peaceful surrender. good evening, i'm dan ashley. >> i'm cheryl jennings. it unfolded at the intersection of camden and wirick avenues. >> lillian kim is live near the scene with the latest on this. >> reporter: a source tells abc7 that there was an exchange of gunfire at the moment where the gunman had taken a woman hostage. we have confirmation two people are dead, the gunman and the hostage, in addition, an officer was grazed by a bullet. this unfolded about three hours after the hostage situation began at around 2:15 p.m. police say a man took a woman hostage, into a home, prompting a response from san jose pd who brought in the s.w.a.t. team.

what led up to the gunfire that resulted in the death is something we're hoping to find out very soon. that is the latest from san jose, abc7 news. a milestone tonight. 14 months since the napa county earthquake. >> michael finney credited the day with helping a group of people still getting their lives back in order. he is here now with what is a victory. >> reporter: napa self storage was red tagged after the quake. the owners planned to bull doze the building unless tenants came up with $190,000. it seemed impossible, but sometimes, the impossible happens. >> these items were in danger of being bull dozed. here she is, in the rain,

smiling. >> my stuff looks good. it looks good. i was confident it looked good. i'm just so happy. today is a good day. >> reporter: it was a day long incoming. napa self storage had been red tagged after the quake. then, for tenants, things went from bad to worse. the storage company pointed to the rental agreement, saying the owner is not responsible for damage to property. tenants could pay a contractor to shore up the building or lose everything in a demolition. >> if it wasn't for channel 7, i don't think we could have gotten to this point. >> really? >> i got a hold of channel 7 for myself and 200 people with belongings in this building. things just weren't happening. >> reporter: fund raising followed. napa self storage contributed $39,000. a $25,000 grant from the napa valley community foundation came in. churches, and well wishers gave.

still raining, and thunderstorms have been firing up in the sacramento valley. we have a tornado warning until 6:30 tonight for east central sacramento county. radar indicating a tornado there. bringing you back to the bay area, we're seeing showers around the santa cruz mountains and watsonville, monterey. showing you what's happening around the peninsula, there are returns around portolla road. east bay, showers around hayward area. flash flood until 9:00 p.m. for the burn areas of solano and lake counties, showers continuing to rotate in from the coast. it's not out of the question to see some moisture moving through the next few hours. rainfall totals are a quarter inch in san francisco. a half an inch of rain in santa rosa. 43/100ths san jose. 34/100ths in oakland. monterey bay got drenched. an inch and a half in santa

cruz. gilroy an inch of rain and monterey, three quarters of an inch. i'll let you know what is in store tomorrow morning if you're going to see a commute coming up. well, another lightning strike, this time on the mid peninsula brought down a tall redwood tree. a huge tree. it was a very close call. david louie is live with the story. david? >> reporter: take a look at this. this is all that remains of a 100 foot tall redwood tree in the backyard of simmon nguyen's backyard. she and her dog were standing nearby when a lightning bolt came down. both feel fortunate to be alive. >> the sky is red. and then, i heard the noise, it exploded. and then, so i said oh, my god. something is going on. i thought it was a bomb. >> it wasn't a bomb, it was

lightning in simone's backyard garden. it launched a crown into the sky, where it exploded. that sent shards of limbs into her yard and surrounding yards. >> no warning. just lightning. after thashg it exploded. that is it. >> reporter: her dog is stim tr trembling. >> if she was anywhere else in the garden she would have been killed. it's a miracle. >> reporter: a large section of the trunk flew through a window and landed on her bed where she had been sleeping. >> if i'm there, i'm in there, i think i'm already dead. yeah. yeah. no way i can survive. >> reporter: the magnitude of what happened has yet to sink in

in return for real estate favors. the offer went nowhere, but the defense lawyer says he wants mayor lee as a witness. today, opening statement before a packed courtroom. raymond chow, better known as shrimp boy sat as the federal prosecutor listed charges against him. money laundering, extortion, counterfeit cigarettes and two murders. chow is accused of ordering the murder of a rival gang murder and the killing of alan leon, a prominent chinatown leader, the head of the free masons. he said while pointing at chow, it was a hit, a cold-blooded murder like in "the godfather" by that man, over there. the prosecution outlined it's case, saying jurors will hear hours and hours of tape

recordings between chou and the fbi agent who posed as a mafia member, and from six trusted gang members. in opening statements, chow's attorney told jurors to hold their opinions until his client testifies on the stand. as for friends, who turned informants, he said all of the witnesses jumped on the band bag war in afghanistan onto get leniency as an act of desperation to save their skins. in 2007, chou spoke to abc7 news saying he changed his life of crime after he got out of prison, on unrelated gang charges. >> today, raymond myself, i face up to the paths i have done and to try to correct my life.

