police rushing to investigate. the scary moment and the serious safety questions this morning. and good morning, america. boy, that was a real scare at the u.s. open last night. let's take a look again. you see that drone flying over the stadium before it actually lands in the stands, and these days you just can't be too sure about what's on that drone. it really did have everybody hold their breath for awhile. we're going to have a lot more on that ahead. we begin with that breaking news for our viewers in the west, a manhunt under way right now after a deadly shooting on a college campus in sacramento. one student dead. two injured. abc's aditi roy joins us with the latest. good morning, aditi. >> reporter: good morning, amy, this morning sacramento city college with 25,000 students in shock as the gunman remains on the loose. a frantic manhunt is sacramento this morning. >> subject shot behind the baseball field. we're getting duplicates of sounds of shots fired in the

area. >> reporter: after an on campus shooting at sacramento city college leaves at least one student dead, two others injured. the gunman firing in the parking lot near a baseball field. the shooting began 4:00 p.m. west coast time, the school notifying students by text as classes evacuated one at a time. >> police officer knocked on the door and told us all that we were evacuating the building. >> reporter: the campus placed on lockdown. >> just block people out of the campus right now, lockdown. >> reporter: the hunt for the gunman continuing. police describe the man as a pacific islander with short, dark hair, the motive not known. as for the wounded, one in serious condition but expected to fully recover, the other, grazed by a bullet but expected to be fine. george. >> thanks very much. now to that county clerk in kentucky jailed by a judge after she refused to issue marriage licenses to same-sex

couples and said it would violate her religion belief. the judge said it was her duty under law. alex perez on the scene in kentucky. >> reporter: good morning. those who sued davis were only seeking to have her fined, but the judge didn't believe that would be enough to get her to comply so he put her in jail. this morning county clerk kim davis waking up behind bars, transferred to jail, a federal judge finding her in contempt of court after refusing to issue marriage licenses to same-sex couples. marriage equality supporters erupting in cheers. davis saying in testimony thursday, "my conscience will not allow me." >> under whose authority are you not issuing licenses? >> under god's authority. >> reporter: the controversial clerk citing religious objections has been denying licenses since june when the supreme court legalized gay marriage nationwide. david ermold and david moore refused in july. >> they needed to give us the application. >> reporter: again in august and one more time this tuesday. >> you absolutely have disrespected us. >> reporter: one of the couples that sued davis now preparing to

wed. >> tomorrow as a couple it'll be a very important day in our lives. >> reporter: on the campaign trail several gop candidates supporting davis from rand paul -- >> i think it's absurd to put someone in jail for exercising their religious liberty. >> reporter: to senator ted cruz to former governor mike huckabee using the #imwithkim tweeting "we must defend religious liberty" asking supporters to sign a petition freeing the clerk but the white house also weighing in. >> the success of our democracy depends on the rule of law and there's no public official that is above the rule of law. >> reporter: davis' deputy clerks have already started issuing marriage licenses, a gay couple, one of the first to get their license, this morning. george. >> thanks, alex. more on this now from the lawyer for kim davis, matthew staver. i understand and respect her beliefs here and her conscience but when a public official's conscience conflicts with the law, doesn't that public official have a duty to resign? >> well, she's elected by the

people, and if the people want her to resign, then the people can ask her to resign, and they haven't done that. in fact, she's a very well-liked individual in that community. you know, just a year ago the attorney general had a conscience conflict with defending the marriage laws and the governor of the state of kentucky accommodated him and allowed him to step down from defending that case and they hired outside counsel for several hundred thousand dollars to protect his conscience rights and that's fine. kim davis is asking for something that doesn't cost anything and she's not the only one. there are lots of clerks in kentucky that have the same conscience convictions and they have just one request, just remove our name from the official licenses. you can have the commonwealth of kentucky, that's fine, they'll record it, that's fine. just don't affix their name and title to a marriage certificate that collides with their religious beliefs. >> another fix is that the deputies can sign the marriage licenses. that's expected to happen today. if that does, indeed, happen, do

