tornado in the sierra foothills east of sacramento. dramatic. good evening, and thank you for joining us this christmas eve. >> let's get straight to abc 7 weather anchor, spencer christian. it is cold out there. >> it is cold. making it even more unusual that we had tornado reports. not in the immediate bay area. we've got clouds around and spots of scattered shower activity. over in the foothills of the sierra, we have two confirmed tornado reports. the early one at modesto at 2:24 this afternoon. the later one -- much later, about 3:10 this afternoon in the location of fulsome. both storms have weakened and moved up into the sierra-nevada with the moisture going along with them. joining the blanket of snow that's falling there. but back to the bay area take a look at what's going on. not much to report right now. we have little pockets of moisture off shore that will be moving slowly down along the coast

coastline during the overnight hours. we have shower activity around the santa cruz mountains. not much more expected to happen tonight. we'll look at christmas day and beyond in a few minutes. >> thanks a lot. if this seems familiar, it's because it's the fourth storm of the week bringing rain to the bay area dumping snow in the sierra. a live look shows thelingering rain that spencer spoke about. >> and rain factor and the so-called king tides. no major problems with the higher than usual tide but hassles, certainly. abc's wayne friedman is live in mill valley. wayne? >> reporter: dan, we had them in the north bay. the king tides weren't the highest we've ever seen -- roughly seven feet. but this spot here at 10:00 this morning, it was under water. for those of us who try to catch rainbows, today would have been a good day to do. it they popped up like candy along the north bay sky but not

without a price. if you didn't look closely you might assume this video was shot from a boat, and you would be wrong. another king tide at its peak in mill valley, rising seas and a microcosm. this traffic island almost disappeared in water that ignored the rules about crossing double yellow lines. are we looking at an optical illusion or a shoreline version of being there? >> i think what we have to do is get used to this happening more often. >> reporter: the lovely happened where we found it -- at cascade falls. more water than we've seen in a long time. plus, sun, rain and mist. sometimes all at once. >> i like to come after the rain and see the water coming down the waterfall. it's a very spiritual place. >> reporter: for the more pragmatic, let's talk about plants and possibly freezing temperatures. >> you want to protect citrus cacti, succulents subtropicals. >> reporter: at garden supply kevin has been reassuring customers all day saying in most

your help to solve a deadly hit-and-run case that's almost a week old now. take a look. this is a picture of the car officers are looking for. it's a black four-door sedan, likely a honda or nissan. the car's front end or windshield may be damaged. police think the car hit a person who was walking on mission near 26th street early friday morning last week. that victim died. in the deadly police shooting of mario woods more protest. today 134r7b 00 converged on city hall to call on the mayor to fire the police chief. they accused him of lying about the police shooting to protect officers. the group is planning to strike in may to protest the police killings of plaque men. a family in gill -- of black men. a family in gilroy overpaid their property taxes for ten years, and they weren't the only ones. more now this multimillion-dollar mix up-and-how many families were affect -- mixup and how many families

were affected. i'll pay. it. >> reporter: for years they overpaid their taxes because the property in the neighborhood of gilroy was over assessed. they had purchased their home at below market rate, and even assisted in the construction as part of a sweat equity program for low-income buyers. >> we worked in the rain. we worked in 106-degree weather on aluminum ladders whether it was hot. sweat pouring down. >> reporter: the nonprofit agency coordinating the sale as well as the city of gilroy never filed the proper paperwork with the county causing their home to be taxed at full market view. she discovered the mixup last spring when her mortgage bill went up. she alerted neighbors who might have been affected and went to the county. >> it's unreal. it took a long time, but it came about. it's a big answer to prayer. >> reporter: she got the documentation needed to prove the case. the county assessor's office immediately spring into action. >> the government makes a mistake, we have an obligation to make it right.

