>> good morning, i'm chris nguyen, let's start with a first look at the forecast. here's lisa argen, tracking live doppler hd. hi, lisa. >> good morning. we are looking at a healthy on shore push. the marine layer allowing for a cloudy start in the east bay. 60 san jose. 60 also is he shoreline. we will see the clouds pull back to the coast and very typical summertime spread.

>> breaking news comes from sonoma in morning where one man is dead and another injured after their car crashed into a tree. the accident happened just after midnight on 7th street east just outside of the city limits. the car also overturned, leaving it so badly crushed it took firefighters longer than usual to extricate the victims. one person who didn't want to be interviewed on camera, said both men had just left a wedding party. the injured man was flown to a local trauma center. out of san jose, investigators are at the scene of a fatal shooting. police responded shortly before 11:00 last night to tully road

and capital expressway. they found a victim with life-threatening injuries who later died at the scene. police say the circumstances and motive surrounding the shooting are unknown. the suspect remains at large. aldon smith is an ex-49er and his career could be in jeopardy. he was released friday after being arrested for dui and vandalism. it's his fifth arrest since 2011. the linebacker was with san francisco for four seasons, although he spent much of that time suspended. abc7 news reporter katie marzullo talked with some of his teammates. >> wide receiver antawn bolden, and they say even if he's not a teammate, aldon smith is still their friend. >> we are just making sure he's okay as a person, but as a team we have to move forward. i wish the west for him. >> players also denying reports there was trouble between smith and quarterback colin kaepernick off the field. >> i have to ask you about the reports that he and colin kaepernick were fighting over a woman? >> i don't know nothing about

that. >> i never heard that until you just said it. >> colin kaepernick said himself saying off-camera it's not his car that smith hit. >> police arrested the 25-year-old linebacker thursday night on suspicion of dui, hit-and-run and vandalism. they say he hit a parked car at his apartment complex in santa clara. smith said this on his way out of jail. >> it wasn't a dui. the situation i have could have been handled differently. i apologize for everyone i did let down and i apologize for how it all played out, but as far as it being a concern, it will work out how it's supposed to work out. >> safety eric reid said in light of smith's previous problems, it seemed like he was doing better. >> his attitude, just the way he talked, the way he interacted with people, he was making some real strides. i think this is just an unfortunate situation. >> head coach jim tomsula hopes the strides will continue. >> although he won't be playing football for the san francisco 49ers, he will be supported and helped. and he will not have to walk this path alone.

>> smith is already on probation after two previous dui arrests and he could now face jail time. he's scheduled to be arraigned october 6th. in santa clara, abc news. the 49ers were invested in keeping smith out of trouble san francisco magazine also had a stake. the september issue was to have smith on the cover with the headline aldon smith is misunderstood. editor-in-chief tweeted this picture yesterday. the article has smith saying he's ditched his party lifestyle for a one bedroom condo and more time with his two-year-old son. smith was also asked if he considers himself an alcoholic. the former 49er said no and that he just likes to have a good time. 6:04 is our time. the san francisco fire department is reacting after the family of an ace yawnna airplane victim dropped his lawsuit against the city. the girl was ejected from the

plane and covered in foam and run over by a responding fire truck. her family isn't talking about the confidential settlement agreement, but yesterday a statement was released saying "i'm hopeful today's dismissal will bring closer and healing to our members and passengers of the flight 214." >> a gunman shot at three people as they tried to run away, hitting a man in the leg. a surveillance camera caught the whole thing. the police said some kind of confrontation occurred between the shooter and the shirtless man. the suspect identified himself as being a member of an asian gang and then and shooting. >> other bullets hit the side of the house and car but no one else was hurt. governor brown granted parole to a transgender inmate

fighting to have the state pay for sex reassignment surgery. in april the judge ordered them to provide 51-year-old rachel with the surgery. it's up clear whether she'll still be able to have the surgery before she is released. there's a lot of concern at cal over the steady rise in crime. a student was recently robbed at gunpoint while walking on campus. sbc7 news reporter alan wang tells us what police and school officials are doing to keep the campus safe. >> the campus of u.c. berkeley offers a certain sense of security. >> yeah, i generally feel the campus is pretty safe for me to walk around. >> but just after midnight a 20-year-old male student was robbed at gunpoint while walking down speaker plaza. the two men took his wallet and cell phone. >> it raises red flags. >> u.c. berkeley police say armed robberies are not that common on campus, but people have been getting robbed about once a week in the neighborhoods just south and west of campus.

despite the major damage to the cars, only one person was hurt. this are a couple sideshow-like skid marks in the area, but so far there's no indication it is related to a sideshow. a burning car held up yesterday evening's commute on the 280 connecting ramp and southbound 87. fortunately no one was seriously hurt. and take a look at this picture. this car exploded yesterday evening. the image was posted on instagram by ray with our media partner the bay area news group. it happened on seventh avenue in oakland. no word how the convertible caught fire. crews were able to put out the fire, but the car was destroyed. 6:08 and our time. it is appear action-packed weekend in san francisco. thousands are going to at&t park to see meg minister joel osteen. 50,000 going to the jay pop summit. and the main event is outside