you expect that the judge will release miss davis? >> no, i don't think he will because, in fact, it's the same thing for kim davis. it still has her name on it. yes, the deputies can -- they did not want to originally, but then the judge brought them in and threatened them with jail time, as well, so five out of the six said they would issue the licenses but it doesn't remedy the situation for kim or anyone else because it still has kim's name on it. one thing about kim, she may be incarcerated behind the jail bars, but her conscience remains free, and just knowing kim, she's made a decision and she can't violate that conscience and she can't have this collision with her religious convictions. i think she represents lots of clerks in kentucky, lots of clerks around the country, and i think there's going to be some effort to change and protect kim's religious freedom and many others like her. >> how long is she prepared to stay in jail? >> she will not violate her conscience, so whatever the consequences of that is, kim davis doesn't want to be in this situation, but she's prepared to face whatever it is. >> mr. staver, thanks for joining us this morning.

>> thank you. my pleasure. >> unclear if it'll come to that, but the judge has the ability to hold her in jail for up to 18 months. >> wow, significant. i'm sure we'll be following that and i'm sure a lot are watching that around the country. also a lot watching the weather. holiday weekend weather. the west feeling the effect of that newest tropical storm and out east, the heat is making a comeback, ginger, no. >> very brief reprieve and then a comeback. we'll get to that but first the strong storms rolling across the desert southwest. stunning pictures of those dust storms. about 4,000 without power so not the strongest that they've seen this week but certainly something that you could see more of, not only today but tomorrow thanks to tropical storm kevin, not that it's going to make landfall, it's going to turn away from cabo, but it will surge enough moisture into the desert southwest that we could see more flash flooding, gusty winds and dust storms. so many of us going to the beach and look at this. rip currents were a problem last week in huntington and took the

thought, vice president biden gave this heart-felt response. >> the most relevant factor in my decision is whether my family and i have the emotional energy to run. >> reporter: biden dismissed other factors including fund-raising and whether or not he could take on hillary clinton. >> it's not the factor. the factor is, can i do it? can my family undertake what is an arduous commitment that we'd be proud to undertake under ordinary circumstances, but the honest to god answer is, i just don't know. >> reporter: the biden family is still coping with the death of son beau biden to brain cancer in may. in his final days, beau reportedly urged his father to run. >> i can't look you straight in the eye and say now, i know i can do that. that's as honest as i can be. >> reporter: biden is expected to take at least a few weeks to make this decision but, george, after those comments last night, it is now more clear than ever why at this point he truly is undecided. >> yeah, you can see it. boy, his demeanor so striking

there, jon. now, he said hillary clinton not a factor, but is she still facing those e-mail questions? one of her top aides testifying on capitol hill yesterday. >> reporter: yeah, and there's no question that it is a factor as far as those close to him. they look at this race, they see that hillary clinton with all the problems dealing with her e-mail issue is clearly vulnerable. they believe she is clearly beatable in a democratic primary and that is the case that they are making to democrats as joe biden makes this decision. >> okay, jon, thanks. we're going to turn to the republicans now. a new move from donald trump reversing course now signed a loyalty pledge to the republican party ruling out an independent run for president. promising to support the gop nominee even if it's not him. abc's tom llamas has been tracking the race and joins us now. >> reporter: good morning. all 17 republican candidates have now signed that pledge. trump says there's no scenario where he leaves the republican party to go rogue. this as an interview with a conservative talk radio show host didn't go exactly as planned. this morning, donald trump's going from this --

is under way as hundreds of middle eastern refugees seeking a better life in europe are demanding to board trains for germany but they're being stopped and forced into camp. some including women and children, look at these incredible images, are blocking railroad tracks in a desperate protest. abc's alex marquardt is in hungary which has been overwhelmed by this crisis. alex, good morning. >> reporter: good morning, paula. some very dramatic scenes. this is essentially a standoff between what may be more than a thousand syrian refugees on this train and these police forces that won't let them go further. you can hear them chanting, freedom. refusing to be taken to nearby refugee camps and demanding that they be allowed to proceed to germany. this morning, their message is clear, but they will not budge, desperate to go on. >> the situation is so bad. >> reporter: the greatest refugee crisis since the second world war. thousands of refugees risking their lives crossing the mediterranean sea, they're taking extraordinary chances

