abc 7 news starts right now with live breaking news. and we're going to begin with remarkable images in martinez. a brush fire that began minutes ago is rapidly advancing on a couple of homes near the edge of the regional park. you can see the flames just eating up dry brush along carter acres lane. >> sky 7 hd was overhead as construction crews worked feverishly to control the flames on their own as they waited for firefighters to get there. one point workers used a garden hose to try to douse the flames as they advanced around the property. even using a bulldozer to create a dirt barrier around the fire. >> this is where the fire is burning in martinez just off of carters acres lane. no word what sparked it. for the moment the big issue is getting it out quickly.

moments ago fire crews arrived to slow the progress. >> a three-story home in alamo burned to the ground this afternoon when a fire broke out near lavenal road. >> you can see the flames rising here and the smoke as well. nearby tree and crash caught fire. firefighters arrived and put the fire out. no reports of any injuries. >> caltrain is under a heat advisory. >> trains are running slower so passengers can expect delays. >> we're living in hot conditions today. triple digit temperature readings in some locations. you can see we've got sunny skies all across the bay area and highs so far. these are not the final official highs. 103 in livermore and gilroy. and 100 at fairfield.

look around the base shoreline here. 92 in oakland. 96 at fremont and redwood city and 89 in san francisco the highs so far. we're feeling a little bit of a cooling breeze here in the city at the moment, but we still have the heat advisory in effect until 8:00 this evening for most of the bay area. we'll go to a live view from our east bay hills camera looking at blue skies and a clear coastline. the air quality outlook is pretty good. here's our first forecast as we look at blue skies over the bay. from our roof camera mostly clear tonight and early tomorrow morning, then tomorrow afternoon, mainly sunny, cooling down a bit. i'm happy to say temperatures in the mid-60s at the coast. i'll have more just a moment. dan and natasha? >> the fire continues to burn this afternoon. the fire started nine days ago and now covers nearly 76,000 acres. >> 2,000 structures have been destroyed and more are still being threatened.

four firefighters have been injured and three have died. >> calfire says this is now the most destructive fire in california history. the cause of the fire is still under investigation. the napa county fairgrounds is clearing out this afternoon. many residents are packing up go home or at least what's left of their homes. >> there are 300 residents staying at the fairgrounds right now and officials plan to keep it open for those who still need a place to stay. >> the process of cleaning up after the valley fire is just beginning. it's a huge job. >> considering that it destroyed 600 homes and other structures as well. laura anthony is live from middletown for us. >> reporter: this section right behind me contains maybe six homes but multiply this by 100 or more, that gives you an idea how big this cleanup will be. this excavator is just a preview

of the massive cleanup effort that lies ahead at the valley fire with hundreds of properties devastated by fire and the debris that's left in its wake. much of it containing toxins. >> that debris can contain some harmful substances that are not visible to the eye. >> reporter: that's why returning residents have been instructed to do as little sifting through their rubble as possible. and if they do, to make sure they wear gloves and masks. >> the county will take in and take care of the major cleanups. we've already signed off the release to allow them to do that. i've called like pg&e and we have our satellite carrier, i called them to cancel about. they say, send back the dish. i said there's nothing to send back. >> reporter: to all who come to this place, welcome, disneyland is your place. >> once residents have gotten what they can, the california office of emergency services working with lake county will come in and remove what's left and scrape the lots to several

inches below the surface. >> the goal of the program sto have the ground safe enough for a 3-year-old to play in the dirt. >> reporter: scraping the dirt here will be the last step. the cleanup will be done in phases. once people get their keepsakes and the contractors hired by oes will come in and remove toxins, metals, those sorts of things and separate everything for safe disposal and salvage. it will all be done for fire victims here free of charge. in middletown, laura anthony, abc 7 news. for the first time today the suspect at the center of the val edgeo kidnapping appeared in court on a complaint linking him to the crime. >> melanie woodrow was in sacramento for the hearing and joins us live. melanie? >> reporter: you may remember matthew muller is a former marine. he's a harvard educated attorney who is accused of not only kidnapping denise huskins but possibly in connection with other home invasions. now he'll be facing another