it's not always easy to do that. >> reporter: today she received a check for nearly $28,000. her refund plus interest. neighbors say they're grateful for her tenacity. >> a lot of years gone by that we have had a struggle. i mean we make it at the end of the day. like i said, we're grateful. >> reporter: a total of $3.3 million in refunds will be distributed to more than 160 homeowners. from gilroy, abc7 news. it's been a stormy week, but not all part of the bay area got the same level of soaking. >> coming up we'll tour south bay reservoirs and find out why the rain has not made much improvement on water levels. a live look at the last-minute shoppers in san francisco's union square. we'll get a live update from our reporter on scene next along with a look at the deals that some shoppers scored.

workers at one east bay restaurant have been working to keep a christmas holiday tradition going. cinco de mayo in martinez has been making tamales for christmas for about ten years. they sell about 700 each year. that takes a lot of hard work as you can imagine. the restaurant says all its workers put in long hours to get them made. one woman especially. >> does a good job of helping us do tamales. especially her -- she stays at night with my brother, armando. to try to get them ready. >> they've got a production line. the tamales come in all sort of flavors -- chicken, pork, beef. for those with a sweet tooth, how about pineapple, strawberry, and cinnamon raisin? >> yum. a christmas eve tradition continued in san francisco today. one woman had a good excuse to drive with her top down on her convertible despite the rain today. >> funny. >> yeah. the only way she could squeeze a free christmas tree or a few actually into her car.

pockets of showers. widely scattered. let's talk about what's happening in the higher elevations. the santa cruz mountains, showers going on. in the higher elevations, a dusting of snow. not at the summit because that's not quite high enough. but in elevations above the summit, patches of snow are falling now. and let's look at the current temperatures in the mountain tops down to 31 at mt. diablo. 29 at mt. hamilton. and we don't have enough moisture in the area really to encourage the thought of widespread snowfall. pockets of movie should travel over those elevations at those temperatures. some snow could fall. temperatures at bay level in the 40s. down to 40 degrees exactly in napa and santa rosa which will fall into the 30s. you get the picture. a cold night. a full moon at 3:11 over the bay. it's full of itself.

a chance of rain or snow. bright and chilly. a freezing cold weekend night coming our way. here's the forecast animation starting at 7:00 this evening. notice the showers will become more widely spread as we get into the late night and overnight hours. after midnight, it's possible that a pocket of showers or two could swing down along the coastline, maybe move over the peninsula, santa cruz mountains. but by 10:00 tomorrow morning should be all over. a partly to mostly sunny christmas day but chilly. a cold snap will be with us for several days. a freeze watch in effect for saturday and sunday mornings over the interior north bay and east bay santa clara valley and east bay mountains. lows could drop into the mid 20s to low 30s. we'll use santa rosa as our indicator of lows. 31 in santa rosa saturday. 29 on sunday morning. and many inland valley locations

will see that kind of low temperature range. meanwhile, overnight generally under the full moon at 3:11 a.m., low temperatures dropping down to about 33 at napa. 34 at santa rosa. 34 at fairfield. mid to upper 30s in the inland east bay and subway. so chilly all around. and then tomorrow, christmas day, should be a partly to mostly sunny day. a chilly one with highs reaching only into the low 50s in most locations. here's the seven-day forecast -- a bright sunny christmas day. mainly for the weekend, as well. clouds will arrive late sunday with a chance of light rain sunday giving way to maybe steadier rain into late monday. we'll call this a one on the impact scale of one to five. a storm of light intensity. and we don't expect really much except for wet spots. it might downgrade below a one. tuesday, wednesday, thursday mainly sunny skies. a gradual increase in

california governor jerry brown pardoned robert downey jr. for a drug conviction that sent him to prison. >> he was one of 21 that receive a pardon in what has become a christmas eve tradition for the governor. >> we have more from los angeles. >> reporter: robert downeyer j received the gift of clemency --

