boulevard around the scene. >> they drove up and found the person who had been shot. rest assured, this is not an incident of a freeway sniper. >> again all northbound lanes are closed, and traffic it being diverted off the interstate on to march roenicka boulevard, around the scene. this is happening on the san rean degree freeway. we will bring you more details as soon as we get them. a three-month-old baby is back with his mother after vallejo police say two men kidnapped the infant. officers arrested john brumfield and michael jones yesterday. they stadiumfield forcibly snatched the baby from the grandfather at his home. it appears the suspects were headed toward the greyhound bus station. brumfield was in a relationship with the child's mother burks it remains unclear if he's the child's biological father. a man is at san francisco general hospital after getting swept up in the waves at ocean beach. a kite surfer tried to rescue

him, but couldn't hold on to his kite and make the rescue. two others managed to pull him out of the water and start cpr before emergency workers got there. one of the rescuers said he saw the man struggling in what he described as choppy water. mark estrada made his first court appearance yesterday following wednesday's killing of sergeant scott lunger. we have more. ♪ ♪ >> the 21-year-old mark estrada was appearing for his first court appearance yesterday following thursday's killing of sergeant scott lunger. >> we have more. >> the 21-year-old marcus judge read the charges against him. the courtroom was packed. >> if you ask teachers neighbors, friends, they all say he's too kind. >> court documents reveal

estrada is the registered owner of the white truck involved in the shooting. he went to the hospital with a gunshot wound to his side and admitted he was shot while in the driver's seat of his truck but he would not say by whom. sergeant lunger's partner fired at the truck. they found a handgun and ammunition at the crime seat and at his house. his attorney said it's speculation that his client is guilty. >> we don't know the totality of the circumstances in this case or how those bullets occurred inside of his car. >> police tell me they are not currently looking for other suspects, but investigators still want to talk with the three people seen getting out of this car at estrada's house after the shooting. grieving members of the community continue to bring flowers to the hayward police department. >> it's very hard. we wanted to come and show our respect. >> the senior baseball league will dedicate their game to their fallen teammate. >> he will always be in our dugout and on the field in spirit. >> mark estrada is expected to enter a plea at his next court

day on august 24th. abc7 news. >> sergeant lunger, a 15-year-old veteran of the force, will be laid to rest on thursday. his funeral has been moved to oracle arena. it's scheduled to begin at 10:00 a.m. and is open to the public. you can offer your condolences by sharing this badge on social media. you can find it on abc7 news bay area. >> the city of san leandro will honor a fallen police officer today with a naming of a street in his name. officer nels was shot and killed ten years ago today while responding to a disturbance call on doolittle drive. he was the first officer killed from san leandro in 40 years. >> he was a good friend to all of us, a great family man. he was a father and a son and a brother. and he is still missed by many. it's something that none of us

will ever forget. >> the city council will rename a stretch of hayes street between east 14th and davis officer dan neime way. a celebration of his life will take place at root park at 1:00 p.m. today. >> also happening today, a community forum will take place in san francisco's mission district to focus open several acts of vandalism against a mural. surveillance video caught a man splashing some kind of flammable liquid on the mural and tried to burn it last month. there has also been graffiti on it. it was debuted at 24th and bryant last month. the mural mixes images from latino and lgbt culture. today's discussion begins at 10:00 a.m. at the mission district campus of city college. now to the fire burning near the lake. it has destroyed 6900 acres in napa and solano counties. right now it's 30% contained. one structure has been

the fire. >> what's his name? >> fred. >> over and over the past few days we've heard about not property, but appear malls. the lucky one, like this cat named gray, still look a little frightened. someone left food for her. >> cat is okay, you are okay? >> yeah. oh, yeah, and the ordeal never completely over until everyone comes home safe and sound. >> wayne freedman, abc7 news. highway 50 is back open this morning as crews begin to gain ground on a fire in eldorado county. take a look at this video. they are removing the cones. highway 50 is one of the main routes to lake tahoe. drivers are being escorted through the fire zone one direction at a time. the fire is 30% contained with about 200 acres burned. the cause is under investigation. one of the most vital tools in fighting a wildfire is the attack from the air. it takes a special sort of pilot to fly in those difficult conditions.

a groundbreaking was held in hayward yesterday at a site where a stone memorial will be built to remember the victims of 9-11 and first responders, but it took on an even sadder tone. here's vic lee. ♪ what so proudly we hail ♪ ♪ at the twilight's last gleaming ♪ >> the memorial is dedicated to the victims of 9-11 and three hayward police officers and a firefighter who died in the line of duty.

but those here at the groundbreaking today had heavier hearts. >> when we planned this, we didn't know sadly this week we were going to have another name to add to the list. >> the name of hayward police sergeant scott lunger, who was killed wednesday during a traffic stop this week. his name will be installed on these ten-foot tall. representing the planes that went down that tragic day. the man behind it, michael emerson. a veteran marine sergeant. this is his seventh memorial project since 9-11. eight years ago in union city he built this granite tribute to to victims of flight 93 who lost their lives in this field. this family lost family members on that flight. to this family, each one of these memorials is as painful as the first. >> you have to keep moving, but it doesn't make it any easier. always fresh. >> emerson is on a patriotic mission. >> i want to make sure that

you can see for yourself. temperatures cool in the north bay where there is some fog in santa rosa 54 degrees. it's foggy down 101 to petaluma. fairfield 58 concord and livermore at 60 trees right now. from the exploratorium looking out toward the bay, you see a light breeze there on the water. so we have areas of morning fog. not that many. a mild to warm weekend ahead and possible record heat next week. we will keep an eye on that as well. looks like it is going to hit tuesday and wednesday. the radar satellite image shows this upper level trough. this is going to face through this weekend. we will still keep things on the sunny side but it will be breezy. then sunday night, as the trough passes through, winds will pick up. so locally brisk in some areas late sunday evening. then check it out. by wednesday midweek, high pressure builds and we will see a stronger offshore flow.

