goodell are scheduled to appear in court here in new york today amid dueling lawsuits in connection with the scandal. the nfl's suit against its players union claims goodell was correct in issuing brady's four-game suspension. the players union has sued the league, seeking to have that suspension overturned. now another nfl quarterback who likely will not be starting as the regular season kicks off next month. geno smith of the new york jets. >> that's because smith now has a broken jaw through the result of an apparent sucker punch from his own teammate. we get the latest now from wabc's jim dolan. >> reporter: backup quarterback ryan fitzpatrick was working out with the starters for the jets, and he'll be there for a while. >> our quarterback's in a hole with a broken jaw. >> reporter: geno smith, the guy who was supposed to start at quarterback for the jets this season, was punched in the face so hard that his jaw broke in two places, sucker punched, the jets say, by another player. >> i thought it was childish

inflammatory. the rookie police officer who fatally shot a black teenager in arlington, texas, has been fired. officer brad miller arrived at a car dealership after 19-year-old christian taylor was seen shattering a window shield. the police chief said miller used poor judgment and made a tactical error by entering the dealership alone. he said miller's mistakes caused a deadly confrontation that put him and other officers in danger. a newlywed american couple is facing terrorism charges, accused of trying to flee to syria to join isis. jaelyn young and 22-year-old muhammad dakhlalla were arrested at an airport in their home state of mississippi. authorities say they planned to work as medics for the islamic state, but the terrorists they reached out to online turned out to be undercover fbi agents. young is a recent muslim convert and daughter of a police officer. dakhlalla is the son of a mississippi imam. both people are currently under arrest. now to that custody battle

involving "gossip girl" actress kelly rutherford. a judge in new york ordered that rutherford's son and daughter be returned to their father in monaco. abc's linsey davis has more. >> reporter: fighting back tears -- >> i have no words at this moment. no words. >> reporter: "gossip girl" star kelly rutherford forced to say a difficult good-bye to her 8 and 6-year-old son and daughter, who were ordered to go back to monaco immediately. a new york judge deciding they should continue to live with their father, german businessman david girl ash, who accused rutherford of kidnapping them when she disobeyed a monaco court order by not sending them back to europe last week. >> i think when you look at the totality of this case, it's a total miscarriage of justice. >> reporter: six years ago when she filed for divorce, they were supposed to share custody, but when his u.s. visa was revoked and he was excpelled from the u.s., a california judge ruled the children, who were 2 and 5 at the time, should live in

monaco with their dad temporarily while he reapplied for a visa. he never did. >> i trusted their father that he would live up to his agreement that it would be temporary, and three years has not been temporary. >> reporter: she argues this is a far cry from shared custody because he's not allowed into the u.s., she's forced to go out of the country to visit her kids. it's been a legal hot potato on both sides of the atlantic. but giersch's attorney says he's thrilled with the ruling. >> he's very excited to have his children back. >> reporter: because rutherford didn't abide by the terms of the agreement, it could mean less access to her kids in the future. her next court date is scheduled for monaco early next month. linsey davis, abc news, new york. federal regulators say driver fatigue was the main cause of a deadly accident that injured tracy morgan. the truck driver which hit morgan's limo had been without sleep for more than 28 hours. investigators also found lapses in the emergency medical response. it took 40 minutes for first responders to get morgan and the others out of the limo.

>> they were getting them out. they didn't have enough basic life support units on scene. so then that even further delayed the delivery to the hospital. >> regulators also found that unused seatbelts made the injuries worse, and the customized limo left the passengers with no way to get out. the new fire that broke out on sunday north of san francisco has mushroomed, more than doubling in size in just 24 hours. the jerusalem fire has scorched 14,000 acres and forced new mandatory evacuations. flames are racing through the dry and rugged terrain, moving so quickly, fire officials are concerned this fire could soon merge with the even larger rocky fire, which has destroyed 43 homes. well, it's believed a strong storm that moved across rhode island could have had something to do with causing a big water main break. when it happened, an sinkhole opened up right under a pickup truck. a police officer who was working nearby ran to the scene and helped the driver get out. he wasn't hurt. >> i think it's very serious to

