cancer. she died just a month ago without a chance to end her own life with medication. this was glass in sacramento earlier this year. >> but how it ends, as cancer runs its course terrifies me. >> her husband was watching today's vote from their home. >> it is still painful that i have lost her. it would have been better if -- for me, too, if jennifer had had the death she wanted, if she could have taken a medication very close to the end. >> governor brown has a chance to veto or sign the bill after he receives it from the legislature. if he takes no action in 12 days the legislation will automatically become law. leanne melendez, abc 7 news. thank you, it could be a late night for lawmakers who are just now taking up three bills voting on medical marijuana. they plan to vote on a new statewide bureau that would

oversee everything from the industry, from retail distribution and laws. lawmakers from oakland are sponsoring these bills and also seek to address the environmental damage caused by illegal pot farms. lawmakers passed new regulations for the california public utilities commission. a lawsuit after that 2010 deadly gas explosion in san bruno showed an improper relationship between legislators. the communications would be strict between the legislation and the companies they regulate. now it will head to governor brown's desk for approval. and a construction company has essentially been fired from a long delayed hospital project costing taxpayers millions more than anticipated. abc 7 news reporter david louis has more on the story tonight. david? >> reporter: dan, this is all happening just within the past half hour. santa clara county has been involved in a longstanding

dispute with this construction company working on the hospital bed building behind me. it has all been about delays and getting it delivered on time. now, the county began to post the signs here closing down the construction site, turner construction, one of the longest contractors in the country, has been involved in the delays. the delays have been costing the county some $36 million a year. turner and the county have been in negotiations to finish the project but the talks have apparently failed. >> they're suspended from the project, and again, will terminate on tuesday. we will look for a new contractor. >> what will this mean in terms of you trying to speed up the time table? >> well, we've made it very clear, we expect -- we are going to be strong about the delivery date of this bed building. >> now what this means is an estimated 125 to 200 construction workers will be

turned away monday if they try to report for work. and the county board of supervisors either on monday or tuesday will fire the construction company. no bid process will be involved. the county will take to get the new facility completed as soon as possible. the county has accused turner of putting more attention on the levi stadium project instead of on this project. the county also released a very shocking video which we showed you here on abc 7 news, with a sub-contractor working when there was a steam explosion that almost skalded that worker. so there has been a lot of controversy. and a man accused of spray-painting racist graffiti appeared in court for the first time today. 52-year-old john skinoni charged with one felony count of

vandalism with a hate crime enhancement, also facing 12 misdemeanor. he has been accused of painting no more chinese. there is a growing problem of ra racism, this is something their office will not tolerate. >> we will not tolerate this in the community. this is a very good example of the evidence, otherwise, where we have clearly the racist behavior against chinese. >> with the help of an appointed attorney, skinoni pled not guilty and is expected back in court next month. meanwhile, a san francisco police officer pled not guilty in charges of grand theft and embezzlement. he is accused of using a city car for personal errands.

the iteam saw these google images showing the white van in question parked outside of rodriguez' home. these pictures are used for the investigation. rodriguez will be back in court for a conference the 21st. and aldon smith will get a second chance, but not with the 49ers. he will get the chance with the raiders, you can see a clearly happy smith there. you remember he was not so happy a month ago when the 49ers decided to cut ties at another dwi arrest. we have been through this before. smith has been arrested five times since he entered the league in 2011. raiders talked about how smith can make the most of this second chance. >> he is a grown man, whatever he has to deal with i'm sure he will deal with accordingly. i mean, i'm not a baby-sitter

and i don't think anybody expects anybody on this team to be his baby-sitter. only thing we expect is that he comes in and works hard. >> smith's contract is reportedly worth up to $8 million. the nfl could discipline him any time though after his latest brush with the law. smith was at practice today and we can expect him to play next sunday. and san francisco police chief greg sur investigating two of his officers joking about body cameras showing officer-involved shootings. graphic images of that was posted on social media. vic lee has more. >> well, dan, the chief was visibly upset by what he believes was improper conduct in a public place by two of his officers. now, he told reporters he expects his officers to conduct themselves in his words as ladies and gentlemen with class. >> we're police officers, so we're public figures.

