and "baywatch" blockbuster. one of the biggest hit shows of the '90s getting a big screen reboot, the rock and zac efron reportedly suiting up and hitting the beach. but all eyes this morning are on the hoff, wondering, will he be diving in again? and we do say good morning, america, on this tuesday morning. good to have david back in for george. and it is coming down out there. the umbrellas are out. i want you to take a look at this map right now. the northeast being hit by strong storms, there's a flash flood watch in effect. you know ginger will have more on that in just a moment. but first, the other storm that won't go away. we're going to begin with what everyone is talking about this morning. donald trump's feud with fox news anchor megyn kelly. she's now responding to the republican front-runner last night, saying she'll not apologize for the questions that led to his strong reaction. hillary clinton now weighing in. and tom llamas covering the

campaign. >> reporter: two working strategies right now in the race for president. either ignore donald trump or take him head-on. this as trump and fox news president roger ailes had peace talks. but it seems his war with one of their primetime anchors is not over. >> you may have heard there was a dustup involving yours truly and presidential contender donald trump. >> reporter: overnight, fox news anchor megyn kelly firing back at trump. >> you could see there was blood coming out of her eyes. blood coming out of her wherefore. >> reporter: kelly refusing to address that comment specifically. but not backing down. >> trump, who is the front-runner will not apologize. i certainly will not apologize for good journalism. >> reporter: he verbally attacked kelly after complaining he was treated unfairly after last week's debate. >> you have called women you don't like fat pigs, dogs, slobs, and disgusting animals.

michigan, new hampshire. >> back to hillary clinton for a second. she said of megyn kelly, very impressive. more than capable of defending herself. hillary clinton said it's a mistake to only focus on trump. what a lot of those men on that stage said was offensive. >> reporter: she went after marco rubio who said future generations will look at the united states as barbarians for legalizing abortion. >> one more big headline. rick perry no longer paying the campaign staff? >> reporter: that's right. former texas governor rick perry. we've been in contact with his campaign all morning. there are reports that he's no longer paying his staff. they're working as volunteers now. they tell us they have to make tough decisions. they're going to compete in iowa, new hampshire, and south carolina. >> okay, david. now to ferguson, the city on edge again last night, heavy police presence on the streets. you see those heavily armed officers in riot gear, dozens of demonstrators were arrested some of them for e throwing rocks at officers. others for acts of civil disobedience. abc's kendis gibson is on the ground in ferguson.

good morning. >> reporter: robin, good morning. some tense moments on the streets of ferguson overnight, as police and protesters face off. >> you shouldn't even be in the streets. >> reporter: overnight, ferguson under a state of emergency. nightfall now and police are already out with riot gear and many protesters gathered across this street as you can see. heavily armed police dispatched throughout the city, arresting at least 23 demonstrators. using mace to disperse the crowds. >> back up. do it. >> reporter: after police say they were hit by rox and frozen water bottles. earlier, nearly 60 demonstrators arrested, after blocking traffic and shutting down a major highway near downtown st. louis. these tensions heightened by days of police protests marking the anniversary of michael brown's death. residents on high alert. you look at this. you know this, at any moment this can turn like that. >> at any moment. and we know that. >> reporter: it can turn ugly. >> yes.

it can turn ugly at any moment. >> reporter: all this after a gun battle between two groups erupted sunday night. people screaming, running for their lives, dozens of shots fired. >> multiple shots being fired. >> shots fired. canfield and west florissant. >> reporter: even capturing ferguson's interim police chief by surprise. right in the middle of an interview. >> what is that? >> reporter: one of the alleged shooters, 18-year-old tyrone harris. cornered in a parking lot. critically wounded. >> he's bleeding out, man, please get him some help, man. >> reporter: police now using state of emergency to bring calm back to the streets. >> all the good work happening on both sides of the street has been marred by violence. >> reporter: this morning, police pointing out there were no burglaries, looting, or shootings overnight. saying that state of emergency may have helped the situation. david? >> all right, kendis, thanks to you. also this morning, a white house assistant on leave, arrested and charged with grabbing her boyfriend's gun, a u.s. capitol police officer, and

