ltsdsed. >> only on abc 7 news right now, a pile of rocks collapsed. six college students died in that tragedy. and we've just learned attorneys from the victims claim the company that's built those apartments knew that the balconies were unsafe. good afternoon, everyone. >> reporter: alma and larry, from the start, all the experts say the balconies suffered from water damage and dry rot. the lawsuit provides new information about the water

damage included this. tenants from october 2008 to summer, 2010 observed large mushrooms growing from multiple locations. the lawsuits called that an unambiguous red flag warning that the wooden joists were rotting and that the balcony was a great risk for collapse. the tenant's complaints are contained in a written document. that memo could be very important to the case. >> if the plaintiffs can demonstrate that there were red flags that they failed to pay attention to, that they ignored, complaints just like the ones we're talking about, that puts those defendants at serious risk. >> the lawsuits allege details of how the balcony became so badly dry rotted. i'll have that and more coming up an abc 7 news at 6:00. we have tried, but no comments so far from the 39 defendants named in the lawsuits and we'll keep trying. larry, al many, snarks. >> dan, thank you.

we'll see you at 6:00. >> turning now to breaking news where police have shot and killed a man. >> it happened in sunnyvale. david louis is on the scene with the very latest. >> larry and alma, you can see that yellow drive is still blocked off because apartment numb per 4 is an active crime scene. it all started at about noon today when a woman said she had been a victim of a battery. that's when police say she arrived and it got worse from there. sky 7 hd live on the scene. a man came to the front door, confronted officers. three officers then fired at him after the man lunged at him with a knife. police are not saying how many shots were fired. the man was wounded and then taken to a local hospital for treatment where he later died. none of the officers was injured. residents in adjoining apartments also said they were not hurt. police so far have not said whether the woman was injured

other than to say that she is now with officers. a department spokes man describes what happened and why officers fired at the suspect. >> officers arrived on scene, made contact with an individual at the residence who was armed with a knife, charged at officers and three officers used their department weapons to fire at the suspect at close range. >> the santa clara sheriff's office responded where its 3 d imaging to help get a reconstruction for the investigation. a command post is set up here indicating that detectives will be here on scene for quite a while documenting the shooting. police are promising to release more details when they are available. we will continue to update you on twitter and, of course, on abc7news at 5:00. >> new details about yesterday's

fatal shooting in san francisco. >> the man had stolen a shotgun in san bruno. but it may have been bent on suicide, not homicide. carolyn joins us live from the scene. carolyn? >> we just obtained security video of the suspect stealing that shotgun from the big five store. it appears he had a death wish. but police in san bruno and here in san francisco still don't know why. >> she believed that yesterday was going to be his last day. >> san francisco police chief says that's what javier lopez garcia told construction workers as he climbed on top of their elevator. >> he told the clerks that he was suicidal and that he didn't want to hurt anyone.

carolyn tyler, abc 7 news. >> breaking news now from the east bay. sky 7 hd live over richmond where a sacramento bound train has struck a pedestrian. a person on the tracks was hit near central avenue. that train has come to a stop. an amtrak spokes personal tells us they're trying to locate the victim right now. >> san jose fire fighters revived two dogs after a house fire in san jose. this is video of the scene from sky 7 hk. crews told us two dogs were pulled from the garage and had to be resuscitated. no one inside the house was injured. it took crews about 30 minutes to get control of the fire. >> a federal appeals court in san francisco today reversed a lower court ruling which it found the california death penalty was unconstitutional because of excessive delays. the unanimous decision by a

three-judge panel of the ninth circuit court of appeals struck down last month. more than 900 people have been sentenced to death in california, but only 13 have been executed since 1978. >> moraga police are hoping surveillance video will help them track down three suspecteds in a home invasion robbery. the men confronted the homeowner at gunpoint around 7:00 this morning. they forced the homeowner back into the house where they stole cash, jewelry and firearms. no one was hurt. the suspects got away in a silver, late-model toyota camyr. >> police want you to take a close look showing two burglarers in the act. in the kitchen, they're laughing, drinking orange juice right out of the carton. police say the men ransacked the house back in august. they've arrested a third man. but the two that you see right here in this video are still on the run. >> get ready for a weekend of

