>> reporter: those lawsuits make a disturbing allegation that the balcony was poorly constructed, dry rot, to the point of growing mushrooms and officials knew about the problems but failed to fix them. hours after the collapse at library gardens complex, killing six students from ireland, experts told me water damage was the cause. you can see the support beams flaking away. >> that indicates it was pretty severe. >> in your opinion? >> yes. >> that is the focus against 39 defendants, including segway construction and subcontractors, black rock investment, the owner and gray star, the property management firm. the lawsuits allege the builders cut corners to save money and the subcontractor does not use plywood, but strand board that

is more sus sementible to water damage. the lawsuits say the builder framed the balcony in 2005 but did not water proof it right away. the wood was exposed to 13 inches of rainfall. hau suits say in january, the defendants chose to water proof and complete construction for apartment 405 without correcting the water saturated wood components, and the water locked in the moisture, with a concealed trap. the lawsuits alleged tenants observed large mushrooms growing on the balcony a red flag warning that it was at risk for collapse. the lawsuits say one complaint is contained in a document. >> how important is that document? >> very important.

if the plaintiffs can demonstrate there are red flags they ignored, and complaints like the ones we're talking about, that puts those defendants at risk. >> reporter: lawsuits do not contain a dollar amount, but abc7 says it could be huge. >> you're talking about millions upon millions of dollars, certainly because thaer young people, from the face of the complaint, appeared to have serious and perhaps life long injuries. that is the case that generates a big statement. >> reporter: through their attorneys, the surviving victims and families declined to be interviewed. the law firm reads in part our clients hope this will bring to light the carelessness that caused this avoidable tragedy that produced so much pain and loss here and in

there has been no comment from the major companies but one engineering firm expects to be dismissed because their work played no role in what happened. >> thank you, dan. >> detectives in sunnivale where officers shot and killed a man. police say they were called to a ground floor apartment by a woman who said she had been battered. they confronted an armed man at the door. >> one individual charged officers and the officer fired at close range. >> the man was taken to the hospital where he died. a specialized camera from the sheriff's office was sent in. it's a system creating a detailed view of the scene. firefighters saved two dogs from a burning home, sky 7 was

over the fire after 2:00 this afternoon. crews pulled two dogs from the garage and resuscitated them. they said both dogs are going to be okay. no one else was hurt. there are delays on amtrak tonight after a pedestrian was struck and killed in richmond this afternoon. sky 7 hd was near the central avenue overpass. according to amtrak, a trespasser was struck by a rain which was bound for sacramento. service on the san joaquin line has been halted between emeryville and richmond stations. in the middle of the drought a list is out detailing the biggest water wasters in the east bay. abc7 news reporter janet oh joins us live with the list. hi, janet. >> reporter: good evening, ama. most of the water users live

past the caldecott tunnel. but water officials said it's not a surprise most of the heavy water users live in these areas, known to have larger lot sizes and hotter weather. east may mud says customers are doing well, continuing to meet bench marks but the agency said they want to be clear we're still in a drought period. you can see the district's biggest reservoir is only 27% full at this time. now, by law, they do have to release water users and we just saw that list an hour ago. there are 1022 people on the list, which is a decrease from two times such a list has been released. >> this is not meant to name, or shame anyone but to show we need to have a response to the

surveillance footage. >> the robbers got away in a silver, late model camery. we're learning more tonight about this tense hospital standoff in san francisco that happened near st. luke's hospital. the man had a stolen shotgun from a sporting goods store in san bruno. we're learning more about what his intentions may have been yesterday. that is right, dan. tomorrow, san francisco police will hold a town hall meeting here at st. luke's to talk about findings. we know this man was from san jose and had a criminal history and according to authorities, he told people he confronted yesterday in san bruno that he was ready to die. this security camera video

released today shows a man in white overalls identified as javier lopez garcia entering a big 5 sporting goods store. he had a black semi automatic weapon and demanded a shotgun. >> he told the clerks that he was suicidal and that he didn't want to hurt anyone, but he did want them to resist as well. >> the 25-year-old man drove to st. luke's hospital, about 12 miles away in the mission district and rode a construction elevator up several floors. >> he believed it would be his last day. >> the police chief says that is what lopez garcia told the construction crew. >> any idea why he chose st. luke's? >> that is the question now. we did talk to family, they don't know if he was seeking an employment opportunity and was unhappy. >> reporter: the chief says

oakland mayor says she's undeterred by reports the raiders have their sights set on a stadium near los angeles. she just returned from a trip to new york city to pitch her city to the nfl. laura? >> reporter: that is right. she admits she felt like her

the largest pier on the old bay bridge is going to be blown up. it will happen at 7:00 a.m. or 1:00 p.m. 26 seconds, it will break apart 20,000 pounds of concrete. it happens underwater so there is nothing to see. caltrans will shut down the bridge 15 minutes before the implosi implosion. the tube will come to a halt for just a short time. carbon monoxide is the cause of accidental poisoning deaths in the nation. abc7 partnered with home depot to make carbon monoxide detectors and smoke alarms available for those that need them and can't afford them. >> this one is expired. >> reporter: a 911 call from a home triggered a search for smoke alarms and carbon

and at 2:00 a.m., it's still across parts of the east bay and south bay. sunday morning most of the rain is shifted to the south bay. you can see mostly cloudy skies and sunny conditions, cloudy where we see showers developing. most of it will be over. as far as rainfall, most areas will get between a quarter to half an inch of rain and we're talking about 8 or 9 inches of snow. this will be great. so you may see mid to upper 30s in livermore, watch out for patches of valley fog. 40s around the coast and bay.

there are charges of excessive force by a sonoma county deputy sheriff. an 18-year-old is suing saying she was arrested after

her high school graduation party. >> vic lee has the story you'll see only on abc7 news. >> gabby graduated from high school in june. her family threw a party at home to celebrate. this is how the party ended. her face, cut, and swollen. her mom and sisters told us at 11:00 a sheriff's deputy showed up. gabby's sister was sitting with her boyfriend in his car in front of the house. they say the deputy questioned both, then acted aggressively toward shaunte, trying to get her out of the car. gabby protested her sister's treatment. >> i told him what he was doing wasn't okay. >> she says the deputy turned his aggression toward her, gabby walked toward the house. >> all of a sudden i just felt an arm around my neck. he lifted me off the ground and

sometimes they're looking for speeders and other times, they're not. it's a good idea for to you know your rights. when thinking of a speed trap, we think of police, lying in wait. >> i don't know what the traffic, what the speed was. >> or we hear of a driver pulled over in arizona, with california plates. >> i had to follow the guy to the police station and pay the fine. >> neither of those scenarios are speed traps. >> there is a misconception to what a speed trap is. >> francisco says every five years, the speed limit should be set in part by how fast drivers are going. >> if you have it set at 35 and 85% of the people measured were traveling at 45. ten, that is a speed trap.

>> there are tunnels and school zones but if the road hasn't been studied or limit set too low, you have a speed trap. if you could prove a road hasn't been studied if five years, you can have a winning defense against a traffic ticket. john bowman is the vice president of the national motorists association. >> people don't bother to fight speeding tickets at all. we estimate that fewer than 5% of the people who get tickets actually plead not guilty and go to trial. >> the association has a website that tracks speed traps. this site lists exit from 280 to san jose avenue in san francisco. we find officers there, pulling over cars and writing tickets. san francisco police department told us they're likely there because people complained about traffic problems.
