on the scene joining us for the very latest. >> well, there is big drama in the san antonio neighborhood. you can see behind me, scores of oakland firefighters, paramedics are ready as they try to pull this man out. this was a private contractor working for the star, rooter and plumbing company. the owner's son told me that the

man came in to put in a new sewer line and he went into a four by three home. he was working it at some point, dirt began to fall on top of him. he is now buried about to his knees. the man is alive. i don't know if you could say he's well. he is in some discomfort, but he has been talking. what you can't see right now are the neighbors, there are dozens of them who have gathered to watch this. at one point, it seemed as if the man was almost out, as if they were going to get him out. they have a harness there, as you can see. this began a couple of hours ago and the work is still going on. we are keep an eye on this developing news and come back to you as soon as we know. but, hopefully, this gentleman, not working for the city of oakland, somehow, became buried

then we heard about a volt of the entire ownership that would put the chargers and the st. lewis ram's in englewood. now, a third possible proposal. the only thing clear here is that anything is still in play. >> if a recommendation is approved by the larger ownership, the raiders may soon be heading south to join forces in a glitzy new stadium with the san diego charges. >> we feel good about our position. >> the c.e.o. seemed confident. just then, that proposal to nfl owners in houston. but the raiders and chargers show a shiny new facility in carson. >> carson is a location design and overall concept of what the raiders and chargers are trying to do there.

they would like to have a big news conference at the end and sing, but, just to wrap it up, if this goes the way we think it's going and it plays out exactly the way that oakland raider fans would have wanted, the raiders essentially being eliminated from that carson plan and staying here, this is a game of billionaire brass knuckles boxing. the owners being forced to choose between loyalty and money. you want to gesz which they way go? they want to protect dean stanos, who owns the chargers. they want to ensure with the los angeles opportunity. that's why they supported them this morning. on the other side, you have the billionaire, the wealthier owners preferring the englewood plan because it looks like a much, much better financial deal for the league on paper. and then you have the raiders,

you the update here on abc 7 news at 4:00. >> and you can always follow us on twitter for the latest as well. in other news today, a santa clara deputy has been arrested on suspicion of driving urn the influence of alcohol and pulling his firearm. nobody was injured. in a statement, the deputy sheriff's association said we expect that appropriate action will be taken after all the facts are determined. >> a toddler and two people injured after a shooting on i-80. it is connected to a series of shooting. one of two bullet holes in the car belonging to a family of five. somebody opened fire. a bullet blasted right through the car's windows, shalterring glass in a toddler's face. two other people in the car also believe they were the gunman's targets. there have been four other

here's live doppler e7 hd. rain up north around eureka. in fact, that first wave of rain, only 100 miles west of san francisco. although some of it will probably hit the north bay coastal areas even sooner than it will hit san francisco. current temperature readings, mid to upper 50s, although we have some low 50s at concord and redwood. on we go to a cloudy, western sky. these are our forecast features tonight continuing through the overnight hours. and this wet pattern will last through saturday. the next storm is ranked number two on our storm impact scale, 1 through 5, that means a storm of moderate intensity, look for half an inch to an inch of rain.

after the mexicans released this video showing the site. blasting their way through five of his men. turns out, mexican intelligence was tracking both actors, and penn, finally speaking out, defending his interview with the drug kingpin telling the associated press, i've got nothing to hide. getting him back to the u.s. could take some time as mexican officials now say his extradition has been suspended.

here are the stories making headlines as we come up on 4:30. right now, nfl owners are meeting in houston to decide what team or teams can move to southern california. the owners are all interested in moving. unhappy with their current stadium situations. it looks like they'll move to englewood with the rams staying in oakland. abc 7 news reporter laura anthony is covering the meeting.

that could change within the hour, however. she'll have a live report coming up from houston on abc 7 news at 5:00. breaking news out of oak labdland, where a rescue is happening as we speak. carolyn? >> the contractor was digging and replacing the sewer line is still in that sewer line. despite the efforts so far of scores of firefighters, he was in there with a company and he had to go down about 13 feet to try to work on this line. what the fire chief, the battalion chief told me is that there was not sufficient trimming and some dirt started caving in, burying the man up to his chest. they have been able to get a

harness on him to, again, begin removing the dirt around him. now, it's down to his knees. so they are making a process, but the chief tells me about their biggest challenge. >> the biggest challenge is we had what was starting out to be a four by four hole. and then when the dirt emptied the space, it came down to a 2 by 2 hole. so we had to remove the dirt. and as we removed the dirt, we made sure the dirt we removed, no other dirt can enter the hole. >> and, during this whole drama, they have given the man pain medication because they said he is not feeling right. he has been talking, though, in spanish, letting him know that he is okay. i asked the battalion chief how

daniel, allegedly ran away from home after getting into an argument with a family member. she was among those who searched for daniel in the months that followed. >> every time we thought we had something, it didn't pan out. >> authorities thought they had spotted daniel. but, again, it showed the man they found with nothing more. >> if he came forward and said i'm okay, that would be really great. it would allow us to close this case. however, we don't have that. >> freemont police say they opened the case last summer. >> we started looking at it and, right away, we started thinking to ourselves, something just doesn't seem right here. >> two weeks ago, they executed a search warnt to dig up the backyard of daniel's childhood home. the search came up empty. neighbors are glad to see that something is being done after all of these years.

marlow believes somebody spiked her drink. she woke up with a strange man and underwent a sexual assault exam. >> she came forward with the hope that the san francisco police department would do what it is charged with doing, and that is to investigate what happened to her. to find the person who did this to her. >> the rape kit sat untested for years. one of thousands as it turns out. it eventually led to a change in state law, as well as san francisco police policy in 2014. where marlow says none of it has helped her. she says that's her best hope for finding her attacker. >> it's more than frustrating. it's been very traumatizing. >> well, police officials did not issue a new comment today. they said they've increased staffing to test dna.

the next challenge for space-x is this weekend when a company tries to land a rocket upright. spacex pulled off its first successful vertical landing in december following three failed attempts. the skies over florida will be very busy this year. about 20 unmanned launchers for making deliveries to the space station.
