correctional deputies. one was accused of killing michael tryee. the attorney says he was beaten owe badly he couldn't see who was beating him. >> they're beating hip, they say if you want to stop, you have to say i am a [ bleep ]. >> powell is representing reuben garcia. he says two correctional deputies beat him up in july. he was in an interview he complained. >> reporter: powell says this is not what garcia looked like directly after the beating. these photos were taken after his recent jaw surgery. he had a gash, black eye and

broken jaw. >> it wasn't discovered until it manifested in what appeared to be an abscessed tooth. >> reporter: a spokesperson told abc7 news garcia got injured during a fight with another inmate. powell says garcia told them there was an inmate on inmate scuffle, but it was later and lasted 30 seconds. >> he said i already had the blood on my face. >> reporter: in a statement, a sheriff's office spokesperson said our detectives are blocking at the evidence and documents to determine if there were any issues with the original documentation. powell says he will file a civil lawsuit that will name the county, and two correctional deputies. he may be representing additional inmates in the near future. >> you can't discount these

stories. there are too many of them. >> reporter: the attorney told me he is considering filing a march type of claim. he says if he does, it would say that there is some false, or failure in the pattern, practices and policies surrounding the deputies training. in the newsroom, abc7 news. thank you, melanie. a controversial 49er is jumping across the bay tonight. not going to the niners, he's going to the raiders. it's a move that surprised all of us. let's check in with wayne freedman tonight. wayne? >> reporter: for alden smith, this has to be a good day bad day. yes, he got a $8 million job, but found out it's official that santa clara county district attorney is going to charge him with three misdemeanors for vandalism, hit and run and driving under the influence with a prior conviction and that is potentially a big one. behind the closed doors of oakland raiders headquarters,

of skills. they're willing to add him to the roster because if raiders just added a star who can wreck opposing offenses and really annoy quarterbacks. if he gets suspended or a judge decides he's going to go back to jail because of the misdemeanors, then, the raiders won'ting paying. if he plays he gets paid. if not, he sits and raisers don't lose anything. >> this controversy swirling around him, is he going to be able to play? >> we're told he's going to be working out. and he probably hasn't been in pads and helmets, i would think that they could play him 10, 15, 20 plays. he could be a huge asset for the

raiders. this is potential worst case scenario. they have to watch and go across the bay where he gets the situation straightened out. he could be a potential star there. >> if he gets his act together. >> he's going to be highly motivated and may potentially thrive. >> thank you, larry. >> governor brown declared a state of emergency tonight for amador and calaves county. cal fire says it's blowing in all directions. the town of angels camp is under mandatory evacuation tonight. and an order was given and lifted for nearby san andreas.

cal fire says they were forced toechl panned because of the explosive nature of the fire. some businesses have closed for the remainder of the night. the fire is only 10% contained and again, spreading. >> deputies went door to door distributing mandatory evacuation notices for a fire burning six weeks now. it's the rush fire. now, some homes are endangered in the town of dunlap. >> reporter: sheriff deputies were warning residents to evacuate and most were complying. >> we're packed up and have been preparing. we've got the cattle out to the south pastures. hopefully, they can survive the fire, the smoke in this case,

also. >> reporter: while called a mandatory evacuation order, not everybody has to leave. >> yes. grown adults can stay if they want to. if they have children, or infirmed elderly, they have to take those people out. >> reporter: some residents are taking a wait and see approach. >> i'm just going to stay here and make sure my stuff doesn't get stolen. other than that, when i see flames, right there, i'll leave. >> reporter: flames are getting closer. the fire has consumed over 119,000 acres up nearly 10,000 in 24 hours. in addition to residents, the giant trees in king's canyon national park are in danger. >> the fire is making its way toward grand grove. it's one of our

national resources. >> reporter: in squaw valley, abc7 news. next week, one of the larnlest construction companies in the country will be fired from a long delayed valley medical center expansion. santa clara county officials lost the gate of the construction site and suspended the contractor called turner construction. there are 200 workers on the project. if they show up on monday they're going to be turned away. the $300 million facility nowhere near being finished at this point, supposed to open just a week from now. >> they're suspended if the project and we'll terminate tuesday. we'll look for a new contractor. we expect and are going to be definitive about the delivery date of the building. >> a new contractor will be hired without a bidding process. a man was injured on a san francisco cable car today on the

powell-hooid street line when the cable car made a turn. the man was hanging out of the cable car and got his leg caught against a vehicle parked close to the tracks. these are photos from the neighborhood news blog hoodline. the high street line remains closed while police investigate. a man accused of spray painting racist graffiti in san francisco pleaded not guilty today. he faces 13 charges, including felony vandalism with a hate crime enhancement. prosecutors say he spray painted "no chinese" in five locations. police say the public helped track him down quickly. he's expected back in court later this month. a former san francisco police officer pleaded not guilty to charges of grand theft and embezzlement. the i team first investigated ricky rodriguez in march for improperly using a unmarked police car. he's accused of using the car to

run personal errands and gassing up on the city's dime. the i-team found these images here parked outside of his home. these pictures are being used as part of the investigation. a protest against an exercise going on every year in the bay area for a decade. urban shield includes training exercises for first responders and police on how to handle a terrorist, or large scale incident. laura anthony has our story now from oakland. >> reporter: with drums and chants, peaceful demonstrators voiced opposition to the annual arrival of urban shield to the bay area. >> double bang will go off twice. >> reporter: in it's ninth year, urban sealed draws police agencies and first responders, mostly from the bay area but as far as korea. >> we have tactical backs that

. california is one step closer to allowing terminally ill patients to choose how they want to die. abc7 news reporter lyanne is in the newsroom with more. >> reporter: the vote was 23 in favor, 14 against the measure, now, it will have to clear one more hurdle. the governor. christy o'donnel hugged a state senator who pushed for the right to die legislation. it was a victory for o'donnell, who is dying of lung cancer.

