live from the kgo tv broadcast center, this is abc 7 news. >> good afternoon. i'm ama daetz. >> i'm larry beil. firefighters are trying to get the upper hand on the burning wildfire. the rocky fire is at 65,000 acres, still only 12% contained. >> the middletown unified school district is delaying the opening of school for a week because some schools are being used as evacuation centers. and a storm could bring more lightning and stronger winds. >> wayne friedman is live. >> reporter: we're standing along highway 20 where yesterday afternoon at about this time the

fire jumped. this area behind me all burned. they built a fire break trying to hold those flames ahead of the highway but they weren't successful. the fire came from that direction and we're beginning to see now hot spots coming up. it's been a strange day, almost winter-like in the county. let me show you some video from an hour ago. rain drops. could they be a sign? unseasonable rain drops. could they make a difference, a miracle. it's not what the book says 12% containment should look like. cal fire says the wind may pick up this afternoon. if it does the fire could blow west toward clear lake. imagine more evacuations, more people worried about the fates of their homes like rene.

he spoke with us this morning. >> worrying about our homes. still don't know. don't know. but we kind of know. but what do you kind of know? >> well, it's still standing, thank god. you know -- >> the fire is still close? >> the fire is close. >> the fire is close but the fire as they say is laying low. it has taken 24 homes so far plus 26 structures. no homes or structures in the last 24 hours that we're aware of. it's a strange fire. the sun only came out for the first time ten minutes ago and as it came out it has become hot again. we'll have more for you in an hour clgd more people in that evacuation center and experts from cal fire giving us their best hopes and in some cases their worst fears. wayne freedman, abc 7 news.

of the delta. producing spotty sprinkles. nothing steady or measurable. let's get to the conditions near the rocky fire. temperature 69 degrees and climbing as wayne pointed out. cloud cover held temperatures down. it's warming up. relative humidity much higher. 58%. winds still strong gusting to 18 miles an hour. and that does not help the frrth effort at all. this area outlined in red includes the acreage to which the fire spread. after 8:00 p.m. to midnight, between miss night and 5:00 a.m., very little wind at all. we expect winds to increase by late morning to midday tomorrow. look eastward, mainly blue sky over the bay. 69 degrees in san francisco. mid-70s in oakland. 71 in half moon bay and parting clouds over the golden gate

right now. santa rose anovato, fairfield and concord, low 70s, except livermore which is 79. i'll have your complete accuweather seven-day forecast in a few minutes. attorneys for raymond a court filing released today, chow's attorneys claim fbi wiretaps implicate them in campaign finance violations and bribery. it's an attempt to get the charges against chow dropped. they sent abc 7 news a statement saying the accusations are without merit. carolyn tyler will have more on this coming up. hayward police are looking for three suspects involved in an overnight deadly shooting. they shot a 17-year-old walking

with a friend. it happened on morningside drive and north avenue. the victim's name hasn't been released but he was a good student and athlete at hayward high. we're hearing from hayward's fire chief who is suspended as he faces charges of fighting with a suborder nat and drinking on the job. >> chief contreras just issued an apology to members of the media for his actions that's took place about 16 months ago. the reason we're talking about this now is they've just come to light this past april. during an investigation chief contreras admitted he was drinking while on call, that he didn't respond to a call for service and drove city vehicles while under the influence of alcohol and had a physical altercation with a subordinate.

>> it's incredibly embarrassing for myself, the fire department and the community. >> reporter: it happened between march and september of 2014. the investigation was launched this past april. the city manager's office says it was not shared with the public because it was a personnel matter. his discipline now coming to light because a print reporter submitted a public records request. chief contreras had this to say when asked how he might discipline subordinates in light of his own admitted mistakes. >> every situation is different. i believe i've always been fair and even-handed. i believe i would continue to be fair and even-handed and follow the lead of my city manager. in this case, fran david recognized i'm human and i've made some significant mistakes and have taken responsibility for those mistakes. >> reporter: the city manager decided to let chief contreras

keep his job because he was so forthcoming with information and also because he agreed to sign a last chance agreement. here's what's that agreement outlines. one month suspension without pay. 9.3% salary cut. no raise through july of 2016. no take-home vehicles and he'll no longer be allowed to drink at city events. what do hayward residents think of all of this, including the fact he's able to keep his job? we'll hear from them coming at 6:00. >> melanie, thank you. investigators are trying to figure out what sparked a fire in san jose on east william court. this video is courtesy of seesmeadphotography.com. caltrans canceled road work scheduled for today in pacifica after the city complained. officials are upset because they weren't notified of work yesterday. it caused huge back-ups in the

southbound direction. pacifica officials want caltrans to go before the city council to explain why the road work isn't being done at night. >> tens of thousands of california criminals are now able to vote again. they are eligible to vote. the aclu sued the state after a court decision found community supervision is different from parole. ex-cons in california are not allowed to vote until after they complete their parole. a group of people sickened by legionnaires disease in new york city continues to grow. >> 86 people have contracted that disease up from 81 yesterday. marci gonzalez has more on this outbreak. >> reporter: concerns today about a growing number of cases of a potentially deadly illness. in less than a month, legionnaires disease killing seven. >> in michigan, the severe form

