broadcast center this is abc7 news. >> now at 11:00, destroy the embryos. that's what a judge is ordering a san francisco woman to do after a nasty fight with her ex-husband to save them. good evening. i'm dan ashley. >> i'm ama daetz. it was an emotional case between a divorced couple involving the frozen embryos they created. >> katie is live in the newsroom with the reason this family's saga may not be over just yet. >> because of cancer treatments and her age she can no longer have children, but she and her ex-husband do have frozen embryos. they also have a contract to destroy them in case of divorce. the judge ruled in favor of upholding the contract they signed. the fertility doctor said it is the right decision. >> if the the court said well these are not going to stand up to scrutiny in these kinds of cases, all of the work we

county social service agency. she works people every day. but she needed help after getting a shocking call last year. >> we are calling regarding a debt and there has been a judgment placed on you and we want to resolve the debt in 2004 they bought a $2,600 credit card from chase that they believed belonged to christie. they served it to chrisy's old address and somebody there signed the papers. >> i can honestly tell you i didn't believe the judgment. >> she believes somebody stole her identity and opened the card. ted merman says companies buy debt for pennies. >> right now under existing law if a debt buyer has gone into court and filed a lawsuit and got a judgment against you

and if they wait more than two years you are out of luck. >> that happened nine years ago. >> she got a call this year threatening to garnish her paychecks. >> she said how about you leave your debit card information on my message. >> what company would ask you to leave your debit card information on the voicemail? i let it go. i said this is a scam. >> it wasn't. soon after the courts allowed the agency to take out $250 from her paycheck. the original $2,600 debt has grown to $8,000. >> there is fees that get put on, attorneys fees, court costs. >> she works for the east bay community law center and she is helping christie in her fight. she is barely able to make ends meet. >> i have to cut things off and let things go and i'm okay with that. as long as i have a roof over my head i'm okay.

during the winter and springtime. i am stepping aside so you can see the numbers. san francisco received 26 inches of rain. oakland over 29 inches and san jose more than 22 inches and 97 and 98 san francisco and oakland over 35 inches of rain. and that's counting three to four months worth. the entire year typically in the bay area we average between 15 to 30 inches of rain. we have the potential -- i i am not saying we will do a rerun of this, but we have the potential to see hefty rainfall if it continues this upcoming winter. we are waiting to see the affects. highs under sunny skies, they were milder than normal in places like santa rosa, 75. 71 napa, oakland, antioch. we are heading into another day like that. the temperatures right now are in the 40s and the 50s. quite comfortable still and a live look from the emeryville camera. a beautiful shot of the moon. we are looking at patchy fog for your morning commute. mild weather through the weekend and getting you a
