happened. >> they were holding on to each other. the guy went in after her when a wave took her out. and she was swept out there. >> reporter: the woman was able to get back to shore. >> he got close to getting out, like about three times, but the waves just pushed him back in. >> reporter: that's when the coast guard found him. >> the coast guard lowered one of their rescue swimmers into the ocean and was able to grab the second victim, lift them out by air and bring them onto shore. >> reporter: both the man and woman were taken to the medical center. we do not have a medical condition on the man, but we are told by fire spokesman that they were performing cpr on him. we do know from witnesses the woman was okay and doing much better. we will give you updated information as soon as we get

in. but the man we do not know his medical condition. >> real tragedy. thank you very much. we have to ask how high are the waves right now? >> let's check in with sandhya patel for the answer on that. >> right now the wave heights between five and seven feet. what ends up happening is perhaps that couple forgot with nice weather like this that those waves can catch you off guard. take a look at the beach hazard statement up until 8:00 p.m. tonight. rip currents usually stronger around piers and jeddies. so be careful on days like this. waves will be building towards the end of the week. we have some changes coming. we'll talk about the records that were set today and those changes coming right up. kristen? >> sandhya, thank you. even bigger waves are coming. that's why the surf competition is on. some of the best surfers in the

world are coming to the bay area for the competition. maverick will take place friday. forecasters expect el nino fueled waves on friday could reach up to 30 feet. >> very rare to be able to call it this far out in advance. but everything lined up. the stars are aligned and we're very thankful. >> mavericks was not held last year due to lack of big waves. this year, organizers are warning the public not to get too close to the action. there will be a live webcam. with crab season just hanging on the edge, california and the bay area's fishermen are getting some help locally and federally. wayne freedman is live in san francisco's fisherman's wharf tonight. >> reporter: this is pier 45.

take a look behind me. all of these crab boxes empty. they should be at the bottom of the sea, but the big move came from the governor who applied to the department of commerce to declare a fisheries disaster in the state of california. that could, if approved, it could bring money to crab fishermen. we were on the dock when larry collins, who represents the boat owners, received a phone call. empty docks, waiting pots. pier 45 in san francisco enduring tough times like never before. >> 35 years of fishing and it's never been this bad. >> reporter: that was larry collins, just before he received a phone call with news that relief may be on the way in the form of a federal fisheries disaster declaration. >> yesterday we had no hope, today we have some. >> reporter: an algae bloom

tainted, then forced closure of california's $60 million a year crash fishery. times are so tough here that just today the port of san francisco waived all fees for fishermen from february through april. >> it means we want to keep the fishermen here. >> reporter: and the crab population continues to decline. researcher william cochland noted he needs research money. >> if we don't want this to happen in the future, we have to learn the root causes. >> reporter: in san francisco, wayne freedman, "abc7 news." a man northern california police nicknamed the hefty heister is in jail tonight. >> get on the ground! put your hands down to the side!

don't move! >> wesley crone was one of at least eight bank robbers. he led officer on a chase. police used spike strips to stop him. the dash camera shows him tossing his gun on the grass and cooperating. he is from antioch. the first robbery happened back in december. all eight cases were around northern california. each one police say he gave the teller a demand note. more than 70% of b.a.r.t. cars, 70% do not have working cameras and recorders. as ost laugh month, more than 500 out of 669 b.a.r.t. cars could not record any images of passengers. the agency admitted to using lots of decoy cameras. last week, b.a.r.t. promised to

outfit every train can working corders. a berkeley house fire forced the evacuation of a pet hospital. the fire raced through a vacant home on haste street just after 11:00. the house is located next door to the berkeley dog and cat hospital. staffers left the business, taking their patients out, as well. crews brought the fire under control in about an hour. the pet hospital was not damaged. a man accused of slashing the throat of a chp officer last week pleaded not guilty today. he's charged with multiple felonies, including attempted murder. investigators say he slashed the officer across the throat and arm during a confrontation a

week ago today. the officer is recovering tonight. when the super bowl came to town. now city officials say it's time to compensate them. i'm talking about the street vendors and artists who lost money. lyanne melendez is live with that story. >> reporter: no one is more desperate to get things s back normal than those artists. they have been a fixture here since 1972. this is a san francisco street vendor displaced during the super bowl. his regular spot is where he's used to tourist dollars. in the past, artists and other vendors have been asked to move and compensated $200 a day. but the super bowl host

committee offered them nothing. >> we're able to move and compensate. but this time there was no transparency. there was no dialogue. they basically said, get out. >> reporter: as super bowl city was being dismantled, vendors were told they couldn't move back in until saturday. the supervisors introduced an ordinance that would create the super bowl 50 impact fund. the money was come from contributions made by the national football league and taxes. >> hotel tax, sales tax, that could be used. but those are taxpayer dollars at the end of the day. >> they wanted to go to super bowl city. >> reporter: he too hopes to get

voting just ended in new hampshire's primary. and abc news declared winners. donald trump is the projected winner the gop race. he was polling double diblg it