like packing themselves into airless trucks. just last week more than 70 syrian refugees suffocating to death in austria. and what may be the lasting image of the world's failure to end the war in syria, the heartbreaking photos of a 3-year-old syrian toddler drowned on a turkish beach as his family tried to reach safer shores. these tragedies fueling calls for action from around the world demands the european leaders do more. just this morning british prime minister david cameron whose country has taken in very few syrian refugees saying they will now accept thousands more. paula. >> yeah. acquiescing to that pressure, alex, thank you. and back in this country overnight, a big welcome home for an american hero. spencer stone arrived to cheering crowds in california. stone, if you remember, was one of four americans who helped stop a terrorist attack on a train in france just last month. sacramento will throw a parade in their honor on september 11th. we do have big news about the economy this morning. 173,000 jobs were created last month. that's the weakest number in five months but enough to help lower the unemployment rate to

5.1%, the lowest in seven years. the fed will be taking these figures into consideration as it determines whether or not to raise interest rates. the plunging price of oil means big savings at the gas pump. this holiday weekend, drivers will be paying the lowest prices in 11 years with prices dropping as much as seven cents overnight. and in indianapolis a scare at the colts game last night. three fans were injured when a bolt fell from the retractible roof as it was being opened. we are told, however, their injuries are not life-threatening. finally proof that if you work hard you can accomplish just about everything. even if you're only 4'5" and you want to be a high school football star. check out adam blazing trails on the football field for the nationally ranked american heritage school's varsity team. adam, you guys, is only 4'5". he weighs 95 pounds but because of his hard work and determination, the 17-year-old made the team standing tall.

>> that will cause a halt in play for a moment. >> reporter: the match coming to a temporary standstill while police rushed to the stands to investigate. shaking both announcers and the players. some even thinking it was a bomb. >> can we continue? >> reporter: the man allegedly at the controls, 26-year-old daniel verley, an off-duty employee of new york city's department of education, arrested early this morning charged with reckless endangerment and violations related to flying the drone. no spectators were injured. the match eventually picking up again with pennetta winning. >> congratulations here at the u.s. open, flavia pennetta, everybody. >> reporter: but this breach in security now raising serious questions. for "good morning america," t.j. holmes, abc news, new york. >> our thanks to t.j. and now to a love triangle that turned leddy. a texas doctor about to stand trial for a second time charged with masterminding a plot to kill his romantic rival. abc's linzie janis is here with that story. good morning, linzie. >> reporter: good morning, amy. it is like a plot out of a tv drama, and it has captivated texas.

now the surgeon charged with murdering a fellow doctor over a woman is back in court after his first trial ended in a hung jury. >> hello, i'm dr. mike dixon. >> reporter: prosecutors say amarillo plastic surgeon dr. mike dixon seen here in his own tv commercial hired a hit man to kill prominent pathologist dr. joseph sonnier in a love triangle turned deadly. richelle shetina dated sonnier for a year before ending up in a relationship. that infuriated dixon, prosecutors say motivating the plastic surgeon to hire david shepard to murder the pathologist. >> somebody has broken a window in the back and the doctor did not show up for work today. >> reporter: sonnier's body found in his home shot and stabbed in july 2012. >> one of his co-workers went in the house, and he says it's not good. >> reporter: shetina told police that dixon insisted on seeing her even though she continued to

date dr. sonnier. but in november last year, a judge declaring a mistrial after jurors failed to reach a verdict. >> call my office for a consultation today. >> reporter: now dixon back for a new pretrial hearing. prosecutors alleging dixon paid shepard in three silver bars worth $9,000. the hit man shepard allegedly confessed to the crime in 2013 but dixon's defense is attacking the credibility of that confession claiming shepard admitted he was insane. george. >> boy, a lot of twists in that story. okay, linzie, thanks very much. we turn to that legal drama for tori spelling. she's suing benihana restaurant, the popular chain that cooks at your table on those hibachi grills. she suffered a bad burn after tripping and falling on one of the grills and abc's kayna whitworth has the story. >> reporter: this morning, tori spelling is lighting up a legal battle with benihana restaurants for a dinner experience she says left her badly burned. the 42-year-old "90210" alum filing a lawsuit against the

japanese hibachi chain after she slipped and fell on one of their grills this easter. according to court document, spelling sustained deep second and third-degree burn injuries requiring hospitalization and surgery. she's now claiming she suffered general damage and wage loss. >> the real question comes down to, did the restaurant create some kind of dangerous condition that caused her to slip or to fall or to trip, therefore, sustaining the burns on her arm. >> reporter: the mother of four's injuries so severe she reportedly had to get skin grafts. in this photo you can see the burn marks on her arm. and in other photos the wound covered with bandages and sleeves. her husband telling "extra" in april she was recovering well. >> she's recovering, she's doing pretty good. she's just at home resting. >> reporter: the restaurant's famously close proximity of diners to the flaming open grills even parodied in the 2014 movie "alexander and the terrible horrible no good very bad day."

