live from the kgo tv broadcast center this is abc 7 news. good afternoon. i'm dan ashley in for larry beil. >> and a.m. ama daetz. first at 4:00 oakland police are defending the actions of one of their officers who shot and killed a man this morning, a man investigators say attacked the officer with a bike chain. >> it happened at 8:30 this morning. abc 7 news reporter laura anthony is in oakland with the story. >> this cell phone video shows the minutes after an oakland police officer shot and mortally wounded a man who investigators say just struck her with his metal bike chain. >> suspect continued to advance. the officer drew her firearm and

fired at the suspect striking him. >> i ran out and seen this man on the ground and an officer on the side. >> reporter: michelle harris said she heard the shots and recorded this video that shows the suspect on the ground. >> she looked like she had blood on the side of her face. something did happen but it was so extreme. >> reporter: neighbors tell abc 7 news the man was a regular in the neighborhood often sleeping wherever he could, sometimes being combative with those who try to get him to move along. >> instead of shooting him they could have tasered him or maced him. i don't think what he did was worth his life being taken just by knowing him personally. >> reporter: demonstrators say they will march from the scene to city hall to protest today's shooting. >> today's incident was the sixth officer-involved shooting in oakland and the fourth fatal one this year. on june 6th officered shot and

killed a man four blocks east of the shooting. on august 3 oakland officers shot and killed a man after he wounded an officer. and police say nate wilkes turned towards them with a gun. we are expecting ahmad brooks to turn himself into authorities. brooks and former defensive end ray mcdonald are accused of sexual assaulting the same woman at a party. the 49ers sent brooks home yesterday and issued a statement saying he would not be playing in saturday's game in denver. mcdonald is due in court next month. no court date is set for brooks but he is expected to post bail. a woman was killed early this morning during another hit-and-run. it happened as a number of children were walking to school.

>> it happened near tully road. here is matt keller. >> reporter: a gruesome and tragic display just off of tully road in east san jose. a woman likely between 30 and 40 years old was dead in the road. police say she was killed when a male driver in a maroon sedan hit her and sped off. his car was abandoned several blocks away. no arrest has been made. >> this is a park. there is a school nearby. there were kids waiting for buses and those kinds of things. it's quite a tragedy and very dangerous. >> reporter: parents walking their kids to nearby katherine smith elementary school trying to avoid the scene. >> today they wanted to walk front side. i said we shouldn't go there. so we walked by that way so they wouldn't have to see that. >> reporter: this is san jose's 31st traffic fatality this year

broken. >> we used to also go kayaking. i look down the river and realized that, you know, she -- i'm sorry. she's not going to be there with me. >> reporter: abc news is not showing the video of the fatal shooting recorded and posted on social media by the shooter, bryce williams whose real name is vester flanagan fired from wdbj two years ago. police continue to search his apartment for answers but in a rambling suicide note faxed to abc news he claims he was the victim of mistreatment at work because he was a gay, black man. and in response to those allegations the general manager here told us those claims of mistreatment were investigated but determined to be unfounded. as for flanagan he committed suicide following a police chase. there is a bit of good news here. we are told the third shooting

their client arrested. the judge said there was no evidence ed lee had committed a crime. the lawyer for the dog sitter accused of animal cruelty pled not guilty. the case came to the d.a.'s office after this disturbing video was captured of her grabbing a dog by the neck and appearing to throw it to the ground. >> the owner was watching television and saw the video and recognized her dog being on the video. at that point she got in touch with the humane society and brought frisco in for an examination. >> prosecutors say that is why she wasn't charged with a felony. she is out on bail. officials say she does not have a business license and is not permitted to board pets where she lives. a dead whale found lodged under a dock has been removed.

