live from the kgo-tv broadcast center, this is abc7 news. >> developing news at 11:00, two alameda county sheriff deputies have been caught on camera beating a man. now new tonight, a third deputy is in trouble accused of stealing from that man. >> they are no better than the criminals they arrested. no better. if these allegations are true. >> good evening. thank you for joining us tonight. i'm ama daetz jie. i'm dan ashley. strong words. this case centers around the arrest of the man in the video that deputies beat after he lead them on a 30-mile high speed chase. >> abc7 news reporter katie is live with the story. katie? >> ama and dan, the sheriff himself will address these new allegations and a spokesman is telling us a third deputy has

been placed on leave and one of the two deputies accused of excessive force did record video with a body camera. >> if these allegations are true of what these deputy or deputy did in regards to stealing items from mr. petroff they are no better than the criminals they arrested. >> strong words from the alameda county sheriff's office hours before stanislaus ' attorney said he would file a lawsuit against the department. >> they violated their solemn duty by doing what they did. >> the lawsuit alleged -- alleges he stole the gold chain and gave it to a homeless couple along with cigarettes and money. we have now learned the sheriff placed that deputy on leave last week. the item supposedly to keep the couple quiet after they witnessed this incident. on november 12th in an alley, you can see two alameda sheriff deputies striking him repeatedly with their batons. in addition to to the

surveillance video there is body cam video as well. at some point during the incident deputy paul weeker turned -- paul weeber turned on his camera. >> it is possible he didn't know he recorded it and turned it in as part of turning in his equipment. >> it has burned -- turned into the district attorney's office. he was tackled after he crashed a stolen car and lead deputies on a 30-mile chase after ramming several police cruisers. he represents the other deputy shown in the video. >> he starts resisting violently. these guy, understandably, are fearful that the man may be armed. >> he was thought armed, but a gun was found in the stolen car. source tell abc7 news that petroff was recently arrested in san francisco. police say he had a gun with the cereal number scratched -- serial number scratched off and guns on him. abc7 news.

>> tonight there is a request to investigate the sheriff of santa clara county amid allegations of professional misconduct. this request comes from the deputy sheriff association. it stems from this fight in the santa clara county jail. it happened after sheriff lori smith purchased cameras for the jail. the timing raised questions for the judge heading up the blue ribbon commission which looks into conduct. the sheriff and the judge had heated written exchanges which we reported. it was a request to the county council whether the sheriff tried to impress the judge. when asked for comment the sheriff gave us a statement that reads in part and the accusations are untrue and are focused on implementing meaningful reforms throughout our jail. happening now three people are trapped on a cliff side in coastal marin county. it is near the popular trail

hail also made its way to vaw knee shaw. this car was pounded near the vaw -- vanecia bridge. at san jose state many were seen running for you cover. firefighters were battling a stubborn grassfire as all of this was going on. the fire chief says he has never seen anything quite like it. >> it was almost apocalyptic in that we had the storm cell coming through and these dark black clouds coming and the winds blowing hour -- horizontal and it is unusual to see something like that. >> they were embracing the wind in san francisco. 20 plus mile per hour winds made for a fun afternoon. >> you can jump and you can go 20 or 30 feet in the a you -- in the air and you can fly. >> making the most of a wild day of weather. lilian kim, abc7 fuse.

fairfield by someone who saw him on the news. >> he is a citizen who went out of his way to contact us and it turned out to be the right guy. >> that citizen called police. >> they arrived and contacted the suspect who ran away on foot. officer pursued the suspect around the eastside of the business where an officer involved shooting occurred. >> the suspect was critically wounded. they won't say if gerard was armed or what caused officers to fire. >> wondered what was up. when we were down at the bank we heard what sounded like a single gunshot. >> he was the prime suspect of a drive by shooting in concord that left an 8-year-old boy wounded while he was playing outside his house. the boy is now home from the hospital. >> running and walking around happy. >> the family didn't know mr. gerard. >> concord police say there was a feud between gerard and someone living at the house. >> we are still trying to determine what it is about and who he was trying to target. >> we went to the family's house, but they did not want

sunnyvale and all of the bay area, this is abc7 news. jay we know a man shot and wounded by police at the u.s. capitol was carrying a pellet gun. the gun fear caused a panic sending tourists scrambling for safety. lauren h's the latest from capitol hill. >> pan tau mown yum in the capitol visitor center. >> there were police everywhere with guns drawn and people running and screaming. people were dropping to the ground. >> they are told to shelter in place or run to safety. >> they said there is a shooter. we ran out. >> the entire capitol compound on lock down. >> we were told to get down on the floor and we were staying -- laying on the floor for

serial bank robber. he has confessed. he told police he used the money to pay his bills and his motive was extreme financial difficulty. he is accused of stealing about $27,000 from 11 banks in northern california many in the bay area. tonight apple says it should have never been ordered to hack into an iphone belonging to the san bernadino shooter, but admits the discussion that followed was an important one. today the department of justice said it doesn't need apple's help getting into that phone. a third party helped investigators unlock it without compromising the data. this ends an on going legal battle for now. they say the case raised issues that deserve a national conversation about our civil liberties and our collective security and privacy. price per pound. that's what done jaw nuss --