robert downey jr. received the gift of clemency from governor brown who granted a full and unconditional pardon to downey and 21 others. his legal troubles began in 1996 and continued until he was sentenced to prison here in 1999. >> now i've found myself like you've said so honestly, manipulative. i know how to comply. what i haven't been able to do is surrender -- until very recently. >> reporter: he wound up serving more than a year in jail. nearly three more on probation, and another two on parole. he's since turned his life around and become one of the world's biggest movie stars starring as sherlock holmes and ironman. according to the governor's office downey jr. like all of those pardoned served their sentences and have gone more than a decade without further criminal activity. his pardon reads, "since his release from custody, he has lived an honest and upright life exhibited good morale character, and conducted himself as a law-abiding citizen. it's an honor that isn't easily

obtained." >> it's exceptionally difficult. governor brown granted 91 pardons this round. one of those was robert downey jr. another one was a client of mine. it's huge. it's a huge life-changing event for all of these people. no holiday cheer at this long-time san francisco restaurant. the lucky penny which had been open for more than 50 years at masonic and geary closed for good today. the restaurant was popular among late-night diners and was one of the few 24-hour eateryies. it will be replaced with condos and retail space. they say nothing escapes a black hole, not even light. but for the raiders, their lease expires this season. the mayor is confident the city can keep the team in oakland. but among raider' fans tailgating before the game, there were mixed feelings.

tornado in modesto. we're getting reports of damage to homes and buildings in both areas. fortunately, no reports of any injuries. this rain in san jose just a small sample of what we've seen across the bay area today. >> really bringing up a bigger question -- are we seeing enough wet their to make an impact on our drought -- enough wet weather to make an impact on our drought. >> we're looking at reservoir levels and why they don't seem to be rising. >> reporter: it's not as simple as fillationing a bathtub. the reservoir can store 18,000 feet of water, but it's only at 13% of capacity. the rainfall we've had is getting absorbed by the drought-parched soil, not releasing much runoff. the chair of the water district board says rainfall across the state is crucial since only a fraction of the supply is captured and stored here. >> it's stored in san luis

reservoir. a lot of it stored in shasta dam and orrville dam. it's small because of the seismic wishes anderson. we can't store as much water as we'd like. >> reporter: water supplies can also be deceiving when you look at levels of perklation ponds u.s. as this at los gatos creek park. water is moved to recharge underground storage. >> i think it comes out of lexington. they started refilling it about midsummer to recharge the groundwater occupier. >> reporter: the prospects of rain and runoff has steve holmes optimistic that in time there will be chinook salmon and steelheads spawning again. >> they had to truck the chinook salmon fry down to san pablo bay and deposit roughly over 40 million of the fish to the waterway. they went out into the ocean and will return in three years. >> reporter: the south bay clean creeks coalition organized 92 cleanups and removed 1 6 tons of

different. >> i've never remembered the season being this busy. >> reporter: in the back of the truck, not christmas cards but piles of presents. >> about one-third come from amazon. >> reporter: amazon is now one of the postal service's biggest customers. holiday shipments are up 15% over last year. >> thank you. >> you're welcome. >> reporter: even as postcards and letters declined. that mail has gone away, and it's never going to come back. it's being replaced by something else something that takes up more space. the postal service is racing to ship. from carrying letters to carrying packages. a large part of the success is the ability to handle the large capacity because of machinery like this. giant laser scanners find the address and sort packages on machines the size of a football field. at least for now, all the technology in the world can't get the packages all the way to your door in time for christmas. the last mile still depends on the good-old postal carrier, and they've been awfully busy. >> i have a package for pat. >> reporter: for gutierrez this is the second run of the day. >> this december we've started

good evening. it's only wunl game, one of 82 on the schedule in the regular season. you know that both the warriors and the cavaliers have had an eye on this game. an nba final rematch tomorrow at oracle. you can watch it here at 2:00 on abc 7. first meeting between the warriors and cavs. game six of the nba finals. the warriors, of course raised the larry o'brian trove oh cleveland's home court. they won 31 straight games at oracle arena. cavs six and six on the road. actually being the road team on christmas day may be an advantage for cleveland. >> being able to focus on the game around the other things going on throughout the day should be a fun challenge. >> i think it's going to be exciting. you know, the crowd's going to be loud. i'll have family in town. you know the competition will be at the highest level that there is.
