abc news starts right now with live breaking news. >> that breaking news is in vallejo where a 3-month-old was kidnapped by a child's grand father by two men. good evening. i'm dan ashley. >> i'm ama daetz. within two and a half hours investigators tracked them to oakland where police say they were headed for the greyhound bus station. that's where officers arrested brumfield who took the child away from the grandfather. >> it happened on boyson street. he is in a relationship with the child's mother, but it is not clear if he is the biological father. police say he snatched the baby and handed it to michael jones who ran down the street with the child and brumfeld picked him up in the car. police say the motive for this kidnapping is unclear, about you the quick detective work may have prevented something horrible from happening.

>> strange and scary obviously. the three-month-old child is back home safe with the mother. >> new at 11:00 a man is at san francisco general hospital after being swept up in the waves at ocean beach. a kite surfer tried to rescue him, but couldn't hold on to his kite and make the rescue. two other men managed to pull him out of the water and start cpr. one of the rescuers tried to help in what he called choppy water. >> mark estrada is being held without bail for the death of hayward police sergeant scott lungar. he was charged with murder and special circumstances for killing a police officer on duty lying in wait 1k3 firing a -- and firing a weapon from a moving vehicle. katie is live with more. katie? >> dan, you can see the

growing memorial. the man accused of killing him was not there, but his mother said he is not guilty. 21-year-old mark estrada was stoic as the judge read the charges. the uniform was packed with police officers and the tearful relatives. >> if you ask teachers and neighbors and friends they all say he is too kind. >> they say he is the registered owner of the white truck in the shooting. he admitted he was shot in the driver's seat of the truck, but he would not say by whom. the sergeant's partner fired on the truck. they found ammunition at the crime scene and at his house. his attorney said it is speculation his client is guilty. >> we don't know the toe tall tee of the circumstances in this case or how those bullets occurred inside of his car.

>> police tell me they are not currently looking for other suspects, but investigators want to talk to the three people seen getting out of this car at estrada's house. grieving members of the community continue to bring flowers to the hayward police department. >> work hard to protect us. we wanted to come and show our respect. >> thesenior baseball league will dedicate their game to him. >> he will be with us in spirit. >> estrada is expected to enter a plea at his next court date, august 24th. abc7 news. >> a 15-year veteran of the force will be laid to rest with full honors next thursday. because so many people are expected to attend his funeral, it has been moved to oracle arena. it is skeed -- scheduled to start at 10:00 a.m. >> you can find this badge on our abc7 news facebook page or twitter and instagram under the abc7 news bay area.

>> prosecutors will seek the death penalty against a man found guilty of killing a vallejo police officer. henry smith junior was convicted of murder with special circumstances. he shot the officer in the back three times after he responded to a bank robbery in 2011. next week attorneys will discuss when the death penalty portion of the trial will take place. some residents are upset they couldn't gee back to their homes because of a large wildfire that destroyed 6900 acres. right now it is 30% contained. one struck -- structure has been destroyed. several people voiced their frustrations with fire officials, but they said they need to keep them away because the fire is much more dangerous than it appears. >> from the road it doesn't look like there is a lot but from above you can see better that there is substantial fire activity in the two canyons.

the wind is going to change again and it can happen very quickly. >> the fire is in an area with steep and rugged terrain making it hard for firefighters to reach it. the winds are dying down which is helping the firefighters. sandhya patel is here with conditions on the fire line. sandhya? >> the wind like you said is coming down slowly and surely. 66 degrees and the relative humidity is 25%. that is not increasing much but the wind out of the west, southwest is gusting to 16 as opposed to 21 as it has been this afternoon and this evening. now look at the wind gust trend. they trend lower and then it gets more breezy tomorrow afternoon, but no where near the intensity of the wind we experienced in days past. hopefully the crews can get a better handle on this. as you look at live doppler hd we have fog coming in along the coastline.

how it will affect your weekend forecast coming up. ama? >> thank you sand yaw -- sandhya. crews are gaining ground on a fire. look at video of cal trans crews removing cones. highway 50 is one of the main routes to lake tahoe. the drivers are being escorted to the fire zone one direction at a time. the fire is now 30% contained with about 200 acres burned. the cause is under investigation. >> and to get the latest information on the fire near lake berry yeses saw download our app. you can enable push alerts for instant updates. louisiana police are vowing to get to the bottom of yesterday's movie theater shooting in which two women died. they want to know what spurred 59-year-old john russell houser to open fire and then turn the gun on himself. marcy gonzalez has the story. >> tonight prayers in louisiana and flowers left outside the movie theater.

