the coast guard suspended the search in bonnie dune beach. and in marin county, there is little hope of seeing a missing surfer alive, he was found unconscious in the water yesterday. >> reporter: it's important to know that el nino is ling in big, very dangerous waves, dan, you can see the search is over. there are just a few friends hanging out, out here, the conditions made it extremely difficult to find him. his wife and family waited, hoping for any signs of the missing surfer. the unfortunate announcement came before dawn. >> we did switch this morning from a search and rescue to a recovery. >> the waves were relentless, making it impossible to navigate the waves in search for defoe.

>> there is a time when conditions cause to you believe you would not have a possibility of rescuing. >> reporter: yesterday, he was surfing at rodeo beach. he was seen in the water, face down. two other surfers tried to help. >> while providing cpr, a wave knocked them loose and separated them. >> reporter: high surf advisories are common, but the national park service says these are happening more off thein because of the el nino pattern. this week, three uc santa cruz students were swept away and two are still missing. >> never turn your back on the water, never trust your child, pet, or yourself close to the water, knee deep or otherwise is safe. >> i hope we find them. you know?

for closure. >> there will be a candle light vigil for two missing sandhya cruz students. a large wave swept them off a rock on monday. the family is hosting the vigil at her childhood park in palo alto at 7:00 at juana brianna park on maybell avenue. our next storm is expected to bring rain within the next few hours or so. the north bay will see the first rain drops tonight. abc7 news was in orinda as crews worked to get trees out of the way. they want to prevent falling trees from taking out phone lines or damaging homes.

bowl resort. a camera captured the avalanche he apparently caught. he was okay and able to climb out. this was not the same avalanche that may have claimed the life of a sugar bowl ski instructor. the search for the 23-year-old carson may has been called off because conditions are too dangerous. >> a san francisco tour bus driver has been cited for a accident over the weekend. investigators say he violated the city law that prohibits drivers from narrating while behind the wheel. vincent jones was driving the bus that killed a man. one possible cause has been ruled out in a deadly bus crash in south san jose. two women died after the bus crashed between 101 and northbound 85 interchange on tuesday morning. david louie is live with new

information from federal investigators. david? >> reporter: it is dark now here in gilroy. the inspection process will resume in the morning. they're anxious to check out video from a camera on the bus. investigators are preparing to create a 3 d image of the bus inside and out that will allow them to recreate the crash. but they're waiting to see what the camera will show and will hopeful it will document the moments leading up to the collision. >> we're attempting to get it to ensure we don't damage that by reframing it improperly. >> greyhound says the driver is on nondriving status during the investigation. he and the company are not talking to reporters. the lead investigator says he's trying to establish innocence and guilt. he's not substantiated

to contract valley fever. caltrans did not tell them there was a fungus near the work site in kern county. the fever can be contracted by breathing in fungus-laced spores from dust. a lawyer says the money will help with medical expenses. san francisco's use of force policy is being revamped after a recent fatal shooting. today there was a hearing at city hall and tonight there is a meeting of the police commission to get community input. carolyn tyler is live in the western edition where that meeting is just getting underway. carolyn? critics say the use of force policy is out dated. tonight here at third baptist church, members of the community can talk about what changes they would like to see and supervisors are looking into this as well.

say whether or not he thinks the officer was justified but he will say he had to make a split second judgment. the police chief admits this doesn't look good. the student had been sent to the office because administrators thought he was acting strangely. the student tried to leave but the security officer blocked his way and a wrestling match began. >> we have witnesses that say the security officer put his hands on the student first, and there are some witnesses is a that say the student put his hands on first. >> reporter: he hinted at media reports the student may have been high on drugs. regardless he admits it looks disturbing. >> i've been in this business 35 years. there has never been a confrontation between a security officer or a police officer with
