n the murder of the va llejo police officer. shots were fired and when the officer's fellow officers reached him, he had been shot three times. he died from his his injuries. the jury in this case say several jurors had been removed. one for expressing antilaw enforcement bias and other times, jurors were ill. now, the jury did find this man,

henry albert smith guilty on all counts. prosecutors will be asking for the death penalty. in fairfield, laura anthony abc7 news. >> the man accused of killing a hayward police officer is now charged with murder and thee charges. this is the new mug shot of mark estrada. katie is live with the story. katie? >> reporter: good evening, his mother coming to his defense, and she was in the courtroom with a lot of hayward police officers, many of them look to be fighting back tears. neither hayward pd nor the da would comment today. court documents do detail a lot of evidence including that he allegedly told a doctor he was shot in his truck. >> i know my son.

>> reporter: raquel estrada believes her son will be cleared. >> i'm devastated for the officer that passed away and my son. >> reporter: estrada faces charges of murder of a peace officer, lying in wait and drive by. hayward chief and many officers packed the courtroom in solidarity of sargent scott lunger and their case. their eyes heavy with emotion. none addressed reporters. >> i know there are no words that could even touch, you know, to help them. and i mean, i -- i don't have the words but i really feel for them too. i do. >> reporter: court documents say lunger's partner heard brief

verbal contact before he was shot. they say bullet holes are consistent with his wounds and they recovered dna evidence. officers found a nine mm gun and spent casings in the truck. they say surveillance video show three people arriving at estrada's home after the shooting and one person was limping. >> we reserve judgment until the facts are in. >> reporter: the judge denied bail. estrada's next court hearing is in august. we're learning details about how scott lunger spent off duty hours. he played baseball for tri-valley a's, part of the men's senior league. teammates say he brought the best out of fellow players. he loved the game of baseball and just as dedicated to his team as his family and his job. >> after struggling shifts getting off at 3:00, 4:00, in

time. the fire has been burning near kyburz. we have carl standing by with an update. carl? >> reporter: the fire has shut down highway 50, now just about a half hour ago, they reopened one lane, that traffic is being escorted. highway 50 heads up to lake tahoe. there are 400 firefighters here, fighting this blaze, they're coming from all over northern california and they are making progress out here. the air attack continue forward a second day as fire crews worked for a second day to secure the heat in the kyburz fire. >> we need to make sure any signs that can fall have been removed or secured. >> reporter: much of the day was spent putting out hot spots the conditions make for unpredictable situations. you can see this is now ash,

a ground breaking today in hayward at the site where a stone memorial will be built to memorialize victims of september 11th and first responders. but the somber ceremony took on an even sadder tone. sheer vic lee live to explain why. vic? >> reporter: well, dan, that corner lot is where that memorial will be built. the city of hayward donated the land and the construction and material will be donated by the public. they hope to complete this

memorial this fall. among the names inscribed on the stone tablets, sadly one more, sargent scott lunger. the memorial is dedicated to the victims of september 11th, and to three hayward police officers and a firefighter who died in the line of duty. but those here at the ground breaking today had heavier hearts. >> we planned this and didn't know we'd sad hi have another name to add to the list. >> hayward police officer lunger. the man behind it veteran marine sargent michael emmer son. this is his seventh mem wril

sunshine for any of your weekend plans, and then enjoy the break from the hot weather because once that trough passes through, high pressure takes over, and as it comes westward building westward, those temperatures are going to soar next week up into triple digits inland and around the bay, it's going to be on the warm to hot side. san jose 83 is the average. staying below that for the weekend. towards tuesday through thursday, you'll notice just how hot it's going to get, low to mid-90s. numbers fall on friday. it was 92 in gilroy today. tomorrow, it's going to be pretty warm. it's not going to be as hot as last year so if you're going to the gilroy garlic festival, sunshine from morning to evening. we're looking at low 70s to start off and warming up into low 80s to mid-90s and cooling off a bit toward evening hours. sunday will be just a little cooler. tomorrow morning fog starts off the day. temperatures in the 50s.

tonight, businesses in berkeley are feeling the closure of the popular municipal pier. the pier is closed because inspectors found significant structural damage. officials say it will take sometime to investigate the damage before the 89-year-old structure reopens. berkeley marina bait and tackle shop says business is already slowing considerably. >> a lot of people can't afford a slip here or to own their own boat so. those are the people that we more target that come out and fish off the pier. >> there is no timetable for when that pier will reopen. this weekend is a big milestone, 25 years since the american was disabilities act became law. larry peredith started a nonprofit legal group fighting for parking changes to bart trains to make them more wheelchair friendly as well as accessibility for the vision and

situation as it unfolds. police in lafayette, louisiana say the man who killed two people in a movie theater may have been casing the place as a possible soft target. >> they know he bought his gun last year despite having a previous application denied because of mental health issues. >> he is knowns a drifter with known for posting hateful and racist messages online. >> reporter: movie goers lined up to see a comedy but the evening ended tragically. police say a 59-year-old john russell houser opened fire killing two and wounding nine others. he say houser tried to escape but turned the gun on himself.

happened, at 9:00. and at 11:00, the lake berryessa fire may be going down but tempers are flaring. the heats dispute between the residents and firefighters. >> well finally tonight a few thoughts about what really matters. these are tough days to be a cop. officers are under scrutiny for how they conduct themselves on the streets like never before. with increasing regularity we see video evidence of apparent excessive force, bad behavior or questionable judgment by law enforcement. sometimes, video is all you need to understand how an officer crossed the line. but sometimes, the video does not reveal the whole story, what looks bad may not be what it appears. we're quick to pile on and assume the worst. we should be equally quick to