get him to safety. as you can see, that could have gotten even worse. that truck may have gone completely under. >> the truck was eventually lifted out of the sinkhole. a couple dozen properties in the area are expected to have their water service back up some time this morning. let's look at today's forecast. showers again in parts of new england and the eastern great lakes. it's even hotter in that fire zone out west with the heat indexes in phoenix hitting 110. heavy rain in utah and colorado. it's stormy along the gulf coast and in the mid-atlantic. >> summer heat from coast to coast, 90s in portland, denver dallas and miami. 80s in seattle, kansas city and boston. 70s in chicago and detroit. this might come as no surprise to anyone who set foot in an airport or dealt with the airlines over the last several months. complaints about air travel are up. the transportation department says consumer gripes about airline increased 20% in the first half of the year. that's compared to the same period last year. the top complaints,

just this spring, she was studying chemistry at mississippi state. >> i know the kind of person that she is, and this doesn't make any sense. she was so smart, top of her class, studying to be a doctor. >> reporter: authorities say she praised the attack in chattanooga last month where four marines were killed. young and 22-year-old muhammad dakhlalla are being held without bond. authorities say they were arrested with tickets in hand, planning to fly delta airlines from columbus, mississippi, with u.s. connections to amsterdam, and then on to turkey. investigators say from there, they planned to slip into syria. he's also a smart one, graduating from mississippi state with a degree in psychology. according to this federal complaint, undercover fbi agents pretending to be terrorists exchanged messages with the couple online. "i am skilled in math and chemistry," she reportedly tells them," and worked at an analytical lab here at my college campus. we learn very fast and would love to help with giving medical aid to the injury."

hillary clinton of breaking the law with her use of private e-mail just as the investigation enters a more serious phase. clinton has directed her team to turn over her private e-mail server to the justice department. a thumb drive containing copies of her e-mails has already been handed over. republican critics have been demanding for months that clinton turn over the server. house speaker john boehner said last night it's about time. a young couple from mississippi is being held without bail, accused of trying to join isis. 20-year-old jaelyn young and her new husband, 22-year-old muhammad dakhlalla were arrested at the airport just before boarding a flight to turkey. authorities say they expressed their commitment to help the islamic state to undercover fbi agents posing as terrorists. and young allegedly praised the chattanooga shooting that killed four marines and a sailor, but her family and friends are stunned. >> we know the kind of person that she is, and this doesn't make sense. it still doesn't. i don't know if it ever will.

she was so smart, top of her class, studying to be a doctor. >> young is a chemistry major and the daughter of a police officer. dakhlalla just graduated from mississippi state university with a degree in psychology. his father is a local imam. investigators say russian-made missile parts have been found at the scene of the malaysian flight 17 crash in ukraine. all 298 people on board the flight from amsterdam to kuala lumpur were killed in july of 2014. russian-backed rebels and ukrainian forces blamed one another for shooting the plane down. both sides deny responsibility. the air force is investigating the cause of an f-16 jet crash in germany. the accident produced a plume of smoke which could be seen for miles. the pilot was able to eject but is expected to survive his injuries. the children of actress kelly rutherford have been returned to their father in monaco. rutherford was supposed to send her son and daughter back last friday but refused.

yesterday a judge ordered the children be reunited with their father. the "gossip girl" actress has been involved in a lengthy custody battle with her ex since they split in 2008. and the head of the environmental protection agency heads to colorado and new mexico today to get a firsthand look at rivers affected by a toxic spill. that spill was caused by an epa clean-up crew when it mistakenly released 3 million gallons of contaminated wastewater into the river there. the lead, arsenic and other heavy metals in that wastewater turning the water orange. and the rivers as well in new mexico are off limits, but the hope is that they can be open for recreational use in the next few days. now some weather. officials in rhode island aren't sure if heavy rain contributed to the breaking of a water main. that break caused a sinkhole to open up right underneath a pickup truck. look at that. the driver going to be helped out of the truck but was uninjured. meantime, this is the scene near denver international

