many russians returning from vacation. they say there are no survivors. a pack of aggressive raccoons on the attack in san francisco an out of town visitor had to undergo rabies treatment, and a neighbor tells us the city is not doing enough to deal with the problem. reggie has the story. >> and the boys came out one after another. >> just as brennan showed us where the attack happened near 41st and anza, two racoons popped out of the exact same spot. they may seem skiddish with our camera story on, but he said it's a completely different story. >> in the group there were at least 12, 15 in the group, but there were four -- there was four vicious and big racoons you

were doing the biting. >> his wife, who didn't want to go on camera, is still very shaken up and she showed us where doctors last night had to give her painful rabies treatment. one. dogs with us are having trouble walking and the other given a bigger trail. we thought he was killed. they were actually dragging him away. >> this is not a one-time incident. two months ago, one street away, a similar attack on a dinner couple led them to the hospital with precautionary rabies treatment. some asked if the city is doing enough. >> i got a hold of animal care control, and they promised that they would do a training out here. we were looking for a site to do the training and i never heard back from them. >> for now there doesn't seem to be a solution so the sullivans warn anyone passing through here of danger lurking between the buildings. in san francisco, abc7 news. we have developing news out of concord this morning. police are looking for a suspect after they say he shot two men last night. one man died and the other is in the hospital and is expected to recover. the shooting happened just after 11:00 near lacy lane and

monument boulevard. an unidentified hispanic man approached the two men in the parking lot and shot them. investigators have not said what led up to the shooting. san francisco police are on the lookout for a gunman who shot two people last night that happened at fillmore and turk around 9:00 p.m. just a few feet away from the northern police station. this photo shows the block closed off. one of the victims is a minor. the other is 19-year-old and has life-threatening injuries. in san jose the state has pulled the liquor license out from a restaurant after the killing of this man. last saturday 34-year-old michael orsega, a real estate agent, was shot and killed outside lou's beer club and restaurant where he had been celebrating a sale. police are still searching for the gunman. last month a shooting injured two other people outside the restaurant. alcohol beverage control said it pulled the license yesterday because management allowed disorderly conditions. 6:04 the time. also in san jose, police say a man was stabbed many time outside his car with his five-year-old child in his back seat.

the 21-year-old travis painter is accused of the stabbing but painter said he was just defending himself. as sergio quintana explains, this all started with road rage. >> reporter: it happened on this cul-de-sac just after 7:00 p.m. in a neighborhood that looks like a save place for trick-or-treaters, not somewhere where you would expect a treat brawl. >> there were police with shotguns drawn out, and they were going around the neighborhood. >> investigators say 21-year-old travis painter was arrested for assault with a deadly weapon of a stabbed a man several times in front of his house. the man who was stabbed had his five-year-old son in his back seat. the child watched the whole thing. painter has been released on bond but when we went to his home nobody answered the door. he did talk to our media partner, the san jose mercury news. >> 21-year-old travis painter said the man cut him off on mcabee road and followed him to his neighborhood. that man then attacked him in his own front yard, so he pulled a pocketknife to defend himself.

>> he told the mercury news he had no idea a child was in the other vehicle. he befuddled me when he proceeded to do what he did when he had his kid in the car. it's 137% self-defense. the guy was on my property attacking me. >> police say painter's parents stopped the fight and called 911. officers did not name the 36-year-old man who was stabbed and sent to the hospital with life-threatening injuries. sergio quintana, abc7 news. hundreds of wind turbines in the ultima pass are set to shut down permanently tomorrow. the company, ultima winds, notified the u.s. fish and wildlife service that their turbines would be turned off november 1st because of the impact it's having on birds. the department said the turbines were associated with the injury or deaths of at least 67 golden eagles. it's illegal to kill an eagle. voters are being warned to stay away from the bay bridge next weekend.