>> to give people like me, like other terminally ill in california, peace. >> reporter: elizabeth is another terminally ill patient. >> i amñi so grateful not for myself, as much, but the fact that my son will not have to experience my agonizing death and that be the last thing he sees. >> reporter: brittany maynard's hustle brated the vote in the senate. she became the face for the right to die legislation in oregon because it's legal there. >> so terminally ill californians can stay here in california. >> reporter: another proponent was jennifer glass of san mateo, documenting her battle with cancer. she died just a month ago, without a chance to end her own life with medication. this was glass in sacramento earlier this year. >> i would find great comfort in

knowing that i had another option. >> reporter: her husband was watching the vote from their home. >> in the end, she passed peacefully. would it have been nice if she passed seven days earl hiker without going through seven days of hellish coma. >> reporter: governor brown has 12 days to sign, or veto the bill after receiving it from the legislature, if he takes no action in 12 days, it will automatically become law. in the newsroom, abc7 news. earlier today, the state senate killed a proposal that would have raised the salary of bar pilots. the ship handlers get paid $450,000 a year to guide vessels through the san francisco bay. the increase was opposed by ship operators and the san francisco bar pilots are the highest paid on the west coast. well, let's talk about the

here is the view from mount tam. we'll see fog and high clouds overnight. next week will be like fall, a more seasonal pattern as a matter of fact. here is our ridge of high pressure that is a hot air mass, sliding eastward now. as it does show, we'll gain clouds from the low of what was tropical storm linda. that pattern has become already. notice animation taking us into saturday afternoon. so we might see light sprinkles in the south bay. not a great chance of that

happening. there is that chance of mainly sunny skies. looking at the end of the heat wave, we'll add to cooling which has begun already. there will be no more triple digits. and natasha is happy to hear that. by monday, a stronger onshore flow. high temperatures dropping into 80s inland, 70s around the bay. low temperatures low to mid-60s, still mild overnight, but cooler the next couple nights. tomorrow, high clouds in the south bay, highs in the mid-80s, low to mid-80s downtown san francisco. up in the north bay, mainly mid-80s. highs in the low to mid-90s. all of next week, highs only in the 80s.

the september 11th attacks, there are memorials underway right now. katie is live at that ceremony. >> reporter: in the last hour, many families have arrived to pay their respects. you can see them along the bridge, which goes over highway 24. many commuters are seeing this sign of respect. as patriotism is evident the bay area. sounds still resonate some 14 years after the september 11th attacks. >> you know emotion comes back. all of these years later. it's something i think we'll draw on for our lives. >> reporter: many bay area departments sent crews to help in the search effort. others served with solidarity. >> departments sent firefighters to go to funerals because there

were so many and wasn't enough people to go to them. >> reporter: it's a family. she comes from a long lineage of new york firefighters, including her father, a fire chief. >> we lost friends and family. and one woman lost both sons and a daughter that day. it's a personal connection for me. >> reporter: the flag brigade covers an overpass, showing how even though we're separated by distance, we're one nation. >> it was a terrible thing but good to remember because people put their lives on the line every day to protect us. >> reporter: remember, and reminding our selfs. >> to serve others is truly one of the highest callings. union city held two special

ceremonies today for the victims of september 11th. the first started before dawn. navy officers gathered at sugar mill landing park. there were two moments of silence. at 4:45 and 6:03:00 a.m. flht 93 was hijacked and crashed in pennsylvania when passengers fought back and overtook the terrorists. >> the title, never forget hits home every time i think about it. you never want to for get about it. >> a bell was rung as the name of each of the flight 93 victims was red aloud. the names of the victims are inscribed on union city's september 11th memorial. >> it's no surprise the mayor of sacramento picked this date to honor three men who stopped a terrorist attack in france last month. all three grew up in sacramento and are considered local, really

world, heros tonight. the parade was held in their honor today. >> reporter: hundreds of people lined the parade route, some standing offer roof top buildings to catch a glimpse of the sacramento hometown heros. >> so we're just excited to be here to celebrate what is good about america and these young boys. >> reporter: patriotism was on full display to receive the three men who helped thwart a terrorist attack on a paris train last month. >> it's a proud thing to have these people do something so magnificent. >> this mom and daughter came with their homemade signs. >> just says welcome home, they made america proud. >> reporter: the parade featured marching bands and military personnel. and had the three heros, moving

tragic accident. nile murray is still recovering and david louie has the story. >> reporter: 21-year-old nile murray is preparing to fly back home to dublin. he suspended a broken wrist, heel and elbow when the balcony collapse. three fingers were broken. he was one of seven survivors while six others died appears to haunt him. . >> i feel quite guilty. >> reporter: valley medical center has been treating four of the seven survivors including hannah waters, who didn't want to be interviewed. when he returns home, niles says he will pay respects to the
