live from the kgo-tv broadcast center this is abc7 news. they got some sanitary issues do deal with here. >> dozens would ate at the popular shows restaurant ended up in the hospital with alarming symptoms from food poisoning and the health department is worried this could be more victims. >> i am kristen sze. >> i am cheryl jennings. >> a dozen would ate at mariscos restaurants are in intensive care and it is linked to one bacteria, shigella. >> we got the new numbers and the public health department is reporting ten new cases overnight. that brings the total to 40

cases since the outbreak first started. most of them have required hospital admission. 12 of them have received admission into the icu. officials say all of people ate at mariscos restaurant in san jose on friday or saturday. restaurant was closed by the county on sunday morning. so far, shigella has been confirmed in 15 cases. officials suspect it was spread by an infected food handler, and a man has been eating there for 15 years with no problems but now this is troubling. >> i would give them a chance...but, maybe a little bit down the road. >> they passed the previous two health inspections but there have been ten violations in 2013 the restaurant will remain closed until the safety of the public can be assured. i am joined now with deputy health officer dr. george hahn.

what is shigella? >> it is caused by a bacteria. it infects you when you eat it. you have little bacteria that gets into the food or someone is preparing food and you eat it and after six or 12 hours you will get cramps, diarrhea, fever, perhaps blood in the diarrhea, and vomiting. >> very serious symptoms, the the recommendation is what? >> if you have the symptoms see your doctor. get tested. possibly get treated. >> get evaluated. >> thank you, doctor, we appreciate your time. my colleague will follow-up on had story and bring you more details coming up later abc7 news. thank you, matt. engineers will inspect the overpass that partly collapsed in oakland.

afternoon. >> a massive sinkhole opened up in union city and could re-open. can you see crews have filled the hole at new hair veteran after the sinkhole grew to 35 feet to 40'. when it started to open up last week, crews had to replace utility lines before they could fill the hole and officials do not know what caused it but they hope to have the street opened by tomorrow. >> the highway patrol is investigating a late night crash along highway 101 that killed one person and left another seriously hurt. the crash forced the c.h.p. to shut down all lanes of southbound 101 near 3rd street before 11 o'clock p.m. with officers responding after a 9-1-1 caller reported an object blocking the lanes. investigator say the person who survived was taken to the hospital with major injuries. >> residents are out of their home after escape an early morning flier with flames before 5:00 at a him on north 14th street between washington and

empire. firefighters contained the fire to just the kitchen and one person is staying with friends now and the red cross is helping the other. >> a san rafael man is under arrest accused of assaulting a woman inside her home overnight. police say the call came this from a him on a street before 3:00 this morning about a strange map running a a. rubbing a woman's shoulders while she was in bed. officers arrived and found the man 33-year-old jumping off the balcony and running away. when they caught up to him he had stolen items from the home. they charged him with burglaring and assault. he also violated his prohibition. >> san francisco sanctuary city policy will be the focus of the board of supervises meeting, supervises are discussing two competing resolutions that are nonbinding. they physical the july shooting of the bay area woman, kate steinle, by an undocumented immigrant deported five times

before the shooting. one resolution calls on the sheriff to continue the policy of not giving federal immigration agents any information of detainees of the other resolution calls on the sheriff to take back the policy. >> the marin county trail where a well-known yoga enstructuror was killed could soon be renamed in his honor. the 67-year-old steve carter was shot and killed october 5 while walking his dog. the marin county parks department received 20 requests to rename the gunshot fire road in fairfax near where the body was found to the steve carter trail. the department said it will take requests for other names for the trail independence december 1st. three drifters have been arrested if his death and the death of a canadian woman. >> a loud protest this morning on the campus of city college in san francisco. >> abc7 was there as faculty members held a walk out to protest a propose a.m. to shrink

>> benicia, san ramon, san mateo and all the bay area, this is abc7 news. if you are waiting for the new chip credit card to arrive, you have to watch out for a new scam. we told you about bangs sending out new credit and citizen bit cards to reduce the fraud. the federal trade commission said that scammers are taking advantage of consumer whose have not received the cards with the new chip. they are sending out fake e-mails retending to be credit card companies. do not give out any personal information if you are not sure whether an e-mail is legitimate, call the number on the back of your card for more details.

the highs will taper through the end of my seven-day forecast and it looks like the storm track, compared to yesterday's model, starts to drift to the north, and i also say, take the back half of the seven-day forecast, especially when it comes to rain during the drought, because that could change so take it with a grape of salt. look at our winds, santa rosa and fairfield, and they are pointing offshore, and that is why our temperatures are in the 60 and 70s on the way to 70s and 80s under all of this total sunshine. now, you look over at south lake tahoe and you can see the clouds but i am calling for a partly cloudy sky and a temperature of 60 which is a little bit below average, 62 degrees but not record highs. the area of low pressure we showed you of video from arizona and watch the storms build and it is slow moving. thankfully, it is moving away from us, and it will not bring anymore flooding to southern california and the counter-clockwise flow, the clockwise throw around this area

of high pressure, that is our offshore breeze and why our temperatures are going to be warmer-than-average today. how about the low-to-mid 80's in the south bay and mill ease and san jose at 80 and los gatos at 84 and we will have upper 70s, millbrae and san mateo, the immediate neighbors and the rest of the peninsula is warm at 82 degrees. because of the fog at half moon bay you are starting off tougher at 69 is where you will end, and, notice, daly city and colma and the sunset, low-to-mid 70s and mid-to-low soviets san francisco and sausalito, and around 70 across the north bay coast and mid-80's throughout the inland neighborhood and along the east bay more and we get close to 80 at berkeley, hayward, newark and young city and we should make 80 to 82 along the east bay shore and mid-to-upper 80s in the inland neighborhoods from concord and pittsburg at 58 and fairfield at 87. now, let me show you tone, the temperatures in the seems are in the 50s but higher elevations because it will be breezy tonight in the 60s, and not so chilly as it was this morning.