this video shows the army corps of engineers towing the carcass by boat to deeper waters. sky 7 hd followed. the national oceanic and atmospheric association says the whale is being taken to a suitable place. we learned the whale was dragged in on monday by a ship. it's not clear if the whale was dead or alive when it was hit by the ship. >> governor brown ordered cities to reduce water use. the results are in. how much the state actually conserved last month. >> the damage after a driver rams into a gas line. >> plus instagram made it hip to be square but not anymore. the new shape the popular photo sharing app is giving users. the golden gate bridge traffic is moving in both directions perhaps a little heavier on the right-hand side.

this is abc 7 news. day light reveals the extent of the damage to a santa clara strip mall. you can see some of the businesses destroyed by an explosion and fire yesterday. police say a driver rammed into a gas meter and caused this fiery blast. two people were injured including a firefighter. surveillance video shows the car

taking off. authorities in almeida are looking into what they say is a suspicious fire that broke out just before 4:00 this morning at a business near ferry point and west atlantic avenue. officials say it is suspicious because it started on an outside wall and there was a nearby dumps administer fire. firefighters quickly knocked it down. no injuries were reported and only minor damage. a surprise today at the end of the preliminary hearing. kate steinle was shot to death last month. prosecutors have been arguing the the suspect in the case should go to trial on a murder charge. abc 7 news reporter vic lee is live at the hall of justice to tell us what happened today. >> reporter: i think everyone covering this case expected the prelim hearing to end today, this after the prosecution wrapped up its case yesterday with its last witness, but for whatever reason prosecutor diana garcia suddenly asked the judge to continue the hearing saying she needed more time to make her

case. and that came after the defense called its only witness, an important one. today public defender matt gonzalez called his only witness, former head of the san francisco police crime lab. gonzalez believes the gun francisco lopez sanchez is accused of firing accidently discharged in his hand. norris's testimony supported gonzalez's position. he said the weapon, a .40 caliber has no safety switch and the weapon has a trigger that requires little force to pull thus supporting the defense position that it could have accidently gone off. a police investigator has also testified that the bullet hit the ground and ricochetted, fatally striking her in the back. but the prosecution believes sanchez was aiming his gun at steinle when it went off. >> we believe the charging decision is proper and the defendant has been charged with murder for that reason.

>> reporter: police criminalist testifies that the trigger had to be pulled for the gun to go off but under cross examination that it could misfire. vic lee, abc 7 news. republican state lawmakers introduced legislation in direct response to steinle's murder introducing a bill to prevent agencies to seeking custody of undocumented immigrant. had the suspect not been removed from federal prison by san francisco sheriff's officials steinle's murder would never have happened. >> if he had been left in the federal prison kate steinle would be left today. quite simply he never should have been moved to san francisco in the first place. >> the bill faces an uphill battle in the democratically controlled legislature but supporters believe it would keep neighborhoods safe from felons.

good news in china is good news for wall street. stocks closed higher today. investors in a buying mood after the chinese stock market saw the biggest gain in eight weeks and reacting to reports that the u.s. economy expanded at a much faster pace than predicted. the dow closed up 369 points. the nasdaq climbed 115 at the end of trading today and the s&p 500 also up 47 points. it is official. apple's product announcement will be made in san francisco. speculation began to grow when police and security guards responded and no parking signs went up. it is unclear what exactly apple plans to release at the event but the companytypically reveals new iphones in september. siri, give us a hint. if you ask siri to give us a

hint you get an answer alluding to next month's announcement. there is a new feature on instagram expanding choices for photographers. starting now photos can be uploaded in square, landscape or portrait. until now square was your only choice. starbucks will be closing the caves across san francisco. the coffee giant says all locations will be nonoperation. 15 locations are in san francisco. the cafe on columbus avenue and the one at 685 market street will close at 1:00 p.m. tomorrow. starbucks did say it will transfer leases to new ownership. california water experts released the latest conservation numbers today and the state exceeded the requirements. mandated a 25% water use reduction across the state in

here is a view as we check out our forecast features. heat will taper off but will be warm in some spots. much cooler everywhere this weekend. we have a slight chance of light showers early saturday morning. satellite and radar composite image shows big hot air mass dominated our weather picture. this ridge is starting to retreat and slide southward just a bit. that will open the door for cooler air mass to our northwest to arrive tomorrow and possibly bring showers early saturday morning. here is the forecast animation. areas will have high clouds pressing through tomorrow and to our evening. early saturday a slight chance of showers reaching into the north bay. it looks like if they do materialize they will be light. we don't expect widespread or steady or heavy rainfall. we see the chance of showers disappearing. a cooling pattern will continue into next week. speaking of cooler pattern.

