family? there is a lot wrong with this picture. >> the attorney general for a man wrongfully convicted and released from pris yn speaks to abc 7 about the miscarriage of justice. thanks for joining us, good evening. i'm ama daetz. >> i'm dan ashley. >> reporter: good news is that luther jones is not unconscious, he is awake and he is according to state law, due $140 per day he spent in state prison. problem is that the money sometimes takes a long time to arrive and sometimes a lengthy process. his family is trying to take care of him. they dropped everything to do so and the california department of constructions is under a lot of heat for releasing a sick man to his family. these are the pictures of luther

jones. he's awake now. >> when did your dad wake snup. >> saturday morning. >> what did he say? >> glad you're here. don't leave me again. >> luther jones was just another inmate just weeks ago, serving 27 years for a child abuse conviction in which he maintained innocence, last week, the then 10-year-old recanted her testimony, his release is fast tracked. >> sending an innocent person to prison is probably a deputy da's biggest year. >> but his trouble dz not end. he'd been in the hospital when released. the state drove him back to lake county in an ambulance. before the next morning he lost consciousness. >> they told me he was sick and different ailments. they didn't tell me the severity of it. >> attorney angela carter. >> there is a continuum of care

at that time prison system is responsible for and luther was released to the care and custody of his adult son. he had one night with his family. the next day, he is unresponsive and taken to the hospital by ambulance. >> reporter: luther was convicted based on the evidence of a 10-year-old girl told to die as part of a domestic dispute. the girl cannot be prosecuted. the mother, maybe. >> she sent someone to prison who didn't belong. >> i shouldn't have to seek out the help, the state, apologies. i shouldn't have to seek out my father's money. it should have been there for him. when he got out. >> instead? >> i got a box of medicine and a sick father. >> from lake county, abc7 news. we have just learned fremont police are trying to identify a body found in the marshlands

near the dunbarton pier. there is no word on how the person died. six months after a young man was shot to death by a police officer, the alameda county police department deemed it was self-defense. after responding to a break in at a specialty sales classic showroom. police say deming resisted arrest. investigators determined lethal force was necessary. another man died from friday's shooting in vallejo. a 22-year-old passed away today. his father died during the shooting on friday. two other people, including a 9-year-old boy were injured. police are looking for a maroon four door sedan seen leaving the

area of porter street, shortly after this shooting. so far no arrests have been made. three former san jose state students have been convicted of battery, but not a hate crime, for incidents involving their roommate. the case is controversial because the victim is black and others are white. david louie is live for us in san jose. >> reporter: each of the three students could be facing up to six months in jail for that misdemeanor battery charge, or conviction, now. and that is when they appear in court. one was found not guilty of a hate crime. but the other two could be put on trial for the same crime. dj williams was rooming with three white students at this at san jose state. prosecutors say the roommates clamped a lock around his neck,

and wrote the "n" word on the white board and draped a confederate flag in the common area. the students were found guilty of misdemeanor battery. on only . >> you have to prove what is going on in someone's mind when committing an act. there is difficulties with it. but we believe the evidence very strongly supported that these acts were motivated in whole and part by bigotry. >> williams, the victim and his father dekriened to talk to reporters. the district attorney must decide whether to retry warren and beachler. >> i'm hesitant to say anything. there is a $5 million lawsuit pending against my client, the

others and the university. so for those reasons i'm not going to comment. >> one juror told me the panel could not reach a verdict on a hate crime due to circumstantial evidence. in san jose, david louie, abc7 news. >> san jose state released a statement saying in part that it's deep into the process of hiring a chief diversity officer and will interview for the position this weekend. students at uc davis held a march demanding the university do more to protect black students after a racially motivated attack this month. members of the african diaspora held signs. students say they don't feel safe on campus. they asked for better lighting and night time transportation. >> we should not have to resort to the buddy system to try to

make ourselves feel safe. >> three men have been arrested for an attack against a black student. police say she was assaulted and then harassed with racial slurs. new at 6:00, a soccer referee suffered a traumatic brain injury after punched by a player after the ref gave the player his second yellow card in san francisco yesterday morning. police say the player sucker punched the ref and drove off. the blow knocked out the ref, loosened his teeth and broke his jaw. the attacker has not been ught. >> police are increasing patrols in santa cruz outside two churches after they were vandalized over the weekend. someone dumped paint on the wall. the outside of the church on center street was damaged and police are treating the

vandalism as a hate crime. >> san francisco police are looking for information following a deadly weekend shooting outside of the mcdonalds on fillmore street. they aren't ruling out it could be related to another shooting hours earlier on eddy. melanie? >> reporter: the chief of police tells me investigators have good video that shows the get away vehicle, a gray sedan, they're on the hunt for more video now, hoping to see a clear picture of the suspect. sfpd says the suspect targeted the victim. >> we have every indication that this was not a random act. >> sunday afternoon, investigators say two men were leaving the drive through, someone went up to the vehicle and started shooting. the driver was not hurt. the passenger died at the

hospital. the medical examiner identified him as a 23-year-old curtis kail, not new to law enforcement. he was arrested in 2012 in connection with another murder. >> i am aware of the 2012 arrest. i don't have any idea if this was related. >> it is brazen. and it's happening in a neighborhood that we are embraced with trying to change it for the better. >> despite the proximity to the northern district station across the street, the area has been the site of several shootings including on new year's. the chief is exploring every option, including it could be gang related. >> we're trying to find the best video. >> several patrol cars were in the area today. investigators are also considering the possibility that the shooting is related to one around 8:30 sunday night on the 1200 block of eddy. you can see one bullet hole

case, a woman describing herself as aguilar's sister put together a memorial and fund raising web page and scribed the victim as a parent. the chief of police said the body was found saturday afternoon in fremont. she had been shot several times and dumped there. >> we do not believe the crime took place in fremont. >> the police chief assured the public they believe the alleged killer is in custody. >> we cannot release the name of the person until charges are actually brought with the district attorney. a woman describing herself as stacy's sister launched a go fund me panl, and the 22-year-old is described as a beloved daughter, sister, and mother. there is no further information about a child. she was seen valentine's day

morning. neighbors tell us they called police nine times because of a rowdy house party and they remember seeing aguilar with her boyfriend and several phone conversations in mexico she told us she was suspicious of the boyfriend. the police say he was arrested for a different charge. >> the boyfriend was arrested for domestic violence. and he is one of the persons that was questioned. and that is all i can provide to you at this time. >> he was taken into custody the day aguilar was reported missing. police confirmed the alleged domestic violence was against aguilar. but they would not say he's a person of interest in the murder case. in hayward, abc7 news. san francisco's police chief is calling for officers from all agencies to adopt his policy requiring off duty officers to secure guns in a lock box while not on the job. >> we don't want to go and hook

mondavi, they think of robert mondavi winery, his brother. peter insisted on quality, family, and stability. he died at age 101 yesterday in st. helena on his estate surrounded by family, his ill -- italian immigrant family brought the winery. he set out to make great wine and started a cold fermentation process. peter and his older brother clashed, robert wanted to grow the family business, and peter wanted slow, and steady. >> i devoted my life to this and will continue until my dying days to promote our wine business here. >> robert left and started his
