live from the kgo tv broadcast center this is abc 7 news. good afternoon. i am larry beil. >> i'm ama daetz. we are learning more about the confrontation with police that led to the closure of the bart station. officers said the man shot himself at least once before he was tased by police. laura anthony is live in oakland with the latest. laura. >> reporter: at first it appeared this was another officer-involved shooting in oakland in a year that has seen many more than usual. bart police were quick to point out the suspect's gun went off when he tried to pull it out of his waist band. >> officers did not draw their weapon. they tried to handle him

physically. >> reporter: bart police say the man critically injured shot himself and the the officers didn't draw their weapons only a taser. >> from the video i'm seeing after reviewing the video the shooting skpen a taser. >> reporter: cell phone video shows the man identified as corey powell on the ground while two officers attend to him. the shooting occurred on the platform after officers asked powell to put out a cigarette. he did so but then climbed on to a wall and threatened to jump. >> officers grabbed him and he is screaming and yelling. >> struggling. you see my officers' hands on the person trying to pull his hands away. at that time one report of a gunshot. >> reporter: police say powell had a no bail warrant on a prior burglary charge and remains in critical but stable condition at highland hospital. laura anthony, abc 7 news.

bay area activists are rallying against racial profiling by police. >> when do i want it now? when do we want it? now! >> some of the protesters are with the group south bay pact. they are hoping to rally support for a bill requiring all law enforcement agencies in the state to document the racial identity of every single person they stop. >> i can't stand to see my kin, my brothers and sisters treated as anything less than the full members of the human family that we all are a part of. that is why i'm going to go to the capital lawn. >> the san jose police department began tracking ethnicity of people stopped by officers while blacks and latinos made up 36% of the population the data showed they made up nearly two-thirds of police stops that don't end in

arrests. home burglaries are on the rise. take a look at surveillance video where you see two burglars combing through a house looking for stuff to steal. police are searching for the thieves. vic lee joins us live with the latest. >> reporter: there has been a rash of home burglaries on the peninsula. among them wealthy enclaves like hils boreo and the residents are nervous and on the lookout. yesterday two burglars broke a large window of a home on denise drive. the home security camera recorded the intruders running through the house, ransacking several rooms. police told us they stole expensive jewelry among other items. san mateo county has experienced a rise in home burglaries. this woman, who lives in bay wood says two of her neighbors were burglarized a couple of weeks ago. >> turns out as the police were coming to this house they got

another call four blocks down and that woman was home. so we are all on the lookout. >> so now she takes no chances of becoming a victim herself. >> lights on, cars, more lights in the yard. obviously we used our alarm 24/7 and i think a lot of people in the neighborhood are now getting cameras. >> police sergeant believes that there are more criminals on the streets because of prison realignment and recently approved ballot measures. >> so put more and more people who would have done time and had consequence in prison or jail to put them on the street. >> by the way, if you have seen these two intruders from the home burglary please contact police. vic lee, abc 7 news. >> closing arguments began today in the trial of two teenagers accused of killing an offduty

paramedic. clint boyar was shot in the head. the teens can face life in prison if convicted of murder. a trial date has been set for the man accused of kidnapping and killing 15-year-old sierra lamar. torres is scheduled to stand trial next year. lamar disappeared while walking to her school bus stop three years ago. investigators say they found her hair and dna inside his home. garcia torres' dna was detected on clothing and her body has never been found. a car going the wrong way today slammed into a building. this was the scene this morning. no reports of injuries at this time it's not clear why the driver was going the wrong way.

>> this afternoon we are getting a look at the rescue of an injured bicyclist. authorities found the bicyclist drifting in and out of consciousness. the injured cyclist was transported to a nearby hospital. he was treated for a head injury. turning to the weather. a little bit cooler today. >> spencer christian is here with our accuweather update. >> cooler than average across the bay area. it feels a little bit like autumn right now. breezy with a few clouds around. here is live doppler 7 hd. you see it is mostly sunny but areas of low clouds at the coast and a few higher clouds drifting over. we still have a red flag warning for high fire danger over parts of the central sierra and over to the eastern slopes in effect until 7:00 this evening. from our emeryville camera clouds. 65 in san francisco. oakland 71. 76 mountain view.

this photo of said chicken. the highway patrol tweeted the picture of the chicken. with the hash tag, the bird is now at the oakland animal services shelter. >> the chicken is walking around. he has food and water and he's making a bunch of noise. he's not showing any signs of distress other than why am i in this cage when i was free on the freeway. >> trying to get to the as game. the chicken doesn't have a name yet. the shelter is taking suggestions along with applications to adopt it. >> i was so thankful it survived on the freeway. >> the police were trying to shield him from cars. the early clubhouse leaders are drum stick. you like it or no? i think it is cute. nugget which i don't think you want to be nugget. >> i like nugget.