inside is a horrific scene investigators are combing through trying to figure out what would trigger a man to suddenly stand 20 minutes into the movie "trainwreck" and then start shooting into the crowd. >> you realize this is real. this guy is shooting everyone in the theater. >> witnesses sharing heroic moments. strangers helping each other to safety. >> a woman pilled -- pulled me around. she got me out of there three or four seconds later. >> one woman taking a bullet for her teacher saving her life and then pulling the fire alarm. >> and then the two who couldn't be saved. 21-year-old student mayci-breaux and jill 11 johnson pictured on instagram. >> we need to bring closure to these families. >> the alleged gunman john

russell houser when the responding officers caught him trying to escape. investigators are now looking into his past. the protective order filed by his estranged wife citing violence and a history of mental illness. police are investigating houser's hateful internet postings and the mysterious findings in his hotel room. >> we found wigs and glasses and disguises. >> still no explain mages. tonight of the nine people who were injured we are told five are still in the hospital and doctors say they are all expected to survive. marcy gonzalez, abc news lafayette, louisiana. in east san jose police are trying to find a man who was shot to death in broad daylight. neighbors say they heard several shots and saw a man lying in the street. police say the shooter left in a small gray car with several people in it. >> two animal rights activists are out on bail tonight after being arrested in oakland today and charged in a

domestic terrorism case. they are accused of setting 5700 minks free in a cross country vandalism spree targeting fur companies. investigators say they slashed tires in san francisco and attempted to flood a home in wisconsin and vandalized businesses and homes with acid. he was previously arrested in 2009 after violent protests on the uc santa cruz campus and at the homes of researchers. charges were later dropped. coming up next on abc7 news at 11:00 crowds clamoring for a chance to meet soccer's superstars. why the best of europe is in the bay area tonight. >> plus there is something in the water and we are not talking about sharks. why beachgoers are being told to steer clear of the ocean at this popular spot. >> i think you will make a great princess. >> and a really magical moment for a young girl battling brain cancer.

midto upper 70s. looking at live doppler 7hd, the fog is starting to fill in the coastline. it will continue to expand as we head toward tomorrow morning. temperatures are falling in the north bay. they are in the mid50s. most other areas in the 60s except san francisco and half moon bay. and here is a live look. this always looks so cool when you look across east bay hills back toward san francisco you can see the shallow fog layer there. mild to warm for the weekend and heats up next week with possible records particularly on tuesday and wednesday. here is a look at the satellite and radar. this trough came through today and we got a little warm up. highs in the mid60s to the upper 80s. as we hit the weekend a slight drop. sunny and breezy weekend ahead. the reason we will see the temperature slip a little is the trough coming through. we call it at or a little below normal for the upcoming weekend. after that things will change. the trough goes through.

next week the temperatures will sore. triple digits are expected inland and even at the coastline it will be very much on the warm side. as you know last year the garlic festival was quite hot and we noticed that garlic was not the only thing roasting. this year it will be quite nice. yesterday it was 92 and tomorrow morning -- last year it was 92. tomorrow it will be about 70. it will cool off nicely in the afternoon. if are you going have a wonderful time. we have a lot more activities going on. the weather looks pleasant for everything. temperatures in the 50s first thing in the morning. if you have early plans or if you are heading out for a run or taking the dog for a walk 90 in gilroy and 87 morgan hill and 80 in san jose. santa clara and sunnyvale upper 70s. 77 redwood city.

81 lossal -- loss altos. downtown san francisco, 67 degrees. a little dip in the numbers. the north bay will go with 60s at the coastline. 79 in san rafael of the 82 in santa rosa. in the east bay mild sunny and doesn't get better than this. 76 in fremont. in our inland spots mid80s for fairfield, concord and livermore and 83 walnut creek. the accu-weather seven-day forecast. the temperatures will fall a couple more degrees on sunday bay and inland. still pleasant. mid60s to the mid80s. warming begins on monday. tuesday and wednesday it is sizzling. temperatures in the 70s along the coastline. we are looking at heat. even though the heat backs off, the humidity rises. it just feels worse when the humidity comes up. the temperatures will continue to fall on friday. we will be watching that thursday in case the monsoon
