it's saturday, july 25th. good morning and thanks for joining us. i'm chris nguyen. let's start with a first look at the forecast with frances in for lisa. >> good morning, everyone. great to start off. in the north bay we had fog and limited visibility. petaluma five miles. elsewhere the clouds will clear to the coast pretty quickly. right now, temperatures mainly in the upper 50s to low 60s except for parts of the north bay. mid 50s in napa. beautiful shot from mt. tam. you see the low clouds and clearing inland in east bay areas.

look for 60s around the bay. partly cloudy with a breeze. your complete accuweather seven-day forecast. >> all lanes of 880 and san leandro are back open following a deadly overnight shooting near the marina boulevard off ramp. officers heard shots fired. they were in the area to investigate another traffic accident. officers followed the sounds of those shots. that's when they found the victim. >> they did see a vehicle pulled over to the right hand shoulder just north of the marina boulevard overcrossing. that's when they drove up to find this person who had been shot. >> rest assured, this is not a freeway sniper. >> the freeway was closed for about four hours after the shooting. 8:01 our time. a 3-month-old baby is back with his mother after vallejo police

say two men kidnapped the infant. officers arrested two men yesterday. they say brumfield snatched the baby from his grandfather before handing the child to jones. it happened at this home. police captured the suspects about 2 1/2 hours later in oakland. the suspects were headed toward the greyhound bus station. brumfield is in a relationship with the child's mother. police say it remains unclear if he is the biological father. a young man in jail after being formerly charged in the murder of a haywood police officer. the 21-year-old made his first court appearance following wednesday's killer of scott lunger. katie marzullo has more. >> reporter: 21-year-old mark estrada was stoic. the courtroom packed with uniformed police officers and the defendant's tearful

relatives, including his mother. >> if you ask teachers, neighbors, friends, they all say he's too kind. >> reporter: court documents reveal he is the registered owner of the white truck with the shooting. he went to the hoch with a gun shot wound in his side and admitted shot while in the driver's seat of his truck but would not say by whom. police found a hand gun and ammunition at the crime scene and at his house. his attorney says it's speculation that his client is guilty. >> we don't know the totality of the circumstances in this case or how thoseç bullets occurred inside of his car. >> reporter: police are are not currently looking for other suspects, but investigators want to talk with the three people seen getting out of this car after the shooting. grieving members of the community continue to bring flowers to the hayward police department. >> they work very hard to protect us. we wanted to come and show our

respect. >> lunger's senior baseball league will dedicate their game to their fallen teammate. >> he will always be in our dugout in spirit and on the field in spirit. >> mark estrada is expected to enter a plea august 24th. >> sergeant lunger a 15-year veteran of the force will be laid to rest with full honors on thursday. because so many people are expected to attend, his funeral has been moved to oracle arena. it is scheduled to begin 10:00 a.m. and is open to the public on thursday. you can offer condolences sharing this badge on social media. you'll find it on our abc 7 news facebook page or twitter and instagram under abc 7 news bay area. prosecutors will seek the death penalty against a man found guilty of killing a vallejo police officer. prosecutors said smith shot officer jim kapu in the back three times after he responded to a bank robbery if 2011.

next week attorneys will discuss when the death penalty portion of the trial will take place. 8:05 is our time. san leandro will honor a fallen police officer with a street dedication in his name. officer was shot and killed ten years ago today while responding to a disturbance call on doolittle drive. he was the first san leandro police officer killed in the line of duty in 40 years. >> it's still fresh in our memories. way as good friend to all of us. great family man, a father and son and brother. he is still missed by many. it's something none of us will ever forget. >> the city council will rename a stretch of hay street officer dan nini way. it will take place 1:00 p.m. today. also today, a community forum will take place in san francisco's mission district to focus on several acts of

vandalism against a mural. they captured a man splashing some flammable liquid and they sprawled graffiti over it. he mixed images from latino and lgbt culture. discussions begin 10:00 this morning at the mission district campus of city college. to the fire burning. here is the latest information. it has destroyed 6,900 acres in napa and solano counties. right now it's 47% contained. one structure has been destroyed, an out building. 140 more structures are being threatened. abc 7 news reporter wayne friedman has more. >> reporter: here is what progress looks like. smoke with an occasional burst of flame and line of cars with engines running, waiting for highway 128 to reopen after almost 48 hours. >> i've been sleeping at my ex's

safe and sound. >> highway 50 is back open this morning as crews begin to gain ground on a fire burning in el dorado county. caltrans crews removing the cone. it's one of the main routes to lake tahoe. the fire is now 30% contained with about 200 acres burned. the cause is under investigation. >> one of the most vital tools fighting a wildfire is attacks from the air. it takes a special pilot to fly in those difficult conditions. as jonathan bloom found out there is something making their job tougher. >> cal fire's air tanker 86 didn't always fight fires. >> this was a subchaser during the war and used to carry torpedos. >> bob's job is to drop those 1,200 gallons of retardant in

new this morning, highway patrol says a man overturned his car trying to escape from officers. you can see the aftermath on highway 101 near san francisco international airport. officers first tried to stop the driver in the south bay. they claim the man sped away northbound along the bayshore freeway. the man escaped from his car after it flipped over. chp officers used a taser to subdue him. a ground breaking was held in hayward at the site where a stone memorial will be built to remember the victims of 9/11 as well as first responders. the somber ceremony took on a sadder tone in wake of what happened in hayward. ♪ what so proudly we hailed ♪ at the twilight's last gleaming ♪