figures ahead. he currently has 33% of the vote. with john kasich in second with 17%. and jeb bush with 12% of the vote. on the democratic side, abc news is projecting bernie sanders the winner. again, that's not a surprise based on polls. there are reports that hillary clinton has conceded in this race. record voter turnout is expected. new hampshire is considered critical. it is the first one for the primary, but it is not always the predictor of who will win the white house. >> since 1976, fewer than 25% of those who won new hampshire won the presidency. >> the person to watch is senator marco rubio, who stumbled in the last debate. >> if he doesn't come in a strong second place, we know some of the voters in new hampshire have taken that robot image and gone with it. and that weakened him tremendously. >> now, one thing is clear, nearly half of republican voters

waited to decide. 22% made their decision just today. all over the bay area, we're starting to see it. gas prices dropping under $2 a gallon. but it may not be all good news. laura anthony is live. what is the downside to cheap gas? >> reporter: there's no doubt the low prices here at the pumps have given people a break financially, but there is a flip side that's not so positive. it seems like something to celebrate. gas prices dipping below $2. but bay area transportation firms warn there's a dark cloud looming. >> many cities across california have lost a significant amount of money. >> reporter: randy is with the metropolitan transportation commission. he says with the state's gas tax formula tied to lower gas

prices, california will lose about $1 billion in transportation funding. that would normally go towards fixing things, like potholes. >> what does that mean? the freeways can't get fixed. >> reporter: low gas prices have helped fuel a surge in truck and suv sales, up 20%. and some customers are being pushed away from hybrids. >> the difference in the hybrid gas ratio was not significant, versus the price point. so they were going with gas instead. >> reporter: but putting more and more less fuel efficient vehicles on the road means greater emissions. >> we hope they have a longer view. the price of gas could spike

back up. >> reporter: changing the minds of consumers may not get easier, as gas prices will stay low for some time. laura anthony, "abc7 news." an economic forum got a little rowdy this morning in san francisco when a protester interrupted a speech by mayor ed lie when he was accused of turning his back on poor people. "abc7 news" was at the san francisco business times forum, as others shouted back at the protesters. the oakland mayor also spoke. she wants new housing that preserves oakland's character. >> this housing can always be affo affordable. but we want to create conditions where people get out of their car. next week, mayor shaft will present a plan to build 17,000 new housing units.

tax scam. peggy and her husband were victims of a tax scam on the rise. >> last year when we filed the taxes, the irs flagged our account because somebody had filed a phony return under my husband's social security number. >> reporter: it was an attempt to steal their refund. >> filing early is a great way to thwart this cam. you get your paperwork in early before a criminal can file anything. >> reporter: filing early has other advantages. for one, you'll get your refund sooner. 2/3 of americans do get a refund, which averaged $2700 last year. >> you'll have plenty of time to figure out where the money is going to come from or set up a payment schedule 23 you have to pay. this year you have to pay which april 18. >> reporter: another benefit of preparing early, you may be able

oakland. high clouds on live doppler 7 hd. not what we need. we need the rain, it's not in the forecast. you can see not only the clouds but also some of the haze there in the air. have you been suffering from allergies? the tree pollen is running high right now. if you've been sniffling, this is definitely because of the weather conditions here. temperatures right now, 70 degrees in san mateo and oakland. many other areas in the 60s. half moon bay, 59 degrees. from our tower camera, sun and clouds, cooler tomorrow. cooling continues into saturday and temperatures will rebound next week. overnight, expecting fog to move in. tomorrow morning, it will be around and the biggest drop will be at the coastline where the breeze will be back in a little stronger. sun and high clouds for your wednesday morning and afternoon, as well.

temperature trend for san francisco. remaining above the average of 61. those numbers will be sliding before you see a recovery. we'll take a look at those morning lows, starting out in the 40s, 50s, not only the fog, but high clouds, as well. in the morning, a little cool. you may need that extra layer. in the afternoon, it's going to be a mild to warm day in the south bay. not as warm as today. 73 in san jose. 73 in gilroy. 71 in sunnyvale. 70 in san mateo. downtown san francisco, 69. daley city at 66. once again, high clouds like you're seeing today continuing to filter our sun tomorrow in the north bay. 70 in san rafael. east bay, berkeley, oakland, 70s. 71 degrees in livermore. a look at the accuweather

seven-day forecast. slightly cooler, but still above winter averages. mid 60s to low to mid 70s through friday. saturday, a mild pattern and sunday, upper 60s to mid 70s. we'll continue to see those temperatures come up on monday and then on today they start to drop. so i know there's still a lot of question about what happened to el nino. well, it's not uncommon to see a dry spell like we're experiencing right now for a week or two weeks at a time. we've seen this with previous el ninos. the next opportunity for rain does not look like it's coming in until beyond the seven-day forecast. >> all right. sandhya, thank you very much. it's been a long time since this fox has seen the outdoors. then at 5:30 --

check out the lightning strike it is the international space station. it shows a thunderstorm as it flew from north africa towards russia. you can see the lightning hitting earth and causing an intense explosion. >> that's really cool. scientists at stanford university say there may be a way to prevent jet lag without medication.