>> we'll send them in. speaking of traffic, it could be a messy weekend of it on the bay bridge. bart is closing the trans bay tube for scheduled maintenance saturday morning through late monday night. bart will provide bus service. the buses will run between the temporary terminal in san francisco and bart's 19th street station in downtown oakland. another heads up for commuters on interstate 80 on the east bay, tomorrow cal trans will begin testing smart signs between richmond and emeryville. the agency says the electronic signs will provide real time recommended speed limits as well as traffic accident and other information for drivers. officials are hoping it will help reduce secondary accidents and congestion. signs will go online later this year. still ahead here on abc 7 news at 4:00, the man police say was behind a bizarre kidnapping is back in court today.

president obama now has the necessary votes to keep the iran nuclear deal alive. today maryland senator became the crucial 34th vote giving the president enough support to uphold a possible veto. said the agreement is the best way to curb iran's nuclear ambitions. congress is set to vote on a resolution disapproving the deal. they called it a dangerous give away to iran. now to the race for president. your voice, your vote. republican candidate jeb bush and donald trump are releasing attack ads aimed at each other. stephanie ramus has a look at the new ads. >> reporter: the gloves are off again. jeb bush and donald trump have attacked each other before but

surprised by the recent attack by bush. >> i think he had no choice. so far everybody that has attacked me has gone down. >> reporter: the campaign has had an effect on trump, bush and democrat hillary clinton. a new "washington post" pole shows the popularity ratings for all three of them are in negative territory. >> on wall street worries over the economic slow down in china were put on the back burner. after yesterday's big plunge all three markets surged today. positive reports showing job growth, rising worker productivity and economic growth. the dow jumped nearly 300 points at the close ending at 16,351. the nasdaq gained 113 points and the s&p 500 rose 35. amazon is expanding its dash button offerings. these dash buttons are designed to be placed in places where you

stow items like soap, diapers, bottled water. you can reorder the items. you don't have to leave your house. originally the buttons were only available for 18 items. amazon said they are adding 11 more and for every $4.99 button a customer buys the same amount will be credited to the amazon account. speculation is surrounding apple one week before the media event. analysts expect to see a new iphone. meanwhile apple is launching a news service on iphones and ipads despite a partnership. a college student in fresno says an iphone helped save his life. the victim told police he was robbed at gun point. the bullet hit the iphone which shattered but stopped the bullet. the student was not hurt. if you use one of those

public toilets on some san francisco sidewalks there's a good chance that somebody is watching you. the city has hired about two dozen workers to keep an eye on the toilets. the presence is intended to help cut down on illegal activities like drug use. the public use employees make sure people do not stay there past the limit of 20 minutes and says normal use has increased since workers began the watch. the as closed out a three-game series this afternoon. the highlights started before the game. ♪ and the home of the brave >> play ball. abc 7 news anchor dan ashley sang the national anthem. two years ago he sang before a warriors game at oracle arena.

here is the view of the golden gate with low clouds getting lower. these are forecast features. mild inland through friday. warmer pattern this weekend. much warmer by sunday and monday. beach weather for labor day with high temperatures in the 90s. here is satellite and radar composite image. here is a trough continuing to drop southward. showers drop into the pacific northwest associated with the pool of cool air reinforcing the cooler than average conditions. through thursday and friday we continue to have mild but not very warm conditions through friday. once that cooler air mass lifts out of here check out saturday's inland readings. upper 80s to around 90. on sunday warmer with highs inland in the low to mid 90s. we see 80s around the bay. 70s on the coast. more 70s on the coast. monday labor day and more 90s in the warmest inland spots on monday. we have quite a warming trend.

overnight look for mainly clear skies in the north and we will see low clouds pushing from the coast across the peninsula and the bay over to east bay and south bay. lows overnight mainly in the upper 50s to right around 60. tomorrow we'll see mainly sunny skies by afternoon. breezy on the coast again and just mild. highs range from mid 60s at the coast to low and mid 70s around the bay and upper 70s to low 80s in our inland areas. here is the accuweather seven day forecast. check out changes coming our way. cooler than average afternoon conditions through friday. it will start to warm up on saturday but the big warmup comes on sunday, monday, tuesday, wednesday with inland highs up to low 90s at least and perhaps above low 90s on monday. mid to upper 80s on the bay and low 70s on the coast. we are going to have beach weather beginning on sunday and labor day looking like a great day to be off although some of

live from the kgo tv broadcast center this is abc 7 news. >> taking a look at the headlines at 4:30. bart police identified the man who shot himself by accident last night. 28-year-old corey powell was on probation for burglary and a 2011 armed robbery. police say powell is in the hospital and is expected to be okay. police are investigating a burglary that happened yesterday afternoon. abc 7 news reporter vic lee says the burglars were captured on the home security camera. vic tells us property crimes are increasing on the peninsula. he will have a full report at 5:00. matthew muller, the suspect

in the kidnapping of denise huskens is in court today but this time for a home invasion case. the judge could decide if cell phone evidence in the case is ad missable which could effect a federal case later. the lawyer wants all the evidence thrown out because police didn't have a warrant for the cell phone. melanie joins us live with all the details. >> reporter: we could have that decision any moment here. right now a detective with the almeida county sheriff's office is testifying. we heard from two other witnesses so far. people are coming out of the court and the decision could be made at any moment. we did hear from two other witnesses including home invasion victim. he described how he was in bed with his wife and somebody came into their home and said your daughter is okay but told them to turn over and said he would tie them up. there was a struggle that ensued and the victim said he said a