police fatally shot a man at 8:30 in the area of mcarthur boulevard. police say the man repeatedly hit the officer's head and face with a metal object. laura anthony says neighbors are questioning this morning's shooting. we will have a full report at 5:00. san jose police are looking for a hit-and-run driver who killed a woman crossing the street this morning. investigators found the car but are still looking for the driver. abc 7 news reporter will give us an update on that story at 5:00, as well. in the wake of yesterday's deadly shooting of a news crew in virginia there is a renewed push for gun control. the man leading that charge is the father of the reporter killed. the issue is taking center stage on the presidential campaign trail. >> i'm sorry. she's not going to be there.

>> reporter: grieving father andy parker is turning his daughter's shooting death to a call for tougher gun laws. >> there has got to be some common sense. >> reporter: the gunman behind wednesday's shooting had a history of anger and aggression according to station management who fired him two years ago. it is believed he sent this suicide note to abc news expressing admiration for the columbine shooters and virginia tech shooters. parker's father when you add newtown, connecticut it is time for screening gun owners. >> the politicians that kicked the can down the road -- >> reporter: the issue, a long time political hot potato is front and center. >> if guns were not so readily available, if we had universal background checks. >> we have a serious mental

problem. >> reporter: just before the shooting wal-mart announced it is no longer selling high powered assault rifles, not for political reasons but because consumer demand was down. it was a hand gun used in virginia and police say it was purchased legally. an online petition has started to cancel a gun show in roanoke, virginia this weekend. it has a few hundred supporters but as of now that show will go on as scheduled. in the oakland hills the power is back on to more than 1,200 pg&e customers after an early morning fire. firefighters say it was started by a blown transformer. crews had to go down a steep hill to reach the fire and were able to put it out before it could spread. there are new details in the kidnapping. the fbi obtained an arrest warrant in june for the kidnapping of huskins.

she disappeared in march from her home only to turn up in southern california. pd said she faked the entire disappearance. now the attorney says a key piece of evidence linking the client should be thrown out. abc 7 news reporter is live in pleasanten with the story. >> reporter: we got a look at matthew muller in court today wearing a red jump suit. at times he smiled at his attorney. today's hearing was continued to next week when the attorney will argue that detective's lack of search warrant for cell phones is enough to unravel the case. in the early morning hours dublin police services responded to a home invasion robbery. the victims fought off the robber who fled but he left behind a key piece of evidence. >> he left his cell phone at the

residence. >> the cell phone was locked so detectives made an emergency 911 call. the operator gave them the phone's number which they used to obtain who the phone was registered to, information that brought detectives to matthew muller's parents and then to him at the lake tahoe home. investigators found more evidence linking him to a march home invasion. prior to that evidence police called the kidnapping a hoax but in late june fbi agents obtained a warrant in connection to the kidnapping. while he was in jail facing charges in the home invasion. >> they put the case together and it turned out great. >> reporter: his attorney claims detectives searched the cell phone without a warrant. >> the phone is really a window into the entire investigation. >> reporter: if the search of the phone is suppressed muller's attorney says -- >> i don't know what evidence would remain.