harvard trained lawyer representing the u.s. attorney's office. we got a look at matthew muller today in court. this is a sketch of him. he was in plain clothes today. his attorney says likely the clothes that he was initially arrested in. he'll be entering a not guilty plea on his behalf. at issue in court is whether or not he'd be fully shackled in the future. the judge decided yes. muller's family and friends were also in court today. his family did not want to speak on camera including his mom who investigators spoke to prior to his arrest after muller left his cell phone behind in a dublin home invasion, they tracked the phone to his family who in turn pointed investigators to his south lake tahoe home where they found muller and more evidence linking him to the vallejo crime. a family friend who has known him his whole life said his family is shocked. >> obviously, somebody that graduates from harvard, that's an attorney, that survives four years in the marines and then

all of a sudden starts going sideways, there's something going on there. and you know, i don't know. i'm not a doctor or anything, but this is not the matthew muller that i knew. >> i think the most shocking thing is to see your loved one in court in shackles, regardless of what the allegations are and what they are accusing mr. muller of. >> reporter: muller faces up to life in prison on the federal complaint. if he is found guilty, the 11 years he already pleaded no contest to in a dublin home invasion would be served concurrently. he's being held in the sacramento county jail and his attorney tells me he will likely be federally indicted in the next few weeks. meanma meantime, a preliminary hearing has been set for october 5th. spark turner school in sunnyvale will decide tonight whether to remain closed until background checks come back an all school employees. here's why. the closure comes after police

arrested 18-year-old lunch monitor jonathan chow for sexually assaulting a girl at the school and having child pornography. the school operating independently of the district and no background checks had been done before the school year started. >> every employee should have cleared a background check before they started work. that's hr 101. >> they monitor 23 charter schools but does not have the authority to order them to close. the school board meets tonight at 6:30 to discuss the closure. the 15-year-old boy accused of kidnapping, sexually assaulting and killing his 8-year-old neighbor pled not guilty in court today. adrian gonzalez is being charged as an adult for the madyson middleton death. madyson's father organized a memorial. he said he's forgiven madyson's

accused killer. >> it doesn't do anything for me. it doesn't change anything. it doesn't give me any satisfaction. i would rather have been out here for madyson and that's what was important to me. >> the next hearing for gonzalez will take place on october 29th. he faces life in prison if convicted. an attack after the niners season opener last monday could result in big changes for fans at future games at levi's stadium. cell phone video shows a man in a minnesota vikings jersey getting pummeled by niners fans last week. you saw that. city council members will discuss what can be done to address safety issues. among the issues are stopping alcohol sales after halftime and bringing in extra officers. three men and a teenager have been arrested in that attack. pope francis is finishing up his trip to cuba before coming here to the u.s. >> unprecedented security. >> abc 7 report er reports.

>> reporter: joyful crowds welcome pope francis. he's the first to visit. it's his goal to preach in places off the beaten path, a mission he won't fulfill on the most recent leg of his trip. he boarded the plane after celebrating the largest mass in the country's history and having a private visit with fidel castro. the aging revolutionary meeting with the pope who brokered a new relationship between cuba and the united states. >> reporter: in his homily today pope francis talked about the sacrifice being made in cuba but he stopped short of any direct criticisms. tomorrow the pope arrives in the united states where big crowds are expected to turn out in washington, new york city and philadelphia. today the vatican released a pretaped video invitation from francis to american pilgrims.

walnut greek, burling game, campbell and all the bay area, this is abc 7 news. police patrols were visible around numerous berkeley schools today. teachers are reminding students about safety after a man tried to lure students at willard middle school into his minivan on friday. janet oh has the story. >> reporter: this morning as students head back to school they're more aware of their surroundings. >> we don't want our children to be frightnd by this. we want them to be alerted.