>> convicted colorado movie theater gunman james holmes will spend the rest their life in prison. >> we, the jury, do not have a final unanimous verdict. >> jurors were dismissed yesterday after failing to agree on a sentence for gunman james holmes. that was after less than seven hours of deliberations. one of the jurors said there was one lone holdout that didn't want the death penalty while two others weren't sure. >> there was nothing further to discuss at that point. it only takes one. >> several aurora police officers burst into tears when

the verdicts were read. victims' families were not happy. >> i think it's outrageous. i still think death is justice for what that guy did. >> that's not justice. he's living, he's breathing, and our loved ones are gone. >> twelve people were killed and 70 others were injured while watching the movie batman in aurora, colorado three years ago. 6:15 is our time. >> evacuations have been lefted for the 14,000 people forced out of their homes in the valley. they can now return back to their home. the rocky fire has destroyed 43 houses and 53 other buildings. more than 69,000 acres have burned, but it is now 50% contained. crews are hoping for full containment late next week. fire crews rescued on injured and very dehydrated dog from the rocky fire.

the dog was found suffering from minor burns yesterday. the firefighters gave the dog food and water and waited in animal rescue arrived and took it to a local animal hospital. now to an abc news investigation. a danger right in your own car. sun roofs shattering without warning with shards of glass raining down on drivers. hundreds of complaints are coming in and now a federal agency is investigating. abc news reporter has the story. >> kate said her sunroof spontaneously exploded while waiting at a stop sign. >> sounded like a gunshot. >> he said his sunroof shattered while he was driving on the highway. >> what is going on? most sun roofs are made of tempered glass, which breaks into smaller rounded pieces instead of sharp, dangerous shards. spontaneous shattering can happen if there's a manufacturing defect. according to glass expert.

today but even with the slight bump up tomorrow it's only a couple degrees. you may not even notice. but then we will cool it back. i'll explain. as we get started to morning, the marine layer pretty deep and over 2,000 feet. it is allowing for the clouds and fog over the bay. we use that as an indicator with the winds to see how far the low clouds and fog have made it. it's cooler by the delta. we are looking at a cloudy shot here. 60 san francisco and san jose. the low clouds and fog making an impact once again. at our coast it's been mild, despite the cloud cover. that won't change either. 59 morgan hill. 63 in oakland. another look over over emeryville where the low clouds are visiting and will be with us the next self hours. 59 santa rosa and napa. it will be sunny and breezy up in the north bay. by the delta very comfortable.

the inland east bay should be nice, in the 80s, maybe a couple 90s come into play for the second half of your weekend. here's mt. tam. it's cloudy. we look for the numbers to be in the 70s, whattic a few 80s. the relative humidity is coming up. it's helping with the firefighting efforts. and the heat is really not going to be with us. a minor bump-up tomorrow. overall mild and warm over the weekend and cooler, even, for the first two or three days of the upcoming work week due to an area of low pressure newspaper the pacific northwest. it's not going to bring us any rain. closest we got was an area of low pressure thursday. and it is headed into novato. the lightning strikes, we had .02 in san jose. otherwise ice the same old, same old. the low fog and clouds going inland, peeling back to the coast and bringing us summertime case we like and enjoy but it will be on the cloudy side for golden gate park. san jose near normal with low 80s today and tomorrow. and here comes the dip very

slightly monday into tuesday, wednesday maybe 80. it looks like by next weekend an area of high pressure to the south and east of us will build back. that will bring more warmth and heat to many locations around the bay. so in the south bay today look for 80s santa clara. 79 sunnyvale. 77 santa cruz. sunshine there. clouds hanging tough from half moon bay to pacifica. 79 for palo alto. looking at 70 downtown. mixture of clouds and sun. up in the north bay a little breezy from time to time. 83 for santa rosa, 79 san rafael. 76 by the water. east bay looking pretty nice once again with 7 about in berkeley, 76 san leandro. fremont about 79. you head inland, temperatures here pretty nice. it will be warm but not too warm. 85 concord. pleasanton 84. maybe a couple 90s out by antioch and brentwood. still the delta breeze keeping it very summer like. the accuweather forecast, a few days warming to em. breezy conditions monday. very little change into tuesday.

>> thanks for joining us, i'm chris nguyen. we will start with a look at the weather with meteorologist lisa argen. hi, lisa. >> hi, chris. low fog and clouds all the way inland. a cloudy start and mainly 50s and 52 hayward. oakland 63. 60 san mateo, half moon bay and san francisco. so low clouds and fog will be burning back to the coast. it will be cloudy there. still kind of mild. we will look for the clouds to still infill straight golden gate park, parts of san francisco but overall typical summertime conditions. we will pinpoint the temperatures and talk about a modest warmup the second half of the weekend and still more summertime weather ahead for the weekend. chris. >> lisa, thank you. a killer typhoon is heading for mainland china this morning after leaving six people dead and hundreds injured in taiwan. it hit the island with a vengence, downing trees and powerlines and winds up to 100 miles an hour, causing

