of what have you done for what will you do for me lately. >> first thing i think about. >> reporter: aldon smith, the 49ers turned raiders dominates with his pass rushing and he dominates headlines, too, after a multi-game suspension last year for substance issues plus a total of five arrests, including the latest on august 7th, for charges of hit-and-run, driving under the influence and vandalism. after that the raiders have signed him. 12 floors up, the court of public opinion debate like a jury divided. in san francisco, among the questions? >> whether or not he should still be on the niners. whether or not the niners have put themselves at a worse position by using the phrase, "win with class". >> he was going to play again whether it was with the raiders,

the 49ers or the st. louis rams. he was going to play. >> well, the gms don't operate with with morals, it's the gm that wins that keeps his job. >> the 49ers, now with the raiders, his contract it valued at $8 million a year, which is a lot more than many make in their lifetimes. it appears there are second chances. >> aldon is a grown man, whatever he has to deal with. i'm sure he will deal with it. i'm not a baby-sitter, and i don't think anybody expects anybody on his team to be a baby-sitter. only thing we expect is that he comes in and works hard. >> back live at raiders quarters in alameda, it is worth noting that even though aldon smith has a new job, his legal problems are mounting.

the santa clara district attorney says he will be charged with misdemeanor, not only for hit-and-run but also for driving under the influence. he will appear in court next month. >> thank you, wayne. well, our resident expert is here, larry, how surprising was this move and how will it manifest itself on the field? >> this is stunning because it comes two days before the start of the regular season and also because aldon is going right across the bay. but we said before he was cut somebody would give him a chance. he is an all-pro layer, he will have a chance. i'll steal a remark that liam e neeson said in the movies, if aldon had played decently he will play a handful of snaps.

in previous situations where he came back he had 20 to ten snaps. >> we're talking about his legal problems, couldn't he be suspended? -- >> he could possibly play four games before the judicial system rules on this. where it gets unclear is trying to figure out what the nfl will do. is the league going to wait until october 6th and the judge decides what happens. and when the niners cut aldon, smith, he is not only a repeat offender, he is a repeat, repeat, repeat. i mean, this goes on and on. but in the wake of tom brady winning his case against the commissioner, roger goodell, we don't even know who is handling the discipline right now in the nfl. the league is in limbo, and that could work in the raiders' favor. one thing is that the 49ers were

vilified during this whole saga for giving him chance after chance after chance. but all we hear from the raiders today is we just got an all-pro player. this is unbelievable, and you were looking at the facebook page, is this guy really healthy or cured. are his problems behind him? will it help his situation in the long run? we'll see, meanwhile, aldon smith is now a member of the oakland raiders. >> wow, this is generating comments on facebook, more than 100 shares on this story, a particularly poignant comment i'm reading. we do want to know what you think, go ahead and weigh in on abc 7. and just moments ago the state senate voted to make california the fifth state to allow terminally ill patients to end their lives. this comes of course after the

death of 29-year-old brittany maynard last year. she had terminal brain cancer and moved to oregon where she could legally end her life with medication. well, the bill moved to governor brown's desk and he has not said if he will sign it. and san francisco want to find this video of two officers joking about shooting a suspect. they talked about body cameras, what they would want captured and what they wouldn't want captured. they laughed when they talked about what it would look like if somebody was shot. the chief says these officers could face punishment. >> the officers are expected to model a conduct and be that of the -- set an example for the public, especially children. >> this is what police officers deal with on a daily basis. and it's -- it's unpleasant sometimes what we're forced to encounter.

and the general public doesn't always realize that. >> just a portion of the video was posted on instagram. police hope to get the unedited version to understand the whole conversation. right now the san francisco police do not use body cameras but the department is working to get them. and we have an update for you. the fire in amador has scorched more than 50,000 acres in just the past 48 hours. take a look on your screen. the governor has declared a state of emergency in both counties. mandatory evacuations are in effect. 6,000 structures are currently threatened. officials say the flames are quickly growing because of the extreme weather conditions there. the fire only 10% contained, down from 20% yesterday. and turning to our forecast, everybody is talking about the heat we have been experiencing. looks like there could be cooling just for the weekend.

center alone. >> mark bingham. >> they remembered the heroes of united flight 93 in shanksville, pennsylvania, mark was among the passengers who tried to regain the plane bound for san francisco. and the flag was unfurled at the pentagon as well where 184 people lost their lives. remembrances were also held in the east bay. >> reporter: on 9/11, the terrorist attacks came before many people were awake on the west coast. early this morning several officers from the navy recruiting district san francisco gathered at the flight 93 memorial in union city. they held a moment of silence at 5:45 a.m. when the first world plane hit the world trade center. then, another moment of silence for when the second plane hit. the military men and women then