>> the memorial is dedicated to the victims of 9/11 and hayward officers and firefighter who died in the line of duty. >> when we planned this we didn't know that sadly this week we were going to have another name to add to that list. >> name of hayward police sergeant scott lunger killed wednesday during a traffic stop. his name will be among those inscribed on these four 10 foot tall gravity monoliths remembering the four planes that went down that tragic september day. this is his seventh moment motorcycle project since 9/11. eight years ago in union city he built this granite tribute to victims of flight 93 which crashed in a pennsylvania field. sandra green and their mother lost their mother, flight attendant wanda green on that flight. each one of these memorials is

popular beach consistently ranked the dirtiest on the west coast. cal beach in santa cruz have unsafe levels of e. coli. it extends west of the wharf to the east end. the dirty beach ranking comes from the nonprofit water quality group "heal the bay." >> the california drought has gotten so bad authorities have begun evacuating fish from fulsome lake. they put rainbow trait into attempt controlled tank and will distribute them to cooler waters. the hatchery is 71 degrees and warming quickly. rainbow trout will start dying at 75 degrees. >> it's not something we want to do but in order to keep life going and to keep the species going, it's what we are doing. >> the fish will be released into donner lake. it has an elevation 7,000 feet and should remain cool enough to keep the fish alive.

>> it's tough. >> reporter: first day 25 people seated for a screening of "trainwreck." including jonas and his friend whose seat choice made the difference. >> it would have been different if we were in the back row. >> reporter: in that same multiplex was john russell houser sitting alone until 20 minutes into the movie. the 59-year-old fires a.40 caliber hand gun causing confusion and chaos. >> we thought it was the movie. we realized, this is real. this guy is shooting everyone in the theater. he was so close to us. >> reporter: houser firing at least 13 rounds killing two and injuring nine others. >> everyone was just running down the stairs freaking outs climbing over chairs and people. >> reporter: movie goers helping one another escape safely even forming a make-shift triage outside the theater. more heroes stepped up.

two teachers seated in that same theater. gina using her body as a shield to protect her friend and co-worker, taking a bullet for her. freeing her to pull the fire alarm. overnight, both women released from the hospital. >> that's how we react to situations. we are very protective individuals. i'm very proud of them. >> reporter: now a community in mourning, a memorial growing outside the store victim gillian johnson owned. the 33-year-old and entrepreneur and a musician. johnson's family celebrating her life posting this photo on instagram. and macy breaux, the 21-year-old student remembered in a prayer service friday. bobby jindal toured the grizzly crime scene. >> we will get through this. it's going to be tough. this is a resilient community.

>> reporter: governor jindal describes the shooter as barbaric and methodical and if it was presidentn't wasn't for the hero's quick thinking others would have died. he temporarily suspended his campaign and says right now is not the time to talk about gun control. dallas police released surveillance video of a woman being rescued from beneath a car. it happened a couple weeks ago after a car collided with a motorcycle trapping kara gibson. she was gasping for air under the weight of the vehicle. realizing the dire situation, a group of police, firemen and bystanders lifted the vehicle by hand. dash cam video captured the entire thing. they rushed her to the hospital. >> all we saw was like an arm and the rest of her. we tried to make sure she was still alive, breathing. >> keep talking to her. help is on the way. we are going to get her out. >> once we saw the big guys show

when an east bay homeowner heard a mysterious noise in her ceiling, an exterminator told her she had rats. she learned rats were not the problem. that's when michael finney stepped in to help. >> reporter: it all began with a scratching sound in the cottage behind judith reed's lafayette home. the critter kept scratching. plaster fell from the ceiling.

>> i was concerned it was a rat. >> reporter: she called terminex to get rid of whatever it was. >> wanted to cut a hole in the ceiling. >> reporter: a sales person told her this was a much bigger problem. she had rats. >> he said if you've got rats in the cottage, i've got them in the house. >> reporter: he looked at the wood around the house and said she had termites. she needed to kill the bugs and rats. >> at that time i was so worried i would have rats coming up the side of my house. >> reporter: she agreed to pay $4,500 for all that pest control. the only thing it didn't include, cutting the critter out of that ceiling. >> in fact he didn't want to go inside to look at it. >> reporter: when technicians came to set the traps they gave her another surprise. >> they said, there are no rats here. >> reporter: they told her she didn't have rats or termites. they figured out what was really

living in the ceiling. >> it was a squirrel, as we very first thought. i realized i had been sold a bill of goods i didn't need. >> reporter: judith called to cancel the contract. she started getting bills for monthly payments. terminex set her up with a loan at 18% interest. nobody asked her first. >> i never received a contract everything was done on the inspector's telephone. i signed with my finger. >> reporter: she contacted 7 on your side. the company agreed to cancel the contract telling us our sales professionals take time to carefully inspect each home and review the service contract with our customers before it is signed. however, misunderstandings can occur. as the satisfaction of our customers is one of our highest priorities we have honored our customer's request to cancel the