>> reporter: alerting the community is just what the district did after two attempted abductions on friday morning. >> i got several messages from the school. e-mails and voice males. >> fortunate that no one apparently was harmed, but it raised the awareness a lot among the parents and the kids around here, which is probably a good thing. >> reporter: gary castroline already had a talk with his seventh grader. >> they told me like never listen or talk to a stranger that you don't know. >> reporter: that lesson will continue in class today when teachers also have a talk with their students telling them to stay away from strangers. this after a man tried to lure two students into his van near willow park. minutes later he tried to lure another young girl a few blocks away. but he took off when he saw her dad. >> our student ds the right things. they saw a danger and stepped

away from it and went to an adult to report it. >> reporter: the man is said to be hispanic, 30 to 40 with dark hair and a muss stash, heavy-set body last seen wearing a baseball cap. his car is described as a dark green minivan possibly a nissan quest model with a rear tint winded window. they'll continue to work with berkeley police to try to catch this guy. they're encouraging students to walk in pairs or groups something many are already doing. in berkeley janet oh, abc 7 news. apple is investigating a major attack on the itunes app store. today apple removed chinese apps that can dupe customers into giving up their passwords. among the infected apps include we chat, used by an estimated 600 million people. the breach is believed to be the first of its kind. customers are encouraged to upgrade to the latest version of

the apps to make sure they don't contain the malwear. macy's plans to hire about 85,000 seasonal workers for temporary jobs to meet the higher holly day demand. it serves as an indicator of expectation of a holiday shopping season which accounts for 20% of the industry's sales. that's according to the national retail federation. a san francisco hospital showed off an ambulance that's unlike any other in the bay area. abc 7 news was at california pacific medical center as medical personnel and kids got first look. take a look. the ambulance is decorated with colorful artwork both inside and out. it has a television and wifi. it's designed to ease the stress for children as they're being transported between facilities. it is also very high tech. medical technicians have google glass available to send live video to doctors during the ambulance ride. >> that's a great idea. so intimidating for adults never

we'll have a cooler pattern starting tomorrow. fall begins early, 1:21 to be precise. we'll have a mild to warm pattern for the middle part of the week. a tropical depression or the remnants of it, tropical depression 16-e having moved into northwest mexico today, now southwestern arizona, picking up showers in southern california. however here in the bay area we can look forward to our wind flows gradually turning on shore as it is doing right now. that will bring us a cooldown over the next couple of days. our forecast beginning tomorrow morning patchy fog near the coast. most of it will disappear tomorrow. that cooling sea breeze brings its cooling influence. highs tomorrow range from 60s at the coast to 70s around the bay to 80s inland. overnight look for some patches of fog to form near the coastline. not along the entire coast, though. mainly clear inland and low temperatures will be generally in the low 60s, although a

little cooler in the north bay valleys. tomorrow sunny in the south bay, 80 at san jose. on the peninsula mainly mid to upper 70s and mid-60s on the coast. downtown san francisco will top out at 68 degrees. napa to calistoga, to santa rosa and calistoga, i should say. and the inland east bay will see highs in the low to mid-80s up to 84 in fairfield 85 at brentwood. here's the accuweather seven-day forecast. fall begins on wednesday. it will be a mild to warm first day of fall. it will be quite warm thursday and friday with inland highs in the 90s. brings a little cooling with it. sunday and monday see inland highs only to 80. and mid-60s on the coast. we'll settle into a more fall-like pattern by the weekend, dan and natasha. >> summer's just saying good-bye to us. >> it is indeed, in a big way.

>> history at the emmy awards last night. actress viola davis became the first woman of color to take home an emmy for outstanding lead actress in a drama series for her role on "how to get away with murder." afterwards davis said what this award means to her. >> it means my work counts for something. it means that 27 years professionally that i put into this business means something. >> the most stirring moment of the night came when comedian tracy morgan walked out on to the stage unassisted. it was his first public appearance since a serious crash last year left him in a coma for eight days and killed one of his close friends. morgan received a standing ovation and managed to crack jokes. >> only recently i've started to feel like myself again. so which means a whole lot of young women are going to get pregnant at the after party. >> afterward morgan said he loved the moment saying it was good to get back with his, quote, community, the show business community, end of quote. >> isn't that great to see? >> yeah, it really was.