♪ and it's a little after 7:40 and we're back now with "gma investigates" and the dangers of ebay. 25 million people are signed up to sell on the site and if you're one of them, your personal information may not be as private as you think. abc's rebecca jarvis here with the details. good morning, rebecca. >> hi, george. good morning to you and just by listing something to sell on ebay, potential buyers have access to a whole lot of your personal information. we were shocked to find how surprisingly simple it is to

track down a seller's full ne, city and state, even their phone number in a matter of seconds. ebay, it's the online marketplace for 25 million sellers, but did you know when you signed up, you've allowed them to give out your personal information to your bidders. "gma investigates" finding that any bidder on an item can request and receive in a matter of seconds a seller's full name, city and state and phone number. >> it's already too easy to get information on people and why make it even easier. >> reporter: so just how easy is it? we place bids -- i'm just going to request it for $1 -- on a handful of auctions and completed this simple request on ebay's website asking for seller contact information. there it is. i have a name, a city and a phone number. one of those people we requested

information for, ebay seller anita. did you know when you signed up that they could do this? >> no, i did not. i thought they protected your information. >> reporter: in ebay's terms and conditions, it says they can do this and the company points out the information is meant to help communication between sellers and buyers. and while ebay doesn't release seller's addresses, using anita's name, phone number and city, it took us under a minute to find her address online. now somebody knows where to find you. >> that doesn't feel very good. i have a family here. i'm doing this to make extra money for my family. >> reporter: ebay notified anita after they gave out her information. at the same time also providing her with our info, but cybersecurity expert adam levin says a scammer or thief could use fake information in their profile to try to get your info. >> a process like this is an enabler for bad guys even though it wasn't designed to be. >> reporter: we reached out to ebay. hi, this is rebecca jarvis with abc news. they declined an on camera interview but tell us of the

excitement coming up in "pop news." right now we have to get the morning rundown from paula faris. >> good morning. the big story this morning, the standoff over same-sex marriage in kentucky. county clerk kim davis who has refused to issue marriage licenses, she spent the night in jail. davis' husband says his wife will not resign and stay in jail as long as it takes. she says same-sex marriage violates her religious beliefs but today most of her deputies are promising to follow the judge's order and hand out the licenses while she remains behind bars. and overseas hundreds of refugees stranded at a train station in hungary are vowing to make their way west on foot if they have to in search of a better life. the refugees mostly are from syria. they're angry they're not being allowed on trains to germany. today the british government is giving in to pressures saying it will accept more of those refugees. and vice president joe biden says he has not decided yet whether to run for president. speaking at a synagogue in atlanta last night, biden said it's going to depend on whether he and his family have the, quote, emotional energy for it

and he said he's just not sure yet. and a terrible ordeal for a family in florida after their home was treated for termites. their young son is now in the hospital unable to speak, unable to move. abc's reena ninan has more on what went wrong. >> reporter: this morning 10-year-old peyton mccaughey hospitalized suffering severe brain damage and unable to move his limbs. >> life as he'd known it has been stolen from him. it's not going to be the same. >> reporter: mccaughey's family says they hired a terminix pest control subcontractor to fumigate their florida home. but within hours of returning to the house on august 16th after they say they were told it was safe to re-enter, the mccaugheys fell ill. >> he was, you know, having some uncontrollable muscle movements. he couldn't stand up. he couldn't speak. so they took him to a local walk-in and the doctor quickly recognized it was probably a poisoning from the treatment.