driver jumped into the victim's car and then ran him down with his own car. they hope these images will help find those men. some california homeowners forced to evacuate because of the wildfire are dealing with a thief who has been ransacking homes. this all happened in madera county an hour north of fresno. that's where the willow fire has been burning. veronica from our sister station has more on what was taken. >> reporter: five families have reported looters breaking into their homes. as more people return, neighbors tell us that number could get higher. the listing of evacuation orders is a sign for neighbors that the willie fire is flaming out. >> is your house okay? >> coming back to lootd houses

wasn't the welcome home they were expecting. >> when he took the kids' piggy banks. >> reporter: he was the first to find his neighbor's house was ransacked by thieves. >> we see the broken window and slit screen. >> reporter: they lost ammo, knives, jewelry, game consoles and liquor. >> they took suitcases and filled them with our things and left. >> reporter: while other neighbors were cleaning up shattered glass, they pror tecting their doggy door where they believe a suspect crawled in. >> my good friend john got broken into. >> reporter: but they don't know at who. >> we had deputies and other law enforcement patrolling there 24 hours a day. there were road blocks so vehicles weren't coming in and out. that leads us to believe whoever did this was on foot.

>> all evacuation orders were lifted at 10:00 this morning but sheriffs deputies are maintaining a heavy preference as flames continue to burn. top congressional lawmakers are in the bay area to convince tech companies to hire more black workers. barbara lee met with representatives of google and apple and intel to talk about minority hiring. it's shameful so few tech workers are african-american. >> they want to disclose their diversity data and commit to plans that will ensure full african-american inclusion by 2020. >> they also want more minorities on the board of directors. a survey of the top 20 found only 3 of the 189 directors are african-american. twitter's slumping stock may make it a takeover company.

the interim ceo warned it will be a while before they stop's slowdown in user growth. some believe it could be part of a strategy to drive stock prices down to make the company easier to acquire. dozens of people met some potential employers today at a hire event in silicon valley today. we were at the biltmore hotel for the free job fair. it allows people to meet with employers who are looking to hire. sales manager, police dispatcher and front desk supervisor were among the 600 open positions. the next hire event is set for september 1st in san francisco. time to check on our weather. cool out there. >> in fact, cloud cover hung around for much of the day. just in the last hour, the clouds have parted.

>> reporter: and a 30 minute jog at a constant speed. the next morning we repeat the same workout. this time i'm wearing the zagora. >> really no difference whatsoever. >> i burned three calories less in zagora and our producer burned 17 more in zagora. an 8% difference. why might that be? >> stephanie is adjusting things more. every movement counts. the other possibility is it has something to do with the clothing. that remains to be seen. >> reporter: they cite three studies where more than 50 women brned 2between 6% and 11% more. but their claim could be confusing to consumers. >> you have to look at the actual numbers themselves. the number of calories burned between using zagora hot pants and other athletic wear is very

rocky fire has grown to 65,000 acres and is still only 12% contained. the middleton unified school district is delaying the opening of school for a week because it's being used as evacuation centers. wayne freedman is at one of those centers. wayne will have a live report at 5:00. six bay area start-ups are talking with president obama about entrepreneurship. they watched their founder on the live white house web cast. this new develop mtd from last month's murder suicide in walnut creek. scott burnis used homemade ghost guns to kill his girlfriend and then himself.

lyanne melendez is live with more. >> reporter: they took one look at those guns and immediately knew what they were. they did a thorough check to see where he had purchased the parts. the late july crime shocked walnut creek police. a murder-suicide of two young people. he showed up at this house killing claire orton and then used a second gun to kill himself. they had been in a relationship but police are not saying what prompted the young man to commit this crime. both handguns were built by burdocks. >> my firearms experts are well aware of it. they are referred to as ghost guns. >> reporter: they've tried unsuccessfully to pass legislation restricting ghost guns.

"good morning america" spoke to the daredevil stunt rider. >> i wasn't certain riding a 300-pound motorcycle in full gear, helmet and boots and getting taken under water in the ocean. there's a lot of unknowns. >> he once drove a motorcycle off the roof of a las vegas hotel and landed perfectly. he thought he was going to die

the disciplinary reaction that's being justified. >> reporter: people all across the nation are reacting strongly to this alarmg scene inside a classroom caught on camera. a kentucky sheriff's deputy handcuffed an 8-year-old boy. the third grader was handcuffed for 15 minutes because of behavior his attorney says is related to his adhd. >> sit down in the chair. >> he's 3 1/2 feet tall. weighed approximately 54 pounds. and at no time is he ever a danger to himself or anybody else. >> reporter: online people are expressing outrage and support. on the sheriff's office facebook page, gene strong says you people have lost your minds. tell me in whose world is it acceptable to manhandle and brutalize 8-year-olds? and one said the sheriff did what was legal and sadly what

us. >> it's an attempt to get his corruption case dismissed. chow and seven others are standing trial this fall on charges of racketeering, money laundering. it came after a federal invest gapgs chow's attorney said the fbi found evidence mayor ed lee and others broke the law. krtis brigs said he knowingly took bribes and another city official allegedly told the fbi, and the former mayor told him you pay to play here. we've got it. we know this. we're the best at this game. better than new york. we do it more sophisticated than new yorkers. we do it without in mafia. attorney curtis briggs said the mayor should also have been indicted. >> according to the fbi, he sat down with federal agents
