>> abc7 news starts right now with live breaking news. >> and that breaking news is in the east bay where a rescue effort trapped in a trench is now approaching its 10th hour. sky 7hd is live over the frantic scene right now. it is just incredible. good evening. i'm dan ashley. >> i'm ama daetz. this is happening on east 23rd street and 21st avenue. >> alan wang is there and joins us with the latest. >> this has been going on for more than 10 hours. people out here are starting to get a little anxious. at this point the rescue workers have the man hooked up to an iv which means they are trying to keep his vital signses stable. all of the pressure from the dirt that is squeezing his lower extremities. we are told he is alert and talking to rescue, woulders who were trying to rescue him after he was buried up to his waste in a trench that collapsed around 12:30 this

afternoon. the victim is identified as 41-year-old esparza who works for star rooter and plumbing. he was trying to attach it to a hole and main sewage pipe under the street. the main sewage pipe was buried so deep they had to build a long, narrow trench 13 feet down. the fire officials tell us the workers used inadequate support which is made from plywood to hold back the crumbling walls in the trench. the soil had the consistency of sand which is making it difficult to hold back and that's why they are using a street cleaner to vacuum it out of the trench while they dig. his foot is also trapped in a clay that is creating a suck force that is holding them down. it is all -- that's why it is taking so long. we also have a storm coming in and the temperature is dropping. mr. esparza is probably getting cold so they are

updated on breaking news. the effort underway right now to free a man trapped in a 10-foot sewer line. sky 7hd is live over the scene. look at the crews working. an independent contractor was working on the line when the trench collapsed on him around 12:50. we are told he fell 10 feet and is trapped with dirt up to his knees. he is alert and talking to emergency crews, but the rain that we are getting is approaching and it could make rescue efforts more difficult. be sure to follow the latest updates on the abc7 news bay area. a grand hello for his big goodbye. president obama rallied his supporters and took on his critics during the seventh and final state of the union

deputy is accused of drunk driving and brandishing a weapon. it happened on sunday around 2:30 a.m. in this jack in the bocks drive-thru. jack in the box drive-thru. a witness told me he started yelling at employees because the order was taking too long. and that's when a cashier said he saw lee's gun. >> the youngster thought he was getting robbed. >> he arrested lee in the parking lot. they released a short statement saying lee is now on administrative leave while an internal investigation is also done. >> he has a good reputation with the sheriff's office. he is a hard worker and respected by his peers. >> it comes after a string of scandals in the department. in september three correctional deputies were charged with murdering a mentally ill inmate at the county jail. a task force found on going problems with abuse and misconduct there. sheriff smith is promising improvement, but this retired

right now the temperatures are in the 50s. this view will look very different in the next few hours as the rainy, wind econ decisions spread overnight. a messy commute tomorrow morning. the wet pattern lasts into next week. we have been rating our storms on the storm impact scale. this one is a two. it is a moderate storm. half an inch to an inch through wednesday morning. more showers tomorrow evening and gusts 35 to 40 miles an hour. the strongest gusts will be the the -- through the early morning hours. heavy at times in the north bay. you will see those oranges popping up. 3:00 a.m. you will see pockets of moderate rain and the wind will rattle your windows enough to keep you awake especially if you are a light sleeper. 4:00 a.m. looks messy. 5:00 a.m. we are looking at scattered showers and the intensity of the rain eases up as we head toward 6:00 a.m. and 7:00 a.m. if you can leave later for work perhaps that may be a

wiser decision. 7:00 a.m., you will notice the scattered showers. 8:00 as you are taking the kids off to school it is a mad rush to get them off to school during a rainy day. hopefully it won't be too bad. scattered showers and sunny breaks. 3:00 it eases up. as we head toward the evening rush it is okay, but notice a few more showers coming back in for the el nino enhanced storms. as we head toward the neck 12 to 24 hours we are looking at the wet weather. up to an inch in the wettest communities. a quarter of an inch for san jose. winds will gust overnight. you will notice at 1:00 a.m. 43, 46 miles an hour along the coast. don't be surprised if you continue to run into difficulty with the wind gusts. napa at 9:00 a.m. and still gusty and the winds will ease. the winter weather advisory foresee yarr raws. midnight

year to build a stadium in oakland or maybe someplace else. we will see if today's decision by the nfl owners keeps the raiders here or is a stay of execution. when this day began the relocation committee supported the proposal of the raiders and chargers moving to a joint stadium in carson. but that was scraped to build in ingelwood. the rams will lead st. louis and play in the l.a. coliseum until their stadium is done in 2019. the chargers have a choice to join the rams in ingelwood, but it gives the city of san diego one more year to get something built down there. if the chargers gary don't go to l.a. the raiders have a chance to join them in 2017. the raiders were given $100

breaking news, rescue crews in oakland for almost 11 hours now. th is happening at 21st avenue and 23rd street. >> they have given him an iv. alameda fire has joined in on the rescue effort. a pick up truck has also just arrived to the scene. they may prevent the rain from coming into the trench and help with the rescue effort. >> he was working on the line when it collapsed on him at 12:50. he has been down there the whole time. we are told he fell about 10 feet and trapped in dirt up to his knees. follow us on twitter for updates overnight and love updates on the morning news at 4:30 a.m. it will be perhaps a long night for him. >> that's it for us.
