finished with a special request. >> i ask you pray for me. don't forget. >> don't forget. francis also met privately with five sexual abuse survivors and the pope promised them the church would hold their abusers accountable. now moving closer to home, caramel police want to find the vandals who toppled a statue of newly canonized saint junipero serra. you can see the damage that happened last night. the salinas california reported that there was paint splashed on the graves of europeans, but thought native americans. some activists blame serra for genocide and for enslaving and killing thousands. bicyclists on the peninsula say someone has been trying to sabotage their ride by laying out metal tacks. it has been happening in san mateo county, and the riding community is now fighting back.

abc7 news reporter has the story. >> andrew is a member of the cycling club that had eight riders get flat tires. it ruined the ride and no one was hurt. >> sometimes it takes a while for the tires to deflate. it could be awhile before you realize before you are going at high speed it is easy to lose control with a high speed crash. >> these are the attacks that were tossed out. it seems someone carefully planted them. >> somebody placed the tacks .y side up inside a crack on the road so they were there and affixed pointy side up. >> cyclists have been getting their tires taken out by these tacks for years. the chp and san mateo county sheriff's office has been told, but no arrests have been made. >> they are popular with bicyclists and even equestrians and they say who ever is laying out the tacks is making it dangerous for

planned to teach to under privileged children will never get that chance. he died at a railroad crossing and an accident that had anything to do with an on coming train. they say a dangerous guardrail killed him. despite on site meetings next to the guardrail in question, one agency didn't remove it until after the fatal accident. >> they called him topu. a cute nickname with a regal meaning. king. >> it feels like an exaggeration, but it is all true. >> his sister, flo, said he spent all of his time in church. >> after a full night and day

volunteering in march anthony drove his family home from church around 6:00 p.m. >> flo says he fell asleep at the wheel. he crashed into a guardrail in front of a railroad crossing dwait at 34th street. one of the steel beams pierced his head. >> i started crying out to god that i wasn't ready for a challenge this big. >> according to the traffic collision report the guardrail surrounded and protected the crossing gate. the public utility commission put in this plastic barrier. they confirm drivers of large trucks having difficulty navigating the term is likely striking the gate causing damage. these types of rail barriers are installed by railroads to prevent damage to rare gates. cpuc also says according to the recent records paperwork to install the steel barrier

was not filed. cpuc says they didn't know who installed it or when. >> when i first got out of the car and i looked at the guardrail something is up to me. >> cpuc says any alterations are immediately noticed by staff during inspections. but despite staff being here three times between 2008 and 2013, the undocumented guardrail remained in place. according to google images the guardrail was here eight months before a cpuc inspec. in 201 within you can see one horizontal beam was knocked off the guardrail and is on the ground. cpuc says the next on site meetings were in january of 2012 and 2013. the federal railroad administration and city of richmond and at least three railroad companies with vested interest in the crossing were also there. the unauthorized guardrail remains. >> here it is in may 2014. you can see an orange safety cone and the broken horizontal

beam that was in the rod in 2011 is now gone. less thanne year later anthony had his accident. according to the traffic collision report when he crashed into the guardrail, the remaining hour horizontal steel beam broke off and went into his windshield. >> this is truly an accident waiting to happen. >> he is filing a wrongful death and negligence lawsuit. it names contra costa county and the city of richmond and richmond railroad. >> nobody is taking responsibility, but everybody let anthony down. >> the plastic barrier provides the same functionality. anthony's brother wonders why the safer alternative was thought there all along. >> if it would have been what is there now which is just these plastic barrier things, he would be walking around. >> these days anthony's family honors him by spending their time in church. >> his sister says he would want them to find peace and answers. >> he would want us to make

sure it didn't happen to anyone else. >> pacific railroad leases the rail line from union pacific. union pacific says richmond pacific is under obligation to inspect and maintain the track and the crossing. richmond pacific did not respond to our calls or e-mails. the federal highway administration put the responsibility for installing hardware such as barriers on the owner of the road. it is not clear who owns the road where this barrier existed. neither contra costa county nor the city of richmond would answer our question. in an e-mailed statement for the city of richmond, they said it was a tragic accident. the city is continuing its investigation. in the newsroom, melanie woodrow, abc7 news. >> we hope foreclosure for that family. now drew joins us with a seasonal chill coming our way. >> it feels like it has been a longtime since we talked about the cooler numbers dominating our seven-day forecast. live doppler 7hd showing you

live from the kgo-tv broadcast center. this is abc7 news. >> good evening. in tonight's headlines, he wrapped up the two-day visit to silicon valley. he spoke about modernizing to an adoring crowd in san jose. outside the protesters shouted about the record on human rights. police are looking for a man who tried to swipe a package from the home when the homeowner was inside. he chased him down and grabbed a purse from inside the car hoping it would help track them down. officers believe the suspect is a man arrested for a similar crime back in 2012. tonight people lined up on the embarcadero in san francisco to see the super blood moon. the event requires three things to happen. a full moon, lunar eclipse and the moon reaching its closest orbit to the earth.

>> in seattle, the duck boat company involved in the deadly crash with the charter bus is temporarily suspending operations. the announcement comes after federal investigators say the duck boat was supposed to have one of the axels repaired in 2013, but for some reason did not. the state inspector wiles look at all of the rides. five international students died in that crash. 13 people are still in the hospital. and now to the race for the presidency. a reality check for donald trump. new numbers are showing trump is in a statistical dead heat with dr. ben carson and a reality check for hillary clinton. >> i am leading every poll nationwide. i am leading every state. >> for months that was true. but the new national poll shows the outspoken billionaire neck and neck with the low key neurosurgeon.

money for middletown high school students will be printed tomorrow as well. a screen printer is donating the shirts with the # middle strong. they sold them last week and at the have already raised $5,000 for middletown. the proceeds will help students buy athletic uniforms. >> they are now 95% contained. they burned 110 square miles. and to the south in monterey county it is 100% contained. that fear -- that fire burned nearly two square miles. one of sacramento's hometown heros received an honor from his school for disarming a terrorist aboard a train in france. they jumped into action to stop a gunman as they traveled from amsterdam to paris last month.

samsung launches the mobile wallet tomorrow. they let you pay with your smartphone. it is the company's answer to apple pay and google's new android pay. they say their version is different using technology that will work with retailers. the new electric vehicle will roll out of the company's factory on tuesday. the company's first suv is more than a year behind at this point. it doesn't seem to be affecting the company. tesla share ropes 18%.
