>>. >> it was all the indications of a murder. >> reporter: with that said, he filed a civil lawsuit on behalf of the family. sitting at the front, his brothers and their mother who said his son was getting his life back together after a troubled past. >> he was the best of me. and he redeemed himself. he did. he redeemed himself. >> two cell phone videos surfaced shortly after the shooting last week. a third surfaced today that says the 26-year-old was shot by officers without provocation. >> you do not see him lunge at the officers, run at the officer with anything in his hand. >> the attorneys showed a series of freeze frames from the video to illustrate their point. >> reporter: during his town hall meeting after the shooting,

the chief had his own display of freeze frames which he says he may have raised his right arm with a knife before he was shot and that the officers stepped back first before he fired. sirs said he could not comment on burris' allegations because of his charge. >> i felt insulted by the chief's kments that he would make a comment to just and support the police officer's conduct so quickly. >> burris says he'll file a wrongful death lawsuit in state court later. vick lee, abc 7 news [ chanting ] >> and this is fallout from the shooting at san francisco city hall today. hundreds of students walking off campus to protest. the deputies made their voices heard on the steps.

piled up on his windshield in san leandro. >> things have calmed down quite a bit. spencer christian here now with our first look at the up date. hi, spencer. >> things have calmed down quite a bit. even a rough surface beginning to calm down. take a look at current conditions. as you can see, we have lots of clear spots right now. still some pockets of moisture just offshore. but notice how it's traveling down to the coastline. not making much of a move inland. here's a view at the santa cruz beach. check out the peak wave height. coming down a bit now, still, we have some dangerous surf. there is a warning in effect until 9:00 p.m.

bedroom during the overnight storm. >> thought that we heard thun r thunder, realized it was something bigger than that. >> the tree ended up crushing the awning. other residents heard it, too, at 3:00 this morning. >> it was just a loud roar on a big thump. residents are demanding that the city take action adding that this is the so he could time this happened and they fear it won't be the last. >> the property manager said they talked to the city of oakland and they don't respond. >> i don't know where we're going to stay. >> a high surf warning is in effect along the coast until 9:00 tonight. huge waves are crashing along bay area shores bringing out hundreds of people.

federal investigators right now are looking into the fatal crash of a medical helicopter. the chopper was on the way to the hospital last night with a pilot, nurse, paramedic and patient on board. they were all killed when that chopper went down. investigators want to know if the rain and fog were factors. >> there's inherent risk in ems. weather events can happen. we don't know in this particular case. >> the chp is investigating a possible dui crash that killed two teenagers last night

a east bay. abc 7 news rorter raw ra anthony joins us live from the medical center with more. laura? >> hi, alma. >> reporter: at this point, hospital officials think as many as 800 people may have been exposed to this infected nurse. but the primary concern and the biggest focus are on the newborn babies. >> officials say as many as 350 infants may have been exposed to a female nurse working in the

newborn nursery. >> infantds have an immune system. when a baby gets tuberculosis, it can unfortunately get into the bloodstream and then travel throughout the body. >> the hospital is reaching out to babies and moms. >> probably not able to spread it that well simply because individuals didn't have any symptoms at all. >> t.b. is typically spread through the air by coughing and sneezing. the babies will be offered screening and a chest ex-ray and antibiotics for 6 months. in san jose, laura anthony, abc 7 news.

about a hum dread students protested today. the shooting in the bayview was captured by at least three cell phones. police say the 26-year-old refused to drop an 8 inch knife. >> state ajents seized more than 40 illegal weapons from the martinez home including assault rifles, silencers and a grenade launcher. agents were just trying to answer the question why were all of these weapons there.

tomorrow could be a history-making day for stanford sophomore player. he's one of three finalists for the most prestigious award in all of college sports. he gained more yards this season nan any player in college foot pal history, including the great barry sanders. alabama's derrick henry and deshawn watson are finalists. june plunkett is the only other player ever to win the heisman. going for their 24th straight victory in boston, that would be the most consecutive wins to start. they haven't lost a single game at all this year. a victory would give them 28 straight wins dating back to last season.
