lawsuit and today there were cheers and applause for gwen woods as she accepted his diploma. the crowd was chanting him name. >> anything i can hope for is to see this moment and know how proud i am of him. >> reporter: some supervisors suggested an official day of remembrance for woods. that controversial proposal will be debated tomorrow, in san francisco, abc7 news. a hayward man shot and killed by police monday night has been identified. police say the 29-year-old charged at officers with a hammer-sized gardening tool when they responded to a home break in. officers say they told him to drop the tool several times but he charged them. a brief chase in hayward ended with police crashing into

the suspect's car, as you can see. sky 7 was over the scene where police say two juveniles were arrested. the car was wanted in a car jacking monday night. today, a team of ntsb investigators arrived to begin examining the greyhound bus that crashed in san jose. >> investigators started to take a look at the wreckage, towed to a storage yard in gilroy. >> it crashed traveling between northbound 101 and highway 805. 20 passengers were on board and two did not survive. we'll get an update in just a few minutes. let's go live now to chris nguyen in salinas. he talked with the family of a grandmother killed in that crash. chris? >> reporter: good evening, maria ortiz was known as the grandmother of the neighborhood. she lived here in salinas nearly 50 years. family members are still in

disbelief or what happened but say they will rely on faith, and friendship to get them through this time. on this block, the matriarch of this family is now gone. >> it is the worst way it could have happened. >> reporter: the grae hound bus she was traveling in crashed in south san jose. the 75-year-old was returning home after visiting relatives in tijuana. >> they thought she's going to board another bus in l.a. and come to salinas. that wasn't the case. >> reporter: family members were notified just after 7:00 last night but just getting details from anyone turned out to be a struggle. >> we called the greyhound station to see if she'd boarded any other buses. no one had information. >> reporter: ortiz came to san francisco from mexico to pursue

looking into the cause of the crash. david? >> this is an investigation that is going to last potentially to months. was he falling asleep at the wheel? the wreckage of the bus has just been moved from the private tow yard here and taken to a caltrans yard in san martin. they'll ged -- need to do thorough investigation. >> they're going to take a look at the driver. he left los angeles at 11:30 monday night and clocked seven hours behind the wheel. the chp says the 58-year-old admitted he was fatigued. the ntsb will look into the

policies. the bus company tells abc7 news it requires drivers to have nine hours of rest. an hour longer than federal regular investigations. they've removed one key item. >> and yes. we have recovered a camera from the bus and will be looking into whether it reported any information. >> he told abc7 news the camera records the driver and road, so if working it could determine if the driver fell asleep at the wheel. >> anything related to the driver will be covered in our human performance investigation. and all factors relating to the driver. >> the ntsb will look at highway design and impact on barrels used to cushion a vehicle falling into a divider. the barrels hit by the bus were hollow. others can be filled with sand or water. the bus weighs 17 tons and was traveling an estimated 65 miles

per hour when it crashed. the ntsb will take a look at what can be done to protect passengers better. chp and ntsb confirmed there were seat belts, but were they being used? in gilroy, abc7 news. two women suffered life threatening injuries after being hit. the woman were walking on a sidewalk when a 77-year-old woman hit them. one victim, an 85-year-old woman is in critical condition. the other victim, a 91-year-old woman suffered critical injuries. police arrested the driver for driving under the influence and are investigating her claim of mistaking the gas pedal for the brakes and being distracted by a small dog on her lap. one person went to the hospital when a pickup truck

protective services. her mother was found unresponsive at this livermore motel on christmas day. she had gone into a diabetic coma. her 6-year-old was alone with her when police arrived. >> she looks you in the eye and says santa didn't come because mommy wouldn't wake up. >> child protective services placed the girl in a foster home. that is where livermore police and firefighters delivered a truck load of toys the day after the christmas. now, the kindergartener's grandmother from florida and her biological father, from colorado both want custody. a court hearing is inconclusive. >> there were no resolutions we're hoping for today, there is a continuation and we'll be returning to court and hopefully, getting some resolutions then. >> reporter: gail dotson told us she'll make sure the little girl grows up with daily reminders of

the ground to look for that person in rough surf tonight. this began about 5:00 this evening. that is when one surfer found another surfer unconscious and began giving him cpr. but a wave washed them out to sea. the surfer trying to save him made it back out safely. rescuers also searched for the unresponsive surfer. the good samaritan is on shore, helping to look, now. >>. a couple pleaded not guilty to dozens of child molestation charges. >> ralph and carolyn flynn face 44 counts. her husband remains in custody. >> the alleged victim is the couple's adopted son. it's an investigation you'll see only on abc7 news. >> 71-year-old ralph flynn is a

marketing representative. his wife is a major account executive. together they face 44 charges involving their adopted son from russia, including continuous sexual abuse of a child, unlawful intercourse and >> everybody is presumed innocent at this point. and i think it's based upon these charges especially. it's difficult for anyone hearing the charges to presume innocence. but the system must. >> according to records, their son told law enforcement ralph flynn started sexually abusing him shortly after he arrived from russia at nine and carolyn flynn joined in when he was 15 saying ralph flynn sometimes would abuse him in a rolls royce in the garage.

the records show flynn admitted molesting another adopted son, now an adult living on the east coast. >> what does that do to your case? >> it makes it more complex. i don't know whether the district attorney intends to call that son as a witness. >> this report began with a tip from inside of the sheriff's department. high level sources are frustrated investigators had a complaint about the flynns in 2012 but did not investigate fully. a psychologist called the sheriff's department after the boy said they had been abusing victim one and the victim had a recording of ralph atestimonying to bribe him for a sex act. the investigator concluded i am requesting the bureau conduct follow up but the case fizzled and that concerns child welfare advocates in the south bay. >> one of the things that concerns all of us in the child

protection field is making sure the abuse stops when we catch it. >> sheriff laurie smith refused to be interviewed but released a statement saying we'll examine how this was handled. sources close to the investigation tell me the detective in 2012 was overwhelmed by his case load, including the sierra lamar murder. investigators urged flynn to write a letter apologizing to his two adopted sons which he did. the u.s. coast guard suspended the search for two missing ucht c santa cruz students believed to be swept out to sea. they were overcome by a wave monday evening. another student managed to swim to shore safely. the missing students are a 19-year-old woman and a 25-year-old man. investors had a rough day, and you can blame it on plunging oil prices.

father to pick up their car that had been stolen. she describes her last words to him. >> i just told him i love you. and, yeah. that is it. >> reporter: according to his attorney he came to the u.s. seeking asylum. >> he was afraid to go back. they never sent him a hearing notice. he never got his day in court ten years ago. >> the ice spokesperson sent us a statement saying he was targeted for arrest based upon his conviction for dui and outstanding order of removal issued in 2005. immigration advocates are not just going after ice. they're angry at local cops. the public defender joined them in in accusing officers of violating the sank sanctuary city ordinance. >> we want to make sure that the police officer who's committed this offense and violated the