visibility, no fog to speak of. 58 in san francisco. it's 53 san jose. morgan hill. and oakland against morning, sitting at 5 had degrees. and speaking of oakland, here's a look from our east bay. you will notice temperatures are cooler. not only out by the delta but napa and santa rosa dropping a few degrees, in the upper 40s. so feels pretty autumn-like this morning. with 56 in concord, you know it's probably going to be another warm afternoon but not as warm as it was yesterday. the east bay hills camera hook out over the east bay where temperatures today are still above average. we were about 10 to 15 degrees above average yesterday. we look for the numbers to continue to be too warm for the end of the month. but that's all going to change. so dry and mild for halloween. hooking at rain arriving tomorrow in the morning in the extreme north bay. otherwise the front slides south throughout the day. we will see scattered showers, cold temperatures for monday. some spotty showers into monday

with the possibility of a thunderstorm. so this cold air will move over the warmer ocean waters, and that could initiate a thunderstorm tomorrow night. but as for today, high pressure hangs on one more day. and with the return to an onshore push later on today, it won't be quite as warm. here's what is arriving for sunday into monday. and those cold overnight temperatures into tuesday and wednesday morning. so tomorrow morning, look at the cloud cover. we've got some spotty mist and drizzle. but by about 8:00, 9:00 it's rapping from ukiah to cloverdale. noontime cloudy and still dry for much of the bay area. as we go through about 4:00 the rain still north around santa rosa and lake port. but as we go through about 5:00, 6:00, it's over the heart of the bay here and continuing to press south into 10:00, 11:00 at night. then that's when we could see some thunderstorms. with the cold air in place and spotty showers into your monday

and we are he will talk about a cool, wet second half 6 the weekend coming up. chris. >> thank you. instead of preparing for halloween, a san francisco hodler is in the hospital this morning after a driver hit her in a crosswalk. it happened at her mother was pushing her in a stroller thursday at the corner of parker and euclin in laurel heights. now city leaders want parents to be especially safe trick-or-treating. the girl's father spoke to abc7 news about her injuries. here's abc7 news reporter katie with more. >> this three-year-old models her costume, but they won't be wearing it on halloween. >> we expected some party, but everything is gone now. >> instead, she's hospital hazed with severe head injuries after being hit in the crosswalk by a car at euclid and parker avenues. i told my mom i have to be with my daughter because she is very serious. >> his wife was pushing a

and police aren't doing enough to find out what's really going on. the latest reported incident supposedly happened recently on cal's fraternity row. we say supposedly because the complaint was not specific. police say they don't have much to go on. abc7 news reporter alyssa harrington has more from the cal campus. ♪ >> halloween weekend celebrations have already started at u.c. berkeley. and students are getting hit with some scary information. a report people may have been drugged at a fraternity party. >> it's very scary. >> u.c. berkeley police are alerting students of the possible danger. >> we felt with the weekend coming up with halloween, there will be a lot of parties. we have the usc game. we wanted to get the word out could that this type of activity is alleged to have occurred and to be safe if you are out this weekend. >> the investigation ends there. that's because this is a third-party report. one of nearly a dozen filed in just the past couple of years.

in april someone reported a woman had been sexually assaulted at a fraternity. last october five people were allegedly given roofies, an attack at a fraternity. at the same time a fellow member reported one of his frat brothers was sexually assaulted. campus police never heard from the actual victims or witnesses. in this latest case they don't even know the name of the accused fraternity. >> we don't have a lot of detailed information to investigate. >> students say the little information out there still serves as a good reminder to be aware of surroundings. >> if we are given a drink, we watch who is making it. never put your drink down. >> abc7 news. >> 6:34 is the time. santa cruz police have a warning for anyone who gets a little too rowdy this halloween. >> because if you are drunk and causing trouble in downtown santa cruz this halloween, the costume you went out in may not

