live from the kgo tv broadcast center, this is abc 7 news. >> good afternoon, thank you for joining us today. i'm ama daetz. >> i'm dan ashley. larry biel has the day off. three former san jose states acushioned of hate crimes against a roommate were found guilty today but not on the more serious charges. david louie is live in san jose with new details, a case that began with san jose state students accused of hate crimes against a roommate were made public. david? >> reporter: the jury of six women and six men were hopelessly deadlocked on two of the defendants although did come back with a not guilty verdict for one of the defendants. they were unanimous in charging them with misdemeanor battery against their roommate d.j.

williams who is back. defendant colin warren is seen leaving the courthouse an hour ago. he and two other roommates charged with put a bicycle lock around his neck and hanging a confederate flag in the dorm room. first we hear from the district attorney. >> you have to prove what was going on in someone's mind when they were committing a certain act, so i think there's always difficulties with it, but we believe the evidence very strongly supported that these acts were motivated in whole and in part by bigotry. >> i'm hesitant to say anything because as you all know, there's a $5 million lawsuit. it is pending against my client. the others, and the university. so for those reasons, i'm not going to comment further. >> reporter: here are d.j. williams and his father outside

the courthouse. they did not make any comments about the jury's verdicts. the defendants will be back in court next month for sentencing. their battery conviction carries a potential jail time of up to six months. now the district attorney's office will pull jurors and consult with victim d.j. williams about whether or not to retry the two defendants for which the jury was deadlocked unable to reach a hate crime verdict. now, we did talk to one of the jurors, number 9, as he left the courthouse and told us there was only circumstantial evidence of a hate crime so the jurors said they agreed respectfully to disagree. we're live outside superior court in san jose, david louie, abc 7 news. >> all right, david. thank you. there are new details now about the murder of a woman last seen leaving a party in hayward. sky 7 hd shows you the area off morrison canyon road in fremont, police found stacey aguilar's body saturday. police say she'd been shot

self-times. police announced today they arrested a person of interest in her murder. aguilar was last seen leaving a party in hayward with her boyfriend last week. police say they interviewed her boyfriend and arrested him but stopped short of identifying him as the suspect in her murder. >> the boyfriend was arrested for domestic violence, and he is one of the persons that was questioned. and that's all i can provide to you at this time. >> abc 7 news reporter sergio quintana was at the news conference. he'll have much more coming up at 5:00. the alameda coroner's office is working to identify a badly burned body found in oakland this morning. sky 7 hd over san born drive earlier today after someone called call ed 911. investigators believe the man committed suicide. police are investigating a deadly weekend shooting at a mcdonald's on fillmore street in san francisco. >> investigators haven't ruled out that the shooting could be related to another one on eddie street. abc 7 news reporter melanie

woodrow is live outside sfpd headquarters. >> reporter: the chief of police tell me investigators have a good video of the getaway vehicle, a great sedan. right now they're hundrting dow more surveillance video hoping for a clear picture of the suspect. patrol cars are out following a deadly shooting at mcdonald's. two men were leaving the drivetru sunday when someone came up to the vehicle and started shooting. >> pow, pow, pow. >> reporter: see five bullet holes to the passenger side. the driver was not hurt. the passenger died at the hospital. the medical examiner's office has identified him as 23-year-old curtis kale. >> we have every indication this was not a random act. >> reporter: he is not new to law enforcement. sfpd arrested him in 2012 in connection with another murder. >> i am aware of the 2012 arrest. i don't have any idea if this was related. >> it is brazen.

it's happening in a neighborhood that we are embraced with trying to change it for the better. >> reporter: despite mcdonald's proximity to the sfpd northern district station across the street, the area has been the site of several shootings, including new years where an innocent bystander was caught in cross fire. they're exploring every option, including the mcdonald's shooting could be gang related. investigators saying this shooting could be related to one around 8:30 sunday night on eddie. see one bullet hole here. the victim is at the hospital with non life threatening injuries. >> anybody who has information we'd love to have it. >> reporter: investigators are not releasing the video they have yet but could later. one of the most wanted felons in houston, texas, has been arrested in the iscommunit of windsor.

