"abc7 news" starts right now with live, breaking news. that breaking news is in san francisco. a car went on a wild ride, hitting a pedestrian and slamming right into a building. good afternoon, everyone. i'm larry beil. >> and i'm ama daetz. it happened at 46th avenue in san francisco's outer richmond district. that's where leeann melendez joins us with the latest. >> reporter: as you can see behind me, what an ordeal. now, an elderly man apparently lost control of his car and managed to get on the sidewalk, hit a pedestrian. we're told that the man is in his 20s. he may have fractured his femur we're being told. the car was still moving when it hit a house. it didn't end there.

the elderly man then ran into a poll. that was the one thing that stopped him. inside the car was his wife who was taken to the hospital. the elderly man was not injured. inside the house was a 1-year-old and of course, her mother playing in the living room when the car hit the structure. >> she was shocked. i was shocked, and i just grabbed her and ran. and i just feel so lucky that she was -- she's okay. i mean, i feel bad for that pedestrian, i think he's going to be okay. >> reporter: there's another look at the damage to the house. the car was taken away. now, at this time, according to police, there is no indication that drugs or alcohol were involved. i'm live from san francisco, lyanne melendez, "abc7 news." san jose police say a

pedestrian was killed when she was hit by an suv backing out of a driveway. the driver stopped and is cooperating with investigators. today's accident is the 10th traffic death in san jose this year. three have involved pedestrians. apple fired back today in its battle against the fbi. >> they filed a court motion asking it not be forced to hack into the iphone oh of a terrorist. kristen sze is here with the latest developments. >> reporter: here it is, this is what apple filed today, a motion to vacate last week's court order compelling apple to help the fbi hack into an iphone. apple said, no court has ever authorized what the government seeks. no law supports such sweeping use of the judicial process and the constitution. the filing is a flat-out refusal to help federal investigators to crack the iphone that belonged

to san bernardino gunman syed farook. in today's filing, the company called it government o.s., something the ceo tim cook warned against yesterday with david muir. >> a piece of software that we view as sort of the software equivalent of cancer. we think it's bad news to write. we would never write it. we have never written it. >> reporter: fbi director james comey went before lawmakers today and says while this battle raises hard questions, it's not the slippery slope that apple fears. >> this is a single phone in a very important investigation where the ask is to write a piece of software that will work only in that phone, not anybody else's phone, and you, apple, can hold the phone so that the software you write never has to leave your premises. >> reporter: apple got a big boost today. microsoft and google both filed briefs in support of apple in this fight.

the big court hearing is scheduled for late march. >> kristen, thank you. a video reportedly made by supporters of isis makes threats against facebook ceo mark zuckerburg and twitter ceo jack dorsey. the group says it's hacked thousands of profiles but experts have not given that much weight. a man was shot in a shopping center in south san jose. >> it happened near the intersection of west capital expressway and copperfield drive. chris nguyen joins us live with new details. chris? >> reporter: we can tell you that the man who was shot is expected to survive, but san jose police tell us the suspects have not been found. customers described a nerve-racking scene today at the south san jose shopping center. >> very nervous because they ran right by me.

>> reporter: just before 10:00 this morning, police received word of multiple shots being fired at west capital expressway and copperfield drive, next to this wells fargo banking center. police tell us two vehicles were initially involved in a disturbance on the expressway. as they turned onto copperfield, someone in the suspect vehicle opened fire, hitting one of the five men in the van. the suspect vehicle drove off as the victims tried to find shelter. one man, who was shot in the leg, was helped by employees at the lucky store. at this hour, the suspect vehicle has not been found. >> they don't really think about what's in the background, and so any bulletks get away from them and striking people not involved. in this case, it did not happen, fortunately. >> reporter: police are working to get a more accurate description of the suspect vehicle and will be taking a look at surveillance video in the area as part of their investigation. customers say they weren't surprised something like this

happened in their part of town. >> i'm always aware, i have to be. a little older now, so i have to be on my guard. >> reporter: if you have any information that can help the investigation, you're asked to call san jose police. chris nguyen, "abc7 news." loved ones paid final respects to a pittsburgh police officer today. sky 7 hd was overhead as the procession carried the casket to his memorial service today. people lined up along the route and saluted as the procession drove by. he served with the pittsburgh police department for 22 years. he died of a heart attack after chasing a shoplifter. he was working a second job at macy's. he leaves behind an 8-year-old son. the san jose police department is asking for help in locating the burglary suspect seen in this video. they are accused of breaking into a parking garage storage locker and stealing two bicycles. it happened around 6:00 sunday

morning. californians fell just short of the state's mandated water saving target. water officials announced today urban water users used 24.8% less water since conservation began last year. it just misses the 25% cut the governor ordered. the numbers mark the first time since june that californians have missed their conservation target. >> the lack of rain we've had this month might inspire people to conserve more, because it feels like it's going to be warm and sunny for an extended period of time. >> spencer christian is here to let us know when we might be getting rain again. >> it's not looking hopeful right now for significant rainfall. here is a look at live doppler 7 hd. so far, sunny and mild to warm. we also have rough surf once again, a high surf advisory in effect from 4:00 a.m. tomorrow to 3:00:saturday. swell heights expected to reach

this is "abc7 news." on tuesday, mayor ed lee gave homeless residents 72 hours to move out. the health department saying sanitary conditions are posing an immediate health risk. >> the deadline is tomorrow. reporter vic lee is live with more developments. vic? >> reporter: larry, ama, this is division street and there you see some of the tents that sprouted up during the super bowl. the targeted area for the cleaning is about a mile wide. police, we are told, will be around if they are needed. oscar mckinney has lived in this tent since september. mckinney bought four tents. he rents the others out. this land lord is ready for