then firing a shot at him during a heated argument. jim avila is at the white house. jim, good morning. >> reporter: good morning, david. most of the white house, including the president, are on vacation. but one white house staffer may not be coming back after her arrest, charged with domestic violence. this may have been barvetta singletary's proudest moment, air force one behind her, just after being promoted to the white house as an assistant to the president of the united states. and this may be her worst moment. this mugshot, when the white house staffer was arrested with first and second degree assault and reckless endangerment after allegedly firing a gun at her boyfriend, a police officer at the u.s. capitol. local prosecutors say she invited the victim to her house in suburban d.c. the couple engaged in a brief sexual encounter. after singletary questioned him about another girl.

authorities say singletary demanded her boyfriend's cell phone. then reached into his bag where she grabbed his phone and his service weapon. a 40-calibiber glock like this one. when he wouldn't reveal his passwords, she's accused of pointing the gun at him and saying, don't think i won't use it. she allegedly fired in his direction. ten feet away on the couch. the white house confirmed that singletary is under investigation saying we are aware of the matter, and have temporarily placed the employee in question on unpaid leave and revoked her access to the white house complex. the white house staffer is now on bail, she has been charged with domestic violence. as for the officer involved he was not charged but capitol police say they are investigating, robin. >> i'm sure they are, jim, thank you. turning now to that toxic spill in colorado, the tainted water spreading quickly, a state of emergency has been declared in neighboring new mexico. and public access to rivers is expected to be closed until at least next week.

abc's clayton sandell is in durango, colorado, with the story this morning. good morning, clayton. >> reporter: good morning to you, robin. people are being told not to swim in the water. not to drink it. it doesn't look very polluted now. but let me show you. it's this orange sludge and the toxins in it that have people worried. this morning, thousands of people who rely on drinking water from two polluted western rivers now told it is toxic. >> avoid showering. any type of bodily contact with that water. don't let the livestock drink it. >> reporter: this after an epa cleanup crew accidentally released more than 3 million gallons of toxic sludge last week from this abandoned gold mine in colorado. >> this is our lifeblood. >> reporter: governors of colorado and new mexico have declared states of emergency. towns are shutting down pipes that normally take clean river water into people's homes. >> where i live it's all basically living off the wells. >> reporter: the plume turned the normally clear waters into

an unnaturally bright yellow after the spill. traveling hundreds of miles from colorado to new mexico, to utah now to arizona. and the grand canyon. the epa is testing the water. even using fish to monitor the health impact on wildlife. the agency is criticized for not providing more information about the long-term health impacts on people. tests show the water carrying 300 times the safe levels of arsenic and 3,500 times the lead. now the towns and businesses that rely on them are shut down in the middle of peak summer season. >> 95% of my business has been swept away and we have about 23 employees who are currently out of work. >> reporter: everyone here is hoping the levels of toxins drop soon. and colorado's governor will be here today to see the damage for himself. david? >> incredible accident.

clayton, thank you. we're going to turn now to a secret government report raising red flags about safety in the skies. at any given moment, there are as many as 5,000 flaens the air above us. you're looking at a live picture. those are the flights in the air right now this morning. many of the air traffic controllers responsible for guiding those planes may not be getting enough sleep. actually falling asleep on the way to work. abc's david kerley live at reagan national airport this morning with the latest. david, good morning. >> reporter: good morning, david. it's concerning how many of these controllers admitted to being fatigued. really tired. and the fact that the faa has had this report for nearly four years and kept it under wrap until the associated press pushed the agency to release it. this crash in kentucky killed 49 and alarmed safety investigators about controller fatigue. other issues, a plane in tennessee. pilots unable to reach the tower. >> yes, sir, we're trying to get a hold of knoxville approach or knoxville departure. we cannot raise them. >> reporter: a similar situation in reno.

