missing the weekend before, last seen at a party on silva avenue at jackson street in hayward. residents say she left with her boyfriend unharmed. police believe she was murdered. on sunday, a small group of volunteers gathered at a neighborhood strip mall to search for her. >> i have family. and i don't want this situation too. i want to help to find the lady. and it's really sad, this situation. >> i have two younger children, and two female nieces, one who is a similar age. if i had kids, i would want folks to help me. >> reporter: aguilar's mother said she's been told very little about what police have found. an autopsy is scheduled for today to help determine a cause of death. reporting live in hayward, matt keller, abc 7 news. >> thank you, matt. more tunnel trouble this

morning on the bay bridge. caltrans found more spots in the tunnel where chunks of concrete could break off. last month one piece did fall into the slow lane of the lower deck tunnel. it damaged a car. the driver was really scared but it didn't actually hurt her. new testing shows corrosion from leaking rainwater caused damage in 12 more locations, all in that eastbound tunnel. caltrans has removed any loose pieces. a spokesman still insists there is no immediate danger. the transbay transit center in san francisco needs cash and is reaching out to goldman sachs for a loan. according to the "chronicle," officials have been forced to take out a short term loan. it puts the public on the hook for $37 million in fees. the "chronicle" also reports the transit authority is struggling to come up with at least $250 million to complete the first phase of construction. police are trying to find a man who exposed himself inside a

business near mission and wilson streets. this is surveillance photos, which are quite clear. police say he had distinctive shoulder-length black hair with light brown tips. san francisco police are still searching for the person who shot and killed a man in the mcdonald's drive-through yesterday right across the street from a police station. abc 7 news reporter lilian kim spoke to a man who says the shooting happened right in front of him. >> reporter: san francisco police say two men were leaving the mcdonald's drive-through when a man came up and opened fire. the driver wasn't injured by the passenger was shot several times. >> pow, pow, pow. >> reporter: tj was only feet away. he was walking on fillmore street around 2:45 p.m. when he heard the gunshots. >> i ran for cover. i knocked a couple of people down and dove on the dirt.

>> reporter: police say the shooter got away. the passenger died at the hospital. they say he was in his 20s but haven't mentioned why he may have been targeted. this mcdonald's on fillmore and golden gate happens to be across the street from the police station. >> there was a lot of car traffic, a lot of pedestrian traffic. so the shooter certainly was not hindered by that or us being down the block. once we know the motive, we can piece a lot more together. >> reporter: nearby businesses are growing frustrated. just over new year's, two people were shooting at each other on the same block when an innocent bystander was caught in the crossfire. >> it's right next to the police station. it shouldn't be happening over here, first of all. but it's happening. and i just don't know what to do. >> reporter: police say the fact that they were so close allowed them to talk to plenty of witnesses who didn't have chance to leave before they arrived. they say they're also hoping security video will help give them more clues. in san francisco, lilian kim,

abc 7 news. protests are now being planned to gather in 30 cities across the u.s. and around the world tomorrow in support of apple's battle with the fbi. demonstrators are standing with apple after a federal judge order the tech giant to hack into an encrypted iphone used by one of the san bernardino shooters. protests are scheduled at apple stores in the u.s., the uk, hong kong, and germany. in the bay area they will have one of these protests in san francisco at the store on stockton street, also at the other locations you see there in palo alto and santa rosa. it all starts tomorrow at 5:30. happening today, a blue ribbon panel will hear from witnesses to ask about racism in san francisco's police department. district attorney george gascon set up the group after officers exchanged a series of racist text messages. all of the judges are from outside the city. they'll look at the 3,000 arrests made by the 14 officers

involved in the scandal. witnesses will include high ranking city officials. a billionaire who closed off access to a popular beach says he's going to reopen it for $30 million. the "mercury news" reports that the lawyer for the man is demanding the amount to reopen half moon bay. he closed off a popular access road. the state land commission says it does not agree with the price. a proposal aims to make it easier to help people find affordable homes in san francisco. the city's planning commission will decide on that plan later this week. it would allow developers to build larger housing complexes if they guarantee that 30% of their units will be set aside as the low market rate. the "examiner" also reports that the plan would apply to buildings zoned in neighborhood districts. castor valley, 43 degrees, one of the cool spots.