this helps increase temperatures. so triple digits for inland areas tuesday and into wednesday. and we could possibly break some records. highs today in san jose, 80 degrees. plenty of sunshine there. 90 in gilroy for the garlic festival. on the lower part of the pensins law, upper 70s so mild. only 63 in pacifica. if you want the cooler temperatures, head to the coast where it will be cloudy. partly cloudy conditions downtown san francisco at 67. napa and sonoma low 80s for you. but we will hit the 90s in cloverdale and lake port. and in east bay for the kite festival, 69 in berkeley with the winds picking up to 20 miles an hour this afternoon. lots of 70s through oakland. san leandro, fremont 76. and look for some upper 80s in antioch and brentwood. and low 80s through walnut correct, san ramon and pleasanton.

we are slightly below average in livermore at 84 degrees. here's the look at the week ahead. to give you an idea of what to expect. average in livermore is 88. but today and tomorrow we will be in the mid-80s. so enjoy the slight relief because notice how things are going to ramp up on monday and we will see 100 possibly on tuesday, 102 on wednesday. i don't think we will break any records in livermore because the records are 106 and 108 respectively but it will be hot out there. you will see that with the accuweather seven-day forecast as well. the warmup on monday climbs and peaks on wednesday. humidity rises thursday and friday. but slightly cooler numbers. we have also temperatures reaching the 90s around the bay and 70s at the coast. so if you want to head to the beach midweek, that would be a great time to do it. >> in berkeley do you think there will be enough wind to help the kites take flight? >> definitely. we will see a slight breeze and it will pick up to 10 to 20 miles an hour.

suddenly stand 20 minutes into the movie "trainwreck," pull out a handgun and start methodically shooting into the crowd. >> you realize this guy is shooting everyone in the theater. >> witnesses sharing heroic moments. strangers helping each other to safety. >> a woman pulled me around. she probably got me out of there three or four second faster than i would have by myself. >> jenna taking a bullet for fellow teacher ellie martin, saving her life. martin then pulling the fire alarm. >> that teacher really saved everybody in the theater. >> and there were two who couldn't be saved, a 21-year-old macy rowe and a 33-year-old mother jillian johnson. they are pictured on instagram. >> we have do everything we can to bring closer to the families. >> john russell houser took his own life when officers caught him trying to escape. investigators are now looking into his past. the protective order filed by his estranged wife citing violence and a history of mental

illness. and police also investigating houser's hateful internet postings and the mysterious findings in his hotel room. >> we found wigs and glasses. >> of the nine people injured, we are told five are still in the hospital and doctors say they are all expected to survive. lafayette, louisiana. dallas police released surveillance video of a woman being rescued from beneath a car. it happened a couple weeks ago after a car collided with a motorcycle, trapping gibson. she was gasping for air under the weight of the vehicle. realizing the dire situation a group of police, firemen and bystanders lifted the vehicle by hand. dashcam video captured the whole thing. they pulled her out and rushed her to the hospital. >> all we saw was like an arm and the rest of her so we tried to make sure she was still alive, still breathing something. >> we were talking to her, keep reassuring her that we were going to get her out from under

there. >> once we saw the big guys show up, i said i think there's enough of us to lift up the car. >> gibson is crediting her rescuers and her helmet for saving her life. she's still recovering. here she is in the hospital after the accident. gibson has since gone home. >> you can now use lyft to get a ride home from the oakland international airport in oakland. you can use their ride sharing apps to get rides both to and from the airport. lyft is currently prohibited at dozens of airports across california. >> reports say square inc has filed for an ipo. square processed $30 billion in payments last year from its millions of merchant customers and has expanded into business lending and payroll processing. the san francisco based company has declined to comment. just ahead a bay area homeowner

. >> when an east bay homeowner heard a mysterious noise in her ceiling, an exterminate tore told her she had rats. she soon learned rats were not the problem. that's when "7 on your side" michael finney stepped in to help. >> it began with the scratching sound in the cottage behind her home. >> we figured it was a squirrel. >> the critter kept scratching and plaster fell from the ceiling. >> i was concerned it was a rat >> so she called terminex to come get rid of whatever it was. >> one wanted to cut a hole in the ceiling and let it out. >> but a salesperson who inspected her property told her this was a much bigger problem. she had rats. >> well, he said, you've got rats in the cottage, you've got them in the house. >> not only that, the salesman

looked at the wood around her house and said judith had termites. she needed to kill the bugs and the rats. >> and by that time i was so worried that i was going to have rats coming up the side of my house. >> she agreed to pay $4500 for all that pest control. the only thing it didn't include, cutting the critter out of the ceiling. >> in fact, he didn't even want to go inside to look at it. >> however, when technicians came to set the traps, they gave her another surprise. >> they looked and said, there are no rats here. >> they told her she didn't have rats or termites. and they figured out what was really living in the ceiling. >> it was a squirrel, as we very first thought. and i realized i had been sold a bill of goods that i didn't need. >> judith called to cancel the contract. instead she started getting bills for monthly payments. turns out terminex set her up with a loan at 18% interest. she said nobody asked her first. >> i never received a contract. everything was done on the inspector's telephone. so i just went like this, signed