there is a serioes of weak spots inside the tunnel. >> yes, it's concrete that's been compromised by rain water and leaking into the 80-year-old structure. last month a car was hit by a falling piece of concrete. >> abc 7 news reporter laura anthony is live on treasure island with the latest on the story. laura? >> reporter: hi, dan. well, when the new eastern span of the bay bridge opened, the tunnel received a new paint job but that was about it. it hasn't had a major renovation in more than 50 years and it's starting to show. it seems that falling concrete incident inside the tunnel last month wasn't as isolated as cal trans first announced. >> there were 13 spots discovered. >> reporter: in fact, cal trans' tests reveal a pattern of failure due to corrosion caused by rain water. it's the same eastbound tunnel where a chunk of concrete gave way in january damaging a car

while narrowly missing the driver. >> there is a little bit of light corrosion on the rebars and we're now going to be meet to talk about the steps going forwa forward. >> reporter: that is the federal highway administration. in the meantime the crumbling sections have been removed. according to the metropolitan transportation commission the problems here may be a symptom of the larger issue facing the bay area and its aging information. >> not only on the state ahighway system but local streets and roads, transit systems. i think a great illustration of this is b.a.r.t. passengers on b.a.r.t. are are dealing with increasing delays. >> reporter: in the tunnel, cal trans says there's no immediate danger to motorists but will likely be a series of late night lane closures while repairs are made. laura anthony, abc 7 news. a new report is posing renewed problems for lumber liquida liquidators.

the centers for disease control and prevention said certain types of floor made by lumber liquidators have a risk of causing cancer or other health problems than previously estimated. people who purchased the flooring are three times more likely to get cancer. shares topped by 19% in trading. the wine industry lost one of its lendgends. >> peter mondavi has passed away. >> kristen sze is here on his amazing legacy. >> amazing, indeed. wean most think of mondavi they think of the winery started by peter's brother. peter, himself, was the lesser known brother who insisted on quality, family and stability as he ran the winery for more than a half century. peter mondavi died at the age of 101 yesterday in st. helena on his estate surrounded by family. his italian immigrant parents

bought the wine ary in 1943 at a time when napa was known for inexpensive jug wine. he set out to improve the wine-making process after serving in the military. he started the cold fermentation movement and produced crisp fruity white wines. peter and his older brother, robert, clashed. robert wanted to grow the family business dynamically. peter wanted slow and steady. >> i've devoted my life to this and i'll continue until my dying days to promote my-9 wine busis here. >> reporter: robert left and started husband own robert mondavi winery in 1999. he made it famous but peter made it better. the brothers reconciled in 2005 three year before peter passed away. peter climbed these stairs to his office every day before retiring last year at age 100.

a new study is shining a harsh light on the lack of diversity in hollywood. usc researchers examined 414 films and tv series and found that out of more than 11,000 speaking roles, 66% were male, 33.5% were female. 7.7% were white, 12.2% black. and only 2% were gay, lesbian or bisexual characters. the researchers also found that women and minorities were underrepresented as directors, writers and show creators, too. reality and talk shows were not included in the report. this year's best actor hopefuls have won an oscar or nominated before. but many eyes are on leonardo dicaprio and whether the five-time nominee will finally take home the gold statue. here's abc news reporter brandi

explains. >> reporter: it's been four years since rebecca survived a harrowing fight with breast cancer and even during chemotherapy she was able to keep her spirits up and shield her young son from the anxiety in part by keeping her hair. >> he didn't even realize i was going through it so i was able to function well enough and because i had my hair. >> reporter: avoided the hair loss we associate with chemotherapy by using a cold cap, fda approved a high-tech version. the cap chills the scalp preventing chemotherapy drugs from reaching capillaries and killing the hair follicles. doctors at ucsf helped spearhead the clinical trial. >> so the goal from the very beginning has been to take this device and get it to be as accessible and available to as many people as possible. >> reporter: but here's the problem. the technology is so new, many insurance plans don't cover it yet. which is why supporters are

>> i'm dan ashley. a person of interest in custody this evening for the death of stacey aguilar, 22-year-old woman reported missing last week as we reported. we're learning new details about what happened. sergio quintana is live with what happened. >> reporter: dan, police chief wanted to assure the public that there was a person of interest in custody because she wanted to make sure that people did not think that there was a murderer out on street, but they would not release many details about that person of interest who's in custody. during an afternoon news conference, the hayward chief of police said 22-year-old stacey aguilar's body was found saturday afternoon in this rural area off morris and canyon road in fremont. she'd been shot several times. >> we do have a person of interest in custody. we cannot release the name of the person until charges are actually brought with the

district attorney. >> reporter: the alameda county coroner completed an autopsy but cannot release the cause of death because of the ongoing investigation. aguilar was last seen at this house on silva avenue at 1:00 a.m. valentine's day morning. neighbors tell us they called police nine times because of a rowdy house party there. they tell me off camera they remembered seeing aguilar at the party with her boyfriend. several phone conversations with aguilar's mother in mexico, she told us she was suspicious of aguilar's boyfriend. the hayward police chief said he was arrested but for a different charge. >> the boyfriend was arrested for domestic violence and he is one of the persons that was questioned and that's all i can provide to you at this time. >> reporter: police say he was taken into custody the day aguilar was reported missing and they said the alleged domestic violence was against aguilar, but they would not say he is a person of interest in this case. in hayward, sergio quintana, abc 7 news. a