back into the upper 60s at the coast while the rest of us in the mid-70s. one of the cooler days is with that storm, it's going to sideswipe us saturday. warmer than average, around 70. a slight chance of rain sunday. so light, i didn't even put a storm impact scale on it. very dry, sue. a look at the bay bridge, headed toward san francisco, no metering lights yet. a nice 11-minute drive from golden gate field into the city. we'll be monitoring that. a look at the san mateo bridge, the chp issued a high wind advisory last night. it looks like, according to chp log, it's been lifted but please use extra caution, an 18-minute drive across the span. overall, traffic map looks green, green is good, except for slow traffic coming out of the central valley. they had that express lane that started this morning, 580 westbound at 5:00 this morning. it doesn't look like it's doing any good here

to 70 in the afternoon. let's see if your commute is that delightful. >> not bad at all, as a matter of fact. just checking your drive from concord and pleasant hill on into walnut creek, the 24 interchange, looking good right now with a 10-minute drive. those tail lights headed in the southbound 680 direction past north main. our overall map is not bad except for coming out of the central valley, some slow traffic there. we have this issue in the north bay, westbound 37 near cirrus point, a big rig off into a ditch. seeing slow traffic now approaching the scene. we'll get a look at that and see if the metering lights are on in our next report. a large piece of concrete that nearly hit a driver in the bay bridge tunnel wasn't an isolated incident. caltrans now says there were a dozen spots vulnerable. abc 7 news reporter amy hollyfield has more. amy?

>> reporter: good morning, reggie. caltrans telling the "san francisco chronicle" it found 12 spots in this tunnel where concrete could break loose and fall, not comforting news for drivers. the "chronicle" reports can transofficials say they don't see anything urgent at this point. it was corrosion that caused the concrete trunk to break through last month. it damaged the car but did not hurt the driver. caltrans says the problem is bigger than they thought. and it's possible it's still more extensive than they have discovered. they're still looking into it. they say they've been tapping on the concrete to see if it is hollow. but they say they will need a more sophisticated testing. they have removed loose material from the tunnel wall, so they think they've solved the immediate threat. but the issue is still being looked at. the extent of the solution is still unknown. but it might require them to

close some lanes overnight. stay with us as we continue to follow this developing story. live, amy homey field, abc 7 news. developing news in alameda county. the coroner will conduct an autopsy today on the body of a missing san jose woman. 22-year-old stacey aguilar's body was found saturday in hayward. police aren't saying how or where but are treating the case as a homicide. aguilar was last seen february 13th leaving a party with her boyfriend. abc 7 news spoke with aguilar's mother who lives in mexico. she tells us police have talked with her other daughter in san jose but did not give many details. hayward police plan to hold a news conference at 2:00 p.m. the search is on for a brazen killer behind a shooting in san francisco, right across the street from the northern district police station. the gunman fired into the car stopped in the mcdonald's drive-through at fillmore street and golden gate avenue at 2:45

yesterday. witnesses say he derived into the passenger window several times and ran off. the passenger died in the hospital. the driver was not hurt. police are trying to figure out if a shooting just four blocks away from that mcdonald's has anything to do with the drive-through murder. police found another shooting victim at eddie and buchanan streets at 8:30 last night. someone drove the person to san francisco general. the victim's condition is still unclear. new this morning, apple ceo tim cook is thanking his employees for their support. as we've been reporting, apple is fighting a judge's order to help the fbi unlock one of the san bernardino shooters' phones. abc 7 reporter tiffany wilson has more. >> reporter: reggie, the e-mail to employees went out early this morning. tim cook says this case is about much more than a single phone or investigation. the data security of hundreds of millions of people is at stake and the fbi's request settings a dangerous precedent that

threatens everyone's civil liberties, apple warns. it says if it's forced to write code to break into the phone, t the technology could get into the wrong hands. cook says the government should drop its demands and instead create a commission of experts in intelligence technology and civil liberties to discuss implications for national security, privacy, and federal freedom. on "this week," apple's attorney gave a strong warning about what would happen if the government goes forward with the case. >> it would require apple to comply with these kind of court orders all over the country and other parts of the world, damaging your personal privacy, your financial privacy, your health records, your location, where your children are. the implications of this are quite serious. >> reporter: last night the fbi director wrote an op-ed saying, "this litigation isn't about setting a precedent. it's about the victims and justices." apple explains why they're objecting to the government's order and answers other customer questions in a public post.