tomorrow's sweep. >> i'm going to stay. >> reporter: starting at 5:00 in the morning, public health crews will begin cleaning division street and adjacent streets because of health risks posed by the homeless living in the tents. homeless advocate jennifer friedenbook says the between does not provide long-term solutions. >> clearing out an encampment when folks don't have a choice makes them more destabilize. >> reporter: but the mayor's pointman, sam dodds, says the health risk is immediate. >> we've been trying to give them as much time as possible, but the health standards have reduced to a place where we have to take action. >> reporter: for months, the homeless outreach teams have been trying to convince those in these tents to move. many have found shelter on pier 80. as of this afternoon, 45 beds

here were still open. other shelters also say they can take in more people tonight. vic lee, "abc7 news." several b.a.r.t. stations are about to get makeovers. here's an idea of what you'll see. a remodel of the station should be complete by 2018. improvements include new elevators and restrooms. b.a.r.t. is also working to replace the stair barriers and add a bike rack. the powell station is getting new lighting. b.a.r.t. is also working with the city to upgrade entrances and escalators. most updates should be finished by 2019. the city of san francisco is taking action to make a dangerous intersection safer for pedestrians. today, plans were announced for the installation of a pedestrian scramble in chinatown where a 77-year-old woman was hit and killed last summer.

learning more about jason dalton's behavior from the attorney for his family. this in an exclusive interview with abc news. >> and i first want to express the family's utter shock and sympathy for the victims. >> reporter: through their attorney, jason dalton's wife and parents are speaking out exclusively to abc news. >> fairly gregarious character, good father, well known in the community, well liked. there was nothing to indicate that something like this would occur. >> reporter: the married father of two only began driving for uber just two weeks before the shooting. now he's in jail facing six counts of murder. the motive is a mystery even to his family. according to the attorney, dalton's wife did sense a change in his behavior in the days leading up to the shooting. >> his wife asked him and he said he was tired.

just his demeanor, just that he seemed to be depressed. >> reporter: on the day of the shooting, dalton visited a gun store, as seen in these surveillance pictures, buying a tactical jacket. the attorney revealing that dalton went to his parent's house after the first shooting telling his family his vehicle had been sideswiped and he needed to switch cars, then headed back out with his parent's vehicle. the attorney also denied reports that the family was having financial troubles at the time of the arrest, stressing the family is also desperate to learn why this happened. at least eight people have died in storms that have pounded the midwest and east coast. the national guard is on the ground in waiverly, virginia after a tornado destroyed homes and killed several people. at least 29 confirmed tornados have couched down in the last two days from texas to virginia.

information about a controversial police shooting in san francisco from two years ago. a witness now claims he had his hands in his jacket pockets when police fired 48 shots, killing him. officers said at the time they thought he had a gun on him. he actually had a taser. tonight on "abc7 news" at 11:00, we have the inside case that is headed to a jury next week. in other news, high levels of lead were discovered today inside an elementary school's main building. >> officials say the levels were safe, and parents are breathing a sigh of relief. wayne freedman is live. wayne? >> reporter: it is the elementary school scare that isn't a scare at all. it just turned out to be a false alarm, and yet it has parents and administrators asking tough questions. >> you're relieved today? >> very relieved today. >> the very first time i heard

about it was monday. >> when we first saw the fountains, it was like great, maybe they're giving the kids fresher water. >> reporter: by the time the water bottles appeared and the fountains turned off, the school district already suspected a problem with cloudy water at 80-year-old heelsburg elementary school. when a test came back showing led at 53 times the safe federal levels it became a crisis. but not for long. after a second test, it was proved to be long. >> trace amounts well within the epa standards. >> reporter: no one can explain the testing discrepancy. but the parents are pleased with how the school dealt with a potential problem but concerned it began in november and they knew nothing of this until almost march. >> based on what was -- they stated they did, bringing water bottles, those are all wonderful things that i think the community would have celebrated. it was just that we had no idea any of this was going on that i

sea world is acknowledging it sent a worker to infiltrate an animal right's group that opposes the group. the admission comes after p.e.t.a. claimed a sea world san diego employee tried to incite violence while posing as an activist.

sea world has suspended that employee. the search is under way for a bald eagle. missing from the palo alto junior museum and zoo, handlers are concerned because they lost the signal from her tracker yesterday. >> katie utis is live with more. >> reporter: handlers received more than 20 sighting reports and they're trying to follow up on every one of them, because it's concerning the 27-year-old eagle has been gone this long. she's been in captivity most her life and cannot hunt on her own and she has some distinct characteristics we're about to show you. a bleep on the tracker. >> the transmitter is a line of sight to the receiver. >> reporter: but no confirmed sightings for sequoia the bald eagle. >> monday she took off and chased a hawk and began to wander. >> reporter: she spread her wing toos far this time. this is file footage. >> we lost her radio signal.

examining paul tichner's truck. >> police were in communication with us several hours before that. >> reporter: police detectives have been looking for shelly since the day after valentine's day when she was reported missing. the husband said he last saw her two days prior. today, the pier was closed where sunday night fishermen found the torso. tuesday night, more body parts were called. should they have called you sunday night? >> i don't know that. >> we have a very strong feeling that it is, in fact, shelly. >> reporter: understandably, when it comes to a homicide investigation, a strong feeling isn't strong enough. it will likely take dna evidence to make the link.
