant scott lunger who was killed wednesday during a traffic stop. his name will be among those inscribed on these four ten foot tall black granite monoliths

representing the four planes that went down that tragic september day. the man behind it, veteran marine sergeant michael emerson this is his seventh memorial project since 9/11. eight years ago in union city he built this granite tribute to victims of flight 93 which crashed in a pennsylvania field. sandra green and her mother lost their loved one, flight attendant wanda green, on that flight. to them, each one of these memorials is as painful as the first. >> had to keep moving but doesn't make it any easier. always fresh. >> reporter: emerson is on a patriotic mission. >> i want to make sure that people remember not only 9/11 but also veterans and first responders. >> reporter: that's why those here believe it is important to include sergeant lunger's name on the memorial stones. alameda county sheriff greg ahearn. >> we do hope that his name will be first on this memorial and we hope that it is the last. >> reporter: amen to that.

vic lee, abc 7 news. >> the city of san landeandro will honor a fallen officer tomorrow. nelles was shot and killed after responding to a disturbance call on doolittle drive. niemi was the first police officer killed in the line of duty in 40 years. they will rename the portion of the street. a celebration of his life will take place at route park at 1:00 p.m. tomorrow. tonight, police are looking for more possible victims of a bay area fitness trainer accused of assaulting a teenage client. william tracy mcdowell was arrested near his milpitas home on july 9th. police believe he assaulted a 16-year-old girl work out with him. mcdowell is a self-empowered fitness trainer who works out of his home. two bay area animal rights activists are accused in a cross country vandalism spree that

caused literally hundreds of thousands of dollars in damage. federal authorities say in 2013 31-year-old joseph budburg and 28-year-old nicole cusain released mink. they were arrested on suspicion of violating the animal enterprise terrorism act. investigators say they also used acid and other items to vandalize a fur retailer in san diego. slashed a meat distributor's truck in san francisco, tried to flood the home of a fur distributor in wisconsin and smashed windows and glued door locks at a furrier in minnesota. brentwood police arrested a juvenile in connection with a home invasion and targeted attack on a couple. the home where it happened early

wednesday morning officers say john and ann ruth were sleeping when three suspects forced their way through a rear door and assaulted the two with a baseball bat. those victims are recovering from blunt force trauma. police say they identified other people of interest in the case. an isolated incident causing ripples of fear. first recall of its kind pulls more than a million cars off the road. a popular bay area pier is shut down. the fda just approved a breakthrough drug for high cholesterol. the first of its kind restaurant in the north bay and how it is sparking a fast food revolution. and check this out, the prehistoric snake with one very big difference from modern snakes. a strange scene unholding in southern california this evening. an l.a. pd bomb squad detonated a package in studio city left behind by a man officers shot and killed outside the bank. a witness says the man had a gun he refused to drop. no bank robbery and no officers were injured. quite a few people in berkeley are upset that the closing of a popular pier that sits west of the city. structural damage has been found and it will take some time before it is repaired. janet oh has the story. >> reporter: fishermen were disappointed this morning when they learned the berkeley pier has been closed. >> we got to spend some time here, yeah. what can we do. >> reporter: the berkeley pier has always been a popular spot to hang out. >> every time i contact -- >> reporter: a sign now posted at the entrance of the pier says it is closed due to structural safety issues. >> didn't feel safe didn't surprise me it would be -- >> reporter: inspectors noticed

damage to the concrete deck and support system days before the fourth of july. the pier was officially closed on wednesday. >> i had to -- it is a safe pier. >> reporter: the tackle shop is not happy with the closure. they are already seeing business slow down considerably in what is supposed to be the busiest time of the year. >> a lot of people can't afford a slip here or afford to own their own boat. so those are the people that we more target that come out and fish off the pier. >> reporter: city officials are trying to figure out the next steps to make repairs. something many hope happens soon. >> great to have access to the water front. i live in the east bay now. it would be nice to run out here and enjoy the scenery. >> reporter: the city of berkeley is working with engineers right now to analyze the extent of the damage figure out methods of repairs and the total cost to fix the problem. in berkeley janet oh abc 7 news. the federal government launched an investigation