>> can't seem to get a hold of the tower here. >> reporter: at washington's own airport, controllers asleep and jetliners landing without guidance. >> tower is apparently not manned. made a few phone calls, nobody's answering. so you can expect to go in an uncontrolled airport. >> reporter: the fatigue report nasa prepared back in 2011 shows controllers reporting worrisome statements. three-quarters of the more than 3,000 surveyed said their schedules led to chronic fatigue. 70% caught themselves about to doze off on the midnight shift. some wore wristbands or admitted to getting less than six hours of sleep a night, or less than four hours before a midnight shift. all of this done four years ago but just released. >> i think these things are still with us. the lack of transparency on the faa in discussing this is not helping the situation. >> reporter: the faa has made changes.

they say fatigue is an issue nor any round-the-clock operation. the faa says real progress has been made. and the faa changes in scheduling. among those changes the faa now requires two controllers in a tower on that overnight shift, it used to be just one, david. >> that's good news. david kerley live in washington. david, thanks so much. right over to amy robach with the breaking headline. involving an f-16. that's right. a u.s. military jet has crashed in southern germany, igniting a fire. in this area right there. you see the smoke rising from the scene. the american pilot survived by parachuting to the ground. the jet was an f-16 carrying a training bomb. the cause of the crash is still unclear. new concerns about the wildfires raging in northern california, the latest fire, the so-called jerusalem fire has now burned more than 6,000 acres, more gusty winds are expected today and evacuations are now mandatory. three firefighters were injured battling another blaze in southern california. and in oregon, a brush fire

spread to this train trestle. crews say it may burn for days. people nearby are being warned to close their windows to avoid breathing in all that smoke. and overnight, japan restarted one of its nuclear reactors for the first time since the fukushima meltdown caused by the earthquake and tsunami four years ago. authorities wanted the reactors switched on to reduce fuel bills, despite public protests. the coast guard is showing off more than $1 billion of cocaine seized from smugglers. the 66,000 pounds of drugs were confiscated in the pacific. off the coast of latin america. it's the biggest offload of nar cot ix in coast guard history. more drugs were seized in the last year than the previous three years combined. some encouraging news about the pro biker involved in this violent crash in utah. speeding out of control into that car which actually may have saved him from riding off a cliff. matt brammeier is in good spirits. tweeting this picture saying, all good. thanks for the messages.

he's covering from fractured ribs and a punctured lung. and a bizarre police chase over los angeles. police were pursuing this man in a motorized paraglider. after he flew over a jail. you see, they thought ron nagin had dropped drugs to an inmate below. but it was a big misunderstanding. it turns out nagin is a local pastor who just got a little lost. finally, anyone who remembers that nerve racking day at the dmv when you went to take the test for your license. ah, yes, i failed mine. but i only knocked over a few cones. but imagine this nightmare. the test driver ended up not driving to the dmv but through the dmv. she's okay. no one was hurt. just her pride. she jumped the curb hitting the gas instead the brake, shattering all those windows. she said she's going to come back another time when she's more comfortable behind the wheel. >> that would be wise. >> i think that's probably good in general with her getting behind the wheel. >> and a different staff on duty. >> maybe.

>> a different office. >> nobody volunteering to give her the test again. >> no. i don't think so. thank you, amy. now to scary moments at the beach, a little boy playing in the sand, trapped, a cave he was digging suddenly collapsing on top of him. people racing to save him. abc's cecilia vega has that story for us. >> reporter: this morning, a 12-year-old boy recovering after an avalanche of sand crumbled right on top of him. trapping him, knocking him unconscious while playing on the jersey shore. life guards and bystanders rushing to yank him out. giving him cpr. a medical helicopter air-lifting him to a local hospital where he's currently in stable condition. officials say the boy was digging deep holes, an activity experts say can trigger the surrounding walls of sand to shift and give way, swallowing whatever lies in the gap. these accidents can often be fatal. last summer, a recent college graduate died, buried alive

