live from the kgo-tv broadcast center this is abc7 news. >> we did recover a rifle from the scene. there were many rounds fired at scene. >> veteran oakland police officer seriously wounded during an early morning gun battle with a suspect. >> thanks for joining us. >> abc7 reporter janet o is in oakland with the latest. janet? >> kristen, oakland police chief did not say how many times or where the police officer was shot but he did say he now is in stable condition after this morning's deadly shootout. oakland police released this photo believed to be the suspect, a legal assault rifle

with an extended magazine used to shoot at officers. oakland police chief described the shootout. >> close to to a full magazine was fired. >> it happened near martin luther king jr. way. officers were following up on a sexual assault investigation. when they alived at suspect's house this is what happened. >> the suspect came out of the front door with a rifle and immediately began firing upon the officers in front of the house. >> officers returned fire and struck the suspect. the 49-year-old oakland resident was pronounced dead at the hospital. the officer was shot at least once. he is a 14-year veteran who recently was promoted to sergeant. >> the police officer sustained significant gunshot wound and is currently in serious-but-stable condition and has undergone one surgery and will likely have more surgeries for the coming.

>> the second officer involved in the shooting was not injured. that officer has been where the department for one year. oakland police and alameda county district attorney's office will be investigating the shooting. >> a special flag called a united states honor flag is waving above the hayward police sergeant in memory of sergeant scott lunger after flowing at several landmarks including ground zero in york and honors american heroes across the country. officers will run at 1:00 o'clock when the flag is brown -- brought down. it will fly for february years an hour for each year of service. >> on the explosive wildfire burning out of space control in lake county. the assault can be seen from the air with two more air tankers joining the fight.

fires are battling tough conditions which has tripled in size since friday. it now is burning in three counties. the rocky fire is 60,000 acres. it is only 12 percent contained. 12,000 resolution accidents are under mandatory or voluntary evacuation orders. 15 structures have been destroyed. 24 are homes. our reporter has more from lake county. >> firefighters on the rocky fire are feel be optimistic about the containment number. they say the next three days the weather looks pretty good and last night was one of the quietest on the fire. they know spots like these can flare-up in the afternoon when the winds pick up so they are still keeping a very close eye on things keeping water on the hotspots just in case. they are clearing residents out of the area. >> another day at the rocky fire, another round of evacuations. officials ordered these people out their homes yesterday. they are prepared to settle here

at the lodge for a few days. >> i will be here until they send us home probably in a couple of days. would knows? >> fires made good progress last night and the weather forecast is looking good. they are not letting down their guard. they have nearly 3,000 firefighters here and more are arrive today. residents say they are impressed and grateful. >> these guys are great. the winds are really bad. that is the problem. >> firefighters say although it looks calm this morning, and they have more than doubled capement lines, residents need to keep their head on a swivel because the near grew so dramatically over the weekend they don't know what it will do. you may not be affected this second but it could change 13,118 people have been evacuated so far and the ones we spoke with say they are aware. >> if you have a bad year, this is the worse fire i have seen in 40 some years up here.

too much brush. >> firefighters say the goal today is to box in the fire using highway 20 and highway 16 as the perimeter. they want to keep it in that area, not let it jump out of there. they feel like the weather is in their favor the next few days and maybe they can turn the corner on this. in lake county for abc7 news. >> the mandatory evacuation can be seen for several communities all residents at spring valley ordered out. areas around paradise canyon and jerusalem valley remain develop evacuated affecting traffic on highway 20 and 53. other bay area firefighters are shooting their own video of the rocky fire. a battalion chief is leading a strike team of five engines and shot this video. they are firing flares to burn fuel to try to stop the flames from jumping the highway.

fine. the next step in the investigation is finding out exactly how he got here. >> albanian special olympian was last seen saturday night at the university of southern california. he missions the closing ceremony on sunday at 6,500 fellow athletes celebrated together at the los angeles memorial coliseum. this morning, after 2:00 a.m., and 350 miles away, the bowling competitor walked into the hayward police department wearing just shores and a t-shirt. >> they determined he was hungry. they got someone to talk to him and they tracked him down over two hours and they figured out who he was and where he was from and they found him which is great. >> hayward police used a translation service to get more information from the 44-year-old. they believe he may is traveled by bus but investigators say he was having difficulty communicating the circumstances of his disappearance other than to say he was looking for a police department prior to his arrival at hayward police

new this morning, san francisco police are investigating a break in at a cell phone story near mark k here you see the front window shattered at the verizon store. witnesses say officers arrested two people with arms full of phone and other accessories. >> the national baseball congress is suspending the use of bat boys and girls during the world series after the death of a 9-year-old bat boy. the boy was hit by a bat during amateur game in wichita on saturday. he died on sunday from the injuries. he was running by a batter who was taking a practice scene and was hid in the head. he was wearing a helmet. the national baseball congress is an organization of amateur and semi professional leagues in the united states and canada.