we're learning about the crab fishing off the california coast may be just beginning. a toxic algae is threatening other sea life and this may be the new normal around here, we'll have to see. wayne freedman is live with the story. wayne? >> reporter: we're talking about an algae going back to the jurassic period, millions and a long, long time. they've had a long time to develop and develop defense

februarying nixes. some people are thinking that is what this is all about. it has a name longer than the length. one millionth of a meter. the tiny algae produces acid that renders the crabs there is an investigator trying to figure out why it's producing the algae. >> it's giving itself a competitive advantage. >> he has specimens in bottles now. >> this year, coming back next year there is no reason to expect it not to come back.

>> we've seen algae blooms before. it just so happens that the neil armstrong import today. we found dr. larry maiden, putting warming waters in a chilling context. >> if you go back, you can see conditions worse than today. >> hence some changes should be permanent from speesy appearing far beyond normal ranges to yes, algae blooms contaminating crabs and filter feeding shell fish and most of us were simply worried about thanksgiving dinners. rare video shows a close encounter with a shark. take a look.

watsonville and monterey, if you take a look, still tracking light returns around 680. sierra nevada, it's been snowing now. chains are required on 80 and this is a welcome site. winter storm warning continues until 7:00 a.m. 12-16 inches expected at the crest. so this area will continue to enjoy fresh powder. taking a look along embarcadero, it's dry now. temperatures low to mid-50s. morgan hill, 48 degrees. a nice view from our emeryville camera. you can see across the bay. there is a live look showing you roadways drying out.

a fairfield courtroom was packed with family, friends, and officers who knew and worked with james capoot, the officer killed during a chase. sergio quintana was in the courtroom. >> officer jim capoot shot in the back. the man he was pursuing just robbed a bank and bought a mask for the crime he was a hollywood quality mask that looked like something maybe like on "mission impossible". >> this sentencing hearing is a welcome end to the trial for the family. they were joined by fellow officers for a mement of silence before heading into the courtroom. >> i'm thankful all of you are here for jennifer and her three daughters. >> reporter: in this picture, you can see henry smith remains

ground has been shining towards sky 7 and one helicopter over our breaking news seen earlier in the cabrian park neighborhood. it's dangerous and illegal because it can blind pilots. our pilot assures us that has not happened but police have been notified. bay area middle school students are so wrried about their future, they went to college today, showing up at uc berkeley to protest the low number of hispanic and black students attending cal. 39% asian, 26% white, latino students representing 14% and only 3% are african american. >> really not fair when more than 50% of california's actual population is black and latino. >> proposition 209 banned

race-based admissions. uc berkeley came up with the african american initiative, a $20 million scholarship for african american students. catching a cab at san jose airport has been all but impossible too long. cab drivers have been striking to protest ride sharing companies like uber and lyft. tomorrow, the city council will consider eliminating the fingerprint requirement and replacing it with random curbside services. self driving cars are causing back ups along highway 101. they're going to study ways of improving traffic around the mountain view area. the goal is cutting down on solo

some experts say letting your plants and lawn die is not going to take the problem saying the state took the easy route instead of coming for real solutions. lawns and landscaping are drying out. . >> i like my garden and grass green, but this is important. >> it's one of the signs people are cutting back on their use. but head south to beverly hills, it doesn't look like everybody got the message. >> the idea of green grass is going to be a thing of the past. >> in april, the governor ordered cuts and the bay area

listened. many water agencies report people here are meeting or exceeding the call to save water, ordering a 32%. beverly hills did impose restrictions but only cut use by 20%. the central valley down of clovis missed its goal by 3%. officials seem worried about saving trees than water. >> it's very unsightly and going to cost money to some day replace that with other plantings, we've had a great loss in trees. >> she doesn't think public and private landscaping should suffer. >> my concern is the way the state imposed restrictions is that they were made without hodge of how plants grow, how water moves into the soil. >> he believes advice could have