at this northern california beach inside a 10-foot-deep hole he dug. dozens of beachgoers trying to pull him out using anything they could. but it was too late. in 2011, matt mena survived after a seven-foot-deep sand tunnel caved in on him. in huntington beach, california, it took firefighters 27 minutes to dig him out. >> i thought i was going to die. >> reporter: two things to remember when digging a hole at the beach. number one, keep it knee deep and number two, cover the hole before you leave. simple reminders to help you stay safe in the sand this summer. for "good morning america," cecilia vega, abc news, los angeles. >> good reminders right there. because you do see that. >> very scary. >> very much so. now to that heavy rain, flash flood watch for new york city and beyond, ginger. >> yes, robin. the heaviest rain is moving

through right now. you can see the radar. some of it moving into long island. you could see flash flooding. the watch in evident through new york city and new haven. the heaviest rain the next couple of hours here. then it moves off to the north and east. the target will be on boston. you have to see this video out of colorado. >> bye bye, daddy's car. >> yes, that is flash flooding coming down from the burn scar, the waldo canyon fire back in 2012. this has happened several times. and at times, worse than this. yesterday, incredible to see those pictures, it could happen again today. locally, up to two inches in some of the places out west. from colorado back into utah. quick look at lansing, michigan, also more than 4 1/2 inches of rain.

into the community so soon. >> i'll order that the defendants be retained in the adult jurisdiction. >> reporter: this morning, a wisconsin judge now deciding that two teenaged girls who allegedly tried to kill their friend to please a fictional character slender man, will be tried as adults. >> this was a premeditated -- was premeditated murder, an attempt to do so. >> reporter: the suspects morgan geyser and anissa weier were just 12 years old when prosecutors said they lured their friend, -year-old payton leutner into the woods last may, stabbing her 19 times with a kitchen knife and lefing her to die. >> is there any bleeding going on? >> her clothing has blood on it. >> reporter: miraculously payton survived. the defendants, now 13, plotted the attack for months to please the fictional character slender man. >> who is slender man?

>> he's this tall, faceless man who preys on children. >> he tarts children most. and so, i was really scared knowing that slander man could easily kill my whole family in three seconds. >> reporter: now, the teens face up to 65 years in prison. the victim's parents telling abc's david muir exclusively last september that their daughter payton's safety is the most important thing. >> she can move on with the rest of her life. >> reporter: one of those defendants morgan geyser has been diagnosed with early onset schizophrenia. and authorities say she still believes slender man is real. both girls scheduled to be arraigned this month. robin? david? >> we're going to be following payton's case. in the meantime, we'll move to the late nest that north carolina case, the police officer there on trial for shooting and killing an unarmed black man looking for help after the accident. and for the first time, the jury got to hear the officer's

version of what happened. the tape played in court. abc's reena ninan with the story. >> reporter: for the first time we're hearing from the officer who shot and killed unarmed former college football star jonathan ferrell. >> i feel like if i hadn't done what i did, he would have been able to take my gun. >> reporter: officer randall kerrick, seen in this newly released police interrogation video, played in court. >> he just had a very aggressive posture. >> reporter: describing what happened after he and two other officers arrived at the burglary call in september 2013. a homeowner calling 911 after the 22-year-old ferrell came to her door at 2:30 a.m. looking for help after crashing his car. ferrell seen in this dash cam video appears to run toward police. >> get on the ground! >> so, as he's approaching me, i'm backstepping and i'm yelling, stop, stop, stop! >> reporter: the officer explaining what happened just

