a good thursday morning to you. we begin with the latest movie theater attack rattling nerves across the country. >> take a look here. this is the man who pounced on moviegoers in nashville, tennessee, in the middle of the afternoon. he's identified as vincente montano reportedly diagnosed with schizophrenia and committed for psychological treatment at least four times. >> he was carrying a hatchet and a pellet gun that looked like a real semiautomatic weapon and police say montano pepper sprayed two women and cut a man before this officer stepped in opening fire and cornering him in the theater until the s.w.a.t. team arrived. with more here's abc's steve osunsami. >> reporter: those shots fired and people running for their lives at a movie theater in tennessee. around 1:13 p.m. the first calls came in describing a man armed with a gun and a hatchet. witnesses say the suspect was a

29-year-old white man wearing two backpacks and a surgical mask. he walked into a showing of the new "mad max" film. one of the officers who was first on the scene confronted him, and suddenly they were in a gunfight. >> the suspect raised his weapon toward that officer, pulled the trigger. that officer then fired on the suspect and then backed away from the theater. >> reporter: outside officers found a man hit in the shoulder with the hatchet and two women recovering from being sprayed with pepper spray. they're being treated at a nearby hospital. about 20 people were hiding out inside still. >> i went out to use the bathroom, and there were two cops out there, and they told me to go back into the theater and that if i saw somebody, a man, a white man with red hair, that i needed to get out immediately because he had a gun on him. >> reporter: then a s.w.a.t. team storms the theater tearing through the cloud of the gunman's pepper spray forcing him out the back door of the

theater where police are waiting, firing away and killing him. police are now identifying the gunman. they say vincente montano had significant psychiatric issues and was reported missing august 3rd. nashville police confirm he had an air soft pistol and not a real firearm. bomb squads blew up the backpack the man left behind which police say was holding a hoax device meant to fool police. >> the actions of that first officer who went in the theater to engage this individual may well have saved multiple individuals inside that theater as officers worked to evacuate everyone in here. >> reporter: steve osunsami, abc news, atlanta. well, the other major story we're following this morning comes to us from politics. the first republican debate now just hours away. >> and though quicken loans arena in cleveland will be packed with thousands of people, tickets said to be tougher to get than tickets to the nba finals, and this is where the ten candidates will face off. >> now, most but not all of the candidates say they are preparing for the big moment.

abc's bazi kanani in washington for us with a preview. can't wait for this thing, bazi. >> reporter: highly anticipated. good morning, t.j. good morning, reena. in less than a year republicans will crown their presidential nominee in cleveland, ohio, but to get there, analysts believe that candidate will have to stand out at tonight's debate. the city of cleveland getting ready for the national spotlight. the largest crowd in republican presidential debate history, 5,000 will gather at the quicken loans arena when the top ten candidates take on the issues and possibly each other. >> certainly i don't want to attack. if i'm attacked, i have to do something back, but i'd like it to be very civil. >> reporter: donald trump says he will wing it, not rehearsing for the debate as the other nine candidates are including dr. ben carson and mike huckabee seen here in practice sessions. analysts say there are different rules for trump, the far away front-runner and his competitors. >> i think donald trump needs to show himself, if i were advising him, to be substantive and not,

you know, overly clownish, which some people are going to expect but be serious and feel presidential, and then the other nine candidates, and if i were advising one of the other nine candidates, i would say they have to figure out a way to get oxygen back in the race. because right now all of that is being consumed by donald trump. >> reporter: trump could face questions about his relationship with the clintons after a new report that just weeks before he jumped into the race, he talked about gop politics in a phone conversation with president bill clinton. and jeb bush may be asked to explain a recent gaffe. >> although i'm not sure we need a half a billion dollars for women's health issues. >> reporter: now the seven republican candidates who did not make the cut for the prime time event will debate at a separate forum four hours earlier. the democratic front-runner, hillary clinton, has said that she will not be watching the debate because she'll be traveling at the time. reena, t.j. >> she may not be watching, but so many of us will. bazi, thank you so much live in

washington. breaking news in the search for flight 370. this morning malaysia's transport minister says it appears the plane's window and other aircraft parts have been found on reunion island where a piece of the plane's wing was found last week. the prime minister con fired it came from the plane but french experts are still working on confirmation. we could get that sometime today. also overseas, taiwan bracing for what's expected to be a direct hit from a typhoon and preparations there are under way amid fears the storm could damage some of taipei's skyscrapers. that's what it looks like from the international space station right there. forecasters say the storm will hit tomorrow with winds around 130 miles per hour. the american commonwealth of saipan is cleaning up from the storm. it could take a month or two to restore power to everyone there. fire crews battling that enormous fire north of san francisco say they've made some progress. it's still spreading, though,

