video shown. >> reporter: the deputies had a chance to review the video and rewrite their reports. another deputy he says robbed him of his gold chain, money and cigarettes to give to witnesses to silence them. >> if that allegation is true, that's one of the most horrific things i've ever heard. >> reporter: a third unnamed deputy in connection with the alleged bribery, has approximately 20 years with the department. it's now more important than ever for the district attorney to bring charges against these officers." the d.a.'s office says it is unable to comment on an ongoing investigation. melanie woodrow, "abc7 news." we learned today that fairfield police shot a suspected gunman while he claims he was trying to pull up his

pants. james gerard was wanted in a shooting that injured an 8-year-old child in concord friday. police warned they considered him armed and dangerous. a fairfield officers cornered gerard in an alley at a mall yesterday and fired two shots when he reached for his waist band. a criminal investigation into last year's deadly balcony collapse in berkeley is over tonight with no criminal charges issued. the district attorney's office has ended a nine-month investigation say thing's not enough evidence to bring manslaughter charges. six people, five young adults from ireland and one from the bay area, keyed in that collapse last june. neighbors are still shaken and a memorial is still outside of the building. >> why should young people have to lose lives? they never thought that was the end of their life. it was horrible what happened.

>> an investigation concluded dry rot led to this collapse. last year, "abc7 news" revealths filed against the contractor, claiming the builders may have cut corners to save money. a scathing report by the state auditor says uc officials lowered admission standards for out of state students. the uc president says the auditors misinterpreted the data. "abc7 news" spoke to her office today. >> they didn't have sound analysis of the data that we shared with them. the truth is that uc admissions policies overwhelmingly support california. >> students from california pay lower tuition than nonresidents. the system has been relying more and more on out of state tuition. a major victory for unions tonight at the u.s. supreme court. the case involved a teacher who

argued that no one should be forced to pay union fees. the vote was split 4-4. only eight of course after the death of justice antonin scalia. lyanne melendez is in the newsroom. the expectation was this would go the other way. >> reporter: you're right, before scalia died, it was a given he would vote against the unions and in favor of this teacher. so dan, it was an unexpected victory for the unions. here is how it work. california is one of those states that says if a teacher is represented by the union, you either pay your dues or opt out and pay a fee. by paying that fee, you get work protection and you benefit from any collective bargaining, so you get the same salary and benefits. what you don't get when you opt out is legal representation and your money doesn't go towards any political campaign backed by the union. we went one oakland teacher from a nonunion charter school who opted out in the past. >> i think that is important

that we, as individuals, express ourselves politically, whether the party or an organization, it shouldn't be dictated by that group what your vote is. >> i really think it was an effort to silence the collective voice of educators and beyond educators, other unions, as well. because a collective voice is a stronger voice. >> reporter: by having a split vote, the court that left in place the decision of the lower court which favored the unions. we have not seen the end of this discussion. there are 25 states that don't have mandatory union fees. so expect more cases like this one to be argued before the supreme court once they have those nine justices in place. lyanne melendez, "abc7 news." >> thank you. the rush is on to finally get fresh crabmeat to the

designed the banners. on the subject of people who risk all to help others, without hesitating, they jumped into action and everyone survived as a result of their action. here is the scene in alameda county last month. hundreds of passengers on board. laura anthony is live in niles canyon tonight with the story. laura? >> reporter: well, it happened on this track right behind me in this remote area. it was a dark and rainy night. dozens of people from at least four different agencies jumped in to help. >> it was, i would say, controlled chaos. >> reporter: sergeant jerry hammond was there, one of the first on the scene when an ace train was derailed by a mudsl e mudslide. >> my thought is, we were going

to be dealing with some real tragedies. but fortunately it didn't work out that way and everybody got out alive. >> reporter: one by one, the men and women, the first responders who jumped into action the night an ace train derailed came forward to accept their rewards. >> i can tell you it really broke my heart that night to see that train. >> reporter: sheriffs were joined by fremont police and other departments. >> we searched the train as far as we could until we got to the water's edge. then we had to go on top of the train to lower a guy to check some void spaces. >> reporter: though most agencies don't train for this exact scenario, the real life experience they gained will go a long way in the future. >> the biggest thing is trust in your training. >> learning from this situation how to apply it to the next one and talking about it afterwards and continue to move forward.

incredible video shows police and good samaritans pulling trapped people out of a burning car in los angeles. look at that. the rescue happened yesterday. a burning mercedes was stuck, wedged into an empty bus. >> the car was on fire. we couldn't get the windows busted open. eventually we pulled the people out through the window. >> it was a reaction. it wasn't really a thought. >> the victims were pulled out before a natural gas tank on the bus exploded. street racing may have caused that accident. >> incredible. finally, all four people who got stuck on a cliff are safe and sound tonight. they went hiking yesterday and got stuck near abalone point. a rope rescue began, but the ground was too unstable.

windy weather prevented a helicopter rescue of two men at the top until 1:00 this morning. an east bay congressman is calling for investigations to see how the nfl is handling concussions. "the new york times" called the nfl's research flawed. the times says the nfl admitted more than 100 concussions from 1996 to 2001. the nfl is now demanding a retraction from "the times. qults wealthy californians are now on the outside looking in when it comes to the state's popular clean vehicle rebate program. starting today, tax filers making more than $250,000 a year no longer qualify for the rebate when they buy an electric car. couples filing jointly won't qualify if they earn more than $500,000. budget constraints prompted the