we're expected to maintain the decorum. >> but the police chief does not see decorum in this cell phone video which somebody secretly reported and posted on instagram. two officers were talking about body cams, talking graphically what they wanted the cameras to show and not show during an officer-involved shooting. >> what you want on video is the guy holding the gun -- [ bleep ]. >> in the second clip, the two talk about the body cam recordings, what might happen when the gunman is shot. >> the chief has ordered an investigation. >> this is not the kind of graphic conversation officers should be having. let alone in a public place. >> in my opinion, this is much

ado about nothing. >> martin hallerman is the president. >> two officers having a conversation which they think is private, i don't think it is a problem. >> and he doesn't see it as a violation. >> some of the language as far as blood spatter, it's graphic. this is what police officers deal with on a daily basis. and it's unpleasant sometimes what we're forced to encounter. >> body cams, halloran said, is a popular topic among officers. they could soon be wearing it if the commission approves it. for the first time, one of the seven survivors of the deadly balcony crash in berkeley is speaking publicly about it. nile murray almost lost a finger and injured his heel and elbow.

[ bells tolling ] >> all those names, 40 bay area people who died when united flight 93 crashed during the terrorist attacks of 9/11 were remembered today in union city. the names of all 40 people are etched on those large stones in the park. a ceremony is held each year there now on 9/11. >> where do i go in order to honor and celebrate this day that we've set aside for our people? union city is the only place i'm really happy to be able to come here again. >> earlier a group of navy

officers held two moments of silence at that memorial. one at 5:45 a.m., when the first plane hit the world trade center then when a second plane hit. there is a ceremony going on right now in lafayette. >> reporter: katie? >> reporter: good evening, the ceremony is going on right now. we're located at old tunnel road. you can see the flags on the overpass which spans over highway 24. so many commuters are able to see this display of honor and the patriotism is evident across the bay area. the squeak of the flagpole. the boom of a bell. sounds that still happen with the first responders some 14 years after the september 11th

terrorist attacks. >> you know, the emotion comes back all of these years later. it's something that i think we'll draw on for the rest of or lives. >> many bay area departments sent crews to help with the search. >> our departments sent people to go help with the funerals because there were so many of them and there were not enough people to go to them. >> it's the families. >> bonnie knows well. she lived in pleasanton but comes from a long line of new york firefighters, including her father. a fire chief. >> we lost many family and friends. one i'm thinking in specifically, lost both sons and her daughter that day. yeah, it's a very personal connection for me. >> reporter: a connection felt also by those who promised never to forget. lafayette's flag covers over highway 24, showing that even though we're separated by great distance, we're one nation. >> i try not to think about it.

i'm very grateful that here in california they are remembering. >> reporter: remembering and reminding ourselves. >> to serve others, it's truly one of the highest callings. >> reporter: in the east bay, abc 7 news. >> and they are also honoring the victims of september 11th in san francisco. mayor ed lee ordered flags to be flown at half-staff at city buildings, including the flags at city hall and the one at the city plaza. and mayor ed lee stood here at the memorial. the names of 343 firefighters who died in new york were then read aloud. the flags at all 44 fire stations were lowered at half-staff to honor the first responders. >> and meanwhile, hundreds of volunteers in the south bay did a lot of good remembering 9/11 by giving back to their communities. they were dispatched to

projects, among them >> it's giving back, volunteering, putting some real elbow grease into helping. >> that is terrific, they are also benefitted by the united way in sacramento. >> and there was a celebration for three hometown heroes, thousands lined the streets of sacramento to honor alekskarlatos, and the three tackled a gunman. the three friends grew up in sacramento. mayor kevin johnson said their actions sent a clear message to the terrorists. >> sent a message to terrorists everywhere, as americans, as sacramento natives, we will not

well, we finally know what that sticky goo was in the san francisco bay that killed hundreds of birds. a team of scientists analyzed what showed up on the san leandro coast. they determined that it was something more like vegetable oil. they still have not determined where it came from. the substance was sticky and made it difficult to remove from the bird feathers. many people think the risk of lyme disease is less during the cooler weather, but there is evidence that it could be worse. >> reporter: ira moore found that the beauty of fall comes with something else. >> i had taken the kids out and shown them how we used to rake