the rocky fire is now about 30% contained but changing winds there continue to spark flare-ups. flames that scorched more than 100 square miles. that's bigger than the city of baltimore. at least 43 homes are destroyed. nearly 7,000 more are threatened. and in washington state the so-called wolverine wildfire is slowing down a bit after exploding to 40 square miles earlier this week. further south the blaze that grew to 17,000 acres and prompted the evacuation of an entire town is no longer threatening homes. that evacuation order has since been lifted. president obama stepping up his campaign to drum up support for the landmark nuclear deal with iran. the president used a speech at american university to take on critics of the argument -- of the agreement calling republican opposition knee-jerk partisanship. he warned there's only one alternative to the deal. >> so let's not mince words. the choice we face is ultimately between diplomacy or some form of war, maybe not tomorrow, maybe not three months from now,

but soon. >> reporter: the president also referred to critics of the deal as armchair nuclear scientists. he says if iran cheats, we can and will catch them. proof this morning that nobody can get out of jury duty, not even a former president. george w. bush got called. he showed up to duty yesterday. this was at a dallas courthouse. he was selected -- he was not selected, i should say, for the jury panel, but look at this. he left after a couple of hours but he took some pictures with some of the other potential jurors. if he can't get out of it, folks, you're not going to get out of jury duty. >> that's right. those selfies were pretty incredible, though. coming up, forget 3d. 4d could be coming to a theater to you. also major developments in a bill cosby assault case. what a judge is now forcing the comic to do under oath. plus, concerning call. a man dialed 911 asking for help and getting an answer he never expected. the dispatcher now being disciplined.

there you have it, that dangerous volcano in mexico erupting again, the colima volcano spewed ash up to 5,000 feet into the air as lava spilled over the sides. people living nearby haven't been ordered to evacuate, but they are keeping a very close eye out. microsoft has followed netflix by offering a more liberal parental leave. starting november 1st new moms and dads can take up to 12 weeks paid leave. this came after netflix announced that new parents could take unlimited paid leave for the first year. experts say it's a sign that competition for high-tech workers is heating up. and coming to a pair of new

airport delays possible in washington, d.c. and charlotte. we turn to north carolina now and the trial of a police officer charged with shooting an unarmed black man. >> the deadly encounter was captured on another officer's dash cam and shown in court for the first time. officers were responding to a call of breaking and entering when jonathan ferrell walks towards them. as the light from a police taser appears on ferrell's chest, he starts running. moments later he was killed shot ten times. prosecutors say the officer overreacted. ferrell's family has already gotten $2.5 million to settle a wrongful death suit. well, bill cosby is facing a deposition in a case brought by one of his accusers. cosby is being sued by a woman named judith huth for sexual battery and emotional distress stemming from an incident in 1974. she was just 15 years old. she is trying to get around the statute of limitations, which has limited other suits against cosby. a judge cleared the way for his testimony yesterday scheduling cosby's appearance for october 9th.

this now from the airport in new orleans where a drunk driver went through a fence right onto the airfield then crashed through another fence in an attempt to get away. it didn't work out. after fleeing his car, he was arrested a short time later. he was charged with driving while intoxicated and hit-and-run. there were no flights affected by the incident. well, a big mistake by a group of bondsmen in arizona. they were looking for a fugitive when they mistakenly raided the wrong house, but it wasn't just any house, it happened to be the home of the phoenix police chief. the bondsmen had their guns drawn and refused to leave until the chief called 911. the owner of the bond company now facing trespassing and disorderly conduct charges. all right. i don't know how good this criminal might have been at hide-and-seek, but check him out. he's trying to get away from police, so what does he do? there he is, hiding on the roof. how is that going to work out? officers alerted their colleagues that the guy was right there. the suspect was ordered down. he was arrested. police had been called to the scene because of a possible

leyla? >> as we look at the bay bridge toll plaza everyone, you can see the cars are willing to pay the cash to head into san francisco from the east bay. when you get there, westbound side at the skyway is where we have an accident blocking two lanes. c.h.p. is there and we have possible injuries. it happened at 4:00 a.m. so it is clearing. still, to lanes are blocked. on walnut creek southbound 680 from pleasant hill looking great. mostly green and we are in great shape. 101 from san francisco to sfo is 11 minutes and 880 is clear and 101 in the south bay is not a problem. >> a legal battle whether uber drivers should be treated as employees opposed to contractors could have a huge impact on the company, the ride sharing industry and millions of customers. matthew mcconaughey is at san jose airport with the story. matt? >> uber is popular for people would need a ride to theairport.

the lawsuit could have a big impact on the drivers. also, on the whole on demand economy. today, in district court in san francisco the judge will decide whether to grant class action status to a lawsuit filed by three drivers. they are suing uber for misclassifying them as independent contractors rather than employees saying they are employees and should be reimbursed for gas and car maintenance and other expenses. uber file a motion in federal courting aing it is more than 160,000 drivers in california are independence contractors not employees. uber saids thering the suit forces them to change their entire business model. if the judge granted class status uber has to deal with 160,000 uber drivers this california rather than the three drivers listed in the country lawsuit which could lead to the company paying daps to all the drivers that could cost hundreds of millions. the hearing is scheduled for
