swollen. gabby, her two sisters and their mom, told us that at about 11:00 that night, hours after the party ended, a sheriff's deputy showed up. gabby's sister, shante was sitting with her boyfriend in his car in front of the house. they say the deputy questioned both and then acted aggressively towards shante, trying to get her out of the car. >> he was just angry from the get go. from the second he got out of the car. >> gabby protested her sister's treatment. >> she says the deputy turned his agrex toward her and gabby walked quickly toward the house. >> all of the sudden, i felt an arm on my neck. that's when he lifted me up off the ground and threw me face first into the ground. >> she was arrested, taken to the hospital, jailed and booked for battery on an officer and resisting arrest. >> did you resist? >> no, there was no way i could have.

he was on top of me with my hands behind my back. >> gabby required more medical treatment. ultimately, the d.a. dropped the charges. a lawyer has long-criticized the sheriff's office for the conduct of its deputies. >> two years ago, they tasered 23 times at the county jail after he was arrested on a d.u.i. last month, a group of inmates charged they were systematically beaten and tortured. excessive force lawsuits are pending in both cases. and now this. sweiger says there was some 1600 use of force incidents in the jails these past six years, none of which the sheriff's office concluded they were excessive. the sheriff's office says it can't comment on pending lawsuits but asks only a small

to the hospital. they were first spotted going over 100 miles an hour west of fairfield. they refused to pull over and then sped away. in sunnyvale, three police officers shot and killed a man this afternoon. the officers claimed the man charged at them with a knife. abc 7 news reporter david louis is live at the scene with the latest about what happened there today. >> dan, as you can see, still a very much active crime scene. we have brand new details that originally came to police as a case of an e alleged battery. she was claiming she was sexually assaulted by her half brother. >> police were called to the ground floor apartment by a woman who says she got battered. they confronted a man at the front door who had a knife in his hands. police say they charged at him and that's when officers opened fire. police were not saying how many

rounds were fired or how many times they were struck by bullets. the officers involved in the shooting are being questioned as part of the investigation. detectives are now busy working on reconstructing the sequence of events. the santa clara county sheriff's office sent in a specialized 3d camera system that will create a detailed view of the scene. >> we used it in several cases. it just provide a more real-life look at the theme. so when we're trying to recreate the events, that we can put things in place that can put things in perspective. >> the glass also has a visible bullet hole. police say the officers fired at close range. a tv set tuned to abc 7 which was likely behind the man was still on showing no signs of damage. police did not indicate that the woman was injured saying only that officers were with her. sky 7 hd showing a large

chilly in the afternoon. here's a look at that system that's going to bring the rain and snow. in the north bay late saturday night. as we head towards the morning, sliding across the bay area. north bay, meanwhile, really starting to get a break by 4:00 a.m. sunday morn e morning. most of it is winding down. we may still see a few showers, especially over the higher terrain sunday afternoon. but most of you will be seeing the sun. you do have opportunities to get out and about. we need the rain so we have to take it when we can get it. snow levels running low, especially in that time period, 4500 to 5500 feet. be prepared for possible delays as we are expecting low snow levels with the system.