[ gun fire ] >> i'm backing up and he's just coming at me even faster. >> reporter: kerrick hitting ferrell ten times. this morning, he's on trial charged with voluntary manslaughter. a jury monday watching his interrogation video, explaining to detectives just hours after the shooting why he fired so many times. >> i was yelling for him to stop, stop. >> reporter: kerrick who has pleaded not guilty faces up to 11 years in prison. for "good morning america," reena ninan, abc news, new york. >> thank you, reena. the latest twist in kelly rutherford's bitter custody battle. the gossip girl star and her children have been ordered to face a judge this morning. their father fighting to get them back in monaco. abc's linsey davis is here with the latest. good morning, linsey. >> reporter: good morning, robin. rutherford was supposed to fly her children, hermes and elena, back to europe on thursday.

instead she announced she intends to keep the kids. this morning, they could be on a plane to monaco as early as tonight. this morning, rutherford's ex-husband is calling her a kidnapper. the "gossip girl" star now ordered to appear in court today with her two kids after she failed to send them back to their father, daniel giersch, in monaco on tuesday. >> my priority is their safety and well-being. as their mother that's what's what i'm going to continue to fight for. >> reporter: six years ago when rutherford filed for divorce, they were supposed to share custody of the children. when his visa was revoked, the judge ruled the son and daughter should reside in monaco with their father temporarily. >> i trusted their father that he would live up to his agreement that it would be temporary and three years it has not been temporary. >> reporter: back in june, a monaco court ruled the kids should spend several weeks of summer vacation with rutherford,

before running to her ex-husband, which rutherford refuses to do. >> it's very hard for the kids. it's been kind of cruel in a way, because you know we just want to see each other and be together. they're very young. >> reporter: in response, giersch is invoking emergency jurisdicti jurisdiction, asking a judge to force rutherford to return the children. because the united states and monaco are both part of an international agreement to protect the best of interest of charn, children, called the hague convention, that means american judges must respect monaco's court order. and now her failure to come ply with the agreement could mean less access to her kids in the future. >> all right, again, in court today, we'll learn more. thank you linsey. now the wildfires in arizona right now. ginger. >> 6,000 acres. this the willow fire, right on

>> it potentially could. initially, when i heard about this, i thought, oh, my god, this is a prescription for crazy chaos. we're going to turn the office into a nursery. i decided to put my skepticism on hold. i called several companies yesterday afternoon that already have policies like this in place. every one of them told me those stereotypical fears are actually unfounded and there's one company i talked to, it's a company in new hampshire and they have been doing this for six years. they've had 15 babies through this program. and they told me a couple of things that are really big benefits that we see across the board with companies. so, one, is that parents return quicker, that's good for everyone. we're constantly juggling everybody else's workload. so in this case, parents return to work faster. the atmosphere is calmer. babies make people happy. even if you're not the baby holder. even if you don't want to be the one. >> that could be debatable. >> i will say, parents, i used to bring duff when he was very young, it makes you want to stay later. i had no problem staying later

equinox gym to see for ourselves. >> ready? >> reporter: spending 15 minutes first walking on a treadmill. then, using an elliptical. >> i can feel it already. >> reporter: each at roughly the same speed with no added resistance or incline. after 15 minutes of walking i burned 60 calories. >> i'm out of breath. >> reporter: me, too. >> i'm pretending not to be, of course. >> reporter: but sure enough on the elliptical. so we're at 12 minutes i already burned more calories. at that 15-minute mark. so, i just burned 17 more calories on this machine. 77 calories burned. near 30% increase just by switching machines. but why? experts say it's the unique elliptical pattern your leg muscles are forced to move in plus the added

heel to toe, you're propelling your body weight forward using muscles around your ankles and calves. >> it's hard to say which one is better. it depends on you, your body, if you got achy knees. >> right. for my clients who have joint problems in their hips or knees, i recommend the elliptical. treadmill, i personally enjoy more, it's a natural movement and it's more -- it helps the integrity of your bones because of the impact. >> can you do a little more to get something? you're working the arms with this. >> and core with this? >> absolutely. the core, you can add the incline, you can increase, decrease the speed. keep in mind the intervals. bringing your heart rate up and down. you essentially burn more calories. >> interval training is the key. it's not how long you're on the machine but how hard you work. >> she's working much harder