be the costume you end up in. >> last year an estimated 15,000 people celebrated downtown. extra precautions are being taken downtown this year. a safety enhancement zone will be in effect. it started late last night and will continue until more than 4:00 p.m. tomorrow. more than 100 police officers will be on hand tonight to monitor the crowds and fines for violators will be given for certain infractions, like carrying an open container of alcohol. >> bart wants to make it easier for their passengers tonight. the agency plans to run longer trains and increase the number of trains in service, especially coming in and out of san francisco. the last east bay train leaves san francisco at 1:26:00 a.m. early tomorrow morning. happening today, state officials are making sure sex offenders are where they are supposed to be as kids trick-or-treat tonight. it's part of the annual operation bootcheck. on halloween violators are not allowed to give out candy or have decorations their homes or

even turn the lights on. offenders are required to stay inside their homes from 5:00 p.m. tonight until 5:00 tomorrow morning. this is the 22nd year of operation boo >> more details on the wine train incident where 11 women were kicked off two months ago. the women filed a lawsuit, but the in paw valley wine train owners want part of that lawsuit dismissed. the women claimed they were kicked off the train for being too loud, and they said they were slandered when a man said they were being aggressive after being kicked off a train. but the wine train's lawyer said that statement was an opinion, not facts, so it does not mean slander. san francisco's last remaining gun shop is set to close today. all that is left at highbridge arms in the city's bernal heights district are gun accessories. the store opened more than six decades ago. part of the reason for closing is because of a new approved law. the new rules require video recordings of all gun and ammunition sales in san francisco.

beautiful start to your saturday. so dry and mild for halloween with rain arriving tomorrow morning in the north bay. it's going to take just about all day to spread south with the cold front and accompanying the cold front we can see a scattered thunderstorm as the cold, cold air moves over the warmer ocean water and then scattered, spotty showers will continue into monday with blustery northwest winds. so our live radar and satellite come positive shows double barrel high pressure. we had the height offshore flow. still kind of hanging on today. but as the day goes on, we will notice the on shore push and the high fades away, traveling to the east as low pressure and an associated pretty strong cold front dives to the south. with that we had take you through the next several hours. so tomorrow morning notice spotty showers from make port to cloverdale. by about 11:00, 12:00, the rine still far north into ukiah. by the middle of the afternoon it's sinking south.

4:00 it's raining in san francisco and 6:00 raining from vallejo into fran, into oakland. we will look for the front to tip to sag south. the heaviest rain acompanying the cold front tomorrow. monday the scattered showers continue. it will be blustery and rainfall amounts ranging from a tenth to a quarter inch in some spots. high are elevations could see about a half-inch. you see san jose about a third of an inch. so pretty decent. in terms of the sierra nevada, we will look for the winter storm warning above 7,000 feet. the heaviest snow into monday morning. so a lot of this should fall as snow due to the cold air in place. so here is the estimates for snow. you can see tahoe city at 9 inches. looking at 7 inches around here and almost a foot at kirkwood. high today 74 in oakland, 77 palo alto, fremont 76 and santa cruz tonight will hook for very mild conditions, 72 at 5:00 and

of two tribes filing suit against caltrans and the federal transportation department. caltrans is building a six-mile freeway through an area that was once got dotted with indian villages. they say caltrans is illegally destroys historic and native american sites. >> it's as if caltrans decided to bulldoze through your church. >> caltrans claims they followed all legal requirements, searching for archeological sites before construction started two years ago. but the tribes say caltrans failed. >> once caltrans started construction, it found over 30 sites. and it's clear caltrans did not do a proper investigation because there's no way caltrans should have missed these 30 sites. >> caltrans has admitted to at least impacting one known site, but blames it on a mapping area. the tribe's attorney claims it was no accident. >> caltrans had trucks come in

in the dead of night and destroy that site without alerting the tribes in advance. >> the tribes say as construction and environmental work continues, crews are still finding more artifacts. >> we understand caltrans is finding areas that suggest not only human remains, but grave sites. >> caltrans denies any findings that indicate possible human remains. a spokesman told us by phone the agency has worked with the tribes in good faith. >> we have been working closely with state and federal agencies throughout this project. we have not destroyed any villages or cultural areas on this project. and we have been working diligently for the last almost two years with all three local tribes. >> and that was dan ashley reporting. the freeway is scheduled to open