live from the kgo tv broadcast center, this is abc 7 news. here are the headlines where you live today at 4:30. the charter school in sunnyvale was temporarily shut down as officials conduct background checks on all employees after an 18-year-old teacher's aide was arrested accused of sexually assaulting an 8-year-old girl. katie utehs tweeted out the request for the closure of the

charter after it failed to complete those background checks. she'll have a report at 5:00. the valley fire in the north bay has burned more than 75,000 acres. it is now 70% contained. more evacuation orders for residents are being lifted tonight. at 5:00, abc 7 reporter cornell barnard will show us the special treasure that made it through the flames in one couple's home. and wisconsin governor and republican presidential candidate scott walker ended his bid for the white house just over an hour ago. now calls for dr. ben carson to leave the race as well after his controversial rashemarn muslims in america. >> no backing down for dr. ben carson after these comments on nbc. >> i would not advocate that we put a muslim in charge of this nation. i absolutely would not agree with that. >> reporter: oée prominent american islamic organization today calling on carson to drop

was dead. he asked mr. mccarthy what he had done and he did not tell her but he said she was a demon anyway, it was her time to die. >> reporter: mccarthy pleaded not guilty today. as did the mother who is charge as an accessory after the fact. a criminal investigation of volkswagen's admission that it cheated on federal air pollution tests for years. volkswagen says some of the diesel models it sound in the u.s. in recent years had software deliberately designed to turn on smog reducers during an emissions test but then turn them off for the rest of the time. they halted the cars yesterday and issued an apology. it didn't help. volkswagen stock took a massive hit on financial markets today losing a quarter of its value. that's more than $17 billion. the arch db bishop of san francisco is heading to washington, d.c. to see pope francis. the pontiff arrives this

wednesday. ama daetz is on her way to washington today and she sat down with the archbishop recently to find out more about the message the pope is bringing. >> reporter: archbishop salvatore cordileone will meet with the pope in a couple of days. >> i won't be surprised if he talks about the environment and how it's connected to more issues like how the poor tend to suffer more. migration and immigration are high profile with the refugees from syria and other countries as well. and immigration is a significant issue here in our own country. >> reporter: while the pope is in washington, he'll name a california saint. >> he's been called the founder of california. >> reporter: father junipero serra founded the first nine of california's 22 missions. on wednesday pope francis will hold a special mass at the basilica at the national shrine of the immaculate conception. serra is a controversial choice for sainthood.

this photo has quickly made the round on social media today. you can see the crying 2-year-old in the arms of a surgeon watching cartoons before the child undergoes heart surgery. >> china's central tv uploaded the images to facebook stating the young girl was crying and nervous without her parents,

understandably. the surgeon calmed her by sharing cartoon videos he watched with his own children. take a look at this very determined rat carrying a slice of pizza down the stairs. this is at an east village subway station. he gives up there. getting lots of attention. the video was taken by matt little. the rat only takes about four steps before he gets spooked and gives up there. after this was posted, #pizzarat began trending nationwide. i feel if the camera guy wasn't that close, he would have gotten that. >> looks like a good piece of pizza, though. can't blame him. is that pepperoni? >> i don't know. >> what about this heat? >> spencer? >> we've had numerous locations in our area exceeding the 100-degree mark today. even around the bay we've had mid to upper 90s. things are beginning to cool down just a bit.

nationwide salmonella outbreak. a federal judge sentenced stewart parnell to 28 years in prison. the former peanut corporation of america owner was convicted a year ago of knowingly shipping food that was tainted with salmonella and for naking fab records that said that the products were safe. nine people were killed and hundreds more became ill. a 5,000% increase for a drug first developed by a hayward company, then sold to a start-up. and a child's favorite fruit. jane king has the wellness report. >> reporter: a common parasite jumped to $750 per pill overnight. they have the exclusive rights to this drug. other drugs lately have jumped in price causing alarm among doctors, patients and the health care industry. a new study is finding a link between diabetes and napping. those who felt very sleepy during the day had a 56% higher