>> they are sacramento born and bred. they are our own, today, they have their chests puffed out a little bit. >> the trio was given france's highest honor of bravery before they left paris. >> it has been more than three months since the balcony collapse took the lives of three young students, one of them a student from ireland. >> for the first time, others shared their feelings of what is often called survivor's guilt. david? >> reporter: natasha and larry, nile murray doesn't recall falling 50 feet from the balcony, but does remember being put on a gurney by first responders. the purpose was to give 21-year-old nile murray to thank publicly all the doctors and

nurses who have been treating four of the seven students who survived after the balcony collapse in berkeley. but it became apparent that murray also needed to share private moments about that night, when he survived when others died. >> i felt quite guilty. and along with the others here today. >> another survivor, hannah waters, sat quietly listening to murray. the group had come to the u.s. to work and pay college expenses. murray has had seven surgeries, including a transplant to save his finger, he suffered a broken wrist, heel and elbow, along with three fingers. >> it has been life-changing, the support from the irish community and all the people we met who we would not have met in other circumstances. >> murray is one of six siblings, they will return home to dublin next week.

>> obviously i would do anything to change what happened that night. with the flashbacks and the people on the balcony. >> it may be months before he can put full weight on his heel. he is recovering well. >> he is discharged from the rehab center. and i think his prognosis for walking is quite good. >> murray says his next challenge will be overcoming a fear of balconies, in san jose, david louis, abc 7 news. and the headset problem during the game last night with the steelers was its problem, not the patriots doing. others remain suspicious. the coaches for the visiting steelers could not communicate with each other for the first half of the game. instead they heard the patriot' broadcasts, wonderful. the league in charge of the headsets say it was an infrastructure problem made worse by the wet weather.

in a post-interview this is the best moment of her life. serena, who was going so well just kind of fell apart in the second and third sets, trying to become the first person to capture all four grand slams in the same year since steffi graph. >> i thought she would do it. >> she was a 300-1 favorite in this match. nobody expected her to lose this match, and she woke up this morning saying there is no way i will beat serena, she said she had no prayers. >> that saved her life. >> and spencer christian joins us with the accuweather forecast and a bit of a cooldown. >> yes, natasha, a bit of a cooldown. certainly a welcome one, we can feel the cooldown except in places like livermore and antioch. a few high clouds, a gentle breeze continuing to build from the coast out over the bay.

and here is a look out over the bay. this is the forecast features. we'll see coastal clouds continuing to develop. not quite so hot. but muggy this weekend. with an increase in humidity. next week will feel like fall which is not far away. the ridge of high pressure has dominated our weather picture the last few days, beginning to move east now and opening the door for a bit of a cooldown, which again has begun already. it is also allowing some energy from what was tropical storm linda to move into the area. by energy, i mean high clouds and moisture streaming up from the south. so it will be more cloudy and muggy. but it will be a lot cooler, as well. that is welcomed relief. by the way, overnight saturday night into early sunday morning there is a slight, slight chance of showers. but not much of a chance, then it will become more sunny on sunday afternoon. we'll have a look at what we can expect tomorrow. a bit of an onshore flow continuing, high temperatures dropping only into the low 90s

in the warmest inland areas. similar picture on sunday. the onshore flow strengthens on monday, further cooler weather next week. overnight, fog over the coast moving out locally over the bay of the mild with low temperatures only dropping down to the low-to-mid 60s in some inland spots, upper 50s right around the bay and on the coast. then tomorrow, hazy sunshine, high clouds, fog at the coast, high temperatures ranging from mid-60s at the coast, some spots along the bay will hit low 80s. and we'll see low-to-mid 90s in the warmer inland locations. the accuweather seven-day forecast by monday we'll probably not see any 90 degree readings in our inland areas. certainly no triple digit readings. the pattern of mid-80s, mid-70s around the bay will hold all the way through thursday. then we get a slight warmup at the end of the week. much more comfortable weather is coming our way. >> that is good.

clara county district attorney from filing three misdemeanor against him. the charges were related to his arrest last month in santa clara. smith is charged with dwi, hit-and-run and vandalism. and the police department is looking into a graphic conversation by two officers. they were discussing shootings about two body cameras. now, the discussions were about a diner or restaurant. abc reporter vic lee will have more. and today marks the 14th anniversary of the september 11th attacks, our abc reporter is there in livermore today. she will have more coming up at 5:00. and on this 9/11 anniversary, emergency training exercises are being held in the bay area for the annual urban shield event. it helps first responders and the community deal with possible terror attacks. but there are critics, a protest is happening right now. abc 7 news reporter laura anthony has more from oakland with the story.