>> reporter: home invasion victim is not a party in the almeida county case but her attorney told abc 7 news he recognizes the implications this could have. and said i'm glad the right person was apprehended. it would be tragic if the case was dismissed on a technicality. the argument ultimately has no merit, a decision the judge will make when the motion is heard next week. president obama is in new orleans right now marking the tenth anniversary of hurricane katrina. the president met with residents working to rebuild neighborhoods in the hard hit lower ninth ward area. he hailed the community's resilience in the face of such massive destruction. >> because this is a city that slowly unmistakebly together is moving forward, because the project of rebuilding here wasn't just to restore the city

as it had been. it was to build the city as it should be. >> in his speech the president made special note of racial and economic inequities. the poverty rate remained near 30%. hurricane katrina killed nearly 1,000 people in louisiana alone. in the race for the white house vice president joe biden says he is not sure if he is ready to run for president. he spoke in a conference call and said he is assessing whether he has the emotional fuel to run for the white house. >> if i were to announce to run i have to be able to commit to all of you that i would be able to give it my whole heart and my whole soul. and right now both are pretty well banged up. we are trying to figure out that issue. >> the vice president lost his eldest son beau to cancer on may 30th and may not be prepared for a run. one friend said he is not

pick up supplies. >> just got a couple cases of water and plenty of food, two generators, hurricane impact windows. we have a propane stove. >> florida hasn't had to prepare for a hurricane in nearly ten years. the last one was in october of 2005. the hurricane-free streak is the longest since 1851. for more on tropical storm erika let's turn to spencer christian. >> here is here with our accuweather update. >> let's go right to the live doppler 7 hd and move to the bay area to the tropical atlantic where tropical storm erika is threatening to become a hurricane. it is moving generally towards the west northwest packing sustained winds of 45 miles per hour. expected to move over puerto rico and through the bahamas. by next tuesday morning if it continues in this path and on this projection it could become

a category 1 hurricane as it makes land fall on the east coast of florida. tropical storm, now hurricane ignasio is a category 1 hurricane. maximum sustained winds 90 miles per hour. it is also on a westward track expected to intensify to category 3 over the weekend and back to a category 1 by tuesday as it possibly moves just north of hawaii. that will get our close attention as we track both storms. across the state tomorrow, state of california look for hot weather in the interior sections. highs in the 90s to above 100. here in the bay area we will probably not have triple digits tomorrow but will be warm in our inland valleys where highs reach low to mid 90s. we see low to mid 80s and on the coast we see highs up to about 70 degrees with high clouds, i might add. at least we have a cooling trend

a minor accident caused big problems in hollywood. water shot high into the air. beside the water loss the geyser hit high voltage lines. witnesses reported two explosions. power and water had to be shut off in that area as you can understand when you see the picture. this week's stock market nose dive sparked howard schultz to take action. he sent an e-mail telling them the market volatility and recent political uncertainty at home and abroad are sure to lead to increased anxiety. he told workers to be sensitive to the pressures customers may be feeling and to do everything

>> good evening. i'm dan ashley. >> and i'm cheryl jennings. there is a search underway in san jose right now for the person responsible for a horrific hit-and-run that left a woman dead near children on their way to school. the accident happened in east san jose. abc 7 news reporter chris nguyen has the latest information. >> reporter: we are standing yards away from where the incident happened. if you take a look behind me you can see that orange cone in the distance there. that is the area where the woman was fatally struck. we just learned the victim's name, 46-year-old laura reyes of san jose. her family has been notified by the coroner's office. tonight investigators are still trying to track down the suspect. just off tully road in east san jose neighbors grieve over the loss of a woman killed by a hit-and-run driver. >> i walk here every morning around the block.

after this i have my granddaughter. there is no way i'm going to chance it. >> it happened at the corner around 7:15 this morning. based on evidence at the scene it appears the driver in a maroon sedan hit the woman on the sidewalk and sped off abandoning the car a few blocks away. >> this is a park. there is a school nearby. there were kids waiting for buses. it's quite a tragedy and very dangerous. >> reporter: a homeowner nearby may have captured the suspect with a surveillance camera. we have covered the man's face. in the video you can see him walking across the drive way. however, police have not commented on whether this is the man they are looking for. neighbors tell us speeding in the area has been a major problem with countless crashes and inconsiderate drives. >> it is worse every day. now that school started it seems like it is getting worse for the kids crossing the