>> reporter: the family has now hired a lawyer to help get answers from terminix about the incident. overnight terminix telling abc news, "we are saddened to learn of this and our hearts are with the family. we are carefully reviewing the matter." earlier this year a delaware family was poisoned after being exposed to toxic pesticide while they were on spring break in the virgin islands. back in florida little peyton, who turned 10 on thursday, is out of the icu and expected to be moved to rehab soon to continue his recovery. for "good morning america," reena ninan, abc news, new york. >> we wish him the best in his recovery. thank you, reena. and a major recall of sliced cheese is now being expanded. more than 330,000 cases of kraft singles are being recalled. ten times more than first announced. the thin strip of wrapping, it can stick to the cheese posing a choking hazard. we're going to have more details on our website. and just weeks after coming under fire for its sunscreen, jessica alba's product line is now facing a lawsuit. her honest brand is accused of deceptive marketing allegedly using synthetic ingredients in soap, cleaners and other

♪ i know you lie welcome back to "gma." time for the "heat index" and this morning's hot button, parenting alert about kids keeping secrets on their phones hiding photos and texts behind apps that appear to be innocent. abc's mara schiavocampo has this story. >> reporter: so-called secret apps, the latest way kids are hiding things from their parents as louisiana mom kristen learned firsthand. >> they can do anything they want and it's all locked with a pass code. >> reporter: kristen, who keeps a close eye on her son's phone, says she was shocked earlier this year to find the 16-year-old installed an app that hides media like texts and photos. >> i'm almost hurt when things like that are found out. i worry about him. >> basically i was hiding from my parents, and it was stupid, yeah. >> reporter: so how do these cybersecret keepers work? >> so this looks like an ordinary calculator app for the iphone.

>> reporter: "yahoo tech" magazine editor in chief dan tynan gave us a demo. >> you tap it. it looks like a standard calculator. in fact, it is a standard calculator, but when you enter the secret password that your child created and hit the percent key, now you have a photo album. now, there's pictures hidden in here that your child didn't want you to see. >> reporter: apps like these becoming so popular, a county district attorney in alabama sent out a warning to parents. >> you and i know if one child knows about it, many children know about it, so take a minute, grab that phone. >> reporter: and some parents we spoke to weren't too happy about it. >> surprise. i'm shocked. >> it's very scary to me. to think about it. >> it would be upsetting to me especially if the child was younger. >> reporter: experts say you can keep your kids from these apps by turning off their ability to install apps without your approval. >> the problem with these apps is they allow kids to hide their cyberlives from their parents and sometimes the things they're hiding can harm them. >> reporter: secret cyberlife exposed. for "good morning america," mara schiavocampo, abc news, new york.

>> that's an eye-opening one right there. let's talk to our parenting expert, ericka souter. it's tricky. when you first hear about this, you want to be able to trust your kids. so how do you approach them to find out if you can trust them? >> well, ideally you have had this conversation before you've given them the phone, but if that ship has sailed, it's not too late. you want to set down some ground rules. number one, they should know that having this phone is a privilege and not a right. and, number two, you are going to monitor what they do, what apps they put on, what kind of communications they're having and, number three, if they do something wrong, that phone is gone. >> yep. >> right. well, that's number one in ours, but you're saying you always have the right to take the phone back. >> you should always have the right to take the phone back. >> my daughters say i have opp, old people's problems meaning i can't navigate their phone. how is someone like me supposed to be able to tell that's a fake app? >> right, well, it's pretty easy. what you want to do, go get their device and go to the app store, right, on their phone and then after you go to the app store, you want to go to the search function, and then you want to type in a phrase like private photos or hidden photos

or secret photos, and that will yield -- like we chose private photos, and that yields over 1700 apps -- >> oh, my goodness. >> 1700? >> -- that could possibly help your child hide things on their phones. but then you take a step further and if you see the word open, that means the app is up and running on your kid's phone. that's an alarm bell. >> if you do find these on their phones, how are you supposed to handle it? i know you said you have to treat it like a privilege, not a right. >> remove it right away. there's no question. sit down and tell them why they should not be hiding things from you. if that conversation is not enough, if you still don't trust your child's judgment, consider installing software, watchdog software like net nanny that helps you monitor their photos and texts and everything they're sending on their phones then lastly, if they are doing something wrong, give an appropriate punishment. take away that device. >> yes. >> you're the parent. whatever will get the message across. >> it's the most effective discipline, far and away. >> oh, it is.