affording housing. some have housing vouchers that are useless because there's so few landlords who will take them. this morning, local, state and federal leaders held a meeting about the crisis. most if not all are chipping in. but the reality is, the more jobs, the more people and the more homes you need. >> i don't think most people are saying let's have a bad economy and a high unemployment rate. no, what we need to do is make sure that there's housing for the people getting those jobs. >> recently, a new program to house all homeless veterans in san jose. while it's a noble effort, if successful, it will only account for about 10% of the homeless population. >> west coast burger chain in and out is suing silicon valley food delivery service door dash demanding that they stop delivering their food and using their logo. door dash does not have their permission to deliver their food to customers.

food quality may be jeopardized when handed by couriers. some customers agreed with that claim. >> if you're going do have your food delivered, you want it to be in the best quality. >> the suit also claims that door dash used the in and out logo without permission and when they were asked to stop, used an invitational logo on their site. abc 7 news reached out to the company for comment, but, so far, they have not responded. >> walmart is making changes this year to its black friday sale which actually begins on thanksgiving night. the company says it's ditching its hourly door buster deals which have a history of causing scuffles between shoppers. all of its discounts and deals will be available at once. most of them will be available online, as well. hours before the stores open, wall mart stores will open at 6:00 p.m. on thanksgiving. the chain says it plans to hire

seeing rain across the entire north bay area. golden gate bridge camera showing you a chamber of commerce view. chilly in the morning. it did drop down to 33 in santa rosa. 33 in farefield. rain arrives saturday night. more snow is in store for the sierra nevada. so let's take a look at our rain chances as we look at the next seven days. biggest probability, i should say, is saturday and sunday. remember, last night, if you were with us, we were talking about the potential for one computer model bringing in some rab. middle of next week, it's not looking very good. so a drier forecast for the middle of next week. rain starts in the north bay at 11:00 p.m. it starts to fly southward while you're sleeping. most of the bay area will be getting some wet weather. 2:00 a.m. is shifting to the east bay and the south bay. 4:00 a.m. is primarily in the south bay. most of the rain will be over by the time your weekend plans begin. but there will be some lingering showers there the early

a thing of the past. it is working on a part of the flu virus that dubts change. it would be years away. the food and drug administration seeking your input to answer a question. how should the agency define natural on food labels. disagreement over what all natural or 100% natural means. and is fat stigma making us miserable? being overweight doesn't necessarily need to make a person distraught. rather it's the teasing and unsolicited advice that causes the greatest psychological harm. people don't like to exercise in public and even avoid preventative health care.

arm on my neck and that's when he lifted me up off the ground and threw me face first into the ground. >> thanks so much for joining us. that 18-year-old woman is now suing the sheriff's department tonight claiming a deputy used excessive force. she says she was arrested for no good reason after her high school graduation party. >> well, that teenager who's suing stands about 5 foot tall and weighs about 115 pounds. now, her attorney says the deputies she's charged with excessive force is bigger and stronger. and that there was no reason, he says, for that deputy to use the amount of force that he did. >> this is how the night ended for the 18-year-old. her face cut, bruised and

swollen. gabby, her two sisters and their mom, told us that at about 11:00 that night, hours after the party ended, a sheriff's deputy showed up. gabby's sister, shante was sitting with her boyfriend in his car in front of the house. they say the deputy questioned both and then acted aggressively towards shante, trying to get her out of the car. >> he was just angry from the get go. from the second he got out of the car. >> gabby protested her sister's treatment. >> she says the deputy turned his agrex toward her and gabby walked quickly toward the house. >> all of the sudden, i felt an arm on my neck. that's when he lifted me up off the ground and threw me face first into the ground. >> she was arrested, taken to the hospital, jailed and booked for battery on an officer and resisting arrest. >> did you resist? >> no, there was no way i could have.
