3:00 and going to 500 acre as cording to cal fire. joining us now on the phone is fire prevention specialist pam tennerman. at 5:00, cal fire had 0 percent containment. how are things looking now? >> unfortunately we still have no containment on this fire. it's over 500 acres with two heads on it moving south and southeast. the haft update, at 20 minutes after the hour, the carnegie motorcycle park, a state recreation park had been evacuated because the fire was moving into the park. we have no injuries reported but as video is showing unfortunately, it looks like we've lost a building out there. >> what are the weather conditions out there? it looks like it's windy just from the smoke moving on the live pictures. >> yes.

i'm dan ashley. >> i'm ama daetz. we have a late word tonight that three firefighters have been killed fighting a small fire in washington state. it's called the twist fire, only 50 acres but threatening 20 buildings. and there are new evacuations in a fire burning east of fresno. authorities ordered 2500 campers, hikers and residents out of the hume lake area after strong winds pushed the fire across highway 180. lightning sparked a brush fire on july 31st, burning 30,000 acres of brush and grass. containment is just 3%. for the first time the oakland police department is letting us watch the officer body cam video from two recent controversial cases. o1 once, at 27th street and martin luther king junior way, one, last month on 54 avenue in east oakland.

laura anthony is live now with what she saw. laura? >> reporter: police have shown us this video, but not before offering it to the families of the two men killed in these incidents. one family has yet to accept the offer. the other has seen it but does not buy police version of events. >> the video is one piece evidence in a large investigation. >> reporter: for the first time, police shared body camera video two of high profile case was reporters but did not release images to the public. >> we believe that doing it in a manner we've done it will allow us to correct misinformation and preserve the integrity of the investigation. >> reporter: one case involves a shooting of a 28-year-old shot and killed being chased by oakland police. the video shows him running from officers with what appears to be a gun. police can be heard yelling for him to get on the ground and drop the gun.

public once they've completed their investigation. in oakland, laura anthony, abc7 news. the san jose police department is under scrutiny after fatally shooting two of three suspects in last week's murder inside of an office building. police are searching for the third suspect. abc7 news reporter david louie is live with the push for an independent investigation into the deaths. david? >> reporter: ama, the independent police auditor, as well as others, are looking into the fact there were two important points about a shooting of a suspect that happened monday evening. one was that he was unarmed and second he was running away from police officers. now, police made split second decisions and did have information that the suspect was planning to kill again. any officer involved shooting, such as sunday ace when a suspect reaches for a gun when officers tried to arrest him triggers an internal investigation. san jose policy spells out rules

have been holed up in a home, that would not allow the police to use lethal force. because it involves speculation. >> reporter: mayor locardo is waiting for more facts in this case. >> we're concerned as we should be concerned and i know our chief is very focused on this issue. i am, too. >> reporter: in san jose, david louie, abc7 news. a new public relations crisis for uber tonight. san francisco and los angeles district attorneys filed civil action against the company, claiming the ride service is misleading the public about its drivers' background checks. abc7 news reporter vic lee is in the newsroom with the story and what they say, vic, could put you in danger. >> reporter: well, this is an amended version of the civil complaint that the d.a. and his counter part filed against uber in december. this new document actually lists the criminal back grounds of dozens of the drivers, most from

la larks but some from san francisco. murders, lewd acts with children, kidnapping. robbery. id theft. the amended complaint cites 22 drivers with serious felonies who passed uber's background checks. what is more, district attorney gascone says many former sex offenders won't show up on the system. >> a person as a registered sex offenders do not appear on the public registry available to identify sex offenders. >> reporter: uber, he says, has big, gaping holes. >> the background process cannot tell if someone was convicted of a serious crime more than seven years ago. >> reporter: taxi drivers in san francisco and other cities undergo checks use fingerprints. a process gascone says ub year does not do. >> a single print, the fact that the rest were convicted would

>> thank you. police just released this surveillance video hoping someone will recognize a robber. the thief pulled a gun on a clerk in a gas station on 19th avenue. that is near san francisco state university. it happened just after 5:00 a.m. on august 8th. detectives believe the robber is in his late 20s, standing about 59 and weighs about 160 pounds. this is how a high-speed chase ended in oakland. police say the driver of the stolen ford lost control of the car being pursued and plowed into a house on 82 avenue. no one was home at that time. the driver was arrested, after a short foot chase. well, are you tired of driving on substandard roads? coming up, a fix or california highways that won't come cheap. but are they going to restrict how much gas we can use? >> is your garbage collector about to become a neighborhood spy? a plan to give police ahand

>> let's move on for just a moment. in a case originally a brush off as an investigation into a colleague, subway sandwich spokesman jared fogle admits he traveled around the country to have sex with under aged girls. >> the u.s. attorney claims he paid adult prostitute's a finder's fee if he can connect them with minors. >> i'm jared the subway guy this, is my story. >> reporter: jared fogle is about to be known for a different story. he pled guilty to possessing child pornography, including images of children as young as six, and engaging in sex acts with minors as young as 16. >> it's about using wealth and secrecy to exploit children. >> he will have to adhere to a pornography ban and treatment.

the trial was to begin today, at the northern california district federal bankruptcy court. the couple faced accusations they made false statements about the financial and business affairs and their bankruptcy filing. but in an 11th hour settlement, he basically agreed to drop his request for a waiver from his detectives. some alleged victims didn't know what to make of it. >> it's confusing to the victims. we'll find out more, obviously. >> reporter: the feds agreed to drop their challenge to bankruptcy. however, the bankruptcy case remains active. the wife, heidi lopez did not agree to drop her request to be freed from debts. one bankruptcy attorney we talked to told us it's possible her husband miguel could still be protected under community property law. >> i think it's very bad because these men have to be nailed.

. scientists from nasa are revealing drastic effects from california's drought. parts of the state are sinking. >> there are some areas that have dropped a foot. the multi million dollar plan to slow it down. >> reporter: lack of rain and snow falling from the sky has many californians pumping more water from the ground. now, researchers say land in the san joaquin valley is leaking faster than before. more than two inches per month in areas. >> it occurs when we pump more than we recharge, over time. >> reporter: the state department of water resources commissioned nasa to conduct the study. scientists used satellite images to see the changes from may of 2014 to january, of this year.

they found one area sunk 13 inches, and another dropped ten inches. >> we're not surprised of the number. we've been tracking this in our area pretty carefully. >> reporter: chris chiet whooit is the general manager of the central california irrigation district saying this bridge is one of the most obvious examples. it had space for boats to pass, now, the water is higher than the pavement. >> we've had to install concrete abuttments to raise up on the size of the bridge so water doesn't splash into the road. >> reporter: there are plans in place for a replacement. state and local leaders are concerned about damage to other bridges and roads, plus changes to flood flows. >> the way to approach it is fixing the pluming in the delta. that is why, that is probably not likely to happen on a short