new york city. a tuesday deluge all while one neighborhood in boston deals with this, a major sinkhole caused by a water main break. watch the street overtaken by water. that same cold front is now through. we'll be much drier and way less stormy behind it. the one thing we have to watch out for is that big high pressure system, the ridge up high in the atmosphere that's been baking the south. it's moving back west, so an excessive heat watch starts friday in phoenix, goes through the first part of the weekend, and horrendous conditions for those fires out in the pacific northwest. ginger zee, abc news, new york. well, new evacuations are under way north of san francisco after the so-called jerusalem fire exploded in size to 14,000 acres. it's only about 5% contained, burning through rugged terrain. but because it spread so quickly, fire officials are now concerned it could merge with the even larger rocky fire. the causes of both blazes still under investigation. the city of los angeles has found a creative, new way to help fight california's

devastating drought. millions of black plastic balls are now floating on top of the city's reservoir. they're part of a $34.5 million plan to protect the city's water supply against everything from sunlight to wildlife as well as cutting down on evaporation. >> by reducing evaporation, these shade balls will conserve 300 million gallons of water each year, instead of just evaporating into the sky. that's 300 million gallons to fight this drought. >> the so-called shade balls cost about 36 cents apiece. in all, just under $3.5 million. it's much more cost-effective than laying down a tarp, which the city says would cost $300 million, nearly 100 times more. well, high wire daredevil nik wallenda has been at it again, this time making his longest walk ever. >> it happened at the wisconsin state fair. wallenda walked a high-wire nearly 1,600 feet long and 118 feet in the air.

presence unnecessary and inflammatory. the rookie police officer who fatally shot a black teenager in arlington, texas, has been fired. officer brad miller arrived at a car dealership after 19-year-old christian taylor was seen shattering a window shield. the police chief said miller used poor judgment and made a tactical error by entering the dealership alone. he said miller's mistakes caused a deadly confrontation that put him and other officers in danger. a newlywed american couple is facing terror charges, accused of trying to flee to syria to join isis. 20-year-old jaelyn young and 22-year-old humid dakhlalla were arrested at an airport in their home state of mississippi. authorities say they planned to work as medics for the islamic state, but the terrorists they reached out to online turned out to be undercover fbi agents. young is a recent muslim convert and the daughter of a police officer. dakhlalla is the son of a mississippi imam. both people are currently under arrest. now to that custody battle

involving "gossip girl" actress kelly rutherford. a judge in new york ordered that rutherford's son and daughter be returned to their father in monaco. abc's linsey davis has more. >> reporter: fighting back tears. >> i have no words at this moment. no words. >> reporter: "gossip girl" star kelly rutherford forced to say a difficult good-bye to her 8 and 6-year-old son and daughter, who were ordered to go back to monaco immediately. a new york judge deciding they should continue to live with their father, german businessman daniel giersch, who accused rutherford of kidnapping them when she disobeyed a monaco court order by not sending them back to europe last week. >> i think when you look at the totality of this case, it's a total miscarriage of justice. >> reporter: six years ago when rutherford filed for divorce, she and giersch were supposed to share custody, but when giersch's u.s. visa was revoked and he was expelled from the u.s., a california judge ruled the children, who were 2 and 5

at the time, should live in monaco with their dad temporarily while he reapplied for a visa. he never did. >> i trusted their father that he would live up to his agreement that it would be temporary, and three years has not been temporary. >> reporter: she argues this is a far cry from shared custody. because he's not allowed into the u.s., she's forced to go out of the country to visit her kids. it's been a legal hot potato on both sides of the atlantic. but giersch's attorney says he's thrilled with the ruling. >> he's very excited to have his children back. >> reporter: because rutherford didn't abide by the terms of the agreement, it could mean less access to her kids in the future. her next court date is scheduled for monaco early next month. linsey davis, abc news, new york. federal regulators say driver fatigue was the main cause of a deadly accident that injured tracy morgan. the truck driver which hit morgan's limo had been without sleep for more than 28 hours. investigators also found lapses in the emergency medical response. it took 40 minutes for first responders to get morgan and the others out of the limo.