laura? >> reporter: hi, natasha, let's show you the protest going on right now, at 14th and lakeside drive. these folks out here loud and clear blocking the intersection to some extent. they are letting traffic through. now, while police and first responders attend the event in pleasanton, the demonstrators are here at the alameda county sheriff's office in oakland saying that the bay area does not need this. in its ninth year, urban shield is way under way at the pleasanton fair grounds at an event that draws police and first responders from all over the bay area, as far away as korea. >> right now we have tactical bags that don't appear tactical, so as not to give away the identity of the officer. >> and pull over, they may have access to their firearms. they open it all the way to show

news. and marin county public works spending the day cleaning up 300 gallons of paint that spilled in the creek. the big rig had slipped sideways down the embankment. the chp had closed the area. and overseas, the collapse of a construction crane at mecca's grand mosque. the death toll now has been raised from 87 to at least 107 people with at least 150 people injured. most of the casualties were pilgrims streaming into the city for the annual pilgrimage that begins later this month. and injured while escorting vice president joe biden's motorcade. the officer crashed while trying to turn at high speeds. he was taken to the hospital. it is not known if he was badly

hurt. the secret service is investigating. and meanwhile, the vice president himself still has not decided whether he will run for the democratic nomination. but a new poll out today may sway his decision. the cnn survey shows biden with solid leads in a matchup with donald trump and others. he hesitated last night on the late show with stephen colbert. >> i don't think any man or woman should run for president unless number one they know exactly why they would want to be president. and two, they can look at the folks out there and say i promise you, you have my whole heart, my whole soul. my energy. and my passion to do this. and i would be lying if i said i knew i was there.

>> doesn't sound as if he is sure. and today we learned that governor rick perry is dropping out of the race. he struggled with low poll numbers and low fundraising. his campaign lasted just 97 days. and we're now hearing from people who were hostages, an l.a. county sheriff's department shot and killed the man who was wanted in a carjacking and led police on a dangerous chase before running into the restaurant where several people were having dinner last night. >> he was very willing to let people out. but he was focused on keeping people in, because he wanted some type of leverage. >> made me feel like i had no control in the situation. and i think that is what scared me the most. he kept saying, i'm sorry. so he was apologizing, he said i have kids at home. >> really scary situation. nobody else was hurt. the coroner took the gunman's body away this morning. wow, still ahead on abc 7

houston, you remember the warriors and rockets played, they had major flooding back then. so 2015 has been kind of challenging for them. >> challenging for them. when we see pictures like that we think is that what el nino is going to look like -- >> right now there is a powerful el nino building. should it live up to its potential it could dump heavy flooding in the bay area. we'll have to wait and see. here is live doppler 7 hd, high clouds above. across the 48 states tomorrow it will be mainly the east coast that is under the threat of thunderstorms and partially the great lakes. the remainder will be under calm and relatively quiet conditions. warm in the interior sections but not nearly so hot as earlier in the week. chico may top out at 100, 90s in many other locations where we had seen 105 or higher earlier in the week. and that plays to the bay area,

fire in east sacramento exploded in size. the butte fire is at 50,000 acres and only 10% contained. reporter dave marquis has more. >> reporter: the fire swept by powerful, erratic winds. >> the stuff that a lot of people don't see in a whole career. >> reporter: crews are forced to take shelter in a meadow. >> it had all gone well, and then all of a sudden a shift in wind and the fire starts to breathe and suck in air. and the winds went from fairly calm to probably 30 or 40 miles an hour. >> it was scary. i can't put it into words. >> reporter: as crews waited in their safety zones, these two were running in the inferno. >> we were running in to get the animals out of the way. and a couple of embers jumped into the road. >> flames everywhere. we couldn't get out in time with our vehicles. that is about it. yeah, i mean, it's a scary

thing. >> in a stroke of lifesaving luck the two brothers ran into a cal-fire crew. >> they gave us water and did everything to help us. >> reporter: the brothers escorted to the meadow as flames covered everything. >> they gave us water and food and just about that time we had a wind shift and we had fire all around our safety zone. >> they led us down here, so they were amazing. >> reporter: a home burns just above the meadow, one of them impossible to save. leaving the crews helpless in a windswept sea of ash and fire. for these brothers, a lesson learned. >> if anything we learned from it to be prepared. >> definitely, save yourself. >> when there was an evacuation notice, there was a reason. >> it was dave marquis joining it. thank you for joining us. abc 7 news at 5:00 begins right now with natasha and dan. >> thank you, the fire you

cal-fire says the mandatory evacuation has grown because of the quote, explosive nature of that fire. the fire is burning in part of nevada in southeast sacramento right now. the mandatory evacuations include san andreas, angel's camp and dozens of other areas. >> and the flames in the sky were in the town of murphy. and cal-fire says there are dangerous high winds and fire. the governor has declared a state of emergency in both of those counties. i'm in for cheryl jennings. and just a short time ago, the california senate approved the right-to-die legislation. last year, brittany maynard became the center of this debate. leanne? >> reporter: well, similar bills