3 million households to go dark. an 8-year-old girl and her mom were swept out to sea, and the girl's twin sister is missing. all 279 domestic flights from taiwan have been cancelled, as well as 37 international flights. new this morning, president obama is asking congress to pass new legislation to make sure every american has equal access to the voting booth. in his weekly radio address the president pointed out that this week is the 50th anniversary of the landmark voting rights act of 1965. the historic act broke down legal barriers that prevented blacks from voting. mr. obama said the act at eliminating hurdles put up to prevent blacks from voting. >> the voting rights act broke down legal barriers that stood between millions of african americans and their constitutional right to cast a ballot. it was, and still is, one of the greatest victories in our country's struggle for civil rights. >> earlier this month a federal

judge ruled that a new voter i.d. law in texas violated the voting rights act and was discriminatory to minorities. 6:32 is our time. happening today, protesters are planning a rally and march in san francisco to mark the one-year anniversary of the shooting of michael brown in ferguson, missouri. protesters held a similar rally in oakland yesterday. the shooting of the unarmed brown by officer wilson launched the black lives matter movement and sparked protests across the country. a grand jury later decided no the to bring charges against wilson, and a department of justice report said he did not violate federal civil rights laws. at&t park will be full of fans tonight but the giants aren't playing. thousands are coming to see megaminister joel osteen for a night of hope. we have the details. >> good morning, earn. good morning to the friends traveling to and from marin. no major traffic conditions to report on. lisa argen will break the weather down for us in a little bit. >> after three years of preparations demolition crews have gun tearing down the san clemente dam. that's in carmel valley. the nearly 100-year-old dam was built in 1912. it was declared unsafe in 1995. a danger to communities downstream in terms of earthquakes or flooding. the project is to tear down the dam and restore the river will cost $83 million, most of which will be covered by monterey county water users. 6:41 is the time. weather-wise, we talked about the cooler temperatures. and also fog out there right now. >> that's right. the base is higher. we aren't looking at any delays at sfo. we are at about 60 degrees in

to do that districts have had to upgrade some of their kitchens. >> serving tables, new floors, new hoods, and warm boxes. >> most of the kitchen at this school in hayward has been modernized. it ensures students are given healthy meals cooked on site. but like the majority of schools, the refrigeration system is out-of-date. >> when you are offering this variety at this volume, you need more space to store the items to make it happen. >> it's both inefficient and lacks the necessary space to store perishable goods, including fruit, vegetables and milk for an entire week. we don't have the infrastructure to support what they say we are to do. >> school districts could be provided with grants in a way to participate in a a loan assistance program to buy equipment and make upgrades. >> you need at least $50,000 to upgrade the high school kitchen to the standards.

bay. the winds gusty through the west side of the delta and that means we are looking at some temperate weather for our inland east bay. cloudy skies in san francisco. notice the wind has not picked up. 61 san jose. 60 half moon bay. we did pg&e low 70s half moon bay. 63 in oakland. about another 10 degrees of warming for you. cloudy start in emeryville. more 70s open the way. a nice afternoon. 60s by the delta. numbers have come up here, 62 concord and 59 in santa rosa. sunshine trying to come out in san jose at this hour. check it out. there's the fireball in the sky above the low to cloud deck, which in some areas measuring over 2,000 feet. we will look for the typical pattern today with the cloudy start. mild to warm over the weekend. we will look for slightly cooler temperatures monday and tuesday. but before that, a bump up in temperatures for the second half

the weekend and temperatures coming up perhaps in the low 90s, where you can manage and figure that would be in the inland east bay. with low pressure heading out of novato, and taking the temperatures from the sierra nevada and bringing in an upper level ridge of medium strength in the bay area. that's bringing us the typical summertime days. with the surge of low clouds overnight and pulling back to the coast. north of the golden gate and the bay bridge, breezy. the clouds hugging monterey. partly cloudy and 77 los angeles. it will be dryer in the sierra nevada. sunny skies, mid-70s around south lake. 90 yosemite. we will be looking at the cloudy skies giving way to more sun and a nice day with advertised in the upper 80s for livermore. and then looking at in a cool-down come monday and tuesday, even into wednesday. it will take until about the end of the week until we warm back up into the 90s. no complains there probably. and outside lands, plenty of cloud cover.

>> good morning, everybody. if you had to identify the 49ers two most important players coming into the season, you probably would have said colin kaepernick and aldon smith. or you will would have said that 24 hours ago. now aldon smith is done as a niner after his fifth arrest in three years. what is shocking is until yesterday morning they were considering a contract extension for aldon smith who could have been look at a $100 million deal with he stayed clean and had a big deal. now he's looking at the possibility of the inside of a jail cell and another nfl suspension. the reaction from an emotional head coach jim tomsula and his ex-niner teammates. >> people stumble. some things are greater risk in things. but he is in that process of turning his life around. he is in that process. in terms of him playing football again, i sure hope so. >> it is a sad day for the team. he's obviously a huge cog in the wheel for us and we will miss him.