couple of times to his wife honey get the gun to scare off the home invasion robber and the home invasion robber did leave the home. we also heard from a sergeant with the almeida county sheriff's office about responding to that scene. a lot of the cross examination here from matthew muller's attorney has focused on whether or not detectivess felt there was an urgent situation in which they needed to get a cell phone number and who the phone belonged to, a cell phone left behind presumably by the suspect on the scene. whether or not the detectives needed to have a warrant to do that. in an attempt to get a key piece of evidence suspect matthew muller's attorney argues investigators didn't have a search warrant for a cell phone muller allegedly left behind at the crime scene. >> the phone is really a window into the entire investigation. >> reporter: muller's attorney says when detectives made a 911

call from the password protected phone they were able to obtain the phone's number. it was registered to muller's parents who pointed investigators to this south lake tahoe home. there investigators found muller and also found more evidence potentially linking him to the kidnapping of denise huskens. police had previously called the kidnapping a hoax. >> they just put the case together and it turned out great. >> reporter: if a judge decides investigators needed a warrant to call 911 from the cell phone there could be implications for the dublin home invasion case and could endanger a potential case for the valejo kidnapping. home invasion victim is not a party in the case but her attorney told abc 7 news he recognizes the implications the motions could have. by phone it was said i'm glad the right person was

apprehended. it would be tragic if the case is dismissed on a technicality. while clever this argument ultimately has no merit. at issue is whether detectives making a 911 call to obtain the phone's number qualifies as a search of the phone. and people are walking out of court right now. we will find out what the judge decided if the judge made a decision on that. we will bring you the latest at 6:00. some new federal documents including a federal warrant was filed on friday. the documents reference another reporter's interview with suspect matthew muller while he was in jail. he believed the interview was not recorded. in it he said according to the documents that he acted alone and he also suggested that some of his mental illness may have been a result to a side effect to a vaccine. we will bring you the latest at 6:00. melanie woodrow, abc 7 news. >> two very complicated cases.

a tense situation in baltimore today. >> we are tired of the same old things! >> protesters block the street outside the courthouse where there was a hearing for six police officers accused in the death of freddie gray. officers arrested one man. the judge refused to dismiss charges. gray died while in police custody on april 12th a week after suffering a spinal cord injury. his death led to protests and a riot. more than 100 investigators are on the ground for a second day searching for three suspicious men thought to have shot and killed a police officer in illinois. marcy gonzalez has the latest. >> reporter: officers trying to track down the gun men who killed one of their own as residents in the town of fox lake nervously wait for their capture. >> i am shaking. i am honestly shaking.

>> reporter: lieutenant joseph gliniewicz was shot to death yesterday morning as radioing in. >> pepper spray, shots were fired. >> reporter: the vague description he gave only saying two of the men were white and one was black is still all investigators say they know about the killers explaining they're scouring surveillance video from the area looking for any sign of the men and relying on the public. >> all it takes is one tip or good lead to break the case wide open. we are vetting through those. we have hundreds of those coming in. >> reporter: gliniewicz, a father of four and army veteran has been on the force for 32 years and was weeks away from retirement. today attorney general loretta lynch sharing her condolences and her concerns about what she describes as an uptick in

violence across the country. >> it is a sad fact now that no one is safe. >> reporter: investigators in illinois say evidence collected from the crime scene is being promised. they explain it will be at least a day before they know if the killers left behind finger prints or dna. marcy gonzalez, abc news new york. two new jersey daycare workers are accused of starting a fight club with children. investigators say the two now former employees of the daycare reference the movie "fight club" as they encouraged preschoolers and kindergarteners to fight each other on the playground. prosecutors say one worker used snap chat to send clips of disturbing fights to a group of people. >> unbelievable. that's unbelievable. >> she was very nice but you don't know anybody really. >> about a dozen children boys and girls between the ages of 4 and 6 just fighting, throwing each other to the ground,

massachusetts authorities plan to keep cape cod beaches open despite a rash of shark sightings. they have seen as many sharks this year as all of last year. marine biologists track nearly 23 of them in a ten mile stretch on monday alone. a few weeks back the atlantic white shark observancy captured this amazing video. they have never seen that before. >> seals are right along the shore line which would draw the sharks in very close. >> i wouldn't get any closer than i had to. >> want to point out there haven't been shark attacks at the summer at the cape. the sightings are prompting life

a smart stethoscope developed at uc berkeley can be used by doctors. as of today the device is now

that we may finally have an actual hiv vaccine. more than 600 patients have been on the drug about three years now and none have tested positive for hiv. abc 7 news reporter lyanne melendez is in the newsroom with the exciting results. >> reporter: the results of those first clinical trials showed it was effective in way more than 90% of patients. since then kaiser has been giving the drug to its patients for more than two years with even better results. >> this medication can be used to prevent hiv. it works. >> reporter: dr. jonathan vulic put patients at risk for hiv on a daily regiment of a drug trrks ruvada proved to protect a vast majority of people from hiv infection. >> it is wonderful to have less worry about hiv.