tonight into chrysler's recall of nearly 1.5 million cars with a major cybersecurity flaw. the feds want to make sure the company is responding effectively here. this comes after two hackers were able to remotely take control of a jeep. the recall affects many model year 2013 to 2015 dodges, jeeps and chryslers. you can visit the website and enter your vehicle identification number to see if your car is affected. be sure to do that if you're suspicious you might have this car. the company will send you a patch on a usb flash drive. apparently fixed fairly easily. the fda hopes to help all of us see how much extra sugar we're consuming each day by adding those amounts to product labels. sugars added to foods and drinks boost calories but not nutrients. separating out a daily percival you would help people distinguish between healthy added sugar and beneficial sugarsnaturally. the fda approved a

breakthrough drug. the drug is an injectable aimed at helping people with hard to treat inherited form of high cholesterol. it is part of an experimental class of biotech medications which are considered the first major advance in the field in decades. analysts expect it to generate billions of dollars in sales for a maker. a new drive through restaurant in the north bay is definitely a hit. amy's kitchen is known for frozen vegetarian food. but now it belongs to a drive through restaurant. the first vegetarian drive through in the country. cornell barnard is there live with the people's reaction to it. >> reporter: this fast food restaurant is unique, only open five days but check it out, parking lot is full and the drive through is jammed. this line wraps all the way around the restaurant on the other side. employees just trying to keep up with demand.

customers helping to try classic fast food with a healthy twist. the line inside the new fast food restaurant was almost out the door. and check out the drive through. hungry customers sat patient in their cars determined to order lunch. >> can i get five of the amy's. >> reporter: the wait was long, almost 25 minutes. still it was worth it. >> healthier now and i'm an athlete. >> reporter: won't find burgers or fried chicken on the menu but other healthier options like vegan mac and cheese and gluten free pizza. kelsey is trying a veggie amy burger. she brought her mom along to try it too. >> my daughter keeps bugging me about vegetarian. >> reporter: the organic vegetarian fast food place is the first of its kind in the country. >> we're trying to take classic american food and make an organic healthy tasty version of

it. >> reporter: amy's is the local company which has been making frozen organic food for years. but never dreamed a restaurant would be such a hit. >> so many people show up and given us a lot of hope that this is a concept that works. >> reporter: chili cheese fries and a burger for month would leave me feeling super guilty. the fries are vegetarian and so is the burger. why not? >> five amy's and one classic burrito. >> reporter: mike is happy for the healthy choice. >> it is important to me. i'm -- i got a young family and obesity has been big in the country. >> reporter: james is still skeptical, though. he had the vegetarian burrito. >> it could be better yes. but it is edible. >> reporter: entrees run between 4 and 7 bucks. 95% of the food organically grown including the roof. employees are paid a living wage with health benefits. >> we have the option. >> reporter: if the business stays like this, amy's plans to open other drive throughs across

the bay area. cornell barnard, abc 7 news. you can now use lyft to get a ride home. the port of oakland approved the permit for operations at the airport. that means you can use the ride sharing app to get rides both to and from the airport. lyft is currently prohibited at dozens of airports across california but does service sfo and now oakland. reports say square ink founded and led by twitter jack dorsey has filed for an initial public offering. square processed $30 billion in payments last year from millions of merchant customers and has expanded into business lending and payroll processing. the san francisco bay company has declined to comment. the east bay regional park district plans to turn 2500 acres of the former concord naval weapons station into a regional park. it is asking the public for input. officials say there will be a

southwest starts to build westward. and we will see those temperatures soar next week. yes, it is going to get hot. i know it is summertime. and some people do not like the hot weather. i'll show you where it will be warm, not too hot in just a moment. san jose you'll remain a little cooler than the average high of 83 degrees. for the upcoming weekend. as we head toward tuesday through thursday temperatures will come up into the hot category and the low to mid-90s. 87 as we head towards the end of that seven-daytime period. going to go to the garlic festival only thing roasting is the garlic. warming up nicely with bright blue skies and staying pleasant for the evening hours. have a great time if you're going. tomorrow morning temperatures in the 50s. fog primarily up the coast. a few patches near the bay. typical pattern we have been in. tomorrow afternoon 80 degrees in the south bay and san jose.

prices range from $14 to $45. in the past, the weak point seemed to be the fittings and connections at the end of the hose. consumer reports used this machine to determine the strength of the new fitting. those made of plastic are tougher than before and the brass fittings won't break. they're stronger than a regular garden hose. then bernie used this machine to measure the strength of the connection between fittings and the hose. each withstood over 100 pounds of force which is good but no stronger than the older hoses. that might explain why so many user reviews are still negative. >> there is a sharp edge and a twist and turn and dent and flex, it is going to wear right at that point. >> reporter: consumer reports