was on the loose, thinking it was the safest option. they mentioned the shooting and the driver appeared to know there was a shooting. >> i said, you're not the shooter, are you? he said, no. i said, are you sure? he said, no, i'm just really tired. >> dalton is expected to be arraigned today on murder charges. the u.s. supreme court goes back into session for the first time since the death of justice antonin scalia. this is video of where the justices will begin hearing oral arguments this morning at 7:00 our time. scalia was 79 when he died this past weekend. his funeral was on saturday. chief justice john roberts is expected to mention scalia's death from the bench today. in and out panel is evenly split 4 h 4-4 between conservatives and liberals. president obama has vowed to name a replacement. republicans say that should be left to the next president. now to the race for the

starting today, you may face some delays if you're driving along mission street in san francisco. the location of some bus stops may also change. that's because crews will begin painting the pavement to designate transit-only lanes. this week's work will take place between caesar chavez and 30th street, part of a progeny to speed up the ride for more than 65,000 muny customers who take muny along mission street every day. gas prices have fallen another nickel across the country over the past two weeks. the nationwide average for a gallon of regular unleaded is now $1.77. that is down 56 cents from this time last year. of course, we're paying more here in the bay area, about 2.47 gallon in san francisco, in san jose and oakland. that's not such great news

for the highway 101 widening project. set to open up five miles of carpool lanes south of petaluma. it's now in jeopardy because of a lack of funding. according to petaluma360.com, it's back to the drawing board for officials looking to fill that financial gap. recent caltrans estimates show the amount of gas tax revenue is $800 million lower than expected. we're used to seeing "baby on board" signs. what if you saw "student driver"? that could be a decal you may soon see when you're white knuckling your steering wheel and screaming not so nice things at the vehicle in front of you. a bill has been introduced requiring the dmv to hand out "student driver" decals to teens with their learning permits. it asks drivers to have a little more patience. happening today, a push to improve graduation rates at csu

a deer. authorities say that feeding deer draws them into our neighborhoods and the hungry mountain lions are not far behind. if you're a dog lover, you'll want to see this video. it shows police and fire crews trying to get out on this ice to rescue a couple of dogs that were on top of that frozen pond in akron, ohio. you see these authorities trudging through the icy waters to it to them yesterday. officials say the dogs ran on the frozen pond, located in the owner's backyard. they were pulled to safety, dried off by the paramedics, and rushed to a nearby vet. both dogs doing just fine this morning. >> thank goodness. new at 6 :00, what to do if you order something at a restaurant and it's not what you wanted. and the special training one lawmaker wants bartenders to be forced to today. forced to today. and take us with you with

we're getting some new details on this crash that killed two women in vallejo. police say the elderly driver was speeding when she slammed straight into the call, killing the passenger. the driver herself died later at the hospital. this is video from the "vallejo times herald." this happened across the street from city hall on sunday. investigators are trying to figure out why she was going so fast. what a scary crash in illinois. firefighters spraying water on a burned-out mega bus outside of chicago. they wanted to make sure it wouldn't burst into flames again. 40 passengers and the driver, they all escaped after a fire broke out while the bus was traveling on a highway in lake forest, illinois. one passenger told a local

to fall, unfortunately. sue, i saw some lights on our walnut creek camera. >> yes, we have a lane at the transition from 680 southbound to 24 blocked. i don't know if you can monitor that on your television, but the flashing lights, we just watched a tow truck try to get through this traffic to get there to get that lane reopened. the right side traffic as you approach 24 is definitely much slower than the left, if you are transitioning onto 24, expect delays southbound on 580 and 680 or towards 580 and 680, should be fine once you get past this, but it is stacking up into pleasant hill. an accident near cirrus point and the other one at san francisco and 280 when we come back. happening today, lawyers for the company that made the rifle in the 2012 sandy hook killings are expected to ask a judge to dismiss a wrongful death lawsuit. the families of nine children and adults who were killed filed that suit in 2014.

they say the ar-15 bush master rifle is just too dangerous to sell to the public. the parent company of the gun says a federal law shields the gun industry from any legal claims. the pope is calling for getting rid of the death penalty around the world. pope francis says the commandment thou shalt not kill applies to both the innocent and the guilty. he says what better time to launch a moratorium on executions than right now during the church's holy year of mercy. the pope made the comments aheads of an international conference against the death penalty which begins today in rome. california bartenders could soon have to go through a required special training on how to spot drunkenness. a proposal out would require that people behind the bar have that training so they can properly step in and cut off a customer who has had too much to drink. the law is called the responsible intervention for beverage service training act. supporters say they hope it would save lives and decrease drunk driving. tesla has a unique contest to win a rare tour of spacex
